Leroux arrived 7:12 P.M. 3.0 APPROVAL OF MINUTES MOTION: Smith made motion, Schletty seconded to approve minutes of February 2, 1976 meeting. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED MOTION: LaValle made motion, Smith seconded to approve minutes of special Febuary 4, 1976 meeting. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: LaValle made motion, seconded by Schletty, to approve the General Claims of February 17, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Lease made motion, seconded by Schetty, to approve Utility Claims for February 17, 1976. VOTING FOR: Lease, LaValle, Leroux, Smith, and Schletty. MOTION CARRIED BID OPENING FOR NEW POLICE SQUAD Clerk read Notice for Bids. MOTION: Lease made motion, seconded by Smith, to close the bid opening. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED Received one bid from McMillan Dodge, Forest Lake for $3,617.70 with trade, for a '76 Dodge Monaco 4 dr. police car-included bid bond of $180.89 - no other bids received. MOTION: LaValle made motion, seconded by Schletty to table matter until next meeting pending review by police chief, City Attorney and City Engineer. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES ON SALE LIQUOR LICENSE TRANSFER FROM WILLIAM GUSE No action taken as appliction was received late and was incomplete. MOTION: Lease made motion, seconded by LaValle to table matter of license transfer from William Guse until March 1 , 1976 City Council meeting. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED WHITE Pry:R ROD & GUN CLUB Jerry -erron and Attorney Jack Wallace appeared Wallace presented nineteen page prepared sworn statement concerning facts relevant to tree planting condition of Special Use Permit. Wallace feels trees already planted does not, in fact, meet requirements of permit but feels that technically meet requirements-token plantings were done to relieve pressuresof environmental groups -planting 19 in excess of ' minumum requirements will be done in spring when trees are available. His opinion that these sworn statements would hold up in a court of law if necessary. Council and City Attorney to study statement before making any decision on the matter. MOTION: LaValle made motion, seconded by Schletty to table the matter of the tree planting condition of the White Bear Rod and Gun Club until the meeting of March 15, 1976, to give Council and Attorney time to study statement before making a decision. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 5.3 NEIL PELTIER - SITE PLAN APPROVAL MOTION: LaValle made motion , seconded by Schletty, to grant Site Plan Approval to Neil Peltier, 5548 140th Avenue North for a building to be used for light manufacturing and a variance for a crushed rock driveway, the drainage plan submitted and the recommenddations of the City Engineer to be included as part of the Site Plan Approval, and a bond in the amount of $500.00 must be posted with the City to insure compliance. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 5.4 MORRIS CARLSON REGARDIL'G SEWER ISTALLERS Carlson questioned need for $25,000bond by both sewer installer and plumber-felt amount was excessive compared to other communities-Lease said no considering Hugo's high water table-attorney stated bond is necessary for plumber and also for sewer installer if working on city right of way-Engineer said installer should remain bonded even if only working on City right of way periodically. 6.0 ORDINANCES AND RESOLUTIONS 6.1 BLOOMINGTON REQUESTING SUPPORT OF CONTINUATION OF SPORT FACILITIES FOR PROFESSIONAL BASEBALL AND FOOTBALL WITHIN CITY OF BLOOMINGTON. MOTION: LaValle made motion, seconded by Leroux, to pass Resolution #76-42, resolving that the City of Hugo fully supports the resolution requesting the State Legislature to put any stadium proposal to a vote of our people. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED Clerk instructed to send copy of resolution to state legislators. 6.2 AMEND ORDINANCE 252 - EXTENDING CONNECTION TIME FOR SAN- ITARY SEWER. MOTION: Motion made by LaValle, seconded by Smith, to have Attorney draw up an amendment to Ordinance 262, providing for an extension for connecting to sanitary sewer without penalty, to September 1 , 1976. No further extension will be allowed. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED RECESSED - 8:32 P.M. RECONVENED 8:48 P.M. 7.0 UNFINISHED BUSINESS SHEPHERD OF FIELDS LUTHERAN CHURCH Engineer presented report in regard to water, recommended road construction, location of sewer and surface drainage. Attorney gave verbal report with written report to follow. Attorney's opinion that if new roadway is generated there would have to be subdivision compliance regardless of who pays for roadway- there have been no REC charges assessed against property so REC charges would have to be determined by size and use of structures in addition to the assessment on the property. Doesn't feel Peloquin would have to subdivide if no new roadway is created. Lease would like to see thru street so there is circular access-feels any construction costs for improvements to 21.1 be paid by developer- doesn't feel obligation to buildstreet even if city owns right of way-developer would have to pay these costs. Peloquin says doesn't expect city to pay for street on his property-feels it should be a fifty foot street with no on-street parking-doesn't feel he should be required to sub- divide. Council instructed Engineer to calculate the cost of laying in watermains, blacktop, etc. , on the approximately 140 feet that the city owns, and use the same figures for figuring the cost on the 389' the church owns and the 230' Peloquin owns. Report to be ready for Planning Commission before Public Hearing. Church pastor, Steven Houser spoke briefly of importance to people of Hugo of building church within the town instead of in country where land would be less expensive; expressed hope that citizenry would be willing to contribute the small amount it would cost to build small section of roadway that Hugo owns. REQUEST MOBILE HOME PERMIT JOSEPH GREGOIRE SR. Petition submitted by Joseph Gregoire Sr. to have a mobile home on his land. MOTION: LaValle made motion, seconded by Leroux, to schedule a public hearing for 8:00P.M. on March 1 , 1976 for the purpose of discussing a mobile home permit for Joseph Gregoire Sr. , at 165th Street and Henna Avenue. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED Clerk instructed to punish notice of public hearing and notify adjoining property owners. CLERK'S CONVENTION MOTION: Motion made by Lease, seconded by Schletty to pay the registration fee for the City Clerk for Annual Clerk's and Financial Convention to be held at the Mariott Inn from March 10-12, 1976, and also to re- imburse for mileage. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED METROPOLITAN WASTE CONTROL COMMISSION DEVELOPMENT PROGRAM Engineer instructed to contact Waste Control Commission regarding proposed plans which will result in reduced capacity for Hugo, and report back to Council. BALD EAGLE INDUSTRIAL PARK MOTION: Lease mae motion, seconded by LaValle, to have Attorney furnish Ken Tschida, Bald Eagle Industrial Park, the Engineer's report regarding drainage for the Industrial Park, informing them the council doesn't agree with their plans and items set forth by our Engineer must be complied with in Phase I of their plans. VOTING FOR: Lease, LaValle, Leroux, Schletty, and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by LaValle, to adjourn meeting at 11 :00 P.M.
