February 2, 1976 PRESENT: Lease, LaValle, Leroux, Smith, and Schletty. 3.0 APPROVAL OF MINUTES MOTION: Lease made motion, Leroux seconded to correct minutes of January 19, 1976 meeting as follows; Page 1 , 4.0 bottom paragraph should read Mayor Lease referred letter from HUD concerning the audit to the City Clerk and Engineer. Page 4, 7.1 motion should be changed to approve Variance Application for Jerry Moe instead of James D. Johnson. Also Voting for: Smith's name should be deleted and recorded as voting against. Page 5, 7.1 motion, Smith's should also be deleted as voting for and should be recorded as voting against. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED MOTION: LaValle made motion, Leroux seconded to approve minutes of January 22, 1976 special meeting. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: LaValle, made motion seconded by Schletty, to approve the General Claims of February 2, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED MOTION: Lease made motion, seconded by Smith to approve Utility Claims for February 2, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 BARTH - VARIANCE EXTENSION REQUEST Friend who is sharing Barth's workshop is unable to close deal on home he is purchasing for ninety days so Barth is asking for two month extension until friend moves permanently. MOTION: LaValle made motion, seconded by Leroux, to grant Robert Barth an extension of sixty days, from March 1 , 1976 to May 1 , 1976, to allow intensification of his cabinet making hobby at his residence at 13317 Homestead Avenue. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED 5.2 L. DURAINE - SPECIAL USE PERMIT FOR REMOVAL OF AGGREGATE 5.3 R. SCHUH - MINING PERMIT MOTION: Lease made motion, seconded by Leroux, to table matter until April 5, 1976 meeting so a road profile, site distance and soil study can bu made of the haul route. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 5.4 K. SCHOTL - RE: CONSTABLE - DIDN't APPEAR 5.5 INDYKIEWICZ - MINING PERMIT RENEWAL LaValle felt permit should be renewed for 3 or 4 months so that it would be renewed in summer so site can be examined. Feels all minimg permits should be realigned to be renewed in summer. MOTION: Lease made motion, seconded by LaValle, to extend Indy- kiewicz minimg permit until June 1 , 1976. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED Upon further examination of permit, discovered not due for renewal until July 6, 1976. FEBRUARY 2, 1976 MOTION: Lease made motion, seconded by LaValle, to rescind the previous motion. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED LAVALLE EXCAVATING -puR LAR MINING PERMITS MOTION: Lease made motion, seconded by LaValle, to extend the minimg permits for LaValle Excavating and Bur Lar, In- coorporated, until July 1 , 1976, and instructed clerk to inform these companies to bring their bonds up to date. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED 5.6 WHITE BEAR ROD & GUN CLUB ON SALE LIQUOR LICENSE LaValle said original intentions were not to have liquor license zoning isn't proper - if license desired should apply for club license. MOTION: LaValle made motion, seconded by Schletty[, to deny the petition of White Bear Rod and Gun Club for on-sale liquor license. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 ORDINANCE COMMITTEE Smith reported committee studying a driveway ordinance - have viewed several communities including Washington County-none seem adaptable to Hugo's type community. Lease wants permit to indicate location, probably under jurisdiction of Engineer, to be taken out when building permit is issued. Crever said should include specs for culverts. Schletty asked Engineer to make recommendation on the matter. 6.2 PLANNING COMMISSION Leroux repmrted Harley Johnson would like to stay on Planning Commission. Had time problem in past but feels has more time now. Discussion concerning Vern Peloquin making application for special use permit for Shepherd of Fields Lutheran Church - some council members felt it was improper-Attorney says if Peloquin applies it can be contingent on sale to church. If they decide to build elsewhere, permit would become void. Smith presented letter from June Smith in regard to allegation of rene Leroux that she has 20 children in her school instead of maximum of 12, including her own. Letter indicates there are never more than 12 there at one time. LaValle said if speciwl use permit had expired on September 1 , 1975 and she did not apply for renewal until September 10, 1975, attorney should be asked for opinion as to whether or not it is now null and void. After studying permit, it was determined by attorney that it was not a renewal but rather a new permit and is in force. However, the permit must be renewed by October 6, 1976 or it will terminate. 6.3 WATER SUPERINTENDENT Has been paid salary of $125 per month for last six years- asked for salary increase on monthly basis for all but maintenance work - amounts to about forty hours per month, and an hourly wage for maintenance work, repairing meters - recommended buying new remote heads at $12.50 apiece, with additional cost of about $5 apiece for installation - would save time reading residential meters, however. Would have to decide how to pay for them would city absorb cost? are about 125 old meters that could be replaced- need no decision 1 4 now but should be considered. Also should consider increasing trench and meter inspection fees which are presently $3 trench fee and $2 meter fee. Feels meter reader should get more money- about 200 meters to read, takes about 20 hours. Needs to order twelve new 5/8 water meters now. Said flyer has been sent out informing those who are not already hooked up to sewer that they have until 4/1/76 to do so. MOTION: Lease made motion, seconded by LaValle to pay Robert Burkard, . water superintendent, a salary of $250 per month for all work exclusive of maintenance. Salary will include water testing, Billing of water and sewer, both regular and special water and sewer reports, and checking of pump house and meters. