ORDINANCE 89-256
AN ORDINANCE REGULATING THE LOCATION, DESIGN,
INSTALLATION, USE AND MAINTENANCE, REQUIRING
PERMITS AND INSPECTION OF INDIVIDUAL SEWAGE
TREATMENT SYSTEMS WITHIN THE CITY OF HUGO.
The City Council of the City of Hugo, Washington County, Minnesota,
ordains as follows:
1 . ADOPTION - The attached document , entitled "CHAPTER 263 - INDIVIDUAL
SEWAGE TREATMENT SYSTEMS" is adopted by this reference, and shall '

govern all applications for individual sewage treatment systems filed
with the City after it' s effective date.
2. REPEAL - Existing Chapter 262 Article II , Sections 25-38 of the Hugo
City Code, entitled "ON-SITE SEWER SYSTEMS" is hereby repealed ,
PROVIDED, HOWEVER, all applications for individual sewage treatment
systems pending prior to the effective date shall be governed by the
provisions thereof until the later of : a) rejection of the
application ; b) granting of the application ; c ) completion by
applicant of all obligations undertaken pursuant thereto; and d ) final
disposition of any litigation pertaining to any such application or
contractural relationship established thereunder.
. EFFECTIVE' DATE This Ordinance shall be effective upon adoption by
the City and publication as required by law.
4. CITY CODE' - At it ' s effective date, this Ordinance shall be
incorporated in the Hugo City Code.

NOTICE OF INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE
he Hugo City Council adopted and passed Ordinance 1989-256 entitled "AN
ORDINANCE REGULATING THE LOCATION, DESIGN, INSTALLATION, USE AND
MAINTENANCE, REQUIRING PERMITS AND INSPECTION OF INDIVIDUAL SEWAGE
TREATMENT SYSTEMS WITHIN THE CITY OF HUGO" on March 6, 1989, a complete
copy of which is on file and available for inspection by the public during
regular office hours in the office of the City Clerk , Hugo City Hall , 5524
Upper 146th Street, Hugo, MN. In compliance with M.S.A. 412.919, Subd . 4,
the Hugo City Council has directed the following Summary of said Ordinance
be published :
. SUMMARY
Consistent with the City' s Comprehensive Plan , Hugo has established a
policy of controlling the use of Individual Sewage Treatment Systems
(septic systems) because the uncontrolled use of said systems adversely
affects the public health, safety , and general welfare by contributing to
water pollution and impairing land values as noted in the Intent and
Purpose of the Ordinance. Said Ordinance repeals former Chapter 262,
Article II for On-site Sewer Systems. Ordinance provides for expanded
definitions, and general provision which include include, but are not
limited to, the following : applicability , general requirements, site
evaluation , and construction and materials. The Ordinance also provides
for alternative systems, permitted alternative systems, operation and
oaintenance, general administration , certification , licensing and permits;
?nforcement f the Ordinance, and the effects and said Ordinance. The
Jrdinance uprades current City standards, and allows for enforcement of
by the City Of Hugo or Washington County as per designation of the Hugo
City CouncilOrdinance prohibits certain installations, requires soil
borings and percolation tests, specifies construction materials, specifies
sewage and septic tanks, restricts sewage tank location , provides for
maintenance requirements, prescribes setback distances, addresses
replacement of existing systems, and modification to standard systems;
permits certain mound systems, prohibits certain holding tanks, addresses
floodplain systems, requires inspections and fees, as well licensing of '
installers; provides for Board of Adjustrent and Appe�� s, and enforcement
of Ordinance. /

CHAPTER 262 . INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE
AN ORDINANCE REGULATING THE LOCATION, DESIGN, INSTALLATION, USE AND
MAINTENANCE OF INDIVIDUAL SEWAGE TREATMENT SYSTEMS WITHIN THE CITY OF
HUGO.
PURSUANT TO THE AUTHORITY GRANTED IN MINNESOTA STATUTES, SECTIONS
145.915 AND 394.21 ET SEQ. , THE CITY COUNCIL OF THE CITY OF HUGO,
MINNEOSTA, DOES ORDAIN:
SECTION 1 . TITLE
101 . Short Title. This Ordinance shall 'be -known , cited and
referred to as the Individual Sewage Treatment System Ordinance,
except as referred to herein, where it shall be known as, "this
Ordinance" .
SECTION 2. INTENT AND PURPOSE
201 . This Ordinance is adopted for the purpose of :
( 1 ) Protecting the health, safety, and welfare of the
residents of the community, present and future.
(2) Regulating the location , design , installation , use and
maintenance of individual sewage treatment systems so
as to prevent contamination of the surface and ground
waters within the city.
(3) Protecting the individual water supply wells of the
community from contamination by inadequate, improperly
designed, located , installed or maintained individual
sewage treatment systems.
(4) Providing for the orderly development of the rural
areas of the community which are not served nor planned
to be served by central public waste treatment
facilities so as to preclude the installation of
" central public systems.

SECTION 3. DEFINITIONS
301 . Rules.
301 .01 . In the event of conflicting provisions in the text of
this Ordinance, and/or other ordinances, the more restrictive
provisions shall apply. The Zoning Administrator shall determine
which is more "restrictive" and appeals from .such .determination shall
be made in the manner provided herein .
301 .02. Words used in the present tense shall include the past
and future tense; the singular includes the plural and the plural
includes the singular. The word "shall " is mandatory, and the word
"may" is permissive.
301 .03. Unless otherwise specified all distances shall be
measured horizontally.
302. Definitions.
302.01 . For the purpose of this Ordinance, certain terms, words
and phrases are hereby defi-ri-ed as follows:
( 1 ) Agent. Washington County Planning Department and Code
Enforcement .
(2) Aeration . The bringing about of intimate contact
between air and a liquid by spraying the liquid irk he
air, bubbling air through the liquid or agitating
liquid surface in air.
(3) Aeration tank . A tank or container into which liquid
or sewage is subjected to aeration .
(4) Alternative System. An Individual Sewage Treatment
System, other than the Standard -System -defi-ned herein .
( 5) Applicant. Authorized person , firm or corporation
making application for required permit(s) for a Sewage.
Treatment System, and shall include the owner(s) and
such other parties as may be specifically authorized
for specific requirements.
(6) Baffle. A device permanently attached or integral to
the Sewage Tank to provide proper operation of the
Sewage Tank and maximum retention of solids.
(7) Bedrock . That layer of parent materials which by its
composition and structure, as compared to soil , is
inadequate to provide adequate filtration and treatment.

(8) Bedroom' Any room within a dwelling unit which, by
virtue of its design and location , might reasonably be
used as a sleeping room.
(9) Building Drain . That part of the lowest piping of the
drainage system-whi-cti receives the Sewage discharge
inside the walls of the building and conveys it to the
Building Sewer which begins at least one foot outside
the building line.
( 10) Building Sewer. That part of the drainage system which
extends from the Building Drain and conveys its •
discharge to an Individual Sewage Treatment System.
(11 ) Capacity. The internal liquid volume of a Sewage Tank
below the outlet level .
( 12) Cesspool . An underground pit into which raw household
Sewage or other untreated liquid waste is discharged
and from which the liquid is allowed to seep into the
surrounding soil . See 402.04 .
( 13) City. The City of Hugo, Minnesota
( 14) City Council . The Governing Body of the City duly
elected and serving pursuant to Minnesota Statutes'
(15) Distribution Pipe. Perforated pipe or spaced
agricultural drain tile which is used to distribute
Sewage Tank Effluent in a Soil Treatment System.
(16) DNR. The- Minnesota Department of Natural Resources'
(17) Dosinq Chamber. A separate tank or chamber which
receives effluent from the Sewage Tank and serves as a
reservoir for the Dosing Device.
( 18) Dosinq Device. A pump, siphon , or other device which
mechanically discharges Sewage Tank Effluent from the
Dosing Chamber to the Soil Treatment System.
( 19) Dwelling Unit. A residential building , or portion
thereof, intended for occupancy by an individual or a
family, but not including hotels, motels, boarding
rooms or rooming houses, tourist homes, or trailers
located in a mobile home park .
(20) Filter Material . Clean rock , crushed igneous rock or
similar durable and decay-resistent material free from
dust, sand , silt or clay which is insoluble in Sewage
Tank Effluent. The size shall range from three-fourths
inch and two and one—half inches.
(21 ) Flood Plain . The area adjoining a river, stream,
channel , lake, or low area which is subject to periodic ,-`
flooding , as presently defined or as may be defined by
a cognizant governmental body or agency, and subject to !
regulations of Chapter 320, Article II-Flood Plain
Management of the City Code, as it may be amended from
time to time.
(22)Governing Body. See City Council .
(23) Grey Water. Liquid waste from a dwelling or other
establishment produced by bathing , laundry, culinary
operations and from floor drains, and specifically
excluding Toilet Waste.
(24) Holding Tank . A Watertight Sewage Tank for the
temporary storage of Sewage until it is transported to
an approved point for treatment and disposal .
(25) Individual Sewage Treatment System. A Sewage Treatment
System or part thereof , serving a dwelling or Other
Establishment, or group thereof , consisting of one or
more Septic Tanks and a Soil Treatment System.
(26) Lot. A Parcel of land , either platted or unplatted ,
upon which a principal building , including a Dwelling
Unit, is or may be placed , and separated from other
Parcels by a separate legal description .
(27) MHD. The Minnesota Department of Health.
(28) Mottling . A zone of chemical oxidation and reduction
activity within the soil , appearing as patches of red ,
brown, orange or gray or combinations thereof .
(29) Mound System. An Alternative Sewage Treatment System
designed with the soil treatment area built above
existing grade to overcome the limitations of water
table, Bedrock, or -soil -permeability.
(30) MPCA. The Minnesota Pollution Control Agency.
(31 ) Natural Soil . Soil which exists undisturbed in its
natural state. Fill shall be considered as natural
soil after it has been in place for a minimum of twelve
( 12) months.
(32) Ordinary High Water Mark . A mark delineating the
highest water level which has been maintained for a
sufficient period of time to leave evidence upon the
landscape. In the case of controlled outlet waters,
the outflow elevation of the control structure.
(33) Other Establishment. Any public or private structure
other than a dwelling , which generates Sewage. ` ~
(34 ) Owner. The person (s) , firm( s) , and or corporation (s) ,
or other legal entities having fee title to a Lot, or
the contract purchaser of a Lot acting with consent of
the fee title holder'

(35) Parcel . See Lot .
(36) Percolation . The movement or flow of water or liquid
through the interstices or-the pores of a soil or other
porous medium.
(• 7 ) Percolation Rate. The calculated time rate of drop of
a water level in a test hole as specified in Section
(38) Permitting Authority. The City or its duly designated
Agent.
(39) Plastic Limit. A soil moisture content, below which
the soil may be manipulated for the purpose of
installing a Soil Treatment System.
(40) Sand . A soil texture composed by weight of at least
eight-five (85) percent of soil particles ranging in
size between 0.05 and 2.0 mm.
(41 ) Seepage Pit ( leaching pit or drywell ) . A lined
-un-derground pit into which- Sewage Tank Effluent or
other liquid waste is discharged and from which seepage
into the soil occurs through the bottom and sidewall
openings.
(42) Septaqe. Those accumulated solids and liquids removed
from a Sewage Tank or holding Tank during regular
periods of maintenance.
(43) Sewage. Any water carried domestic waste, exclusive of
footing and roof drainage, from any dwelling ,
industrial , agricultural , commercial establishment , or
other structure. Domestic waste includes but is not
limited to liquid waste produced by bathing , laundry,
and culinary operations, and liquid waste from toi lets
and floor drains, and specifically excludes animal
waste and commercial process waste.
(44) Sewage Flow Rate. Flow rates as determined by actual
metered water use or as estimated on the basis of use
and
er�occupancy.
(45) See Tank . A Watertight tank used for the retention
of Sewage, Including , but is not limited to Septic
Tanks, Holding Tanks, and pumping chambers.
(46) Sewage Tank Effluent. That liquid which flows from a
Septic Tank under normal operation .
(47) Septic Tank . A sound , durable, Watertight Sewage Tank
designed and constructed to receive the discharge of
Sewage from a Building Sewer, separate solids from
liquid , digest organic matter and store liquids through
a period of detention .

(48) Shoreland . The perimeter of any lake in whole or in •
. `
part within the City, subject to setback , usage, and/or
other use regulations of any cognizant governmental
body or agency.
(49) Site. The area bounded by the dimensions required for
the proper location of the Soil Treatment System.
( 50) Site, Previsoulv Developed . A lot or parcel upon which
a dwelling or other establishment is in existence as of
the enactment of this Ordinance.
( 51 ) Slope. The ratio of vertical rise or fall to
horizontal distance.
( 52) Soil Characteristics, Limiting . Those soil
characteristics which preclude the installation of a
Standard System, including but not limited to proximity
to bedrock or watertable, and percolation rates which
are excessively fast or excessively slow.
f53) T-he alteration ofnatural soil
conditions by means including but not limited to
placement of fill , removal of soil or alteration of
topography.
( 54) Soil Survey. The U.S. Department of Agriculture, Soil
Conservation Service, Soil Survey of Washington County,
• 1977.
( 55) Soil Textural Classification. Where soil particle
sizes or textures are specified in this Ordinance, they
refer to the soil textural classification found in the
Soil Survey Manual , Handbook No. 18, U.S. Department of
Agriculture, 1951 .
( 56)- Soil Treatment Area. - Thatarea of trench -or bed bottom
which is in direct contact with the filter material of
the Soil Treatment System.
( 57) Soil Treatment System. A system whereby Sewage Tank
Effluent is treated and disposed of below the ground
surface by filtration and percolation through the soil .
( 58) Standard System. An individual Sewage Treatment System
employing a Building Sewer, Sewage Tank and the Soil
Treatment System commonly known as a drainfield or
leachfield '
( 59) Surface Discharge. The discharge of any sewage onto
the surface of any land, or the escape of any sewage •
discharged into an Individual Sewage Treatment System •
onto the surface of any land .

(60) Surface Water Flooding . The one hundred ( 100 ) year
Floodplain along rivers and streams as defined by the
Federal Emergency Management Agency, or in the absence
of such data, as determined by the largest flood of
record . On lakes, highwater levels as determined or
recorded by the DNR and/or the Federal Emergency
Management Agency.
(61 ) Ten Year Flood . That flood which can be expected to
occur, on an average, of once in ten ( 10) years; or the
level to which flood waters have a ten ( 10) percent
chance of rising in any given year.
( 58) Toilet Waste. Fecal matter, urine, toilet paper and
any water used for flushing .
(59) Valve Box . Any device which can stop Sewage Tank
Effluent from flowing to a portion of the Soil
Treatment System.
(60) Water TabLe. The- hig-hestele*ation of the soil where
all voids are filled with water, as evidenced by soil
Mottling , the presence of water, or other information .
(61 ) Watertiqht. Constructed and maintained to prevent
inflow of water or outflow of effluent.
(62) Zoning Administrator. The City of Hugo Zoning
Administrator, deputy zoning administrator or his
designated agent.
(63) Zoning Map. The official map adopted by the City which
delineates the zoning district and Flood Plain
boundaries, as it may be amended by the City Council
from tixr��
to-time.

