PRESENT: LaValle, Leroux, Smith and Schletty. 3.0 APPROVAL OF MINUTES MOTION: LaValle made motion, seconded by Lexoux to approve the minutes of the March 15, 1976 meeting. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to approve the minutes of the March 29, 1976 special meeting of Sunset Lake. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 4.0 APPROVAL OF CLAIMS In addition - LaValle excavating for $1 ,282.19 hauling from March 18, 1976 to April 5, 1976. To be paid from General Fund instead of road fund. MOTION: Leroux made motion, seconded by Smith, to approve the General Claims of April 5, 1976. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Smith made motion, Schlettty seconded, to approve the Utility Claims of April 5, 1976. VOTING FOR: LaValle, Leroux, Smith and Schletty. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS AND LICENSES 5.1 MOBILE HOME PERMIT RENEWAL - Joseph Zaspel MOTION: Leroux made motion, Smith seconded to renew mobile home permit for Joseph Zaspel, 17205 Forest Blvd. N. , Hugo, Minnesota, under Chapter 40, Article III, Subdivision D, for ninety days. VOTING FOR: LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOBILE HOME PERMIT RENEWAL - ROBERT MC CLOUD Fee paid but permit not received. Tabled until next meeting. 5.2 MINING PERMIT - RICHARD SCHUH City Engineer requested to investigate previous operation - has inquired from county what materials coming out of there - has no reply from county yet. Hiniker requested both bond and letter of credit be reduced - felt both excessive compared to what is required of other mining operations. City attorney stated that previously other oper- ations were required to have larger bonding and letters of credit. Permit inspection fee and bonding is reduced from year to year where operators have complied with conditions. Inspection fee discussed was $500.00 and is in line with the original inspection fee for Fisher and Barton on their original permits and when the history of. these permit holders was good and their renewals were due, in many cases they were left at residual fees. City tngineer said road is in bad shape at this time-will have to tighten up before any heavy hauling can be done in the area-at least mid-May before conditions will im- prove. Road will rave to be watched closely as it isn't built for heavy usage. If the road breaks up or needs maintenance, contractor will be required to make repairs. Hiniker said his client under- stands. Council agreed to amend Number 7 of the permit to read that it will be reviewed on August 2, 1976. APRIL 5, 1976 MOTION: Smith made motion, seconded by Schletty to issue a minim permit to Richard Schuh with the conditions as outlined previously and with the changes as indicated, to expire June 1 , 1977. VOTING FOR: LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 5.3 S. ASHBY - HUGO RESIDENTS NEAR FOXHILL Presented bills to City Council for residents' mufflers, car paint jobs towing, etc. , because of the muddy road conditions. LaValle told her she could present the bills to the clerk for payment but the Council will not pay them. The group will also file for property tax reduction because they haven't had paved road for past three years. Told her she could appear before Board of Review on May 20, 1976. 5,4 DOG CATCHER APPLICATION Dean Good of Stacy discussed dog catcher service for Hugo. Was told there are no funds at present for this type of service-Good said by licensing of dogs the funds could be raised-Council recommended discussing the matter at next budget meeting-Good said he would pick up dogs on an emergency basis for time being. Council asked him to send in written proposal of his services. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 ORDINANCE COMMITTEE 6.1 .1 DRIVEWAY ORDINANCE To be handled by the building inspector, or in some cases by City Engineer at descretion of building inspector. In cases where there is a problem or dangerous situation with an existing driveway a certain time would be allowed to cor- rect the situation. Nngineer said there are several driveways that need corrective work or they will present street pro- blems. Culverts must be installed if required by the City Engineer, at owners expense. City will not stockpile or furnish culverts. LaValle would like to see as many existing driveways brought up to standard as possible. Building In- spector will inspect the layout and if there is a problem, will refer to the city Engineer. Attorney said proposed ordinance, as written, doesn't prohibit driveway from being built without a permit. 6.2 PLANNING COMMISSION - SHEPHERD OF THE FIELDS CHURCH Has obtained verbal OK from Rice Creek-but no official letter-to be handled as minor subdivision-Peloquin to make application for a minor subdivision and appear at April 19th meeting for action on it. Peloquin said boundary stakes near substation are removed - Kuusisto will take care of matter. 