HomeMy WebLinkAbout1996.11.04 ORD 1996-312 CITY OF HUGO WASHINGTON COUNTY, MINNESOTA ORDINANCE NO. 1996-312 AN ORDINANCE AMENDING THE CITY ZONING ORDINANCES TO ESTABLISH A ZONING DISTRICT TO BE KNOWN AS "LONG TERM AGRICULTURE . " THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, DOES HEREBY ORDAIN AS FOLLOWS : A. The City Zoning Ordinance is hereby AMENDED as follows : 1 . Section 320-4 , Subd. A. Section 320-4 , Subd. A is hereby amended by adding an additional zoning district . The additional zoning district shall read as follows : Symbol Name LTA Long Term Agriculture 2 . Guidelines for Accessory Buildings in Various Zones . The chart known as "Guidelines for Accessory Buildings in Various Zones" found at page 26 of the City Zoning Ordinance is hereby amended to add the category of Long Term Agriculture to the same column as the requirements for a "Conservancy" Zoning District . 3 . Section 320-4 , Subd. 0, Lot Requirements . Section 320-4, Subd. 0 is amended by including requirements for "lot area per dwelling unit" for a LTA Zone . The amended Ordinance shall including the following: LTA (1) Lot Area Per Dwelling Unit (sq. ft . ) One-Family Residence 40 acres Two-Family Residence Multiple-Family Residence with 3 families or over One-Bedroom Unit Two-Bedroom Unit Three-Bedroom Unit Efficiency Unit More than three-bedroom unit* 1 4 . Section 320-4 , Subd. O. The City Zoning Ordinance is hereby amended by adding an additional subdivision to be known as Section 320-4 , Subd. Q, entitled "Regulations for the Long Term Agriculture District (LTA) , " said regulations to read as follows : Subd. Q. Regulations for the Long Term Agriculture District (LTA) . Within the Long Term Agriculture District, unless otherwise provided in this Ordinance, no building or land shall be used and no building shall hereafter be erected or structurally altered except for one or more of the following uses : (1) Permitted Principal Uses . Agriculture uses, single-family dwelling unit, sod farming and tree farming. (2) Permitted Accessory Uses . One road side stand offering for sale only those products grown on the premises, provided that such stand does not exceed an area of five hundred (500) square feet , is located in conformance with the yard regulations, and provisions are made for adequate off-street parking and access; off-street parking space for all necessary and operable farm equipment and machinery; riding stables; horse trail rides; commercial animal training; swimming pools; and dog kennels . Private garage not exceeding 1, 000 square feet ; farm building (s) and accessory storage not exceeding 3 , 600 square feet for parcels of land up to twenty (20) acres, and unlimited for parcels of twenty (20) acres or more, provided in all cases and approved farm/accessory building site plan meeting the requirements of Section 320-5, Subd. I , is first submitted and approved. (3) Intent and Primary Use . The intent of the Long Term Agriculture District is to preserve commercial agriculture as a viable permanent land use and a significant economic activity within the community, and to encourage the use and improvement of agricultural lands for the production of food and other agricultural products . LTA Districts envision land which could be enrolled under the Agricultural Preservation Act (Minnesota Statute Chapter 473H) . 2 5 . Effective Date . This Ordinance shall be in full force and effect from and after its passage and publication according to law.