SECTION 4. GENERAL PROVISIONS
401 . Applicability .
401 .01 . Administration by state agencies.
( 1 ) Individual Sewage Treatment Systems which serve a
single facility generating greater than fifteen
thousand ( 15,000) gallons per day shall make
application for and obtain a state disposal system
permit from the MPCA.
(2) Collector systems which serve fifteen ( 15) dwellings or
five thousand ( 5,000) gallons per day, whichever is
less, shall make application for and obtain a state
disposal system permit from the MPCA.
(3) Individual Sewage Treatment Systems serving facilities
licensed or otherwise regulated by the State of
Minnesota shall -ma4*s ,appli-cation for and obtain permits
and/or approvals from the appropriate state agency.
(4) Any individual Sewage Treatment System requiring
approval by the State of Minnesota shall also comply '- -

with this Ordinance and all other applicable local
codes and ordinances.
401 .02. Administration under this Ordinance. All Individual
Sewage Treatment Systems installed subsequent to the adoption of this
Ordinance and all alterations, extensions, modifications or repairs
to existing systems irrespective of the date of original installation
shall be regulated in accordance with all requirements of this
Ordinance. Existing systems which show evidence of Sewage Tank
Effluent discharge to the ground surface, ground or surface waters or
other evidence of failure to-adequately treat the Sewage Tank
Effluent shall be replaced , reconstructed or repaired within ninety
(90) days of notice and order to comply by the Zoning AdministraThe.
402. General Requirements.
402.01 . Surface Discharge. Unless specifically permitted by the
MPCA, Sewage, Sewage Tank Effluent, or seepage from a Soil Treatment
System shall not be discharged to the ground surface, abandoned
wells, bodies of surface water, or into any rock or soil formation
the structure of which is not conducive to purification by filtration
or into any well or other excavation in the ground .

402.0 2. Treatment Required . The Sewage Treatment System, or
systems, shall be designed , installed and maintained , to receive all
Sewage from the dwelling , building , or Other Establishment served .
Footing or roof drainage shall not enter any part of the system.
402.03. System Components. The Sewage Treatment System shall
consist of a Building Sewer, Sewage Tank and Soil Treatment System.
All Sewage shall be treated in a Sewage Tank or Toilet Waste
treatment device, and the Sewage Tank Effluent shall be discharged to
the Soil Treatment System.
402.04. Prohibited Installations. Cesspools shall not be
installed .
40 .05. Location . Sewage Treatment Systems and each component
thereof shall be located and installed to insure that, with proper
maintenance, it will function in a sanitary manner, will not create a
nuisance nor contaminate any domestic water supply well . Location
shall consider Lot size and configuration , proposed structures and
other improvements, topography, surface drainage, soil conditions,
depth to groundwater, geology, -existing and proposed water supply
wells, accessibility for maintenance, and expansion or replacement of
the system. Installation of Systems in low swampy areas, drainage
swales or area subject to recurrent flooding is prohibited . Systems
shall not be located within utility or drainage easements nor with
dedicated public or private rights-of-way.
402.06. Clear Water Waste. Uncontaminated clear water waste
from geothermal heat pump installations shall not be introduced into
individual sewage treatment systems. Such waste may be discharged to
the ground surface or to a body of water, however in no case shall
surface discharge be permitted where such discharge encroaches on an
adjoining property or public way. Where subsurface disposal is
provided , such installation shall be separated from the required
sewage treatment site and shall be designed and sized as prescribed
for a standard soil treatment system.
403. Site Evaluation.
403.01 . Prior to the issuance of a building permit, a permit to

install an Individual Sewage Treatment System must be obtained and a
field investigation may be conducted by the Zoning Administrator of
all proposed sites_. for Sewage Treatment Systems, at which time they
shall be evaluated as to:
( 1 ) Depth to the highest known or calculated ground water
table, zone of periodic saturation , or Bedrock .
2) Soil conditions, properties and permeability.
(= ) Slope.
(4 ) The existence of low lands, surface drainage swales,
local surface depressions and rock outcrops.

( 5) All legal setback requirements from: existing and
proposed buildings; property lines; Sewage Tanks; Soil
Treatment Systems; water supply wells, buried water and
utility lines; the Ordinary High Water Mark of lakes,
rivers, streams, flowages, or other bodies of surface
water; and the location of all existing Sewage
Treatment Systems and water supply wells on adjoining
Lots within one hundred ( 100) feet of the proposed Soil
Treatment System.
(6) Surface water flooding probability.
403.02' Soil Testing. Applicants for Sewage Treatment System
permits will be required to submit soil test data derived from soil
borings and Percolation Tests for each proposed site or installation .
403.03. Conduct of Tests. All testing shall be conducted in
accordance with the requirements of this Ordinance and shall be done
by qualified personnel , certified under the MPCA training and
certification program.
Exception : Testing may be done by any individual on a lot
proposed for his personal residenee -or-presently occupied by
him. Any such testing which results in data which is
inconsistent with actual soil conditions may be rejected by
the Zoning Administrator and professional testing required .
403.04. Soil Borings. At a minimum, four (4) satisfactory soil
borings per site shall be made, outlining the perimeter of a minimum
area of five thousand (5,000) square feet per lot for a permit
application . Larger areas may be required where conditions of use,
soils, topography or vegetation require. Soil borings shall be made
as follows:
( 1 ) Borings shall be by auger or excavation and shall be
staked and protected until notification that field
evaluation has been completed .
(2) Borings or excavations shall be made to a minimum depth
of eight (8) feet below existing or proposed grade, or
until bedrock or watertable is encountered , whichever
is less.
(3) A soil texture description shall be recorded by depth
and notations made where texture changes occur.
(4) Particular effort shall be made to determine the
highest known water table or zone of periodic
saturation by observation and recording the first
occurrence of mottling in the soil , or if mottling is
not encountered , the open holes in clay or loam soils
shall be observed after standing undisturbed a minimum
of sixteen ( 16) hours, at which time, depth to standing
water, if present, shall be measured .

( 5) If one ( 1 ) or more borings encounters unsuitable or
limiting conditions, additiohal borings shall be made
in order to outline an adequate area of suitable soil
conditions. If the minimum site area cannot be
identified by suitable borings, work should be
suspended and the data submitted to the Zoning
Administrator.
403.05. Percolation Tests. For all sites, after soil borings
have outlined the minimum area of suitable soils, Percolation Tests
shall be made as follows:
( 1 ) Test hole locations and dimensions:
a. Within the outlined area, a minimum of two (2)
percolation tests, evenly spaced shall be made.
Where soil conditions vary within the tested area,
one ( 1 ) additional percolation test shall be made
in each soil type.
b. Each test hole shall be six (6) to eight (8)
inches in diameter, have vertical sides, and be
bored or-dug- to the depth 'of the bottom of the
proposed drainfield trench.
c . Hole diameter and soil texture descriptions shall
be recorded noting depths where texture changes
occur.
(2) Preparation of the test hole:
a. The bottom and sides of the hole shall be
carefully scratched to remove any smearing and to
provide a natural soil surface.
b. All loose material shall be removed from the
bottom of the test hole and two (2) inches of
cuoe=quar±er .(1/4) -to three-quarters (3/4) inch
gravel shall be placed in the hole to protect the
bottom from scouring .
(3) Soil saturation and swelling :
a. The hole shall be carefully filled with clear
water to a minimum depth of twelve ( 12) inches
above the hole bottom and maintained at this depth
for not less than four (4) hours. (Failure to
adequately saturate the test hole may result in
rejection of the test. )
b. The soil shall then be allowed to swell for at
least sixteen ( 16 ) but not more than thirty (30)
hours. In soils classified as sand , the
saturation and swelling procedure shall not be
required and the test may proceed if one ( 1 )
filling of the hole has seeped away in less than
ten ( 10) minutes,

(4) Percolation Rate measurement :
a. In sandy soils adjust the water depth to eight (8)
inches above the soil at the bottom of the test | |
hole. From a fixed reference point , the drop in
water level shall be measured in inches to the
nearest one-eigth ( 1/8) inch at ten ( 10) minute
intervals. If eight (8) inches of water seeps
away in less than ten ( 10) minutes, a shorter time
interval may be used . But in no case shall the
depth of water exceed eight (8) inches. The test
shall continue until three (3) consecutive
measurements vary by no more than ten ( 10)
percent.
b. In other than sandy soils, adjust the water depth
to eight (8) inches over the soil at the bottom of
the test hole. From a fixed reference point, the
drop in water level shall be measured in inches to
the nearest one-eight ( 1/8) inch at thirty (30)
minute intervals, refilling after each measurement
to maintain an eight (8) inch starting head . The
test shall -c-ontinue until three (3) consecutive
measurements vary by no more than ten ( 10)
percent. The rate may also be measured by
observing the time it takes the water level to
drop one ( 1 ) inch from an eight (8) inch reference „
point, provided a constant water depth of at least
eight (8) inches has been maintained for at least
four (4) hours immediately prior to the
measurement.
( 5) Calculation of Percolation Rates:
a. Divide the time interval by the drop in water
level to obtain the percolation rate in minutes
per inch.
b. Percolation rates shall be determined for each
test hole and recorded on worksheets showing all
measurements and calculations'
(6) Percolation tests shall not be run where frost exists
at and below the test hole bottom.
404 . Construction and Materials. '
404.01 . Building Sewers. The design , construction , and location
of and the materials permitted for use in building sewers shall be as
regulated by the Minnesota State Building Code as it may be amended '

404.02. Sewage Tanks. All tanks, regardless of material or
method of construction shall be:
! ( 1 ) Watertight.
(2) So designed and constructed as to withstand all lateral
earth pressures under saturated soil conditions with
the tank empty.
(3) So designed and constructed as to withstand a minimum
of seven (7) feet of saturated earth cover above the
tank top.
(4) Not subject to excessive corrosion or decay.
( 5) Any tank installed where the water table is closer than
three (3) inches to the bottom of the excavation at the
time of installation shall be required to have an
integrally cast bottom.
404.03. Septic Tanks. All tanks, regardless of material or
method of construction , shall be designed to conform to the following
criteria:
( 1 ) The liquid depth of any Septic Tank or compartment
thereof shall not be less than thirty (30) inches. A
liquid depth greater than six and one-half (6 1/2) feet
shall not be considered in determining tank capacity.
(2) No tank or compartments thereof shall have an inside
horizontal dimension less than twenty-four (24) inches.
(3) The inlet and outlet of each tank shall be submerged by
means of a baffle device.
(4) The space in the tank between the design liquid level
and the top of the inlet and outlet baffles shall not
izeless than twenty (20) percent of the total design
liquid capacity, except that in horizontal cylindrical
tanks this space shall be not less than fifteen ( 15)
percent of the total design liquid capacity.
( 5) Baffle Devices. Shall be constructed of acid resistant
concrete, acid resistant fiberglass or plastic and
shall be integrally cast with the tank , affixed with a
permanent waterproof adhesive or affixed with stainless
steel connectors, top and bottom. Where a sanitary tee
is used as a baffle device, it shall be joined to the
inlet or outlet pipe with a permanent waterproof
adhesive.
(6) The inlet baffle shall extend below the design liquid
level a minimum of six (6) inches but not more than
twenty (20) percent of the total design liquid depth,
and a minimum of one ( 1 ) inch above the crown of the
inlet sewer.

(; ) The outlet baffle and baffles between compartments 414
shall extend below the design liquid level a distance
equal to forty (40) percent of the design liquid depth,
except in horizontal cyl. .i.ndrical tanks where this •
dimension shall be thirty-five (35) percent of the
design liquid depth. Baffles shall extend above the
design liquid level as required in 404.03(4) , however
in no case shall they extend less than six (6) inches
above the design liquid level .
(8) There shall be a minimum of one ( 1 ) inch between the
underside of the top of the tank and the highest point
of the inlet and outlet baffles.
(9) The inlet invert shall be not less than three' (3)
inches above the outlet invert.
( 10) Sanitary tees used as baffles shall be a minimum of
four (4) inches in diameter. Inlet baffles shall be
not less than six (6) inches or more than twelve ( 12)
inches measured from the end of the inlet pipe to the
nearest edge of the baffle. Outlet baffles shall be
six (6) inches, measured from the end of the outlet
pipe to the nearest edge of the baffle.
( 11 ) Access to the Septic Tank shall be as follows:
There shall be one or more manholes, at least
twenty (20) inches least dimension located within •
six (6) feet of all walls of the tank . The
manhole shall extend through the cover to a point
within twelve (12) inches below finished grade.
The manhole cover shall be covered by at least six
(6) inches of earth.
b. There shall be an inspection pipe of at least four-.
(4) inches diameter or a manhole over both the
inlet and outlet baffle device. The inspection
pipe shall extend through the cover and be capped
flush with or above finished grade. ty downward
prosection of the center line of the inspection
pipe shall be directly in line with the center
line of the inlet and outlet baffle device.
( 1.2) Compartmentation of Septic Tanks, Septic Tanks larger
than three thousand (3,000) gallons and fabricated as a
single unit shall be divided into two (2) or more
compartments as follows:
a. When divided into two (2) compartments, not less
than one-half nor more than two-thirds (2/3) of
the total volume shall be in the first
compartment , at the inlet side of the tank .

b' When divided into three (3) or more compartments,
one-half ( 1/2) of the total volume shall be in the
first compartment and the other half equally
divided in the other compartments.c . Connections between compartments shall be baffled
as specified for inlet and outlet baffle devices.
d . Adequate venting shall be provided between
compartments by baffles or by an opening of at
least fifty ( 50) square inches at the top of the
compartment wall .
e' Adequate access to each compartment shall be
provided by one or more manholes as specified in
404.03, ( 11 ) (a) .
( 13) Multiple Tanks. Where more than one ( 1 ) tank is used
to obtain the required liquid volume, they shall be
installed as follows:
a. Multiple tanks shall be connected in series.
b. Each tank shall comply with all provisions of this
section .
c . No more than four (4 ) tanks in series can be used
to achieve the required liquid volume.
d . The first tank shall be no smaller in volume than
any subsequent tanks in series.
404.04. Tank Capacity. The required volume or liquid capacity
of a septic tank shall be determined on the basis of estimated sewage
flows as follows:
( 1 ) Dwellings. The Septic Tank capacity shall be
determined-1ry thenumber ^of bedrooms contemplated or
provided in the dwelling unit served and shall be at
least as large as the capacities given below:

For ten ( 10) or more Bedrooms, the Septic Tank shall be
sized as an Other Establishment. For multiple family
dwellings containing two (2) or more dwelling units,
the size shall be the sum of the individual dwelling
unit requirements.

