VOTING FOR: Lease, LaValle, Leroux, Smith, Schietty MOTION CARRIED MOTION: Leroux made motion, seconded by Schietty to approve the minutes of the Special Audit Meeting held January 12, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith, Schletty MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Smith made motion, seconded by Schletty to approve the General Claims of January 19, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith, Schietty MOTION CARRIED MOTION: LaValle made motion, Leroux seconded to approve the Utility Claims for January 19, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith, Schletty MOTION CARRIED HUD - Mayor Lease referred letter from Hud concerning the audit to H. Kuusisto, Engineer, and City Clerk. 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 NORDEEN - WASHINGTON COUNTY BICYCLE SAFETY PROGRAMS iii uuaSION: Proposed license fee is $2.00, one time only for that bicycle, or if sold, new owner must buy a new license. Film shown. Law enforcement to be encouraged. Mayor Lease can see the education program, but doesn't like fining a child. Wants to know what is being done to make bike riding safer for the bicyclist - Nordeen says juveniles can't be fined - fines are for the adult rider. MOTION: LaValle made motion, Schletty seconded to refer the pro- posed Bicycle Safety Ordinance to Hugo's Ordinance Committee for study. VOTING FOR: Lease, LaValle, Leroux, Smith, Schletty MOTION CARRIED PUBLIC HEARING 8:00 PM Clerk read the notice for the Public Hearing, a Public Hearing for a petition for a Mobile Home Permit for James D. Johnson, 7194 - 132nd Street North, Hugo, Minnesota. Lease asked if Johnson realized the previous mobile home was on a hardship basis - stated he would also apply for the hardship basis as he is recovering from a fractured shoulder and needs the help of the man in the mobile home until this spring. He purchased the mobile home after he bought the farm buildings and 10 acres. LaValle questioned the future use of the land-residing on land or farming on the 10 acres, a minimum amount. Johnson said it is in the agreement for the next three (3) years that he would have accessibility to the 118 acres of cropland. No comments from anyone other than the council. PUBLIC HEARING CLOSED AT 8:08 PM 5.4 J. iUtnNbUA - MOBILE HOME PERMIT MOTION: Smith made motion, Schletty seconded to grant a Mobile Home Permit to James D. Johnson, 7194-132nd Street North, Hugo, Minnesota, under Chapter 40, Article III, Subdivision D for a period of not to exceed ninety (90) days for a medical with the understanding that more dramatic proof will be needed if a renewal permit is sought. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty MOTION CARRIED 5.2 DOUGLAS FINK ATTY. FOR HAROLD BRAMSTEDT-OVERFLOW DRAINAGE Bramstedt owns 160 acres - claims the drainage to Egg Lake will cause an overflow of some 70 acres of his tract. Claims this watering JANUARY 19. 1976 - CITY COUNCIL will decrease the valuation of his property and reduce useable land. City Engineer will present data at next meeting of February 2, 1976. 5.3 N. PELTIER - VARIANCE APPLICATION AND SITE PLAN APPROVAL Slab already poured for proposed building. Council questioned dis- tance form building to road and drainage problem. Peltier said he had no drainage problem. MOTION: LaValle made motion, seconded by Schletty to table the Variance Application and the Site Plan Approval until a drainage plan is established for the property and given to the City Engineer for his consideration. VOTING FOR: Lease, LaValle, Leroux, Smith, Schletty MOTION CARRIED 5.4 L. DURAINE — SPECIAL USE PERMIT R. SCHUH - MINING PERMIT - REMOVAL OF AGGREGATE ONLY LaValle said Rehbein said the pile was deliberately stockpiled in violation of the Ordinance and Smith said Barton also feels that Schuh was in violation, (when Schuh was a subcontractor for M. Rehbein) , of the Mining Ordinance. Leroux asked if Schuh wasn't aware that he couldn't stockpile without a permit - Hiniker said no. Attorney Hiniker did say that R. Schuh was aware that there was a Mining Ordinance. LaValle said he feels Schuh was in violation pre- viously, and he will vote against it. Hiniker said the pile is there, and Mrs. Duraine has a right to this income from her property. Hiniker said if approval is given, they will comply with all reasonable requests of the city. Lease said part of the problem is Schuh's past unwillingness to comply by getting a permit. He was crushing rock over four (4) years. Hiniker said he now realizes he must com- ply with all reasonable requests. C. Johnson said it should be documented and have engineers photograph the stockpile as a record of how it stands right now. Lease wants to go on record as saying the pile should be removed if something can be worked out, but sees haul routes and policing as a big problem. Special Use Permit conditions: 1. Performance bond of $3,000 be posted for inspection fees and letter of credit. 