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to increase the meter reader's salary from $3.50 to $4.50 per hour for 1976. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Smith made motion, seconded by Schletty to order twelve new Rockwell 5/8 Water Meters for household use. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED Matter of hourly rate for water superintendent to be looked at further. 6.4 SEWER COMMITTEE LaValle reported Frank Hovald and Jim Wisner have complained about pipe in drainage easement across their property being about 30' shorter than they were told it would be-City Engineer instructed to look at it on February 3rd. Electric conduit is sheared off and wires exposed in Lift Station #1 , LaValle said. Engineer instructed to inspect too. Also re- ported Hoffman Brothers has not met all easement conditions. Engineer says the city will not pay til all matters are taken care of. He will cheek into matter. 6.5 BUILDING INSPECTOR No building permits this month, Crever reported. LaValle asked if George Miron problem was resolved-Crever said that the lot was sold prior to present zoning laws and Clerk has approved the lot. LaValle asked if a new state zoning law was adopted- Crever said no, a new book comes out every three years and is automatically adopted. New energy law went into effect February 1st. 6.6 POLICE CHIEF MOTION: Lease made motion, LaValle seconded, to accept the monthly police report. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED Lease stated that Manuel Peloquin has refused to sign the complaint he filed against Richard Dalin-claims Lease told him not to- Lease says he didn't. Attorney to talk to police chief and to ask Manuel Peolquin again to sign and if not, the matter will be dropped. 6.7 FIRE CHIEF - No report 6.8 ATTORNEY Reported Horton's attorney called judge and asked for delay be- cause of prior committment-has been postponed to indefinite date- still wants to settle-Norm Sr. in Florida-Norm Jr. will try to resolve issue in his absence. FEBRUARY 2,1976 i Storm sewer project-talked to Mr. Ricci about easement status- 1 Ricci's been unable to get easement behind property. MOTION: LaValle made motion, seconded by Leroux, to have Engineer write a letter to Ricci to have necessary documents executed to have the line put in, or a change will be requested in the sewer program. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED Regarding petition for improvements in Rice Creek Watershed District, requested by Hugo, LaValle, asked about public hearings - Johnson said it appeared they have already been held-LaValle asked why we weren't informed. Construction is proposed for earliest possible date. Engineer requested to look in to it. LaMetti-Attorney has necessary information from building inspector and will take action immediately. Jerry Moe - regarding covenants - sent their attorney report of what is necessary - hasn't had reply - doesn't know status. Manuel Peloquin's road - sent deed back to Peloquin's attorney for clarification. . 6.9 ENGINEER Item 5-HUD grant has been turned over to Mr. John Telfer of HUD and he indicated will act on it. Bald Eagle Industrial Park-have studied plat revisions and drain- age plan in detail. Harold Branstedt - storm sewer drainage would probably account for i to 4/10" or less of rise in liquid in Egg Lake. Does not take into account outlet which would tend to reduce amount. In- structed Engineer to notify Mr. Bramstedt of findings. 6.10CLERK Presented bill from Maurice Carlson to Vern Peloquin for $420.50 for back hoe operator trying to locate sewer stub for Vern Peloquin supposedly ten feet down. Had not located at thirteen feet and stopped diggiig. MOTION: Lease made motion, seconded by Schetty, to have Engineer send bill from Maurice Carlson to Vern Peloquin for trying to locate stub to Hoffman Brothers tieir considera- tion. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTON CARRIED LEE STJ WART Clerk instructed to send him letter informing him his money is not refundable for a special use permit he requested for a used car lot on August 20, 1975. CHANGE ORDERS MOTION: LaValle made motion, seconded by Schletty to sign Sanitary Sewer Change Order No. 123-1973-1 . VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 7.0 ORDINANCES AND RESOLUTIONS 7.1 RESOLUTION # 1976-41 MOTION: LaValle made motion, seconded by Leroux, to approve Resolution #1976-41 , placing part-time police officer J. Ion, under the co-ordinating fund of P.E.R.A. 1 6 VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED ASSESSMENT SEARCHES Council directed Attorney to prepare a resolution regarding ass- essment searches. 8.0 UNFINISHED BUSINESS 8.1 ROCKVILLE ON SALE LIQUOR LICENSE APPLICATION - Did not appear. Tabled until council hears from them. 9.0 NEW BUSINESS 9.1 SHEPHERD OF FIELDS LUTHERAN CHURCH Lester Winter, representing the church explained they have earnest money agreement with V. Peloquin whereas if they obtain all nece- ssary permits to build church, they will buy land from him. Attorney said special use permit could be vacated within a certain amount of time, if they decide against building there. Sees no problem issuing permit to Peloquin on behalf of church. Winter inquired as to what would be necessary for extending water to site and grading the road. Easement is approximately 40 or 50 feet wide. Site consists of 6.8 acres abutting Hugo Elementary School. Lease didn't feel city could extend water unless land between present utilities and site is subdivided. Winter said parking lot would handle 100 - 120 cars so no need for on-street parking. Council instructed Attorney and Engineer to review the project regarding drainage, subdivision and street requirements and report at the Council meeting of February 17th. MOTION: Lease made motion, seconded by Leroux, to table the matter of a special use permit for Shepherd of Fields Lutheran Church until a full report is received from the Attorney and Engineer. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTON CARRIED MOTION: LaValle made motion, seconded by Schletty, to adjourn meeting at 10:20 P.M.