(2) Other Establishments ' The liquid capacity of a Septic
Tank serving an establishment or use other than a
dwelling shall be sufficient to provide a Sewage
detention period of not less than thirty-six (36 ) hours
in the tank for Sewage flows less than fifteen hundred
( 1 , 500) gallons per day, but in no instance shall the
liquid capacity be less than one thousand ( 1 ,000)
gallons. For Sewage flows of fifteen hundred ( 1 , 500)
gallons per day or more, the minimum liquid capacity
shall equal one thousand one hundred twenty-five
( 1 , 125) gallons plus seventy-five (75) percent of the
daily Sewage flow.
404.05. Sewage Tank Location . The location of each Sewage Tank
shall be according to the following :
( 1 ) The Sewage Tank shall be placed so as to be accessible
for maintenance pumping for removal of liquids and
accumulated solids.
(2) The Sewage Tank shall be installed on undisturbed or
compacted soils capable of bearing the weight of the
tank , its contents -and 'covering earth.
(3) Sewage Tanks shall be set back as specified in Table
IV.
(4) Sewage Tanks shall not be placed in areas subject to
flooding or in Floodplains delineated by the Floodplain � ~
Ordinance as it may be amended from time to time.
Exception: Where Ten ( 10) Year Flood information is
available, Sewage Tanks may be installed within the ten
( 10) year floodplain floodway zone "A" in accordance
with all provisions of Section 502.06.
404.06. Maintenance. Each Septic Tank installed under this
Ordinance as well as all existing .Septic Tanks, shall be maintained
in proper operating condition at all times.
( 1 ) The owner of each septic tank shall be responsible for
maintenance of the tank and may be required to report
its condition to the city.
(2) Accumulated septage shall be removed from each tank
prior to the time when the sludge layer reaches a point
twelve ( 12) inches below the bottom of the outlet
baffle or when the bottom of the scum layer reaches a
point three (3) inches above the bottom of outlet
baffle.
(3) Pumping for removal of Septage from Septic Tanks shall
be performed only by persons certified and licensed by
the City or it ' s agent. See Section S.

(4 ) Disposal of Septage shall be only at approved disposal
sites or facilities' Dumping or spreading of Septage
on the surface of the ground is prohibited except where
surface disposal sites have been specifically approved
and permitted .
( 5) The Zoning Administrator shall maintain appropriate
records of Septage pumping and disposal activities and
shall require such reporting by licensees as is
reasonable and necessary to insure that adequate
maintenance and disposal is being accomplished .
(6) In any instance where it is determined that maintenance
practices or procedures are inadequate or improper, the
Zoning Administrator shall require the owner to comply
with the provisions of this Ordinance within thirty
(30) days of notice served upon the owner.
404.07' Aerobic Tanks. Aerobic tanks shall comply with the
requirements set forth for Sewage Tanks in this Ordinance, and with
the following :
( 1 ) The Tank , including each-individual unit or compartment
shall be readily accessible for inspection and
maintenance and shall be provided with secured covers.
(2) The Raw Sewage Flow from the Building Sewer shall be
intercepted by a trash trap prior to its entering the
aeration compartment. The trash trap shall have a net
holding capacity of not less than twenty (20) percent
of the average daily Sewage flow. The invert level of
the inlet to the trap shall be above the liquid level
and shall discharge directly into the trap. The outlet
from the trap to the aeration compartment shall have a
deep baffle or shall be equipped with a tee or long
ell .
(3) The trash trap shall be_readily �_ccessible for
inspection and effective cleaning and shall be so
constructed as to prevent unauthorized access.
(4) The aeration compartment shall have a minimum holding
capacity of five hundred ( 500) gallons or one hundred
twenty ( 120) gallons per bedroom, whichever is greater.
( 5) The method of aeration shall be mechanical , diffused
air, or both. The method used shall maintain aerobic
conditions at all times.
(6 ) The settling compartment shall have a minimum net
holding capacity equal to twenty (20) percent of the
: volume of the aeration compartment. The design shall
: provide for effective settling and continuous return of
� settled sludge to the aeration compartment '

( 7 ) A minimum one ( 1 ) year warranty and an initial. two ( 2 )
year service c._ontrac_t which specifies regular
inspection calls and effluent quality checks shall he
provided as a part of the purchase agreement. Copies
of the warranty and service contract shal 1. be filed
with the permit application submitted to the Zoning
Administrator.
(8) All other features of Aerobic Tanks not specifically
mentioned in this Ordinance shall comply with National
Sanitation Foundation Standard No. 40 (November 1970) .
404.08. Distribution and Dosing of Effluent. The distribution
and dosing of Sewage effluent to the Soil Treatment System shall be
as follows:
(1 ) Gravity Distribution.
a. Level or Slightly Sloping Ground . Sewage Tank
effluent may be distributed by a distribution box
provided that the final ground surface elevation
of the lowest trench in the system is at least one
( 1) foot -above -the -out-]-et inverts ..of the
distribution box . Distribution boxes shall be
constructed and installed according to the
following:
( 1 ) The box shall be watertight, with a removable
cover and shall be constructed of durable
materials not subject to excessive= corrosion
or decay.
(2) The inverts of all outlets shall be at the
exact same elevation as measured from a liquid
surface in the bottom of the box .
3) The inlet invert shall be a minimum of one ( 1 )
_ iri.ch ._ab.ov.e the .outlet i_nv.ert✓
(4) The outlet inverts shall be a minimum of four
(4) inches above the distribution box floor.
( 5) Each distribution pipe shall be connected
separately to the distribution box and shall
not be subdivided .
(6) When Sewage Tank Effluent is delivered to the
distribution box by pump, a baffle, wall , or
device shall be installed in the distribution
box , or the pump discharge shall be directed
against a wall or side of the box on which
there is no outlet. The baffle shall be
adequately secured and shall extend at least
one ( .1. ) .inc=h above the crown of the inlet.

b. Sloping Ground . Where the elevation difference of
the ground surface exceeds twenty-eight (28)
| | inches in any direction within the Soil Treatment
System and a distribution box cannot be used as
,
specified in 404 '08, 1 . A ' , a drop box shall be
installed at the inlet end of each distribution
line as follows:
( 1 ) Connections .between drop boxes shall be by
watertight piping .
(2) The drop box shall be watertight and
constructed of durable materials not subject
to excessive corrosion or decay.
(3) The invert of the inlet pipe shall be a
minimum of one ( 1 ) inch above the invert of
the outlet pipe leading to the next trench.
(4) The invert of the outlet pipe leading to the
next trench shall be a minimum of two (2)
inches above the invert of the outlet pipe to
'the trench served -by 'the box .
( 5) When the sewage effluent is delivered to the
box by a pump, the discharge shall be directed
� - against a wall or side of the box on which
there is no outlet.

(2) Pressure Distribution. Where required, pressure
distribution of Sewage effluent shall be as follows:
a. Pressure distribution laterals shall be sized as
shown in Table I .
b. Laterals shall be spaced no further than twenty
(20) inches from a trench or a bed wall .
c . Laterals shall be spaced no further than forty
(40) inches apart.
d . Laterals shall be connected to a manifold or
header pipe of two (2) inch diameter or as
required by design of pipe from pump and inlet
position .
e. Laterals and manifold shall be installed so as to
drain completely after every dosing .

(3) Dosing . Where installed , a Dosing Device shall comply
with the following requir-ements:
a. The Dosing Chamber shall be watertight and
constructed of sound and durable materials not
subject to excessive corrosion or decay.
b. The Dosing Chamber shall have one or more
manholes, twenty ( 0) inches in least dimension ,
located directly above the Dosing Device. The
manhole shall extend through the chamber cover to
finished grade and shall be provided with a cover
secured to prevent unauthorized access.
c . The size of the effluent dose shall be determined
by the Soil Treatment System design but in no case
shall the chamber _be sized to provide a dose of
less than seventy-five (75) gallons.
d .. Dosing Devices for gravity distribution :
( 1 ) A pump or siphon shall be utilized to deliver
the dose to the Soil Treatment unit for
gravity distribution over the soil treatment
area.
(2) For dwellings, the Dosing Device shall
discharge a minimum of six hundred (600)
gallons per hour but not more than
twenty-seven hundred (2,700) gal ions per hour.
(3) For other establishments, the Dosing Device
shall discharge at a rate at least ten ( 10)
percent greater than the water supply flow
rate but no faster than the rate at which
effluent will flow out of the distribution
box .

(4 ) When the Dosing Device is a siphon , a regular
maintenance inspection shall be made at a
minimum of six (6) month intervals by the
owner or his agent. The siphon shall be
maintained in operating condition at all
times.
( 5) When the Dosing Device is a pump, it shall be
cast iron or bronze fitted with stainless
steel screws or constructed of other sound ,
durable and corrosion-resistant materials as
approved by the Zoning Administrator.
(6) Where the soil treatment area is at a higher
elevation than the pump, sufficient dynamic
head shall be provided for both the elevation
difference and friction loss.
(7) Where the Dosing Device is a pump, an alarm
device shall be installed to provide warning
of pump failure.
(8) Electrical service ±o_pumps and control shall
be completed in compliance with the Minnesota
State Electrical Code or as amended . Separate
electrical permits and inspections are
required from the Minnesota Board of
Electricity.
e. Dosing Devices for pressure distribution :
( 1 ) The dosing device shall be a pump which is
cast iron or bronze fitted and with stainless
steel screws or constructed of sound , durable
and corrosion-resistant materials.
(2) The pump discharge capacity shall be a minimum
of seven and one741alf (7 1/2) gallons per
minute for each one hundred ( 100) square feet
of soil treatment area.
(3) The pump discharge head shall be at least five
( 5) feet greater than the head required to
overcome pipe friction losses and the
elevation difference between the pump and the
distribution device.
(4) The quantity of effluent delivered for each
pump cycle shall be no greater than
twenty-five (25) percent of one ( 1 ) day' s
sewage flow.
( 5) An alarm device shall be installed to provide
warning of pump failure.

(6 ) Electrical service to pumps and control shall
be completed in compliance with the Minnesota
State Electrical Code. Separate electrical
permits and inspections are required from the
Minnesota Board of Electricity.
4.04.09. Final treatment and disposal of all Sewage Tank e:ffl.u.ent
shall be by means of a standard soil treatment and disposal system.
( 1 ) System sizing :
a. The required soil treatment area shall be
determined by the daily Sewage flow, either
measured or estimated , and the Percolation Rate of
the soil within the soil treatment area.
b. Sewage flows for Dwellings shall be calculated as
shown in Table II . Number of Bedrooms shall be
determined by an examination of building plans and
shall include all rooms having a reasonable
potential for use as a Bedroom. In the case of
existing development, the number of Bedrooms shall
be -determined by -an inspection of the premises.
Minimum daily Sewage flow capacity for any
Dwelling unit shall provide for two (2) Bedrooms.
For multiple residential units, the daily Sewage
f low shall consist of the sum of the flows of the
individual. units,

shall extend a minimum of two (2) inches above the
distribution pipe.
2. System location:
a. On slopes in excess of twelve ( 1 2) percent, the
soil profile shall be carefully evaluated in the
location of the proposed soil treatment area and
downslope to identify the presence of layers with
different permeabilities that would cause si.dehi_l. l.
seepage. In no case shall a trench be located
within f ft.es'n.. .(15) ._foot .f . wfe.r.e __=.u!ch a layer
surfaces on the down slope.
b. Soil Treatment Systems shall _ = located as
specified in Table IV.
c . Soil treatments

(3) Design and construction :

.corrosion, or decay or to loss of strength
under continuously wet conditions.
(2) Perforated distribution pipe shall have one
( 1 ) or more rows of holes of not less than
one-half ( 1/2) inch diameter spaced not more
than thirty-six (36) inches apart. Holes
shall be cleanly bored and spaced so as to
prevent failure due to loads . Distribution
pipe shall have a minimum load bearing
capacity of not less than one thousand ( 1 ,000)
pounds per lineal foot after perforation .
j ' Pressure distribution .
( 1 ) Distribution pipes used in soil treatment
systems for pressure distribution shall be a
minimum of one ( 1 ) inch in diameter and of

sound and durable material not subject to
corrosion or decay or to loss of strength
under continuously wet conditions.
(2) Perforations shall be cleanly bored , sized and
spaced as shown in Table 1 .
Distribution pipes shall be laid level or on a

seeding cannot be accomplished prior to
September 1 , the soil treatment area shall be
protected by a uniform cover of hay or straw.
(4) Dual fields.
a' Dual field systems may be installed in soils
having percolation rates slower than five ( 5)
minutes per inch.
b. Dual field systems shall be sized , designed and
constructed as set forth in this Ordinance for
standard systems except as follows:
( 1 ) The soil treatment area shall be divided into
two (2) or more equal parts.
(2) Alternating soil treatment areas shall each be
connected to a valve box outlet.
c ' Any portion of a divided system shall be used for
no more than one ( 1 ) year unless inspection of
effluent levels indicates that a longer duration
is acceptable.

(6 ) Where trench bottoms terminate entirely in natural
! �� ' soils, fill to achieve required cover may be placed at
the time of system installation .
(7) Where trench bottoms are required to terminate in fill ,
such fill shall be placed without compaction and
allowed to settle for a period of at least twelve ( 12)
months. After settlement, soil shall be tested and
data submitted for approval .
(8) Where fill is placed to achieve adequate separation
from the water table, a minimum of three (3)
observation wells shall be placed within the filled
area as follows:
a. Install one ( 1 ) inch to four (4) inch diameter,
solid pipe, to a minimum depth of six (6) feet
below final grade and three (3) feet below design
depth of system, capped above ground surface.
b. Bore hole for pipe a minimum of four (4 ) inches
larger than the diameter of the pipe.
c . Set pipe on two (2) inches of pea gravel , with six
(6) inches of gravel extending up around outside
! of pipe bottom.

tester as follows:
( 1 ) First observation to be made within two (2)
weeks after frost is absent and every seven

(2) If water is observed after the frost is
absent, or at any other time, an observation
shall be made one ( 1 ) week later' If water is
present at both observations, monitoring can .
cease since the site is unacceptable.

(3) If water is not present at the second
observation , monitoring shall continue until
June 1st. If any two successive observations
show the presence of water above the critical
depth, the site is unacceptable.
r (4) The occurrence of rainfall (s) of one-half
, ( 1/2) inch intensity or more during the
_. monitoring period may necessitate observations
at more frequent intervals.

