ABSENT: LaValle 3.0 APPROVAL OF MINUTES: In Approval of Minutes, change the second from Schletty to Smith. MOTION: Lease made motion, Leroux seconded to approve minutes of October 20, 1975. VOTING FOR: Lease, Leroux, Smith and ScIletty. MOTION CARRIED 4.0 APPROVAL OF GENERAL CLAIMS: Item #5 $12.50 Police Dept., and $115.38 Fire Dept. MOTION: Schletty made motion, Smith seconded to approve the General Claims of November 3, 1975. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED APPROVAL OF UTILITY CLAIMS MOTION: Leroux made motion, Smith seconded to approve the Utility Claims of November 3, 1975. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 5.0 PETITIONS, REQUEST, COMMUNICATIONS & LICENSES 5.7 BELLAIRE RUBBISH LICENSE MOTION: Lease made motion, Leroux seconded to grant a rubbish license for the collection of garbage and rubbish to Charles E. Johnson, Bellaire Sanitation, Inc. at a fee of $50.00 under Chapter 120 of the Hugo City Code. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED NORTHERN STATES POWER COMPANY — INSTALL GAS MAIN vAa� MOTION: Smith made motion, Schletty seconded to grant permission to Northern States Power Company to install gas mains at 148th. Street North between Highway 61 and Foxhill, G-840127. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED NQd EI11BER 39 1975 OFF SALE LIQUOR LICENSE - N. NITTI TRANSFER FROM TRAEGERS MOTION: Smith made motion, Schletty seconded to approve the transfer of Off Sale Intoxicating Liquor, On Sale Intoxicating Liquor, On Sale Sunday Liquor, Cigarettes License and Soft Drink License from Traegers to Nick Nitti, for a total amount of $155.99 for the month of December 1975. Mayor Lease asked Mr. Nitti if he was acting as owner and operator of the establishment. Mr. Nitti said he was acting as himself, as owner and operator. Mayor Lease asked Mr. Nitti if there were any contingencies in the sale. Mr. Nitti said there were no contingencies. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 5.1 CUSTOM ELECTRONICS SYSTEMS 2.'L3 i A representative from Custom Electronics presented his viewpoint regarding the bill sent to the Fire Department. In his determination, he felt the fire department was responsible for the damage to the cable. He said that in stapling the cable they cut into the jacket of the cable. Said his firm was to deliver only and not install but would help the department in installing. Chief K. Granger questioned who was responsible for the problem but said that if the firm said the fire department was in error, they would accept the responsibility for the payment of the repair bill. MOTION: Lease made motion, Smith seconded that the Fire Department accept the responsibility of the X0474.50 repair bill, and the bill would be paid. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED Mayor Lease called recess at 8:10 P.M. Public Hearing was called at 8:11 P.M, Clerk Burkard read the published notice of Public Hearing 1atermain Improvement Project No. 75-2 City of Hugo, Minnesota. Engineer Kuusisto explained the reason why the City wanted the watermain in but actual assessable amount had not yet been determined. Mayor Lease explained that he would like a one time hookup and then assessed when the party hooks up. NOVEKEBER 39 1975 V. Peloquin representing the American Legion, said they would be opposed if they were assessed. Stated that they did not need the water and that the _land would be used for parking. Financially they could not afford it, the sewer assessment was enough of a burden. M. Carlson also stated that as a representative of the Legion Club, they could not afford it and that the land would, in his estimation, would never be buildable for anyone to be interested in water. Mr. Ray Erickson, 14862 Foxhill Avenue No. said it would be of no benefit to him also couldn't afford it along with the other assessments. MOTION: Lease made motion, Schletty seconded to close the Public Hearing at 8:24 P.M. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED Mayor Lease reopened the meeting at 8:25 P.M. MINING PERMIT - R. SCHUH - SPECIAL USE PERMIT - DURAINE Duraine Permit expired on September 30, 1975. The pit was never brought back to grade. Councilman Smith said the pile should not be removed. Attorney Johnson said if legal action was to be taken, the obligation would be removed. MOTION: Schletty made motion, Smith seconded to table the Special Use Permit and Mining Permit, Duraine and Schuh until the next meeting of November 17 when Attorney Johnson will have a report. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 5.3 R. RICCI - BUILDING PERMIT MOTION: Lease made motion, Leroux seconded to have Building Inspector Crever issue a Building Permit to R. Ricci for the continuation of building his home with the contingency that the survey be in by December 1, 1975 or a report thereof. Mr. Ricci informed the Council that the mortgage company, First State Bank of Hugo has been informed of the re -platting. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 5.4 CETA APPLICATION - POLICE DEPARTMENT MOTION: Schletty made motion, Smith seconded granting approval to Police Department to proceed with the CETA program for a patrolman. Council wanted the chief to make the applicant clear that when the grant time has run out, the City would not be responsible for continuation of employment. YOVE1,11BER 39 1975 2 c 5 VOTING FOR: Lease, Leroux, Smith and Schle tty. MOTION CARRIED 5.5 WHITE BEAR ROD & GUN CLUB No lighting plans were available for engineer review and Council review. Council told Club member what they wanted and to have it on paper so the engineer could review it. Review at next meeting. Mayor Lease called recess at 9:10 P.M. Back to order 9:21 P.M. 6.0.10ETA - J. OSTERMANN Some problems have come to the Mayors attention which were discussed with Ostermann. Some suggestions were made to him regarding his time and responisbility to equipment. 6.1.1DOG ORDINANCE - Was reviewed and further changes were suggested: Indentification tags to be included in Ordinance. Fee collection and receipts and handling method to be inserted. Summarize Minnesota Statutes. Mayor Lease questioned: 1. Sec. 1 A "dog or permits the same to be kept or to��staZ on or about his premises" (he preferred�teon his premises not on or about) Sec. 3 C "Has shown vicious habits" - who determines vicious habits. Sec. 7 "permitted by Minnesota Statutes". Itemize Minnesota Statues - too vague. To be reviewed at next meeting November 17, 1975. OFF SALE LICENSES: MOTION: Leroux made motion, Smith seconded to approve the Off Sale Intoxicating Liquor License to Swan Anderson, Carpenters, 14559 Forest Blvd., Hugo. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Smith made motion, Lease seconded to approve the Off Sale Intoxicating Liquor license to Robert Ricci, Ricci's Saloon, 14777 N. Forest Blvd., Hugo. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Leroux made motion, Schletty seconded to approve the Off Sale Intoxicating Liquor license to Eugene Peltier, Countryside Center 17305 Forest Blvd., No. Hugo. MOTION CARRIED MOTION: Lease made motion, Schletty seconded to approve the Off Sale Intoxicating Liquor license to Nick Nitti, 13891 No. Forest Blvd., Hugo. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 6.1.2 ORDINANCE PROPOSED - Attorney Johnson to check with Attorney Generals office regarding who can and cannot install the hook ups to the sewer lines, report at next meeting. 6.7.1 MUGG BOND - Attorney stated there may be a change from a Bond to a letter of credit in the amount specified. Re -Zoning - Attorney to draw up the amendment to Ordinance - Granger legal description matches. TAUER PROBLEM: Tauers moved but rental problem still exists. Hugo Police Department to check. MOTION: Smith made motion, Lease seconded to extend meeting beyond 11:00 P.M. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED WHITE BEAR ROD & GUN CLUB - Questioned why the gun club was going ahead with there building when they no longer have a valid Special Use Permit. Attorney Johnson to talk to there attorney regarding there plans. CETA EXTENSION MOTION: Smith made motion, Lease seconded to accept the extension of the CETA Program until June 30, 1976. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED SPEED LI14IT: MOTION: Lease made motion, Smith seconded to recind Resolution No. 1975-29. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED NOVE1-,1BER 3, 1975 As per the Highway Department, governing bodies cannot set a speed limit they request a traffic survey to determine the reasonable and safe speed of the street. MOTION: Lease made motion, Smith seconded to adopt Resolution No. 1975-39 A RESOLUTION REQUESTING THE COMMISSIONER OF HIGHWAYS TO CONDUCT A TRAFFIC SURVEY TO DETERMINE THE REASONABLE AND SAFE SPEED OF THE FOLLOWING STREETS: EVERTON AVENUE NORTH AND ETHAN AVENUE NORTH FROM 120TH. STREET TO ELMCREST AVENUE NORTH. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED LA VALLE EXTENSION - Letter received from LaValle Excavating stating t a per condition #10 they were to submit cross sections and elevations of there gravel pit on or before November 1, 1975. They are presently in the process of having the work done but will not have all the necessary information ready in time and are asking for a 30 day extension. MOTION: Leroux made motion, Lease seconded to grant a 30 day extension for condtion #10 of the Mining Permit. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED WATERMAIN IMPROVE14ENT PROJECT NO. 75-2 MOTION: Lease made motion, Schletty seconded to have engineer prepare final plans and advertise for bids for Watermain Improvement Project No. 75-2. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Lease made motion, Leroux seconded to Receive and Open Bids for Watermain Improvement Project No. 75-2 on December 1, 1975 at 8:00 P.M.
