PRESENT: Lease, Leroux, Schletty and Smith ABSENT: LaValle 3.0 APPROVAL OF MINUTES MOTION: Smith made motion, seconded by Schletty to delay the approval of the minutes of the April 5, 1976 meeting until the next council meeting. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Lease made motion, seconded by Smith to approve the minutes of the April 5, 1976 meeting with one exception, the approval of minutes. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED 4.0 xrr'xuvAL OF CLAIMS MOTION: Lease rade motion, seconded by Schletty to approve the Gen- eral Claims of April 19, 1976. VOTING FOR: Lease, Lerotz, Smith and Schletty. MOTION CARRIED MOTION: Smith made motion, seconded by Leroux, to approve the Utility Claims of April 19, 1976. VOTING FOR: Lease, Leroux, Smith and Schletty. MOTION CARRIED MOTION: Smith made motion, seconded by Schletty to disallow the six claims made by people in Hugo for damages done to their automobiles by bad roads in Hugo. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS AND LICENSES 5.1 LAnnvibw LIQUOR APPLICATION MOTION: Lease made motion, seconded by Smith to grant an off-sale non-intoxicating liquor, an on sale non-intoxicating liquor, a soft drink, a Games of Skill license and a cigarette license in the amount of $104.31 to Lakeview Inn. VOTING FOR: Lease, Leroux, Schletty, and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by Smith to grant a cigarette and soft drink license to LaRoche's cafe in the amount of $13.50. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED A & W ROOT BEER APPLICATIONS MOTION: Leroux made motion, seconded by Schletty, to grant a cig- arette and soft drink license to the A & W Root Beer in the amount of $13.00. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED MOBILE HOME PERMIT RENEWAL - ROBERT MC CLCUD MOTION: Leroux made motion, seconded by Lease, to renew a temporary mobile home permit for Robert McCloud, 9627 122nd Street North, under Hugo Code, Chapter 40, Article III, Subdivision D, for ninety days at a fee of $10.00. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED MOBILE HOME PERMIT RENEWAL - JAMES D. JOHNSON MOTION: Lease made motion, seconded by Smith to grant an extension for 90 days to James D. Johnson, 7194 132nd Street N. , APRIL 19, 1976 35 for a temporary mobile home permit, under Hugo Code, Chapter 40, Article III, Subdivision D, and at that time owner will have to show real proof of medical disability for further renewal. 5.0 PETITIONS. ETC. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 5.2 SENIOR CITIZEN ADVISORY COUNCIL Pat Gamble representing a delegation from the Senior Citizen Advisory Council of White Bear Lake spoke regarding their Senior Citizen's Handyman Chore Service - to provide list of skilled handymen who will work for senior citizens for $3 per hour with a maximum of ten hours for each job done. City of White Bear Lake has contributed $4,480.00 to the project, Birchwood - $185.00. They have total budget of $6,400.00 for first year. They are asking other communities to contribute if they can. White Bear Lake gave $5 per household. Hugo has 71 homes in White Bear School District - are asking Hugo for approximately $355.00 for their share of the total budget for the first year. Pro- gram will begin July 1 , 1976 - got their start thru a Ramsey County grant. Leroux mentioned that a similiar program is being considered by Washington County. (Clerk instructed to consider this program in quarterly report) Council will consider after quarterly is submitted to Council by Clerk. 5.4 JEROME HINTZ - R. WALLER -REGARDING WATER DRAINAGE Complained of excessive water in vicinity of Hyde Avenue. Brought to Council's attention a year ago, they said, and Engineer made recom- mendations to the developer and this year there is the same situation. Additional home building is being done which aggrevates situation. Engineer said developer has been told to clear trees and debris from ponding areas and told he had to build a dyke. Complained that debris in ponding areas are fire hazards and breeding grounds for rats. Engineer said representative from Rice Creek Watershed District will investigate area. Matter tabled until next Council meeting. 6.0 ORDINANCES AND RESOLUTIONS 6.1 1976 -43 ESTABLISHING BOUNTY ON POCKET GOPHERS MOTION: Lease made motion, seconded by Smith to adopt Resolution 1976-43, A RESOLUTION ESTABLISHING A BOUNTY ON POCKET GOPHERS CAPTURED IN THE CITY OF HUGO, MINNESOTA, AND AUTHORIZING THE APPOINTMENT OF A BOUNTY PAYMASTER FOR RECEIVING CLAIMS AND PAYING BOUNTIES ON POCKET GOPHERS, AND ESTABLISHING COMPENSATION FOR THE BOUNTY PAYMASTER. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 1976-44 ESTABLISHING A FEE FOR IDENTIFICATION ON TAGS-DOGS MOTION: Lease, made motion, Smith seconded, to adopt Resolution 1976-44 A RESOLUTION ESTABLISHING A FEE FOR THE IDENTIFICATION TAGS FOR IDENTIFYING DOGS AS TO OWNERSHIP; A FEE SET AT ONE DOLLAR ($1 .00) PER TAG. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 1976-45 ESTABLISHING FEE FOR SPECIAL ASSESSMENT SEARCHES MOTION: Leroux made motion, seconded by Smith to adopt Resolution No. 1976-45. A RESOLUTION ESTABLISHING A FEE FOR SPECIAL ASSESSMENT SEARCHES; A FEE SET AT FIVE DOLLARS ($5.00) PER SEARCH. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED 1976-46 - ESTABLISHING FEE FOR JUNK YARD LICENSE Tabled until May 3rd, 1976 Council meeting. Attorney instructed to prepare ordinance amendment for that meeting. 4PRIL 19, 1976 o r ) BURNING PERMITS Lease announced that the Pollution Control Agency has notified the City Clerk that no outside burning is allowed in Hugo. Under certain conditions, clearing of land, etc. , a special burning permit may be obtained directly from the Pollution Control Agency. Attorney to study matter - to be reviewed at May 17, 1976 meeting. 