SECTION 5. ALTERNATIVE SYSTEMS
� .
501 . Applicability.
501 .01 . Replacement of existing systems. Except as provided by
Section 501 .02 and 501 .03, on previously developed sites where system
replacement is required by virtue of existing System failure and
where site and soil conditions do not permit installatin of a
Standard System, an alternative system as provided by this section
may be considered subject to the following conditions:
(1 ) The engineering design and substantiation of
perfomnance of proposed system shall be submitted for
approval '
(2) There shall be no discharge allowed to the ground
surface or surface waters.
(3) Method of treatment and disposal of wastes shall
provide protection to the public health and general '
welfare equal to that provided by a -Standard System.
(4) Proposed alternative systems shall be required to
comply with all state rules and standards.
(5) City reserves the right to require financial security
to assume adequate performance of system.
501 .02. Modified standard system. On any site, where soil
conditions may reasonably be altered by placing fill to provide
suitable conditions as required for a Standard System, a modified
Standard System may ,be considered subject to the following
conditions:
( 1 ) Soil and site conditions shall be evaluated and system
sized and located as prescribed by this Ordinance for a
standard system.
(2) Modified soil areas shall be adequate in size to
accommodate a minimum of two (2) complete systems. On
specific sites, area requirements may be increased when
appropriate under the long range sewer plan for the
location .
(3) Proposed fill projects shall require engineered design
to be submitted for review and approval by the
permitting authority prior to the start of work , and
the issuance of a grading permit as required by the
Zoning Ordinance. -
(4 ) Fill material shall be selected and placed under � |
competent supervision '
( 5) Existing soils shall be protected from compaction and
properly prepared by scarifying or plowing , prior to
placement of fill .

( 5) A site which is saturated at or above the critical
depth of seven (7) consecutive days or more in a normal
/ spring season ( preceded by six (6) months of
precipitation which is at a minimum normal for the
area) is an unacceptable site.
501 .03 ' Experimental systems. Systems utilizing innovative
techniques or methods may be considered for new development under the
following conditions:
( 1 ) System being proposed is substantiated by engineering
data.
(2) System is in compliance with Minnesota Pollution
Control Agency rules.
(3) An adequate area of suitable soils as required for
standard systems is identified and reserved on the
site.
(4) Performance monitoring of the system, including but not
limited towater /usemeteriog` effluent quality and
system maintenance are provided .
( 5) Failure of experimental system to function or to
properly treat Sewage will require discontinuation of
„
use and replacement with an acceptable alternative.
502. Permitted alternative systems.
502.01 . Sewage treatment beds. Where existing developed sites
are limited in area so as to preclude installation of a Standard
trench System, a sewage treatment bed may be considered subject to
the following conditions:
( 1 ) Soil and site conditions shall be evaluated and system
sized and located as prescribed by this Ordinance for a
Standard System.
(2) Bed construction shall be limited to areas having an
natural slope of six (6) percent or less.
(3) Excavation for beds shall be by back hoe or other' means
that allows equipment wheels or tracks to remain on
surface soil ' Excavation equipment or other vehicles
shall not be driven on the soil treatment area'
(4 ) Gravity distribution pipes in beds shall be uniformly
spaced no more than five ( 5) feet apart and not more
,
than thirty (30) inches from the sidewalls of the bed .
( 5) Distribution of Sewage effluent may be by gravity or
pressure distribution . Installation shall be as
specified in 404.09(3) '

502.02' Sewage treatment mounds' On sites having soil
conditions which do not permit installation of a Standard System, a
sewage treatment mound may be considered . Proposed mounds shall
require engineered design (conforming to the following conditions) to
be submitted for review and approval prior to any permit issuance or
construction .
( 1 ) General conditions.
a. The soil Percolation Rate in all layers of the
natural or fill soil to a depth 'of at least
twenty-four (24) inches below the sand shall be
faster than one hundred twenty ( 120) minutes per
inch.
b. Below the sand layer there shall be at least one
( 1 ) layer of soil , at least twelve ( 12) inches in
depth, which has a Percolation Rate slower than
five ( 5) minutes per inch.
c . Mounds shall be located on flat areas or crests of
slopes. Mounds shall not be installed on natural
slopes exceediog three (3) .percao± where the
Percolation Rate is slower than sixty (60) minutes
per inch in the twenty-four (24) inches below the
sand layer.
d . Mounds shall not be located on slopes exceeding �
six (6) percent where the Percolation Rate is ^ -
slower than thirty (30) minutes per inch in the
twenty-four (24 ) inches below the sand layer .
(2) Soil surface preparation .
a. The discharge pipe from the pump to the mound area
shall be installed prior to soil surface
preparation . The trench shall be carefully
backfilled and compacted to prevent effluent
seepage.
b' The total area selected for the mound , including
the dikes, shall be plowed to a minimum depth of
eight (8) inches or the sod layer broken and
roughened by back hoe teeth. Furrows shall be
thrown up slope and no dead furrow shall be
permitted under the mound . The soil shall be
plowed or broken only when soil moisture to a
depth of eight (8) inches is below the plastic
limit.
c . Where soils in the top eight (8) inches of the -`
natural surface have percolation rates faster than
fifteen ( 15) minutes per inch, disking may be used
for surface preparation '

'- ! d . A rubber tired tractor may be used for plowing or
. disking but in no case shall such equipment be used
after the soil preparation is completed in soils having
a Percolation Rate slower than fifteen ( 15) minutes per
inch. A crawler or track type tractor shall be used
for these conditions.
e. Mounds shall not be located on slopes exceeding twelve
( 12) percent under any conditions.
f . Mounds shall be installed only in areas where existing
soil conditions provide a minimum twenty-four (24 ) inch
depth to Water Table or Bedrock .
g. The bottom area of the filter material shall be sized
on the basis of 0.83 square feet per gallon of waste
per day.
h. In no case shall the width of the filter material in a
single bed exceed ten (10) feet.
i . Mound locations shall be subject to setback
requirements listed in Table IV. Distances shall be
measured from the toe of the slope.
Installation of mound systems shall , in all cases,
require installation of water use metering at the
dwelling or facility being served .
k . Mound construction shall proceed immediately after
completion of soil surface preparation.
(3) Mound construction .
a. A minimum of twelve ( 12) inches of Sand (302.01-25)
shall be placed over the prepared surface to the limits
of the proposed filter material . A crawler type
tractor and blade shall be used to move sand into
place, maintaining a minimum of six (6) inches of sand
beneath the equipment to minimize compaction of the
soil surface. The sand layer shall be level when
placement is completed .
b ' Filter material to a minimum depth of nine (9) inches
shall be placed over the sand layer, below the
distribution pipe.
c . Distribution of effluent over the filter material shall
be either by four (4) inch distribution pipe with
gravity flow from a distribution box or by perforated
pipe under pressure from a manifold '

( 1 ) Gravity distribution '
(a ) Four (4 ) inch distribution pipes shall be
rigid plastic with one-half ( 1/2) inch
minimum diameter holes spaced no further than
thirty-six (36 ) inches apart. Pipe shall be
placed with one ( 1 ) row of holes at the
bottom of the pipe.
( b) Distribution pipe shall slope downward , two
(2) inches per one hundred ( 100) feet away
from the distribution box , spaced no further
than five ( 5) feet apart and no further than
thirty (30) inches from the edge of the
filter material .
(c ) The outer ends of the distribution pipe shall
be connected '
(d ) Distribution pipes shall be connected to the
outlets of a distribution box .
(e) The quantity of effluentdelivered to the
distribution system per pump dose shall be at
least twenty-five (25) percent of the daily
sewage flow.
( f ) Gravity distribution shall be permitted only
where soils existing at the mound location
have Percolation Rates of sixty (60) minutes
per inch or faster.
(2) Pressure distribution .
( a) Perforations shall be as required by
Table I . Holes shall be cleanly drilled ,
straight into pipe, and not angled .
( b) Perforated pipe laterals shall be connected
to a two (2) inch diameter manifold pipe,
with ends capped . Laterals shall be spaced
no more than forty (40) inches on center and
no further than twenty (20) inches from the
edge of the filter material .
(c ) The perforated pipe laterals shall be
installed level with perforations downward .
(d ) Manifold pipe shall be connected to the
supply pipe from the pump. Manifold shall be
sloped downward toward the supply pipe.
,
d . A minimum of two (2) inches of filter material shall be �
placed over the top of the laterals or distribution
pipes.

e. Straw or hay, to an uncompacted depth of three ( 3) to
four (4) inches, or other approved permeable material
shall be placed over the entire filter material area
.
f ' Construction vehicles shall not be allowed on the
filter material until backfill is placed .
g . Sandy loam soil shall be placed over the covered filter
material to a minimum depth of twelve ( 12) inches at
the center of the mound and six (6) inches at the
edges.
h. A maximum of two (2) ten ( 10) foot wide beds may be
installed side bY side in a single mound if the soil
Percolation Rate is between five ( 5) and sixty (60)
minutes per inch to a depth of at least twenty-four
(24) inches below the sand layer. Beds shall be
separated by four (4) feet of sand .
i . Where two (2) beds are installed side by side, the
sandy loam covering fill shall be placed to a depth of
eighteen ( 18) inches at the center of the mound and six
(6) inches at the edges.
j . Six (6) inches to topsoil shall be placed on the fill
material over the entire area of the mound and grass
cover established as soon as possible.
k . No shrubs or trees shall be planted on the top of the
mound. Shrubs may be planted on the side slopes and at
the foot of the mound .
I . Side slopes on the completed mound shall be no steeper
than three (3) to one ( 1 ) .
m. Surface run-off from areas adjacent to the mound shall
be diverted away from the mound by construction of
appropriate diversion structures.
502'03- Collector systems. On previously developed sites, where
site and soil conditions do not provide suitable conditions for final
treatment and disposal on an individual Lot, a Soil Treatment System
located on another lot or lots may be employed under terms approved
by the Governing Body.
( 1 ) General conditions.
a. Collector systems designed to serve fifteen ( 15)
dwelling units or five thousand ( 5,000) gallons of
waste per day` whichever is less, shall require
• ! application for and issuance of a state disposal
system permit from the MPCA.

b' Collector systems shall be designed by a
registered Professional Engineer , licensed in the •
State of Minnesota, and certified by the MPCA as
competent in the field of on-site system design '
c . Application to the Zoning Administrator shall be
accompanied by engineering drawings and
specifications and shall demonstrate compliance
with the Zoning Ordinance, Plumbing Code and
issues relating to joint ownership of land , joint
system maintenance responsibilities, homeowners
associations, easements, covenants and such other
items as may apply to the specific proposal .
(2) Design .
a. The size of common Soil Treatment Systems shall be
based on the sum of the areas required for each
• dwelling unit or establishment being served .
b. Sewage Tanks may be either individually installed
at each Dwelling ..Unit or a_common Sewage Tank .
Common Tanks shall be sized using the formula:
one thousand one hundred twenty five ( 1 , 125)
gallons plus seventy-five (75) percent of the
daily sewage flow, except that the minimum size
for any common sewage tank shall be three thousand
(3,000) gallons, and shall be compartmented if a �
single tank .
(3) Sewers.
a. Sewer systems shall be designed for the daily
flows for dwelling units plus flows from other
establishments.
h. The sewer for systems wi±h commoo .Sewage Tanks
shall be so constructed to give mean velocities,
when flowing full , of not less than two (2) feet
per second . The sewer for systems with individual
Sewage Tanks shall be so constructed and designed
to hydraulically conduct the flow for which
designed . In no case shall a gravity sewer be
less than four (4) inches in diameter.
c . Infiltration or exfiltration shall not exceed two
hundred (200) gallons per inch of pipe diameter
per mile per day.
d ' Cleanouts, brought flush with or above finished
grade shall be provided wherever a common sewer
joins an individual Building Sewer or piping from
an individual Sewage Tank , or every one hundred
( 100) feet, whichever is less, unless manhole
access is provided '

e. There shall be no physical connection between 1
sewers and water supply systems' Sewers shall be

, � required for building sewers- (See 404 .01 ) Where
it is not possible to achieve proper separation
distances, the sewer connections shall be
watertight and pressure tested .
(4 ) Pumps and pump stations.
a. Pump stations shall be watertight.
b. Pump stations shall be provided with manhole
access flush with or above grade, with covers
constructed so as to prevent unauthorized entry.
c . Pumps and pump stations shall be sized to handle
peak system flows.
d . Each pumping station shall be provided with an
alarm system which will warn of pump failure,
overflow or other malfunction .
( 5) Maintenance.
a. All property owners using a collector system and
common drainfield shall assure, through use of
personnel or approved equivalent means, that the
system will be adequately maintained throughout
its useful life. The system so maintained
includes but is not limited to common drainfields,
common individual sewage tanks, pumps, pump
stations, and common sewers.
b. The permitting authority shall be provided the
right of access to any and all components of a
common system for the purpose of periodic
maintenance and operational inspection .
c . In the event of uncorrected deficiencies which
pose an immediate hazard to the public health or
welfare, the governing body may take such
corrective actions as are necessary to mitigate
the hazard . Costs incurred in such event shall be
paid by the system owners.
502.04. Sewage osmosis. The electroosmosis system (a
proprietary installation process under U.S. and Canadian patents) may
be considered for installation on previously developed sites or sites
meeting the criteria for experimental systems.
( 1 ) Standards and criteria for approval .
, . a. Sewage osmosis installations shall comply with all
_-: applicable requirements for Standard Systems
contained in this Ordinance as pertain to system

502.05. Sewage Holding Tanks. If approved by the City Council
Sewage Holding Tanks may be considered for installation on previously
developed sites, as a temporary method for periods of up to one ( 1 )
year, during which time measures are being taken to provide municipal
sewer service or the installation of an approved alternative system
as provided in this Ordinance.
( 1 ) Design ..and installation .
a. A Sewage Holding Tank shall be constructed and
installed as specified in this Ordinance for
Sewage Tanks. �
b. Holding Tanks shall be located as required for
Sewage Tanks, Table IV, and at locations readily
accessible by normal pumping equipment.
c . Holding Tanks shall be provided with a clean-out
pipe of six (6) inch minimum diameter extending to
or above the ground surface, capped or sealed to
prevent odors and inflow of surface water.
d . Holding Tanks shall be provided with a manhole of
twenty (20) inch minimum least dimension to within
a minimum of twelve ( 12) inches below finished
grade' Covers shall be secured to prevent
unauthorized entry.
e. When installed in areas of high ground water,
within six (6) feet of the ground surface, Holding
Tanks shall be installed entirely above the ground
water level or shall be installed according to an
engineer' s design to prevent flotation .

