ABSENT: Lease 3.0 APPROVAL OF MINUTES: MOTION: Schletty made motion, Leroux seconded to approve minutes of September 2, 1975. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 4.0 APPROVAL OF GENERAL CLAIMS: MOTION: Smith made motion, Schletty seconded to approve General Claims of September 15, 1975. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 5.0 PETITIONS. REQUEST, COMMUNICATIONS AND LICENSES: 5.1 ROBERT BARTH POLICE CHIEF - HIRING Chief Barth introduced two mean to the Council, James W. Bradbury, White Bear Lake and Michael C. Gressman of Lino Lakes, who he wanted to hire for one or two nights a week as patrolman In recent months two men have left the department. and these two new men will complete his department. MOTION: Smith made motion, Leroux seconded to hire two new part-time patrolmen, James W. Bradbury and Michael C. Gressman at a fee which has been established for and budgeted by the Police Department. VOTING FOR: LaValle,Leroux, Smith and Schletty. MOTION CARRIED 5.4 WILLIAM M. PAVEI{ - SPECIAL USE PERMIT - RE: FENCING Mr. Pavek requested approval of a fence approximately 518" high and extending 80' along Ingersoll Avenue to be taken down during wester so as not to interfere with snow plowing. The Planning Commission recommended the following four conditions: 1 . The cross members of the fence may be placed only from the first of May through the first of November of each year. SEPTEMBER 15, 1975 V � 2. That the southwesterly 24' of the fence be either removed or rebuilt in order to join to the northeasterly corner of the garage. 3. The Special Use Permit must be renewed on an annual basis without fee. 4. Failure to comply with any of the above conditions shall result in immediate termination of the Special Use Permit. Mr. Pavek stated that he disagreed with recommendation #2 that he had no viaability problem and did not want to change the fence he wanted it left where it is installed now. He also stated it is a solid cedar fence and that he wanted to extend it 30' further north. MOTION: Schletty made motion Smith seconded to grant a Special Use Permit to William M. Pavek regarding the installation of his fence with the four conditions recommended by the Planning Commission with the Permit being placed on an annual review bases. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED AMERICAN LEGION MEMORIAL C. Crever representing the American Legion requested withdrawal of placing a memorial at City Hall. As the memorial contemplated will be a permanent installation they wanted it installed at a prominant place and it was being questioned wheather City Hall would remain at its present site. They are considering two other sites, the American Legion Hall or the Hugo Cemetary, preferably the Legion Hall as the Cemetary represents one denomination and the memorial will represent all. 5.0 PETITIONS 5.3 ROBERT H. VANDERWERFF - VARIANCE Mrs. VanDerWerff stated that if they built their garage at the required setback it would be in the msctile of their lot and that they would have to remove some tree. MOTION: LaValle made motion, Smith seconded to grant a Variance to Robert H. VanDerWerff to build a garage at less than the required setback. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 5.5 JUNE SMITH - AMENDED SPECIAL USE PERMIT Mrs. Smith had previous Special Use Permit to operate a Day Care Center. She has now reduced it to a Nursery School with less hour:. The Planning Commission recommended approval with the following conditions: SEPTEMBER 15, 1975 . . E A. The City sewer inspector shall perform a semi-annual inspection of the on-site sewer at the applicant's expense. Septic system pumped yearly. B. The Special Use Permit shall be terminated on October 1 , 1976 unless renewed by the applicant. MOTION: Leroux made motion, Schletty seconded to grant a Special Use Permit to Mr. and Mrs. James Smith to operate Nursery School changing condition A to annual inspection from semi-annual and that the Special Use Permit will be terminate( on October 1 , 1976 unless renewed by applicant. VOTING FOR: LaValle, Leroux, and Schletty. ABSTAIN: Smith MOTION CARRIED 5.6 D. ELDRIDGE - METROPOLITAN STEEL AND BALD EAGLE INDUSTRIAL PARK D. Eldridge requested Variance to gravel parking lot instead of blacktopping as the gravel on 130th. would ruin blacktop. Mr. Tschida called to floor and was