HomeMy WebLinkAbout1998.10.05 ORD 1998-32714 CITY OF HUGO WASHINGTON COUNTY, MINNESOTA ORDINANCE NO. 1998- 327 AN ORDINANCE ESTABLISHING A STORM SEWER IMPROVEMENT TAX DISTRICT WITHIN THE MEANING OF MINNESOTA STATUTE §444.16 ET. SEQ. The City Council for the City of Hugo, Washington County, Minnesota, hereby ordains as follows: Section 1. Purpose. This Ordinance is adopted to establish a storm sewer improvement tax district within the meaning of Minnesota Statute §444.16 et. sec. The district is established in order to create a framework to maintain the storm sewer drainage system within the plat of Creek View Preserve. The City Council has determined that it is in the best interests of the City to set up a method to insure that the drainage areas and outlots are properly maintained for the benefit of the residents of the plat, and that the costs of maintenance are fairly and equitably apportioned among those properties contributing water to those drainage areas. Section 2. Authority. The City has adopted this Ordinance pursuant to the provisions of Minnesota Statute §444.16 et. sec.. Section 3. Description of Land. Pursuant to Minnesota Statute §444.17, the territory or area included within the storm sewer improvement district is described with particularity on the attached Exhibit A, said land is hereinafter referred to herein as the "Subwatershed." Section 4. Name of District. The storm sewer improvement district created herein shall hereinafter be referred to as "Hugo Storm Sewer Improvement Tax District No. 2." Section 5. Filings. The City Clerk of the City of Hugo is hereby directed to file a certified copy of this Ordinance with the County Auditor and a separate certified copy with the County Recorder pursuant to the statutory mandate found in Minnesota Statute §444.17. Section 6. Effective Date. This Ordinance shall be in full force and effect from and after its passage of publication according to law. Whereupon said Ordinance was declared passed and adopted by the City Council of the City of Hugo, Washington County, Minnesota this 5th day of October , 19 98 .