(2) Capacity '

a' Sewage Holding Tanks shall have a minimum capacity
of one thousand two hundred ( 1 ,200) gallons or
four hundred (400) gallons times the number of
Bedrooms for a Dwelling Unit, whichever is
greater.
b. For Other Establishments, capacity shall be based
on measured or estimated flow rates. Minimum
capacity shall be equal to at least eight (8)
times the daily flow rate.
c . Water use metering shall be required for each
Dwelling Unit or other establishment served by a
Holding Tank .
3. Service and maintenance.
a. Where Holding Tanks are installed , the owner shall
provide and maintain a contract with a licensed
pumper, providing for regular pumping of the tank.
b. Records of pumping data, to include dates,
quantities and septage disposal location , shall be
maintained by the pumping contractor and reported
quarterly to the Permitting Authority'
c ' Holding Tanks shall be provided with alarm or
warning devices which will activate a signal when
the tank reaches seventy-five (75) percent of its
capacity.
d . The permitting authority shall be provided right
of access to perform periodic maintenance and
operational inspections of the system.
502.06. Floodplain systems. Installation of Individual on-site
Sewage Treatment Systems in areas subject to recurrent flooding is
prohibited except as provided herein .
( 1 ) Where Ten ( 10) Year Flood occurrence data is available
from and/or approved by the State of Minnesota, DNR,
Individual Sewage Treatment Systems may be considered
subject to the following :
a. Every portion of an individual on-site sewage
Treatment System installed in a Floodplain area
shall comply with all other codes, ordinances, and
regulations applicable to Shorelands, Floodplains,
wild and scenic rivers and general Zoning '
b' The soil treatment area shall be a Standard trench
� | System with no pipe or other opening installed
^ ~ between the filter material and the ground
surface.

The trench system shall be located on the highest
feasible area of the lot and shall have location
precedence over all other improvements except the
water supply well .
d . The bottom of all trenches shall be at an
elevation no lower than the elevation designated
as the ten ( 10) year flood occurrence.
e. Where topography permits, sewage tanks may be
installed to provide gravity flow to the soil
treatment area.
f . Pumping stations shall be installed so as to
prevent the pump from operating when inundated by
flood waters.
g . On Lots where the principal structure complies
with requirements for a floodproofed building ,
fill may be placed to bring the soil treatment
area up to the required elevation . Provisions of
501 '02 shall apply to fill .
h. When the top of the Sewage Tank is inundated
during floods, the dwelling must cease discharge
of Sewage into it. This may be accomplished by
temporary evacuation of the dwelling until flood
waters recede or by diverting sewage to a Holding
Tank sized and installed according to the
requirements of 502.06 ( 1 ) j .
i . The Building Sewer shall be designed to prevent
back flow of liquid into the building when the
system is inundated . If a Holding Tank is
installed for temporary diversion use, the
Building Sewer shall be designed to provide rapid
diversion of Sewage into the Holding Tank when the
system is inundated .
j . Where a Holding Tank is used under provisions of
this section , its capacity shall be equal to one
hundred ( 100) gallons times the number of Bedrooms
times the number of days between the ten ( 10) year
stage on the rising limb of the Regional Flood
Hydrograph and the ten ( 10) year stage on the
falling limb, or one thousand ( 1 ,000) gallons,
whichever is greater.
k . Whenever the water level has reached a stage above
the top of the Sewage Tank , the tank shall , before
being returned to use, be pumped to remove all
solids and liquids.

SECTION 6' OPERATION AND MAINTENANCE
.
/ 601 ' General Requirements.
`
601 .01 . Each Individual Sewage Treatment System currently
existing as well as those installed under this Ordinance shall be
operated and maintained according to the provisions of this section .
601 .02. Responsibility for proper operation and maintenance of
Individual Sewage Treatment Systems shall be as follows:
( 1 ) The owner of each Dwelling Unit or Other Establishment
served by an Individual Sewage Treatment System shall
be responsible for the proper functioning and
maintenance of the system.
(2) The Zoning Administrator shall be responsible to
ensure, through routine periodic monitoring,
investigation of complaints, and other appropriate
means, that corrective action is ordered to protect the
health, safety and welfare of the city in the event
that the responsible owner is negligent or fails to
take action as required by this Ordinance.
601 .03. Maintenance inspection shall be performed annually by
, the owner or an individual or firm certified and licensed to provide
maintenance services if required by the zoning administrator. Such
, inspection shall include, but is not limited to:
( 1 ) Measurement of accumulated sludge and scum in the
septic tank .
(2) Inspection of effluent levels in Soil Treatment Systems
which are provided with inspection wells.
(3) Inspection of pumps and pump stations when included as
part of the system.
(4) Inspection of distribution devices, valve boxes and
drop boxes.
601 .04 . Whenever inspection of the Septic Tank discloses that
the accumulated sludge in the bottom of the tank has reached a point
twelve ( 12) inches or less from the bottom of the outlet baffle
device, or that the bottom of the floating scum layer is less than
three (3) inches above the bottom of the outlet baffle device, the
owner shall have the tank promptly pumped to remove all accumulated
septage.
_ � Exception : Where a conforming Septic Tank serving a Dwelling is
' regularly pumped on an annual basis, the annual inspection of
sludge and scum accumulation is waived .

601 .05. Whenever inspection of pump stations, distribution �� `
devices, valve or drop boxes indicates the accumulation of solids �

such device shall be promptly cleaned . ' !
601 -06. For existing systems having one or more Seepage Pits or
drywells as part of the system, annual inspection shall be made as
follows:
( 1 ) Between the date of May 1 and June 30 each year, the
depth of liquid in each Seepage Pit or Drywell shall be
measured .
(2) When such measurement indicates a liquid level one ( 1 )
foot or less below the inlet ' invert, a second
measurement shall be made eight (8) to twelve ( 12)
hours after the first measurement, during which time no
discharge of liquid to the tank is permitted .
(3) When the second measurement indicates a drop in liquid
level of less than two (2) feet during the indicated
period of time, the system shall be considered
inadequate.
. (4) The owner shall be responsible to provide adequate
expansion or replacement of any Soil Treatment System
�
found to be inadequate as a result of (3) above. .
601 .07' Pumping of Sewage Tanks and other components of Sewage
Treatment Systems shall be performed only by contractors licensed by
the City of Hugo or Washington County to provide such services.
601 .08. Septage shall be disposed of only by approved means as
follows:
( 1 ) Where practicable, into a municipal Sewage treatment
system.
(2) When municipal facilities are not available, at a land
disposal site approved by the Zoning Administrator'
(3) In no case shall Septage be discharged to any body of
water or to the ground surface at locations which have
not been approved for surface application .
301 .09. Records and Reports- Licensed contractors shall
maintain accurate records of pumping activity and shall report such
data quarterly to the Zoning Administrator on forms provided by him.

SECTION 7. ADMINISTRATION
701 . Applicability.
701 .01 . The Ordinance shall apply and be in effect for the stated
purposes within the corporate limits of the City of Hugo.
701 .02. Enforcement.
( 1 ) The City of Hugo and/or its authorized agent
representative shall be responsible for administration
and enforcement of this Ordinance.
(2) The Zoning Administrator or his agent shall be qualified
and certified by the MPCA as competent in the design ,
evaluation and inspection of Individual Sewage Treatment
Systems.
701 .03. Board of Adjustment and Appeals.
( 1 ) The Hugo City Council shall hear and decide appeals and
review any order, decision or determination made by the
Zoning Administrator regarding the enforcement of this
Ordinance.
(2) The City Council shall hear and act upon all Variance
requests where provisions of this Ordinance are
specifically variable.
(3) An appeal of an administrative decision or determination
may be filed by any person or governmental agency with
the City Clerk .
701 .04. Permits shall be required for Individual Sewage Treatment
Systems as follows:
( 1 ) All new installations of Sewage Tanks, Treatment Systems
and components thereof .
(2) All repair, extension , replacement or modification of
existing Sewage Treatment Systems and components.
(3) Any change in use of a facility served by an existing
Sewage Treatment System.
(4) Permits shall not be required for normal routine
inspection and maintenance of Sewage Treatment Systems.
(5) No building permit shall be issued for construction ,
alteration , expansion or remodeling of any Dwelling Unit
or Other Establishment served by an Individual Sewage
Treatment System until the permit required for the
treatment system has first been issued if it is
determined by the Zoning Administrator that the existing
system is inadequate.

( 6 ) Where work requiring a Permit under this Ordinance has
been commenced without first having obtained a Permit,
work shall be ordered to stop until the Permit
requirement has been satisfied .
(7 ) Permit Applications shall be available at Hugo City
Hall and shall be approved by the Zoning Administrator.
701 .05. Inspection as required to determine compliance with this
Ordinance shall be performed by the Zoning Administrator or his
authorized agent under the following circumstances:
( 1 ) Site inspections to verify and evaluate soil and site
conditions and to determine suitability of soils and
Sewage Treatment System design .
(2) Installation inspections shall be made at each
installation, prior to any work having been covered by
backfill '
a. The Applicant shall be responsible to notify the
Zoning Administrator a minimum of twenty-four (24)
hours prior to the time work is ready for
inspection or reinspection '
b. Work which is backfilled prior to required
inspection may be ordered to be uncovered whenever
necessary to determine compliance.
c . When , upon inspection, any part of the system is

determined not to be in compliance with this
Ordinance, written notice shall be provided by the
Zoning Administrator indicating the deficiency and
the required corrections.
d . Noted deficiencies shall be properly corrected and
reinspected before any other work on the project
is continued .
e. No system shall be placed or replaced in service
until final inspection and approval of the
installation.
f . Contractor, upon completion of installation , shall
file with the Zoning Administrator, as-built
drawings indicating the location of system
components dimensioned from a permanent reference
point.
(3) Operation and maintenance inspections shall be
performed by the Zoning Administrator as required to
insure compliance with this Ordinance.

4) The Owner or occupant of a property shall be
responsible to provide access at reasonable times, to
the Zoning Administrator or his agent, for the purpose
of performing inspections required under this
Ordinance.
( 5) Fees for inspections, reinspections, or other services
rendered under this Ordinance shall be as set by
resolution of the City or it' s Authorized Agent from
time-to-time.

SECTION 8. CERTIFICATION, LICENSES AND PERMITS
801 . Certification .
801 .01 . Effective April 1 , 1989, any person , firm or corporation
proposing to engage in the business of soil testing , design ,
construction , installation ., or pumping of on-site sewage treatment
systems within the jurisdiction of this Ordinance, shall be required
to provide to the Zoning Administrator, proof of certification by the
MPCA.
8C)2. Licensing .
802.01 . All persons, firms, or corporations proposing to engage
in the business of installation , constructing, pumping , or providing
maintenance services for Individual Sewage Treatment Systems within
the City shall first obtain an annual license to carry on such work .
802.02. Annual licenses shall be in effect from January 1 to
December 31 and shall be valid only during the year for which issued.
802.03. License applications shall be submitted to the Zoning
Administrator and shall contain the following:
( 1 ) Name of individual , firm, or corporation seeking
license.
{ (2) After April 1 , 1989, proof of certification by the
MPCA.
(3) Documentation indicating insurance coverage which shall
remain in effect during the license term and
noncancel lation provisions which provide a minimum ten
( 10) day notice to the Zoning Administrator prior to
cancellation , as follows:
a. Public liability insurance, not less than one
hundred thousand dollars ($100,000.00) for
inJuries including accidental death to any one ( 1 )
person and subject to the same limit for- each
person in an amount of not less than three hundred
thousand dollars ($300,000.00) on account of any
one ( 1 ) accident.
b. Property damage insurance, not less than fifty
thousand dollars ($50,000.00) for each accident
and not less than one hundred thousand
($100,000.00) aggregated .
c . Workmen ' s compensation insurance coverage of
employees as required by Minnesota Statutes.

AN ORDINANCE REGULATING THE LOCATION, DESIGN,
INSTALLATION, USE AND MAINTENANCE, REQUIRING
PERMITS AND INSPECTION OF INDIVIDUAL SEWAGE
TREATMENT SYSTEMS WITHIN THE CITY OF HUGO.
The City Council of the City of Hugo, Washington County, Minnesota,
ordains as follows:
1 . ADOPTION - The attached document , entitled "CHAPTER 263 - INDIVIDUAL
SEWAGE TREATMENT SYSTEMS" is adopted by this reference, and shall '

govern all applications for individual sewage treatment systems filed
with the City after it' s effective date.
2. REPEAL - Existing Chapter 262 Article II , Sections 25-38 of the Hugo
City Code, entitled "ON-SITE SEWER SYSTEMS" is hereby repealed ,
PROVIDED, HOWEVER, all applications for individual sewage treatment
systems pending prior to the effective date shall be governed by the
provisions thereof until the later of : a) rejection of the
application ; b) granting of the application ; c ) completion by
applicant of all obligations undertaken pursuant thereto; and d ) final
disposition of any litigation pertaining to any such application or
contractural relationship established thereunder.
. EFFECTIVE' DATE This Ordinance shall be effective upon adoption by
the City and publication as required by law.
4. CITY CODE' - At it ' s effective date, this Ordinance shall be
incorporated in the Hugo City Code.

he Hugo City Council adopted and passed Ordinance 1989-256 entitled "AN
ORDINANCE REGULATING THE LOCATION, DESIGN, INSTALLATION, USE AND
MAINTENANCE, REQUIRING PERMITS AND INSPECTION OF INDIVIDUAL SEWAGE

. SUMMARY
Consistent with the City' s Comprehensive Plan , Hugo has established a
policy of controlling the use of Individual Sewage Treatment Systems
(septic systems) because the uncontrolled use of said systems adversely
affects the public health, safety , and general welfare by contributing to
water pollution and impairing land values as noted in the Intent and
Purpose of the Ordinance. Said Ordinance repeals former Chapter 262,
Article II for On-site Sewer Systems. Ordinance provides for expanded
definitions, and general provision which include include, but are not
limited to, the following : applicability , general requirements, site
evaluation , and construction and materials. The Ordinance also provides
for alternative systems, permitted alternative systems, operation and
oaintenance, general administration , certification , licensing and permits;
?nforcement f the Ordinance, and the effects and said Ordinance. The
Jrdinance uprades current City standards, and allows for enforcement of
by the City Of Hugo or Washington County as per designation of the Hugo

CHAPTER 262 . INDIVIDUAL SEWAGE TREATMENT SYSTEM ORDINANCE
AN ORDINANCE REGULATING THE LOCATION, DESIGN, INSTALLATION, USE AND
MAINTENANCE OF INDIVIDUAL SEWAGE TREATMENT SYSTEMS WITHIN THE CITY OF
HUGO.
PURSUANT TO THE AUTHORITY GRANTED IN MINNESOTA STATUTES, SECTIONS
145.915 AND 394.21 ET SEQ. , THE CITY COUNCIL OF THE CITY OF HUGO,
MINNEOSTA, DOES ORDAIN:
SECTION 1 . TITLE
101 . Short Title. This Ordinance shall 'be -known , cited and
referred to as the Individual Sewage Treatment System Ordinance,
except as referred to herein, where it shall be known as, "this
Ordinance" .
SECTION 2. INTENT AND PURPOSE
201 . This Ordinance is adopted for the purpose of :
( 1 ) Protecting the health, safety, and welfare of the
residents of the community, present and future.
(2) Regulating the location , design , installation , use and
maintenance of individual sewage treatment systems so
as to prevent contamination of the surface and ground
waters within the city.
(3) Protecting the individual water supply wells of the
community from contamination by inadequate, improperly
designed, located , installed or maintained individual
sewage treatment systems.
(4) Providing for the orderly development of the rural
areas of the community which are not served nor planned
to be served by central public waste treatment
facilities so as to preclude the installation of
" central public systems.