questioned about his drain- age plans and future plans of the Industrial Park. He was also questioned why he has not lived up to his committments which were the conditions stated when the park was approved. He stated that with the sale of the property to Metropolitan Steel he would have the funds to complete his planning. Council questioned how much property had to be sold before final plans are submitted and that this was the same story that they heard two years ago at which time they had stated no more building would be done until they could see some progress on eliminating the water. Mr. Eldridge stated that where he wants to build there is no water problem. Attorney Johnson stated that $$5,000 - $6,000 could be put into escrow toward the purpose of developing the plans. MOTION: LaValle made motion, Smith seconded to table the Variance Application until the next Council Meeting of October 6, 1975. VOTING FOR: Smith VOTING AGAINST: LaValle, Leroux, and Schletty. MOTION DENIED Councilman Smith accepted a petition from Mrs. S. Ashby, a petition listing the name of people opposed to the storm sewer. 5.7 BARTON MINING PERMIT RENEWAL Clerk stated that there was : 200.00 balance for inspection fees and that the Certificate of Insurance had been received. SEPTEMBER 15, 1975 MOTION: LaValle made motion, Smith seconded to renew the Barton Mining Permit subject to conditions on Permit #5, accepting the ° 150.00 balance as the inspection fee. VOTIXG FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 5.8 RICHARD WLASCHIN - VARIANCE Request to build pole shed 6' from road right away. H. Schletty to check with Washington County regarding the right away. MOTION: Leroux made motion, Smith seconded to grant a Variance to Richard Wlaschin to build a pole shed 61 from road right away subject to the approval of the Washington County Zoning Administrator. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED Recess 9:19 returned 9:45 7.0 UNFINISHED BUSINESS 7.1 PIONEER CLUB - G. WASTE Mr. Waste called and stated at the time of removing debris from fire, he also removed the trees that were placed on his property. He feels the remaining debris is the contractors re- sponsibility. Hoffman to rove their debris this week. Clerks offict to contact DNR regarding progress on the problem. 8.0 NEW BUSINESS Clerk read request again from White Bear Township requesting caution sign on Everton Avenue going North by Smiths Point exit. H. Schletty to check on available sign and install if available. Clerks office to write White Bear Township stating what is being done. MC CLOUD APPLICATION FOR RE ZONING Clark McDermaid has withdrawn his application for rezoning the McCloud property and inquired if there would be a refund. MOTION: Smith made motion, Leroux seconded directing the Clerks office to write to C. McDermaid stating that it is City policy that no refund would be issued when time has been spent on an application therefore his request has been denied. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED SEPTEMBER 15, 1975 RAY PALME CANCELLATION NOTICE OF BOND MOTION: LaValle made motion, Schletty seconded to direct Clerks office to write Ray Palme, Jr. stating that the City of Hugo has been notified of his bond cancellation and that the bond is necessary to be a licensed Sewer Installer, his license is therefore revoked. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 1976 BUDGET MOTION: LaValle made motion, Schletty seconded to have the 1976 Budget meeting September 22, 1975 at 7:00 P.M. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED ZASPEL MOBILE HOME RENEWAL MOTION: Motion made by Leroux, seconded by Smith to grant a renewal to Joe Zaspel, 17205 Forest Blvd. , No. under Chapter 40, Article III, Subdivision D for a fee of 9$10.00. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED MC CLOUD MOBILE HOME RENEWAL MOTION: Motion made by Leroux, seconded by Smith to grant a renewal to Robert McCloud, 9627 - 122nd. St. No. under Chapter 40, Article III, Subdivision D for a fee of x$10.00. VOTING FOR: LaValle, Leroux, Smith, and Schletty. MOTION CARRIED STREET IMPROVEMENT - Bids are to opened September 18, 1975 and the contractor will be decided on at the City Council meeting of October 6, 1975. 