Ayde at a fee of $50.00 under Chapter 120 of the Hugo City Code. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED MOTION: Lease made motion, LaValle seconded to grant a license for the collection ofarbage and rubbish to Dennis R. MOTION CARRIED MOTION: Schletty made motion, Leroux seconded to grant a license for the collection of garbage and rubbish to Jack Gallagher of Suburban Pickup Service, Inc. at a fee of $50.00 under Chapter 120 of the Hugo City Code. MOTION CARRIED 5.9 NW BELL TELEPHONE BURIED CABLES J.O. 31066, 31081 and 31084 Engineer Kuusisto approved J.O. 31066 and 31084 and 31081 noting that the cable is 9' west of the centerline and examination in the field indicates that any distance greater than this the cable would be in water and may require movement westerly. MOTION: Lease made motion, LaValle seconded to approve the three J.O. 31066 buried cable under Janero Avenue, J.O. 31081 a buried telephone cable on Geneva Ave. from Oneka Lake Boulevard southerly, and J. 0. 31084 buried cable on Forest Boulevard North. VOTING FOR: Lease, Leroux and Schletty. OPPOSE: LaValle MOTION CARRIED 6.0 REPORTS OF OFFICERS & COMMITTEES UUTUBER b, 11J-15 6.2 PLANRTING COMMITTEE - A Public Hearing will be held for re -zoning for Grangers Body Shop & DX service from Concentrated Business to Industrial Use - manufacturing limited. Lee Stewart re: Used Car Lot - Tabled. J. Moe re -zoning instead of conservancy to agricultural committee suggested changing to RR 2. 6.3 SEWER COMMITTEE - Clerk met with bonding company re: Palme problem and settlement is to be soon. Storm sewers - Rice Creek Watershed District approved the permit submitted with the following stipulations: 1. A suitable inverted baffle be installed at the storm sewer inlet from the City Hall parking lot. 2. Suitable pollution control structure be installed between. the fill outlet and the north end of Egg Lake. Copy of the permit to be sent to the DNR. 6.4 BUILDING INSPECTOR - 4 new homes, 1 remodel, 3 garages and 1 commercial and 2 pole buildings. Inspector wrote LarRetti notifying him that no building permit was issued and that there are certain requirements that will have to be met as it is located in the Industrial zoning. He also stated he has enrolled in a building inspection class. 6.6 POLICE CHIEF - Patrol incidents for the month 1,021. Car mileage for month 5,427 to date 51,990. 6.7 ATTORNEY REPORT - Mugg Bond reviewed and some deficiencies were found, letter sent to Mr. Mugg requesting corrected Bond. ASSESSMENT AGREEMENT MOTION: LaValle made motion, Schletty seconded to have Mayor and Clerk execute an agreement between the City of Hugo and the County of Washington, State of Minnesota to acquire the services of the County of Washington, under the provisions of Minnesota Statute 471.59 and Minnesota Statute 273.072 to provide for the assessment of the property in said City of Hugo by the Washington County Assessor for a term of one (1) year at a cost not to exceed One Thousand Four Hundred Dollars 01,400.00). VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED ORDINANCE AMENDING CHAPTER "SEVER SYSTEM" MOTION: LaValle made motion, Schletty seconded to adopt Ordinance No. 124 An Ordinance Amending Chapter 262 Of The Hugo City Code, Entitiled, "Sewer System" To Extend The Time Limit For Connection To The Sanitary Sewer System, Reference To The Minnesota Plumbing Code OCTOBER 6, 1975 `� ORDINANCE AMENDING CHAPTER "SEWER SYSTEM" MOTION: And Clarifying Insurance And Permit Requirements, subject to the following changes: 1. Insert before In Section 262-7, Subd. F and Subd. G. 2. Extended date to April 1, 1976. 3. Delete September for adoption date and publish ed date. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED MOTION: LaValle made motion, Lease seconded to purchase a circular chart recorder complete with totalizer aryl indicator, purge meter, and air supply pump for measuring flow through a 3" Parshall flume from Trai-b r Court for sanitary sewer from Davco, Inc., St. Paul, Minnesota, for a sum of $19500.00. VOTING FOR: Lease, LaValle, Leroux, and Schletty. Engineer Kuusisto said approximate installation charge would be $700.00. MOTION CARRIED 6.9 CLERK RESOLUTION 1975-38 LEVY MOTION: Lease made motion, LaValle seconded to adopt Resolution 1975-38 A RESOLUTION CERTIFYING ANNUAL LEVY TO COUNTY AUDICR, General :78,934.39, Oustside limitation $19,914.80. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED CETA — Job description for sewer operator has been approved by the CETA program. Leroux and Deputy Clerk to attend meeting October 9, 1975 on recent election laws. BIDS ON HOOK UP TO SANITARY SWER TO CITY HALL Three bids were read and reviewed by Engineer Kuusisto. MOTION: Schletty made motion, Leroux seconded to accept the low bid from LaValle Excavating Company for $570.00 with Clerks office asking for the following four requirements: OCTOBER 6, 1975 BIDS ON HOOK UP TO SANITARY SEWER TO CITY HALL MOTION: 1. Cast iron pipe to be used. 2. Bid includes connection. 3. Pumping of septic tank. 4. Filling of cesspool. VOTING FOR: Lease, Leroux and Schletty. ABSTAIN: LaValle MOTION CARRIED LAMETTI AND SON MOTION: Lease made motion, Schletty seconded directing the Clerks office to write to LaMetti and Son asking for plans for their commercial building addition and to table until October 20, 1975 when approval can be considered. VOTING FOR: Lease, Leroux, LaValle and Schletty. MOTION CARRIED STREET AND STORM SEWER IMPROVEMENTS OF 1975-1 Resolution 1975-32 awarding contract to RoSo and Shafer was reviewed by Engineer Kuusisto and Council. RoSo requested a change in the casting which was acceptable by the Engineer and Council. ARTHUR JENSEN - SPECIAL USE PERMIT - BUILD DUPLEX City Planner Schwab disapproved of plans. Planning Commission granted approval with two recommendations. MOTION: LaValle made motion, Schletty seconded to grant a Special Use Permit to Mr. and Mrs. Arthur Jensen to build a duplex in agricultural zoning with the following conditions: 1. That the existing house on property be removed within one (1) year that building inspector certifies to City of Hugo that duplex is completed. A Bond in the amount of $1,000.00 be posted to insure such. 2. That a adequate sewer system be designed and installed in accordance with the City Building and Plumbing Code. The sewer system design shall be of a type approved by the City Engineer. Design of sewer system shall be by the engineer of Mr. and Mrs. Arthur Jensen. VOTING FOR: Lease, LaValle, and Schletty. VOTING AGAINST: Leroux MnMTnV f A PPTPn OCTOBER 6, 1975 Recess called 9:50 Resumed 10:00 7.0 RESOLUTIONS 1975-35 Water Sinking Fund MOTION: LaValle made motion, Leroux seconded to adopt Resolution No. 1975-35 a Resolution requesting the County Auditor of Washington County to reduce by $6,450.00 the taxes levied for collection in the next ensuing year for payment of the said principal and interest, pursuant to Minnesota Statutes, Sec. 475.61 VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED 1975-36 Sanitary Sewer Improvements 1974 MOTION: Leroux made motion, Lease seconded to adopt Resolution No. 1975-36 an assessment roll for the Sanitary Sewer Improvements 1974 for placement on 1976 tax rolls. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED 1975-37 SPECIAL ASSESSMENTS MOTION: LaValle made motion, Schletty seconded to adopt Resolution 1975-37 a Resolution certifying special assessment on deliquent water bills. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED WATER MAIN ON 148TH. ST. BETWEEN FOREST BLVD. AND FOXHILL AVE. MOTION: LaValle made motion, Schletty seconded directing the Engineet to draw up preliminarr plans and specifications for water main on 148th. street between Forest Blvd. and Foxhill Ave. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED MOTION: LaValle made motion Schletty seconded directing Attorney Johnson to prepare notice for a Public Hearing on November 3 at 8:00 P.M., for water main on 148th. street between Forest Blvd. and Foxhill Ave. VOTING FOR: Lease, LaValle, Leroux and Schletty. MOTION CARRIED OCTOBER 6, 1975 91 C it Mayor Lease read letter from M. E. Cammack registering a complaint of hunters trespassing and felt the City should post signs at the outskirts of the City stating "Hunting Restricted". After discussion Council felt the Ordinance #264 amply covered hunting and that between the Hugo Police and Game Warden has adequate protection. Clerk reported he invested $20,000.00 of Sewer Sinking Funds in Certificate Deposit for 3 months at 5J% and $1,879.69 from Special Park Fund in Certificates for 6 years at 7--;'Y%. (2) That the County Auditor of County is hereby requested and directed to reduce y $_6,450,00 the taxes levied for collection in the next ensuing year for payment of the said principal and interest, pursuant to Minnesota Statutes. Sec. 475.61. The motion for the adoption of the above resolution was duly seconded by member __Leroux , and upon a vote being taken thereon, the follow- ing members voted in favor thereof: Lease, LaValle, Leroux and Schletty and the following voted against the same: • None whereupon said resolution was declared duly passed and adopted.