SECTION 3. DEFINITIONS
301 . Rules.
301 .01 . In the event of conflicting provisions in the text of
this Ordinance, and/or other ordinances, the more restrictive
provisions shall apply. The Zoning Administrator shall determine
which is more "restrictive" and appeals from .such .determination shall
be made in the manner provided herein .
301 .02. Words used in the present tense shall include the past
and future tense; the singular includes the plural and the plural
includes the singular. The word "shall " is mandatory, and the word
"may" is permissive.
301 .03. Unless otherwise specified all distances shall be
measured horizontally.
302. Definitions.
302.01 . For the purpose of this Ordinance, certain terms, words
and phrases are hereby defi-ri-ed as follows:
( 1 ) Agent. Washington County Planning Department and Code
Enforcement .
(2) Aeration . The bringing about of intimate contact
between air and a liquid by spraying the liquid irk he
air, bubbling air through the liquid or agitating
liquid surface in air.
(3) Aeration tank . A tank or container into which liquid
or sewage is subjected to aeration .
(4) Alternative System. An Individual Sewage Treatment
System, other than the Standard -System -defi-ned herein .
( 5) Applicant. Authorized person , firm or corporation
making application for required permit(s) for a Sewage.
Treatment System, and shall include the owner(s) and
such other parties as may be specifically authorized
for specific requirements.
(6) Baffle. A device permanently attached or integral to
the Sewage Tank to provide proper operation of the
Sewage Tank and maximum retention of solids.
(7) Bedrock . That layer of parent materials which by its
composition and structure, as compared to soil , is
inadequate to provide adequate filtration and treatment.

(8) Bedroom' Any room within a dwelling unit which, by
virtue of its design and location , might reasonably be
used as a sleeping room.
(9) Building Drain . That part of the lowest piping of the
drainage system-whi-cti receives the Sewage discharge
inside the walls of the building and conveys it to the
Building Sewer which begins at least one foot outside
the building line.
( 10) Building Sewer. That part of the drainage system which
extends from the Building Drain and conveys its •
discharge to an Individual Sewage Treatment System.
(11 ) Capacity. The internal liquid volume of a Sewage Tank
below the outlet level .
( 12) Cesspool . An underground pit into which raw household
Sewage or other untreated liquid waste is discharged
and from which the liquid is allowed to seep into the
surrounding soil . See 402.04 .
( 13) City. The City of Hugo, Minnesota
( 14) City Council . The Governing Body of the City duly
elected and serving pursuant to Minnesota Statutes'
(15) Distribution Pipe. Perforated pipe or spaced
agricultural drain tile which is used to distribute
Sewage Tank Effluent in a Soil Treatment System.
(16) DNR. The- Minnesota Department of Natural Resources'
(17) Dosinq Chamber. A separate tank or chamber which
receives effluent from the Sewage Tank and serves as a
reservoir for the Dosing Device.
( 18) Dosinq Device. A pump, siphon , or other device which
mechanically discharges Sewage Tank Effluent from the
Dosing Chamber to the Soil Treatment System.
( 19) Dwelling Unit. A residential building , or portion
thereof, intended for occupancy by an individual or a
family, but not including hotels, motels, boarding
rooms or rooming houses, tourist homes, or trailers
located in a mobile home park .
(20) Filter Material . Clean rock , crushed igneous rock or
similar durable and decay-resistent material free from
dust, sand , silt or clay which is insoluble in Sewage
Tank Effluent. The size shall range from three-fourths
inch and two and one—half inches.
(21 ) Flood Plain . The area adjoining a river, stream,
channel , lake, or low area which is subject to periodic ,-`
flooding , as presently defined or as may be defined by
a cognizant governmental body or agency, and subject to !
regulations of Chapter 320, Article II-Flood Plain
Management of the City Code, as it may be amended from
time to time.
(22)Governing Body. See City Council .
(23) Grey Water. Liquid waste from a dwelling or other
establishment produced by bathing , laundry, culinary
operations and from floor drains, and specifically
excluding Toilet Waste.
(24) Holding Tank . A Watertight Sewage Tank for the
temporary storage of Sewage until it is transported to
an approved point for treatment and disposal .
(25) Individual Sewage Treatment System. A Sewage Treatment
System or part thereof , serving a dwelling or Other
Establishment, or group thereof , consisting of one or
more Septic Tanks and a Soil Treatment System.
(26) Lot. A Parcel of land , either platted or unplatted ,
upon which a principal building , including a Dwelling
Unit, is or may be placed , and separated from other
Parcels by a separate legal description .
(27) MHD. The Minnesota Department of Health.
(28) Mottling . A zone of chemical oxidation and reduction
activity within the soil , appearing as patches of red ,
brown, orange or gray or combinations thereof .
(29) Mound System. An Alternative Sewage Treatment System
designed with the soil treatment area built above
existing grade to overcome the limitations of water
table, Bedrock, or -soil -permeability.
(30) MPCA. The Minnesota Pollution Control Agency.
(31 ) Natural Soil . Soil which exists undisturbed in its
natural state. Fill shall be considered as natural
soil after it has been in place for a minimum of twelve
( 12) months.
(32) Ordinary High Water Mark . A mark delineating the
highest water level which has been maintained for a
sufficient period of time to leave evidence upon the
landscape. In the case of controlled outlet waters,
the outflow elevation of the control structure.
(33) Other Establishment. Any public or private structure
other than a dwelling , which generates Sewage. ` ~
(34 ) Owner. The person (s) , firm( s) , and or corporation (s) ,
or other legal entities having fee title to a Lot, or
the contract purchaser of a Lot acting with consent of
the fee title holder'

(35) Parcel . See Lot .
(36) Percolation . The movement or flow of water or liquid
through the interstices or-the pores of a soil or other
porous medium.
(• 7 ) Percolation Rate. The calculated time rate of drop of
a water level in a test hole as specified in Section
(38) Permitting Authority. The City or its duly designated
Agent.
(39) Plastic Limit. A soil moisture content, below which
the soil may be manipulated for the purpose of
installing a Soil Treatment System.
(40) Sand . A soil texture composed by weight of at least
eight-five (85) percent of soil particles ranging in
size between 0.05 and 2.0 mm.
(41 ) Seepage Pit ( leaching pit or drywell ) . A lined
-un-derground pit into which- Sewage Tank Effluent or
other liquid waste is discharged and from which seepage
into the soil occurs through the bottom and sidewall
openings.
(42) Septaqe. Those accumulated solids and liquids removed
from a Sewage Tank or holding Tank during regular
periods of maintenance.
(43) Sewage. Any water carried domestic waste, exclusive of
footing and roof drainage, from any dwelling ,
industrial , agricultural , commercial establishment , or
other structure. Domestic waste includes but is not
limited to liquid waste produced by bathing , laundry,
and culinary operations, and liquid waste from toi lets
and floor drains, and specifically excludes animal
waste and commercial process waste.
(44) Sewage Flow Rate. Flow rates as determined by actual
metered water use or as estimated on the basis of use
and
er�occupancy.
(45) See Tank . A Watertight tank used for the retention
of Sewage, Including , but is not limited to Septic
Tanks, Holding Tanks, and pumping chambers.
(46) Sewage Tank Effluent. That liquid which flows from a
Septic Tank under normal operation .
(47) Septic Tank . A sound , durable, Watertight Sewage Tank
designed and constructed to receive the discharge of
Sewage from a Building Sewer, separate solids from
liquid , digest organic matter and store liquids through
a period of detention .

(48) Shoreland . The perimeter of any lake in whole or in •

part within the City, subject to setback , usage, and/or
other use regulations of any cognizant governmental
body or agency.
(49) Site. The area bounded by the dimensions required for
the proper location of the Soil Treatment System.
( 50) Site, Previsoulv Developed . A lot or parcel upon which
a dwelling or other establishment is in existence as of
the enactment of this Ordinance.
( 51 ) Slope. The ratio of vertical rise or fall to
horizontal distance.
( 52) Soil Characteristics, Limiting . Those soil
characteristics which preclude the installation of a
Standard System, including but not limited to proximity
to bedrock or watertable, and percolation rates which
are excessively fast or excessively slow.
f53) T-he alteration ofnatural soil
conditions by means including but not limited to
placement of fill , removal of soil or alteration of
topography.
( 54) Soil Survey. The U.S. Department of Agriculture, Soil
Conservation Service, Soil Survey of Washington County,
• 1977.
( 55) Soil Textural Classification. Where soil particle
sizes or textures are specified in this Ordinance, they
refer to the soil textural classification found in the
Soil Survey Manual , Handbook No. 18, U.S. Department of
Agriculture, 1951 .
( 56)- Soil Treatment Area. - Thatarea of trench -or bed bottom
which is in direct contact with the filter material of
the Soil Treatment System.
( 57) Soil Treatment System. A system whereby Sewage Tank
Effluent is treated and disposed of below the ground
surface by filtration and percolation through the soil .
( 58) Standard System. An individual Sewage Treatment System
employing a Building Sewer, Sewage Tank and the Soil
Treatment System commonly known as a drainfield or
leachfield '
( 59) Surface Discharge. The discharge of any sewage onto
the surface of any land, or the escape of any sewage •
discharged into an Individual Sewage Treatment System •
onto the surface of any land .

(60) Surface Water Flooding . The one hundred ( 100 ) year
Floodplain along rivers and streams as defined by the
Federal Emergency Management Agency, or in the absence
of such data, as determined by the largest flood of
record . On lakes, highwater levels as determined or
recorded by the DNR and/or the Federal Emergency
Management Agency.
(61 ) Ten Year Flood . That flood which can be expected to
occur, on an average, of once in ten ( 10) years; or the
level to which flood waters have a ten ( 10) percent
chance of rising in any given year.
( 58) Toilet Waste. Fecal matter, urine, toilet paper and
any water used for flushing .
(59) Valve Box . Any device which can stop Sewage Tank
Effluent from flowing to a portion of the Soil
Treatment System.
(60) Water TabLe. The- hig-hestele*ation of the soil where
all voids are filled with water, as evidenced by soil
Mottling , the presence of water, or other information .
(61 ) Watertiqht. Constructed and maintained to prevent
inflow of water or outflow of effluent.
(62) Zoning Administrator. The City of Hugo Zoning
Administrator, deputy zoning administrator or his
designated agent.
(63) Zoning Map. The official map adopted by the City which
delineates the zoning district and Flood Plain
boundaries, as it may be amended by the City Council
from tixr��

SECTION 4. GENERAL PROVISIONS
401 . Applicability .
401 .01 . Administration by state agencies.
( 1 ) Individual Sewage Treatment Systems which serve a
single facility generating greater than fifteen
thousand ( 15,000) gallons per day shall make
application for and obtain a state disposal system
permit from the MPCA.
(2) Collector systems which serve fifteen ( 15) dwellings or
five thousand ( 5,000) gallons per day, whichever is
less, shall make application for and obtain a state
disposal system permit from the MPCA.
(3) Individual Sewage Treatment Systems serving facilities
licensed or otherwise regulated by the State of
Minnesota shall -ma4*s ,appli-cation for and obtain permits
and/or approvals from the appropriate state agency.
(4) Any individual Sewage Treatment System requiring
approval by the State of Minnesota shall also comply '- -
: !
with this Ordinance and all other applicable local
codes and ordinances.
401 .02. Administration under this Ordinance. All Individual
Sewage Treatment Systems installed subsequent to the adoption of this
Ordinance and all alterations, extensions, modifications or repairs
to existing systems irrespective of the date of original installation
shall be regulated in accordance with all requirements of this
Ordinance. Existing systems which show evidence of Sewage Tank
Effluent discharge to the ground surface, ground or surface waters or
other evidence of failure to-adequately treat the Sewage Tank
Effluent shall be replaced , reconstructed or repaired within ninety
(90) days of notice and order to comply by the Zoning AdministraThe.
402. General Requirements.
402.01 . Surface Discharge. Unless specifically permitted by the
MPCA, Sewage, Sewage Tank Effluent, or seepage from a Soil Treatment
System shall not be discharged to the ground surface, abandoned
wells, bodies of surface water, or into any rock or soil formation
the structure of which is not conducive to purification by filtration
or into any well or other excavation in the ground .

402.0 2. Treatment Required . The Sewage Treatment System, or
systems, shall be designed , installed and maintained , to receive all
Sewage from the dwelling , building , or Other Establishment served .
Footing or roof drainage shall not enter any part of the system.
402.03. System Components. The Sewage Treatment System shall
consist of a Building Sewer, Sewage Tank and Soil Treatment System.
All Sewage shall be treated in a Sewage Tank or Toilet Waste
treatment device, and the Sewage Tank Effluent shall be discharged to
the Soil Treatment System.
402.04. Prohibited Installations. Cesspools shall not be
installed .
40 .05. Location . Sewage Treatment Systems and each component
thereof shall be located and installed to insure that, with proper
maintenance, it will function in a sanitary manner, will not create a
nuisance nor contaminate any domestic water supply well . Location
shall consider Lot size and configuration , proposed structures and
other improvements, topography, surface drainage, soil conditions,
depth to groundwater, geology, -existing and proposed water supply
wells, accessibility for maintenance, and expansion or replacement of
the system. Installation of Systems in low swampy areas, drainage
swales or area subject to recurrent flooding is prohibited . Systems
shall not be located within utility or drainage easements nor with
dedicated public or private rights-of-way.
402.06. Clear Water Waste. Uncontaminated clear water waste
from geothermal heat pump installations shall not be introduced into
individual sewage treatment systems. Such waste may be discharged to
the ground surface or to a body of water, however in no case shall
surface discharge be permitted where such discharge encroaches on an
adjoining property or public way. Where subsurface disposal is
provided , such installation shall be separated from the required
sewage treatment site and shall be designed and sized as prescribed
for a standard soil treatment system.
403. Site Evaluation.
403.01 . Prior to the issuance of a building permit, a permit to

install an Individual Sewage Treatment System must be obtained and a
field investigation may be conducted by the Zoning Administrator of
all proposed sites_. for Sewage Treatment Systems, at which time they
shall be evaluated as to:
( 1 ) Depth to the highest known or calculated ground water
table, zone of periodic saturation , or Bedrock .
2) Soil conditions, properties and permeability.
(= ) Slope.
(4 ) The existence of low lands, surface drainage swales,
local surface depressions and rock outcrops.