5.3 JOE OMAN - SPECIAL USE PERMIT MOTION: LaValle made motion Smith seconded to grant a Special Use Permit to John Oman to add seven (7) additional pads to his present park with minimum building permit fees for each pad and SAC & REC's to be paid at the time the building permit is issued. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED Recess 10:30 Resumed 10:34 SEPTE1BER 15, 1975 5.0 PETITIONS CONTINUED 5.6 D. ELDRIDGE AND BALD EAGLE INDUSTRIAL PARK Two letter of intent were submitted to the City Council number one and two as follows: Number 1 City of Hugo The Grace Development Co. Inc. agrees to the following: 1 . To develop and submit to the City final working drawings for the drainage of the Bald Eagle Industrial Park. 2. To install a drainage ditch from 130th St. N. South to the existing drainage ditch immediately upon the completion of above drainage plan and the Ci',; OK to install this ditch. 3. To escrow with the First State Bank of Hugo $7,000 for installation of the above ditch and payment of the above drainage and plans. 4. Within 60 days we will develop a comprehensive staged development plan for the Bald Eagle Industrial Park. 5. The Grace Development Co. Inc. , herein agrees that there will be no future sale of vacant land in the Industrial Park until the City approved a staged development plan and that plan is implemented to service the property in question. Number 2 It is agreed between Metropolitan Steel Fabricators, Inc. and the Grace Development Co. Inc. , that we will escrow at the First State Bank of Hugo $7,000.00 for the purpose of installing a drainage ditch from 130th. St. N. South to the existing drainage ditch and also it is to pay for the plan for drainage. Signatures SEPTE1J3ER 159 1975 MOTION: LaValle made motion, Leroux seconded that the City of Hugo place on file the letter of intent from the Grace Development Company for immediate progress in the Bald Eagle Industrial Park. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED ELDRIDGE - SITE PLAN APPROVAL MOTION: Leroux made motion, Smith seconded to accept the site plan from Dan Eldridge for Lot 1 Block 1 , Bald Eagle Industrial Park, lying in Section 30 with the following three conditions: 1 . Recommendation by the Planning Commission to dedicate one- half required additonal property for a turn-around. 2. When entranceway becomes hazardous, it will be eliminated. 3. Submit drainage plan. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED ELDRIDGE - VARIANCE APPLICATION POTION: Leroux made motion, Schletty seconded to grant a Variance to Daniel Eldridge to gravel his parking lot until the road is blacktopped at which time he will blacktop his parking lot. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED MOTION: LaValle made motion, Leroux seconded to extend meeting beyond 11 :00 P.M. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED WHITE BEAR ROD & GUN CLUB The Sewage Disposal System recommendation has been received. Attorney Johnson. gave his views on the White Bear Rod and Gun . Club Special Use Permit. Conditions number one and two, there was no question that if the conditions were not met, the Special Use Permit becomes null and void in its entirety. He also stated in condition number 22 if any undue hardship results, a request for a variance could be filed out with the City Council. As the Rod & Gun Club did not fill out their Variance until September 21 1975 the Club let the Special Use Permit go by default. The Plann- ing Commission had tabled their recommendations does not alter the conditions of the Permit. SEPTEMBER 15, 1975 The Club will have to apply for a new Special Use Permit. The previous conditions would be an outline for the new Permit. A new permit could not generate a whole new set of laws because efforts have been made to meet most conditions. The only conditions of concern would be the ones not met. Attorney Johnson to send letter to Clerks office and M. LaValle, stating his opinion of the Permit. MOTION: Smith made motion, Schletty seconded to direct Attorney stating opinion and recommendation on the White Bear Rod & Gun Club Special Use Permit to be sent to the Clerks office who will then inform the Club that the Special Use Permit is null and void and that they will have to apply for a new Permit. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED MOTION: LaValle made motion, Schletty seconded to adjourn meeting at 11 :45 P.M. VOTING FOR: LaValle, Leroux, Smith and Schletty.