7.0 UNFINISHED BUSINESS 7.1 SHEPHERD OF FIELDS - MINOR SUBDIVISION-148th STREET EXTENSION AND WATER LINE ixTJ SION - PETITION RECEIVED MOTION: Lease made motion, seconded by Smith to approve the minor subdivision applied for by Vern Peloquin for the West of the NW4 of the NE4f Section 20, T31 , R21W, subject to receipt of the survey, with final approval being tied to the condi- tions of the Special Use Permit. VOTING FOR: Lease, Leroux, Schletty and Smith MOTION CARRIED Mr. Eldon Morrison, architect from White Bear Lake, presented proposed building plans for Shepherd of Fields Lutheran Church. Stated building to be built on east side of property with parking on the west. Build- ing to be 98 X 60 with a total of 6,000 square feet. There will be seating for 238 people in the sanctuary. Heating will be provided by a three furnace forced air system. There will be two entrances and two extra exits. Lease said city does not have sufficient money to build portion of road now owned by City but not constructed, but would be willing to pay cost of extending water through that section of road with money in the water fund. Engineer stated road would be 36 feet wide, would require 8 inches of Class 5 and three inches of bituminous surfacing. Regarding road construction required of him, Peloquin asked if City objected to him putting in a storm sewer from culvert going north- Engineer said agreeable but would like to have outlet. Peloquin asked if letter of credit instead of bonding was acceptable. Council agreed. Petition received from church for extension of the water line to the church. Engineer stated minimum extension allowed would be to the east side of the church property. Peloquin objected to having to loop the water. Engineer said eventually they would have to find some way of looping. Attorney stated that if either the road or water extension involved assessments to anyone but the developing parties, it would become subject to a public hearing. Church pastor spoke - feels the city should pay for the portion of the street (1401 ) that the city owns. Matter tabled until May 3rd Council meeting. RECESS - 9:50 - RECONVENE - 10:10 P.M. 8.0 NEW BUSINESS MOTION: Lease made motion, seconded by Smith to approve Job Order 31268 of the Northwestern Bell Telephone Company to place buried cable in 156th Street North, Henna Avenue North and 170th Street. Part of this construction is on County R.O.W. and C.S.A.H.4 along the north side easterly to Ingersoll Avenue North, also along Henna and C.S.A.H. 4, SE corner of intersection, also on east sida of Henna from 165th Street North, north to about 200 feet. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by Smith to approve Job Order 31274 of the Northwestern Bell Telephone Company to place buried cable in the East side of Ingersoll Avenue North APRIL 19, 1976 from 500' south of 157th Street to the north side of 157' h� Street. The Construction is along the east side of Ingersoll about 6' west of east P.L. northerly to north side of 157th Street. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by Smith, to approve Job Order 31263, of the Northwestern Bell Telephone Company to place buried cable on Homestead Avenue North, south of 137th Street, north to 137th Street, along the east side varying from 10' to 14' west of the east right of way. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by Smith, to refer Job Orders 31295, 31268, 31330,and 31341 of the Northwestern Bell Tele- phone Company to either Washington County or to the state of Minnesota as all lines are within either county or state right of way. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED DON TAUER Residents are concerned that the home on Ingersoll Avenue owned by Don Tauer will be rented as two rental units. Council advised that only one rental unit would be allowed. ROBERT RICCI - EASEMENT FOR STORM SEWER Attorney advised easement not properly notarized and agreement is not filled in the amount agreed on. It is unrecordable. Clerk notified to return to him advising him it is not acceptable because it is not notarized. AG LIME FOR BALL DIAMONDS MOTION: Lease made motion, seconded by Schletty to allot $300 for AG lime for use on the ball diamonds at the Hugo City Park and at the Withrow School alloting $200 for the City Park and $100 at Withrow. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED TRAEGER'S ADDITION Attorney advised contacting Ed Waugh to ascertain when plat will be recorded. Clerk instructed to notify Mr. Waugh it must be recorded no later than June 1 , 1976. E BRBREEN #2 AND #3 Clerk instructed to make certain City has copy of Vail's bond for Evergreen #2 and #3. RAY PELTIER - WATER PROBLEM City has received complaint from Ray Peltier that they have an un- natural source of seepage into their basement. Engineer advises that it should be determined if there is a main leak before the road is paved. In the meantime, the fire department ahould be cautioned ag- ainst washing the fire trucks in the front of thefire hall. JOSEPH GR GOIRE Inspection by the building inspector determined septic system installed does not come up to code-has been notified wants extension of time- been busy planting and hasn't had time to install aa.new system Clerk np instructed to notify Gregoire to appear at next council meeting and )0 to be in compliance or action will be taken at that time to terminate their permit. WHITE BEAR ROD & GUN CLUB MOTION: Smith made motion, seconded bj Schletty to send the White Bear Rod and Gun Club a letter indicating that they do not have a Special Use Permit and give them until May 12th to reapply for a Special Use Permit and appear before the Planning Commission on May 12th regarding Condition #2. VOTING FOR: Lease, Schletty and Smith VOTING AGAINST: Leroux MOTION CARRIED MOTION: Lease made motion, seconded by Smith to extend meeting past 11 :00 P.M. VOTING FOR: Lease, Leroux, Schletty and Smith. MOTION CARRIED CONDITIONS OF ROAD Because of the seriousness of the road problems this spring, a special meeting will be held on May 11 , 1976 at 7:00 P.M. for discussion of such.