( 5) All legal setback requirements from: existing and
proposed buildings; property lines; Sewage Tanks; Soil
Treatment Systems; water supply wells, buried water and
utility lines; the Ordinary High Water Mark of lakes,
rivers, streams, flowages, or other bodies of surface
water; and the location of all existing Sewage
Treatment Systems and water supply wells on adjoining
Lots within one hundred ( 100) feet of the proposed Soil
Treatment System.
(6) Surface water flooding probability.
403.02' Soil Testing. Applicants for Sewage Treatment System
permits will be required to submit soil test data derived from soil
borings and Percolation Tests for each proposed site or installation .
403.03. Conduct of Tests. All testing shall be conducted in
accordance with the requirements of this Ordinance and shall be done
by qualified personnel , certified under the MPCA training and
certification program.
Exception : Testing may be done by any individual on a lot
proposed for his personal residenee -or-presently occupied by
him. Any such testing which results in data which is
inconsistent with actual soil conditions may be rejected by
the Zoning Administrator and professional testing required .
403.04. Soil Borings. At a minimum, four (4) satisfactory soil
borings per site shall be made, outlining the perimeter of a minimum
area of five thousand (5,000) square feet per lot for a permit
application . Larger areas may be required where conditions of use,
soils, topography or vegetation require. Soil borings shall be made
as follows:
( 1 ) Borings shall be by auger or excavation and shall be
staked and protected until notification that field
evaluation has been completed .
(2) Borings or excavations shall be made to a minimum depth
of eight (8) feet below existing or proposed grade, or
until bedrock or watertable is encountered , whichever
is less.
(3) A soil texture description shall be recorded by depth
and notations made where texture changes occur.
(4) Particular effort shall be made to determine the
highest known water table or zone of periodic
saturation by observation and recording the first
occurrence of mottling in the soil , or if mottling is
not encountered , the open holes in clay or loam soils
shall be observed after standing undisturbed a minimum
of sixteen ( 16) hours, at which time, depth to standing
water, if present, shall be measured .

( 5) If one ( 1 ) or more borings encounters unsuitable or
limiting conditions, additiohal borings shall be made
in order to outline an adequate area of suitable soil
conditions. If the minimum site area cannot be
identified by suitable borings, work should be
suspended and the data submitted to the Zoning
Administrator.
403.05. Percolation Tests. For all sites, after soil borings
have outlined the minimum area of suitable soils, Percolation Tests
shall be made as follows:
( 1 ) Test hole locations and dimensions:
a. Within the outlined area, a minimum of two (2)
percolation tests, evenly spaced shall be made.
Where soil conditions vary within the tested area,
one ( 1 ) additional percolation test shall be made
in each soil type.
b. Each test hole shall be six (6) to eight (8)
inches in diameter, have vertical sides, and be
bored or-dug- to the depth 'of the bottom of the
proposed drainfield trench.
c . Hole diameter and soil texture descriptions shall
be recorded noting depths where texture changes
occur.
(2) Preparation of the test hole:
a. The bottom and sides of the hole shall be
carefully scratched to remove any smearing and to
provide a natural soil surface.
b. All loose material shall be removed from the
bottom of the test hole and two (2) inches of
cuoe=quar±er .(1/4) -to three-quarters (3/4) inch
gravel shall be placed in the hole to protect the
bottom from scouring .
(3) Soil saturation and swelling :
a. The hole shall be carefully filled with clear
water to a minimum depth of twelve ( 12) inches
above the hole bottom and maintained at this depth
for not less than four (4) hours. (Failure to
adequately saturate the test hole may result in
rejection of the test. )
b. The soil shall then be allowed to swell for at
least sixteen ( 16 ) but not more than thirty (30)
hours. In soils classified as sand , the
saturation and swelling procedure shall not be
required and the test may proceed if one ( 1 )
filling of the hole has seeped away in less than
ten ( 10) minutes,

(4) Percolation Rate measurement :
a. In sandy soils adjust the water depth to eight (8)
inches above the soil at the bottom of the test | |
hole. From a fixed reference point , the drop in
water level shall be measured in inches to the
nearest one-eigth ( 1/8) inch at ten ( 10) minute
intervals. If eight (8) inches of water seeps
away in less than ten ( 10) minutes, a shorter time
interval may be used . But in no case shall the
depth of water exceed eight (8) inches. The test
shall continue until three (3) consecutive
measurements vary by no more than ten ( 10)
percent.
b. In other than sandy soils, adjust the water depth
to eight (8) inches over the soil at the bottom of
the test hole. From a fixed reference point, the
drop in water level shall be measured in inches to
the nearest one-eight ( 1/8) inch at thirty (30)
minute intervals, refilling after each measurement
to maintain an eight (8) inch starting head . The
test shall -c-ontinue until three (3) consecutive
measurements vary by no more than ten ( 10)
percent. The rate may also be measured by
observing the time it takes the water level to
drop one ( 1 ) inch from an eight (8) inch reference „
point, provided a constant water depth of at least
eight (8) inches has been maintained for at least
four (4) hours immediately prior to the
measurement.
( 5) Calculation of Percolation Rates:
a. Divide the time interval by the drop in water
level to obtain the percolation rate in minutes
per inch.
b. Percolation rates shall be determined for each
test hole and recorded on worksheets showing all
measurements and calculations'
(6) Percolation tests shall not be run where frost exists
at and below the test hole bottom.
404 . Construction and Materials. '
404.01 . Building Sewers. The design , construction , and location
of and the materials permitted for use in building sewers shall be as
regulated by the Minnesota State Building Code as it may be amended '

404.02. Sewage Tanks. All tanks, regardless of material or
method of construction shall be:
! ( 1 ) Watertight.
(2) So designed and constructed as to withstand all lateral
earth pressures under saturated soil conditions with
the tank empty.
(3) So designed and constructed as to withstand a minimum
of seven (7) feet of saturated earth cover above the
tank top.
(4) Not subject to excessive corrosion or decay.
( 5) Any tank installed where the water table is closer than
three (3) inches to the bottom of the excavation at the
time of installation shall be required to have an
integrally cast bottom.
404.03. Septic Tanks. All tanks, regardless of material or
method of construction , shall be designed to conform to the following
criteria:
( 1 ) The liquid depth of any Septic Tank or compartment
thereof shall not be less than thirty (30) inches. A
liquid depth greater than six and one-half (6 1/2) feet
shall not be considered in determining tank capacity.
(2) No tank or compartments thereof shall have an inside
horizontal dimension less than twenty-four (24) inches.
(3) The inlet and outlet of each tank shall be submerged by
means of a baffle device.
(4) The space in the tank between the design liquid level
and the top of the inlet and outlet baffles shall not
izeless than twenty (20) percent of the total design
liquid capacity, except that in horizontal cylindrical
tanks this space shall be not less than fifteen ( 15)
percent of the total design liquid capacity.
( 5) Baffle Devices. Shall be constructed of acid resistant
concrete, acid resistant fiberglass or plastic and
shall be integrally cast with the tank , affixed with a
permanent waterproof adhesive or affixed with stainless
steel connectors, top and bottom. Where a sanitary tee
is used as a baffle device, it shall be joined to the
inlet or outlet pipe with a permanent waterproof
adhesive.
(6) The inlet baffle shall extend below the design liquid
level a minimum of six (6) inches but not more than
twenty (20) percent of the total design liquid depth,
and a minimum of one ( 1 ) inch above the crown of the
inlet sewer.

(; ) The outlet baffle and baffles between compartments 414
shall extend below the design liquid level a distance
equal to forty (40) percent of the design liquid depth,
except in horizontal cyl. .i.ndrical tanks where this •
dimension shall be thirty-five (35) percent of the
design liquid depth. Baffles shall extend above the
design liquid level as required in 404.03(4) , however
in no case shall they extend less than six (6) inches
above the design liquid level .
(8) There shall be a minimum of one ( 1 ) inch between the
underside of the top of the tank and the highest point
of the inlet and outlet baffles.
(9) The inlet invert shall be not less than three' (3)
inches above the outlet invert.
( 10) Sanitary tees used as baffles shall be a minimum of
four (4) inches in diameter. Inlet baffles shall be
not less than six (6) inches or more than twelve ( 12)
inches measured from the end of the inlet pipe to the
nearest edge of the baffle. Outlet baffles shall be
six (6) inches, measured from the end of the outlet
pipe to the nearest edge of the baffle.
( 11 ) Access to the Septic Tank shall be as follows:
There shall be one or more manholes, at least
twenty (20) inches least dimension located within •
six (6) feet of all walls of the tank . The
manhole shall extend through the cover to a point
within twelve (12) inches below finished grade.
The manhole cover shall be covered by at least six
(6) inches of earth.
b. There shall be an inspection pipe of at least four-.
(4) inches diameter or a manhole over both the
inlet and outlet baffle device. The inspection
pipe shall extend through the cover and be capped
flush with or above finished grade. ty downward
prosection of the center line of the inspection
pipe shall be directly in line with the center
line of the inlet and outlet baffle device.
( 1.2) Compartmentation of Septic Tanks, Septic Tanks larger
than three thousand (3,000) gallons and fabricated as a
single unit shall be divided into two (2) or more
compartments as follows:
a. When divided into two (2) compartments, not less
than one-half nor more than two-thirds (2/3) of
the total volume shall be in the first
compartment , at the inlet side of the tank .

b' When divided into three (3) or more compartments,
one-half ( 1/2) of the total volume shall be in the
first compartment and the other half equally
divided in the other compartments.c . Connections between compartments shall be baffled
as specified for inlet and outlet baffle devices.
d . Adequate venting shall be provided between
compartments by baffles or by an opening of at
least fifty ( 50) square inches at the top of the
compartment wall .
e' Adequate access to each compartment shall be
provided by one or more manholes as specified in
404.03, ( 11 ) (a) .
( 13) Multiple Tanks. Where more than one ( 1 ) tank is used
to obtain the required liquid volume, they shall be
installed as follows:
a. Multiple tanks shall be connected in series.
b. Each tank shall comply with all provisions of this
section .
c . No more than four (4 ) tanks in series can be used
to achieve the required liquid volume.
d . The first tank shall be no smaller in volume than
any subsequent tanks in series.
404.04. Tank Capacity. The required volume or liquid capacity
of a septic tank shall be determined on the basis of estimated sewage
flows as follows:
( 1 ) Dwellings. The Septic Tank capacity shall be
determined-1ry thenumber ^of bedrooms contemplated or
provided in the dwelling unit served and shall be at
least as large as the capacities given below:

For ten ( 10) or more Bedrooms, the Septic Tank shall be
sized as an Other Establishment. For multiple family
dwellings containing two (2) or more dwelling units,
the size shall be the sum of the individual dwelling
unit requirements.

(2) Other Establishments ' The liquid capacity of a Septic
Tank serving an establishment or use other than a
dwelling shall be sufficient to provide a Sewage
detention period of not less than thirty-six (36 ) hours
in the tank for Sewage flows less than fifteen hundred
( 1 , 500) gallons per day, but in no instance shall the
liquid capacity be less than one thousand ( 1 ,000)
gallons. For Sewage flows of fifteen hundred ( 1 , 500)
gallons per day or more, the minimum liquid capacity
shall equal one thousand one hundred twenty-five
( 1 , 125) gallons plus seventy-five (75) percent of the
daily Sewage flow.
404.05. Sewage Tank Location . The location of each Sewage Tank
shall be according to the following :
( 1 ) The Sewage Tank shall be placed so as to be accessible
for maintenance pumping for removal of liquids and
accumulated solids.
(2) The Sewage Tank shall be installed on undisturbed or
compacted soils capable of bearing the weight of the
tank , its contents -and 'covering earth.
(3) Sewage Tanks shall be set back as specified in Table
IV.
(4) Sewage Tanks shall not be placed in areas subject to
flooding or in Floodplains delineated by the Floodplain � ~
Ordinance as it may be amended from time to time.
Exception: Where Ten ( 10) Year Flood information is
available, Sewage Tanks may be installed within the ten
( 10) year floodplain floodway zone "A" in accordance
with all provisions of Section 502.06.
404.06. Maintenance. Each Septic Tank installed under this
Ordinance as well as all existing .Septic Tanks, shall be maintained
in proper operating condition at all times.
( 1 ) The owner of each septic tank shall be responsible for
maintenance of the tank and may be required to report
its condition to the city.
(2) Accumulated septage shall be removed from each tank
prior to the time when the sludge layer reaches a point
twelve ( 12) inches below the bottom of the outlet
baffle or when the bottom of the scum layer reaches a
point three (3) inches above the bottom of outlet
baffle.
(3) Pumping for removal of Septage from Septic Tanks shall
be performed only by persons certified and licensed by
the City or it ' s agent. See Section S.

(4 ) Disposal of Septage shall be only at approved disposal
sites or facilities' Dumping or spreading of Septage
on the surface of the ground is prohibited except where
surface disposal sites have been specifically approved
and permitted .
( 5) The Zoning Administrator shall maintain appropriate
records of Septage pumping and disposal activities and
shall require such reporting by licensees as is
reasonable and necessary to insure that adequate
maintenance and disposal is being accomplished .
(6) In any instance where it is determined that maintenance
practices or procedures are inadequate or improper, the
Zoning Administrator shall require the owner to comply
with the provisions of this Ordinance within thirty
(30) days of notice served upon the owner.
404.07' Aerobic Tanks. Aerobic tanks shall comply with the
requirements set forth for Sewage Tanks in this Ordinance, and with
the following :
( 1 ) The Tank , including each-individual unit or compartment
shall be readily accessible for inspection and
maintenance and shall be provided with secured covers.
(2) The Raw Sewage Flow from the Building Sewer shall be
intercepted by a trash trap prior to its entering the
aeration compartment. The trash trap shall have a net
holding capacity of not less than twenty (20) percent
of the average daily Sewage flow. The invert level of
the inlet to the trap shall be above the liquid level
and shall discharge directly into the trap. The outlet
from the trap to the aeration compartment shall have a
deep baffle or shall be equipped with a tee or long
ell .
(3) The trash trap shall be_readily �_ccessible for
inspection and effective cleaning and shall be so
constructed as to prevent unauthorized access.
(4) The aeration compartment shall have a minimum holding
capacity of five hundred ( 500) gallons or one hundred
twenty ( 120) gallons per bedroom, whichever is greater.
( 5) The method of aeration shall be mechanical , diffused
air, or both. The method used shall maintain aerobic
conditions at all times.
(6 ) The settling compartment shall have a minimum net
holding capacity equal to twenty (20) percent of the
: volume of the aeration compartment. The design shall
: provide for effective settling and continuous return of
� settled sludge to the aeration compartment '

( 7 ) A minimum one ( 1 ) year warranty and an initial. two ( 2 )
year service c._ontrac_t which specifies regular
inspection calls and effluent quality checks shall he
provided as a part of the purchase agreement. Copies
of the warranty and service contract shal 1. be filed
with the permit application submitted to the Zoning
Administrator.
(8) All other features of Aerobic Tanks not specifically
mentioned in this Ordinance shall comply with National
Sanitation Foundation Standard No. 40 (November 1970) .
404.08. Distribution and Dosing of Effluent. The distribution
and dosing of Sewage effluent to the Soil Treatment System shall be
as follows:
(1 ) Gravity Distribution.
a. Level or Slightly Sloping Ground . Sewage Tank
effluent may be distributed by a distribution box
provided that the final ground surface elevation
of the lowest trench in the system is at least one
( 1) foot -above -the -out-]-et inverts ..of the
distribution box . Distribution boxes shall be
constructed and installed according to the
following:
( 1 ) The box shall be watertight, with a removable
cover and shall be constructed of durable
materials not subject to excessive= corrosion
or decay.
(2) The inverts of all outlets shall be at the
exact same elevation as measured from a liquid
surface in the bottom of the box .
3) The inlet invert shall be a minimum of one ( 1 )
_ iri.ch ._ab.ov.e the .outlet i_nv.ert✓
(4) The outlet inverts shall be a minimum of four
(4) inches above the distribution box floor.
( 5) Each distribution pipe shall be connected
separately to the distribution box and shall
not be subdivided .
(6) When Sewage Tank Effluent is delivered to the
distribution box by pump, a baffle, wall , or
device shall be installed in the distribution
box , or the pump discharge shall be directed
against a wall or side of the box on which
there is no outlet. The baffle shall be
adequately secured and shall extend at least
one ( .1. ) .inc=h above the crown of the inlet.

b. Sloping Ground . Where the elevation difference of
the ground surface exceeds twenty-eight (28)
| | inches in any direction within the Soil Treatment
System and a distribution box cannot be used as
,
specified in 404 '08, 1 . A ' , a drop box shall be
installed at the inlet end of each distribution
line as follows:
( 1 ) Connections .between drop boxes shall be by
watertight piping .
(2) The drop box shall be watertight and
constructed of durable materials not subject
to excessive corrosion or decay.
(3) The invert of the inlet pipe shall be a
minimum of one ( 1 ) inch above the invert of
the outlet pipe leading to the next trench.
(4) The invert of the outlet pipe leading to the
next trench shall be a minimum of two (2)
inches above the invert of the outlet pipe to
'the trench served -by 'the box .
( 5) When the sewage effluent is delivered to the
box by a pump, the discharge shall be directed
� - against a wall or side of the box on which
there is no outlet.

