PRESENT: Lease, LaValle, and Smith. 3.0 APPROVAL OF MINUTES MOTION: LaValle made motion, Smith seconded to approve minutes of February 17, 1976 meeting. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Lease made motion, seconded by LaValle, to approve the General Claims of March 1 , 1976. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED MOTION: Smith made motion, Lease seconded to approve the Utilities Claims for March 1 , 1976 with the addition of Fadden Pump Company for $300.82. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS AND L11i15iibi s 5.1 ON SALE LIQUOR LICENSE - W. GUSE TRANSFER License transfer from William Guse, to Stanley F. Lynn, 693 Birmingham Avenue, St. Paul, Minnesota. Plans to up-date heating, plumbing and air conditioning - instructed to notify building inspector. MOTION: LaValle made motion, Lease seconded, to transfer license froml William Guse to Stanley F. Lynn, 693 Birmingham Avenue, St. Pail, for On-Sale Intoxicating liquor for fee of $1 ,125.00, On-Sale Sunday Intoxicating liquor $200.00, Off-Sale Intoxicating liquor $100, Cigarette License $9, and Soft Drink license $5.00. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED 5.2 ON SALE LIQUOR LICENSE - EUGENE PELTIER Eugene Peltier presented proof of ownership-explained on-site septic system consists of two 750 gallon tanks with 150 lineal feet of drain fields. Engineer advised to review the septic tank system. MOTION: Lease made motion, LaValle seconded, to grant a Special Use permit to Eugene Peltier, to operate an on-sale liquor establishment at 17205 Forest Boulevard North with the following conditions: 1 ) Special use permit will be terminated if the property owner fails to maintain a valid on-sale liquor license for a period of twelve consecutive months. 2 That the property owner obtain a building permit 3 That the property owner furnish proof of ownership to the City for Planning Commission and Council files. 4) That the City Engineer review their Sanitary sewer system. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED MOTION: LaValle made motion, seconded by Smith to grant Eugene Peltier an on-sale intoxicating liquor license for a fee of $1 ,250.00 and an on-sales Sunday intoxicating liquor license for a fee of $200.00. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED MEETING RECESSED 7:59 P.M. 8:00 PUBLIC HEARING Mobile Home request — Joseph Gregoire, 7600 165th Street. 22 Notice of Public Hearing read. Mr. Gregoire applied for a temporary mobile home permit on the Gregoire property under Chapter 40, Article III, Subdivision D. Lease explained that such a permit is normally issued in cases of dire need because of illness orwhere there is a full time farm operation where there are dairy cattle and a large tract of acreage to maintain. Read letter from Mr. Gregoire explaining his unemployed son is travelling from. Stacy to help his father with his chores, which because of his rheumatism he can not do himself — ex— plained there are already two residenses on the property — one he lives in and one his son Jim lives in — Jim helps him as much as possible. LaValle questioned that there is one full time farming operation being handled by three part time people on the same eighty acres of land. Gregoire said there is a water line and cesspool already there which are not being used. Cesspool has not been used for the past ten years. Son would like to build home later when he can find employment. Lease explained that if issued, the permit is only good for ninety days, after which time it would have to be renewed. Hearing closed at 8:08 P.M. MEETING RECONVENED AT 8:09 P.M. JOSEPH GREGOIRE — MOBILE HOME PERMIT MOTION: Lease made motion, seconded by Smith to approve the request for a mobile home permit for Joseph Gregoire under the following conditions: 1 ) That a complete review be made in one year to see if there is any change in the operation. 2) Have building inspector determine if new sanitary sewer system is needed. VOTING FOR: Lease, LaValle, and SMith. MOTION CARRIED 5.2 INSURANCE REVIEW MOTION: LaValle made motion, seconded by Smith, that the Mayor contact a firm to do a study to review the insurance needs of the City and report back. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED 5.3 MOBILE HOME PERMIT — GORDON W. RUSSETT MOTION: LaValle made motion, seconded by Smithy-to grant renewal of a mobile home permit for Gordon W. Russett, 8086 165th Street for ninety days, subject to a letter being sent by the clerk informing him it is not to be used as a home. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED SUNSET LAKE REVIEW Due to complaints that Sunset Lake was being polluted, the City Engineer was requested to make a complete study of the lake. He found an overflow pipe from a septic aystem drain— ing into the lake. City ealth officer and Councilman Smith also inspected problem. Engineer recommends Council review the matter. Mel Strand, who purchased the property September 1 , 1975 from Don Tauer, said he was lead to believe that thn sewer system was very adequate and he believed him. The system has a 1 ,500 gallon septic tank and a 500 gallon lift station that pumps into a distribution box and then into the drain fields which consist of washed sand and washed aggregate covering 750 cubic feet of drainage area. After Strand's daughter moved in on September 1 ,1976, there was an odor detected and he later discovered there was an overflow pipe running into thelake. Because of the location of the pipe, he couldn't immediately MARCH 1 , 1976 23 determine if the pipe was coming from his own system or from a neighbors. After plvzgging the end of the pipe, he determined the overflow was part of his system. Upon complaint of Strand, several times Tauer repaired the faulty pump, but each time it was only a temporary measure. Strand contends that Mr. Tauer is still the fee owner of the property and it is his responsi- bility to rectify the situation. He is living on the property only under a purchase agreement and will not sign closing papers until Tauer corrects the situation, and at the present time he has litagation against Mr. Tauer. Smith asked Strand if he plans on doing anything to remedy the situation at this time. Strand said he could solve the overflow problem by plug- ging it, but then Tauer would still have to replace the pump. Dr. Olson, City Health officer stated that if the overflow was plugged, without repairing the system, it would result in a health hazard. Richard Miller, PCA, said they would assist the City in whatever way they can to solve this problem, as well as other problems on the lake too. PCA would like local government to handle these situations but will give whatever assistance is necessary, he said. Terry Skelton, Rice Creek Watershed, said they could probably have an injunction placed on them in ten days. Health office Dr. Olson instructed to take whatever steps necessary to have this problem eliminated. City Engineet said all the lakeshore residents of Sunset Lake are in violation in one way or another. MOTION: LaValle made motion, seconded by Smith, to have Dr. Olson contact the County Health Department for a possible injunction to close the Tauer or Melvin Strand home. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED MEETING RECESSED AT 9:30 P.M. - RECONVENED AT 9:05 P.M. MOTION: Lease made motion, seconded by Smith to amend Chapter 262 of the Hugo City Code, entitled, "Sewer System" to extend the time limit for connection to the sanitary sewer system from April 1 , 1976 to September 1 , 1976. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED BID FOR NEW POLICE SQUAD MOTION: Smith made motion seconded by Lease to accept the low bid for one Dodge Monaco, four door with trade of 1975 Plymouth to for $3,617.70, to McMillan Dodge of Forest Lake, Minnesota. V€TING FOR: Lease, LaValle, and Smith. MOTION CARRIED MOTION: Smith made motion, seconded by LaValle, to make a change from the 360 to 400 (cubic inch carburator 'with 4 barrell carburator) engine for a difference of $111 .00. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED MOTION: Lease, made motion, seconded by LaValle, to accept the monthly police department report. VOTING FOR: Lease, LaValle, and Smith. MOTION CARRIED 6.0 REPORTS OF OFFICERS AND COMMITTEES ORDINANCES Smith reported the committee is working on a driveway permit ordinance and should have it ready for first council meeting in April. BUILDING INSPECTOR 24 Building inspector's report submitted and approved by Council. ATTORNEY Presented check far $500.00 from McDermott additional payment to cover engineering and legal fees - Mr. Bayless has appealed to Supreme Court - will be 60 days or so before knowing any- thing further - Bob Ricci has signed storm sewer easement and will turn in soon. ENGINEER Engineer reported that Centerville Interceptor will not result in loss of capacity for Hugo. MOTION: LaValle, made motion, seconded by Lease, to accept Engineer's report regarding Sunset Lake. VOTING FOR: Lease, LaValle, and Smith.
