AN ORDINANCE ADOPTING THE MINNESOTA STATE BUILDING CODE AS REVISED
AND PROVIDING FOR ITS APPLICATION, ADMINISTRATION, AND ENFORCEMENT;
AND PROVIDING FOR THE REPEAL OF ALL INCONSISTENT ORDINANCES .
The City Council of the City of Hugo does hereby ordain as
follows :
City Code Sections 40-1, 40-2 and 40-3 are hereby repealed in
their entirety and replaced with the following:
40-1 . 0 State Building Code Adopted. The Minnesota State
Building Code, established pursuant to Minnesota Statutes 16B. 59
through 16B . 75 and published in Minnesota Rules Chapters 1300
through 1370 and incorporating the Minnesota Plumbing Code and the
Minnesota Energy Code, Chapters 4715 and 7670 respectively of
Minnesota Rules, is hereby adopted as the building code for the
City of Hugo, and is incorporated into this Ordinance as if set out
in full subject to the following specifications :
40-1 . 2 Mandatory Enforcement Provisions . The following
chapters of Minnesota Rules shall be enforced and administered
without change by the City as mandatory provisions of the Minnesota
State Building Code :
A. Chapter 1300 - Minnesota State Building Code
B. Chapter 1301 - Building Official Certification
C. Chapter 1302 - Construction Approvals
D. Chapter 1305 - Amendments to the Uniform Building Code
(UBC) (Adoptions of the 1994 Uniform
Building Code) . The adoption of this
chapter specifically includes UBC
Appendix Chapters : 3 , Division I
"Detention and Correctional Facilities" ;
12 , Division II "Sound Transmission
Control" ; and 29 "Minimum Plumbing
Fixtures" . The adoption of optional UBC
Appendix chapters under Section 1305 . 0020
shall be as indicated in Section 40-1 . 3
of this Ordinance .
E . Chapter 1307 - Elevators and Related Devices
F. Chapter 1315 - Electrical Code (Adoption of 1993
National Electrical Code (NEC) )
G. Chapter 1325 - Solar Energy Systems
H. Chapter 1330 - Fallout Shelters
I . Chapter 1335 - Floodproofing; Except Sections 1335 . 0600
through 1335 . 1200 . Construction
standards for flood plains are found in
Hugo City Code Chapter 3211 .
J. Chapter 1340 - Facilities for the Handicapped

40-1 . 3 Optional Enforcement Provisions Adopted.
The following Appendix Chapters of the 1994 Uniform Building
Code, representing optional provisions of the Minnesota State
Building Code as provided in Chapter 1305 . 0020 of the Minnesota
Rules, are adopted by the City without change, except to the extent
that the City may adopt revised fee schedules and bonding
requirements under UBC Appendix Chapter 33 , as a part of the State
Building Code for the City:
A. UBC Appendix Chapter 3 , Division II - Agricultural
Buildings
B . UBC Appendix Chapter 3 , Division IV - Requirements
for Group R, Division 4 Occupancies
C. UBC Appendix Chapter 4 , Division I - Barriers for
Swimming Pools, Spas and Hot Tubs
D. UBC Appendix Chapter 15 - Reroofing
E . UBC Appendix Chapter 19 - Protections of
Residential Concrete Exposed to Freezing and
Thawing
F. UBC Appendix Chapter 31 - Division II - Membrane
Structures

40-1 .4 Application, Administration, and Enforcement . The
application, administration, and enforcement of the Minnesota State
Building Code in the City shall be in accordance with Minnesota
Statutes Chapter 16B and Minnesota Rules Chapters 1300 and 1305 .
The City Council, pursuant to Minnesota Statutes 16B . 65, shall
appoint a Building Official who shall attend to all aspects of
Building Code administration. Additional members of a City
Building Department shall be authorized by the City Council as
needed. Organization of the City' s Building Department shall be as
established by Chapter 1 of the 1994 Uniform Building Code, as
amended by Minnesota Rules . The Minnesota State Building Code
shall be enforced within the incorporated limits of the City.
40-2 Certificate of Occupancy. The City hereby adopts
Chapter 1305 . 0109, Section 109, "Certificate of Occupancy, " of the
Minnesota State Building Code requiring Certificates of Occupancy
for Group R, Division III occupancies; Group U occupancies; and
manufactured homes .
40-3 Permits, Inspections and Fees . Permits shall be issued,
inspections conducted, and fees collected according to the
following:
1 . Fees .
A. Fees and charges shall be due and payable upon
initial application for permit, and shall be
collected from the applicant for said permit .
B . The valuation for permit purposes shall be
determined by the Administrative Authority, and
shall calculated by multiplying the square foot
area of the proposed structure times the factor
prescribed by the State of Minnesota, Building Code
Division, as is in effect at the time of
application.
C. Where work for which a permit is required is
started or proceeded with prior to obtaining said
permit, the permit fee shall be double, but the
payment of such double fee shall not relieve any
persons from fully complying with existing codes or
ordinances in the execution of the work nor from
any other applicable penalties .
D. The fees and charges listed herein are exclusive of
fees and charges required by the State of minnesota
pertaining to electrical permits and inspections .
E . At the discretion of the Administrative Authority,
an additional charge, no to exceed actual expenses
incurred, may be required in such instances where
repeated violations of the building codes and
ordinances make necessary an excessive number of
reinspections in order to insure compliance with
the provisions of said codes and ordinances . Such
charges shall be payable by the permittee prior to
the issuance of Certificate of Occupancy.
F. All building permit and related fees shall be
established by Council resolution.
2 . Surcharge .
In addition to the permit fee required under Section 3
above, the applicant for a Building Permit shall pay a
surcharge to be remitted to the Minnesota Department of
Administration as prescribed by Minnesota Statutes
16B . 70 .
This Ordinance shall be in full force and effect from and
after its passage and publication according to law.
WHEREUPON, said Ordinance was declared passed and adopted this
21st day of August, 1995 .