2. Speed limit of 45 MPH on City of Hugo roads. 3. Haul route established by City Council from pit going South on Irish to 8A. 4. Permit limited to stockpile only. MOTION: Motion made by Lease, seconded by Smith to table until the next meeting of February 2 until the engineer's report is in. VOTING FOR: Lease, LaValle, Leroux, Smith, Schletty MOTION CARRIED Attorney Hiniker would like a representative to be present when Kuusisto reviews the site. Recess called at 9:47 PM until 10:10 PM. 6.0 ORDINANCES & RESOLUTIONS J. Ion qualifies for PERA and it was questioned whether she should come under the coordinated plan or Police, a Council decision. MOTION: LaValle made motion, Smith seconded that a Resolution be drawn up by the Clerk to be presented at the next meeting of February 2, placing J. Ion under the coordinated fund. VOTING FOR: Lease, LaValle, Leroux, Smith, Schletty MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 J. MOE - PLAT APPROVAL Copy of covenants given to attorney. Road profile, cross sections, and easements all given to engineer. Preliminary road plan sub- mitted, not final plan. MOTION: LaValle made motion, Lease seconded to approve Variance Application for Jerry Moe, a variance for blacktop to gravel for roads and extension of road to cul de sac as property cannot be devided any other way. VOTING FOR: Lease, LaValle, Leroux, and Schletty. VOTING AGAINST: Smith MOTION CARRIED MOTION: LaValle made motion, Lease seconded to approve preliminary approval of Plat subject to the following conditions: 1 . Electric transmission line on the West property line know condition of that easement. 2. Park covenants i4ve to be agreed upon. 3. Road profile has to be approved subject to drainage easements. 4. Subject to possible easement to the West for future road extension. 5. Subject to ponding areas be left at their natural state. VOTING FOR: Lease, LaValle, Leroux, and Schletty. VOTING AGAINST: Smith MOTION CARRIED 7.2 ROCKVILLE - LIQUOR LICENSE MOTION: Lease made motion, Schletty seconded to table the liquor license issue .uni;-il further notice. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED It is the concensus of the council that if an application is re- ceived from E. Forsblad and if the taxes are paid; they will issue a license - to act on February 2nd. meeting. 8.0 NEW BUSINESS TREASURER - SALARY REVIEW MOTION: LaValle made motion, seconded by Leroux to increase Treasurers salary form $1 ,000.00/year to $1 ,400.00 per year. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty MOTION CARRIED MOTION: Leroux made motion, LaValle seconded to extend meeting beyond 11 :00 P.M. MOTION CARRIED A & W SPECIAL USE PERMIT MOTION: Motion made by LaValle seconded by Leroux that the A & W Special Use Permit be amended reducing bond from $5,000 to $2,500 the bond requirement for one year umtil a decision is made regardingg, storm water and condition #2 on lighting be extended one year with an annual review in 1977. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 8.3 WHITE BEAR ROD & GUN CLUB - SPECIAL USE PERMIT J. Perron stated trees were planted but apparently were minimal, but felt they met the terms of the permit, and has witness to such. Council suggest applying for a new Special Use Permit, with public hearing etc. at which time the original conditions could be re- examined. MOTION: Lease made motion LaValle seconded to have J. Perron bring in documental proof that they did plant those trees in question, prior to June 1 , 1975. VOTING FOR: Lease, LaValle, Leroux, Schletty. OPPOSED: Smith MOTION CARRIED January 19, 1976 F MOTION: LaValle made motion, Leroux seconded to have a Special Meeting on Thursday, January 22, 1976 at 7:00 P.M.