6.3 WATER SUPERINTENDENT MOTION: LaValle made motion, Schletty seconded, to instruct the Water Superintendent to attend the Waterworks Seminar at the Thunderbird Motel on April 6-8th. City will re-imburse for the registration fee and mileage. VOTING FOR: LaValle, Leroux, Schletty, and Smith. MOTION CARRIED Mr. Burkard inquired about obtaining remote water meters. Instructed to prepare a recommendation for the cost of remote reading meters- will city absorb cost for all or part? 6.4 SEWER REPORT - No report 6.5 BUILDING INSPECTOR Re; : Joseph Gregoire-Trailer has been moved in on property but sewer system has not been updated according to requirements-septic tank plus absorption area is required, 432 MOTION: LaValle made motion, seconded by Leroux, to have clerk send letter to Joseph Gregoire, 7600 165th Street to inform him he has not met with the conditions of his mobile home permit and he has ten days to get the approval of the build- ing inspector for his on-site sewer system or get the trail- er out. VOTING FOR: LaValle, Leroux, Schletty, and Smith. MOTION CARRIED Re: Eugene Peltier-One extra sewage unit is required. Present system doesn't conform. Present drainfields are not spread out-needs more square footage, and extra tank. Kuusisto will send plans to building inspector and E. Peltier will be informed what to do to meet standards. 6.6 FIRE CHIEF Re: Fire wardens: Ordinance needs amending then burning permits will be made up-need fire warden in Withrow area-told old wardens could temporarily be sworn in to issue permits-new permits should be made out in triplicate-one copy each for fire warden, applicant and city clerk. $1 .00 fee for obtaining burning permit. Fee to be fire warden's salary. Fire department requested additional air tank. Would like to pur- chase air tank for fire hall. Now have three tanks-feel they need fourth as they aren't getting the pressure they need-also need radio on one of the trucks and don't have a radio in the jeep. Ordered a base station with money from sale of C:B's and money made at smoker. Also would like to sign a service contract with Motorola for all maintenance including base station for $300.00 per year. Also would eventually like to &et pagers for all people in the department - would like to get six lagers now at cost of $1890.00. LaValle said City doesn't have money at this time to buy pagers or radio. Olson told to bring in proposal for the Motorola service contract. MOTION: LaValle made motion, Leroux seconded, to set the rate for fighting railroad fires tit the rate of $250.00 per hour for the year 1976. VOTING FOR: LaValle, Leroux, Schletty, and Smith. MOTION CARRIED MOTION: Schletty made motion, seconded by Leroux, authorizing fire department to purchase one air tank. VOTING FOR: LaValle, Leroux, ,Schletty, and Smith. MOTION CARRIED 6.7 POLICE CHIEF MOTION: LaValle made motion, Smith seconded, to accept the Police Report for March, 1976. VOTING FOR: LaValle, Leroux, Schletty, and Smith. MOTION CARRIED 6.8 ATTORNEY Will meet with Horton and his attorney next week-nothing from Robert Ricci on the storm sewer easement-attorney to notify Mr. Ricci that if he desires to hook-up to the storm sewer, he can hook up to the stub in the street at his expense. Regarding Cinterville reserve capacity-received letter that it will not affect Hugo's reserve cap- acity. Rice Creek is checking into whole drainage plan at Evergreen Hills. MOTION: Smith made motion, seconded by Schletty, to direct City Attorney to seek legal action to stop White Bear Rod & Gun Club from using property until a new Special Use Permit and Occupancy permit is granted. Neil Peltier culvert should be put in and ditching done. Will meet with Hoffman Bros. on April 12th and geta time schedule for doing corrective work. Evergreen Hills called to Rice Creek's attention and they will look into matter. Bald Eagle Industrial Park-conditions must be met before other developments can be discussed. Horseshoe Lake- a formal hearing will be held after Rice Creek Watershed District checks with property owners so that a fair appraisal can be made. Strand-Sunset Lake-Rice Creek Watershed District observed some disturbing of the soil near the septic tank and it appears that one section of the pipe has been removed. City Engineer doesn't know if it is still contributing to the lake or not. LaValle recommended a road inspection in Hugo with Engineer on Monday, April 12th. 7.0 Clerk Annual Board of Review will be held Thursday, May 20th from 9:30- 3:00. Schletty, Smith, Leroux, and LaValle will attend. Clerk instruct- ed to post the notice in the newspaper. Clerk noted that City Hall phones are presently limited to 75 calls per month with an additional charge of 100 per call for additional calls. Monthly bills are higher than if were billed for unlimited service. MOTION: Leroux made motion, Smith seconded, to change telephone service from limited calls to unlimited service. VOTING FOR: LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to give the Lion's Club's building plans to the building inspector-building inspector to report back at noxt meeting. VOTING FOR: LaValle, Leroux, Schletty and Smith MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to extend meeting beyond 11 :00PM. VOTING FOR: LaValle, Leroux, Schletty and Smith. MOTION CARRIED MISCELLANEOUS City attorney instructed to contact Frank Murray of Rice Creek Water- shed District to make application for a permit to discharge water into Hardwood Creek from Horseshoe Lake. Building Inspector stated that Mel Strand and his daughter who re- sides in the basement apartment in the home still owned by Don Tauer, are both vacating the premises. Building Inspector requested City to notify Tauer that the home should be returned to a single family dwelling. City Clerk instructed to check city files regarding previous correspondence.