(2) Pressure Distribution. Where required, pressure
distribution of Sewage effluent shall be as follows:
a. Pressure distribution laterals shall be sized as
shown in Table I .
b. Laterals shall be spaced no further than twenty
(20) inches from a trench or a bed wall .
c . Laterals shall be spaced no further than forty
(40) inches apart.
d . Laterals shall be connected to a manifold or
header pipe of two (2) inch diameter or as
required by design of pipe from pump and inlet
position .
e. Laterals and manifold shall be installed so as to
drain completely after every dosing .

(3) Dosing . Where installed , a Dosing Device shall comply
with the following requir-ements:
a. The Dosing Chamber shall be watertight and
constructed of sound and durable materials not
subject to excessive corrosion or decay.
b. The Dosing Chamber shall have one or more
manholes, twenty ( 0) inches in least dimension ,
located directly above the Dosing Device. The
manhole shall extend through the chamber cover to
finished grade and shall be provided with a cover
secured to prevent unauthorized access.
c . The size of the effluent dose shall be determined
by the Soil Treatment System design but in no case
shall the chamber _be sized to provide a dose of
less than seventy-five (75) gallons.
d .. Dosing Devices for gravity distribution :
( 1 ) A pump or siphon shall be utilized to deliver
the dose to the Soil Treatment unit for
gravity distribution over the soil treatment
area.
(2) For dwellings, the Dosing Device shall
discharge a minimum of six hundred (600)
gallons per hour but not more than
twenty-seven hundred (2,700) gal ions per hour.
(3) For other establishments, the Dosing Device
shall discharge at a rate at least ten ( 10)
percent greater than the water supply flow
rate but no faster than the rate at which
effluent will flow out of the distribution
box .

(4 ) When the Dosing Device is a siphon , a regular
maintenance inspection shall be made at a
minimum of six (6) month intervals by the
owner or his agent. The siphon shall be
maintained in operating condition at all
times.
( 5) When the Dosing Device is a pump, it shall be
cast iron or bronze fitted with stainless
steel screws or constructed of other sound ,
durable and corrosion-resistant materials as
approved by the Zoning Administrator.
(6) Where the soil treatment area is at a higher
elevation than the pump, sufficient dynamic
head shall be provided for both the elevation
difference and friction loss.
(7) Where the Dosing Device is a pump, an alarm
device shall be installed to provide warning
of pump failure.
(8) Electrical service ±o_pumps and control shall
be completed in compliance with the Minnesota
State Electrical Code or as amended . Separate
electrical permits and inspections are
required from the Minnesota Board of
Electricity.
e. Dosing Devices for pressure distribution :
( 1 ) The dosing device shall be a pump which is
cast iron or bronze fitted and with stainless
steel screws or constructed of sound , durable
and corrosion-resistant materials.
(2) The pump discharge capacity shall be a minimum
of seven and one741alf (7 1/2) gallons per
minute for each one hundred ( 100) square feet
of soil treatment area.
(3) The pump discharge head shall be at least five
( 5) feet greater than the head required to
overcome pipe friction losses and the
elevation difference between the pump and the
distribution device.
(4) The quantity of effluent delivered for each
pump cycle shall be no greater than
twenty-five (25) percent of one ( 1 ) day' s
sewage flow.
( 5) An alarm device shall be installed to provide
warning of pump failure.

(6 ) Electrical service to pumps and control shall
be completed in compliance with the Minnesota
State Electrical Code. Separate electrical
permits and inspections are required from the
Minnesota Board of Electricity.
4.04.09. Final treatment and disposal of all Sewage Tank e:ffl.u.ent
shall be by means of a standard soil treatment and disposal system.
( 1 ) System sizing :
a. The required soil treatment area shall be
determined by the daily Sewage flow, either
measured or estimated , and the Percolation Rate of
the soil within the soil treatment area.
b. Sewage flows for Dwellings shall be calculated as
shown in Table II . Number of Bedrooms shall be
determined by an examination of building plans and
shall include all rooms having a reasonable
potential for use as a Bedroom. In the case of
existing development, the number of Bedrooms shall
be -determined by -an inspection of the premises.
Minimum daily Sewage flow capacity for any
Dwelling unit shall provide for two (2) Bedrooms.
For multiple residential units, the daily Sewage
f low shall consist of the sum of the flows of the
individual. units,

2. System location:
a. On slopes in excess of twelve ( 1 2) percent, the
soil profile shall be carefully evaluated in the
location of the proposed soil treatment area and
downslope to identify the presence of layers with
different permeabilities that would cause si.dehi_l. l.
seepage. In no case shall a trench be located
within f ft.es'n.. .(15) ._foot .f . wfe.r.e __=.u!ch a layer
surfaces on the down slope.
b. Soil Treatment Systems shall _ = located as
specified in Table IV.
c . Soil treatments

least twelve ( 12) inches and not more than
twenty-four (24) inches below the distribution
pipe.
Distribution pipes - gravity distribution .
( 1 ) Distribution pipes used in soil treatment
systems for gravity flow distribution shall be
a minimum of four (4 ) inches in diameter, and
of sound and durable material not subject to
.corrosion, or decay or to loss of strength
under continuously wet conditions.
(2) Perforated distribution pipe shall have one
( 1 ) or more rows of holes of not less than
one-half ( 1/2) inch diameter spaced not more
than thirty-six (36) inches apart. Holes
shall be cleanly bored and spaced so as to
prevent failure due to loads . Distribution
pipe shall have a minimum load bearing
capacity of not less than one thousand ( 1 ,000)
pounds per lineal foot after perforation .
j ' Pressure distribution .
( 1 ) Distribution pipes used in soil treatment
systems for pressure distribution shall be a
minimum of one ( 1 ) inch in diameter and of

sound and durable material not subject to
corrosion or decay or to loss of strength

(2) Perforations shall be cleanly bored , sized and
spaced as shown in Table 1 .
Distribution pipes shall be laid level or on a
uniform slope of not more than four (4 ) inches per
one hundred ( 100) feet away from the distribution
device'
1 . Filter material shall be covered with three (3) to
four (4) inches of uncompacted hay or straw, or
other approved permeable material '
m. Trenches shall be backfilled and crowned above
finished grade to allow for settling . The top six
(6) inches of backfill shall be of the same
texture and density as the soil adjacent to the
trenches'
n . Themmioimum -depthof sxzil cover over the
distribution pipes shall be eight (8) inches. The
maximum depth of cover shall be twenty-four (24)
inches.

o. The owner or his agent shall establish grass cover
over the soil treatment area as soon as possible
after installation to protect the system. Where
seeding cannot be accomplished prior to
September 1 , the soil treatment area shall be
protected by a uniform cover of hay or straw.
(4) Dual fields.
a' Dual field systems may be installed in soils
having percolation rates slower than five ( 5)
minutes per inch.
b. Dual field systems shall be sized , designed and
constructed as set forth in this Ordinance for
standard systems except as follows:
( 1 ) The soil treatment area shall be divided into
two (2) or more equal parts.
(2) Alternating soil treatment areas shall each be
connected to a valve box outlet.
c ' Any portion of a divided system shall be used for
no more than one ( 1 ) year unless inspection of
effluent levels indicates that a longer duration
is acceptable.

(6 ) Where trench bottoms terminate entirely in natural
! �� ' soils, fill to achieve required cover may be placed at
the time of system installation .
(7) Where trench bottoms are required to terminate in fill ,
such fill shall be placed without compaction and
allowed to settle for a period of at least twelve ( 12)
months. After settlement, soil shall be tested and
data submitted for approval .
(8) Where fill is placed to achieve adequate separation
from the water table, a minimum of three (3)
observation wells shall be placed within the filled
area as follows:
a. Install one ( 1 ) inch to four (4) inch diameter,
solid pipe, to a minimum depth of six (6) feet
below final grade and three (3) feet below design
depth of system, capped above ground surface.
b. Bore hole for pipe a minimum of four (4 ) inches
larger than the diameter of the pipe.
c . Set pipe on two (2) inches of pea gravel , with six
(6) inches of gravel extending up around outside
! of pipe bottom.

d . Fill around remainder of pipe and compact at
| ground surface.
e. Observations shall be made by a certified soil
tester as follows:
( 1 ) First observation to be made within two (2)
weeks after frost is absent and every seven
(7) days thereafter until June 1st, or until
the site is determined to be unacceptable,
whichever comes first.
(2) If water is observed after the frost is
absent, or at any other time, an observation
shall be made one ( 1 ) week later' If water is
present at both observations, monitoring can .
cease since the site is unacceptable.
.
(3) If water is not present at the second
observation , monitoring shall continue until
June 1st. If any two successive observations
show the presence of water above the critical
depth, the site is unacceptable.
r (4) The occurrence of rainfall (s) of one-half
, ( 1/2) inch intensity or more during the
_. monitoring period may necessitate observations
at more frequent intervals.

SECTION 5. ALTERNATIVE SYSTEMS
� .
501 . Applicability.
501 .01 . Replacement of existing systems. Except as provided by
Section 501 .02 and 501 .03, on previously developed sites where system
replacement is required by virtue of existing System failure and
where site and soil conditions do not permit installatin of a
Standard System, an alternative system as provided by this section
may be considered subject to the following conditions:
(1 ) The engineering design and substantiation of
perfomnance of proposed system shall be submitted for
approval '
(2) There shall be no discharge allowed to the ground
surface or surface waters.
(3) Method of treatment and disposal of wastes shall
provide protection to the public health and general '
welfare equal to that provided by a -Standard System.
(4) Proposed alternative systems shall be required to
comply with all state rules and standards.
(5) City reserves the right to require financial security
to assume adequate performance of system.
501 .02. Modified standard system. On any site, where soil
conditions may reasonably be altered by placing fill to provide
suitable conditions as required for a Standard System, a modified
Standard System may ,be considered subject to the following
conditions:
( 1 ) Soil and site conditions shall be evaluated and system
sized and located as prescribed by this Ordinance for a
standard system.
(2) Modified soil areas shall be adequate in size to
accommodate a minimum of two (2) complete systems. On
specific sites, area requirements may be increased when
appropriate under the long range sewer plan for the
location .
(3) Proposed fill projects shall require engineered design
to be submitted for review and approval by the
permitting authority prior to the start of work , and
the issuance of a grading permit as required by the
Zoning Ordinance. -
(4 ) Fill material shall be selected and placed under � |
competent supervision '
( 5) Existing soils shall be protected from compaction and
properly prepared by scarifying or plowing , prior to
placement of fill .

( 5) A site which is saturated at or above the critical
depth of seven (7) consecutive days or more in a normal
/ spring season ( preceded by six (6) months of
precipitation which is at a minimum normal for the
area) is an unacceptable site.
501 .03 ' Experimental systems. Systems utilizing innovative
techniques or methods may be considered for new development under the
following conditions:
( 1 ) System being proposed is substantiated by engineering
data.
(2) System is in compliance with Minnesota Pollution
Control Agency rules.
(3) An adequate area of suitable soils as required for
standard systems is identified and reserved on the
site.
(4) Performance monitoring of the system, including but not
limited towater /usemeteriog` effluent quality and
system maintenance are provided .
( 5) Failure of experimental system to function or to
properly treat Sewage will require discontinuation of
„
use and replacement with an acceptable alternative.
502. Permitted alternative systems.
502.01 . Sewage treatment beds. Where existing developed sites
are limited in area so as to preclude installation of a Standard
trench System, a sewage treatment bed may be considered subject to
the following conditions:
( 1 ) Soil and site conditions shall be evaluated and system
sized and located as prescribed by this Ordinance for a
Standard System.
(2) Bed construction shall be limited to areas having an
natural slope of six (6) percent or less.
(3) Excavation for beds shall be by back hoe or other' means
that allows equipment wheels or tracks to remain on
surface soil ' Excavation equipment or other vehicles
shall not be driven on the soil treatment area'
(4 ) Gravity distribution pipes in beds shall be uniformly
spaced no more than five ( 5) feet apart and not more
,
than thirty (30) inches from the sidewalls of the bed .
( 5) Distribution of Sewage effluent may be by gravity or
pressure distribution . Installation shall be as
specified in 404.09(3) '

502.02' Sewage treatment mounds' On sites having soil
conditions which do not permit installation of a Standard System, a
sewage treatment mound may be considered . Proposed mounds shall
require engineered design (conforming to the following conditions) to
be submitted for review and approval prior to any permit issuance or
construction .
( 1 ) General conditions.
a. The soil Percolation Rate in all layers of the
natural or fill soil to a depth 'of at least
twenty-four (24) inches below the sand shall be
faster than one hundred twenty ( 120) minutes per
inch.
b. Below the sand layer there shall be at least one
( 1 ) layer of soil , at least twelve ( 12) inches in
depth, which has a Percolation Rate slower than
five ( 5) minutes per inch.
c . Mounds shall be located on flat areas or crests of
slopes. Mounds shall not be installed on natural
slopes exceediog three (3) .percao± where the
Percolation Rate is slower than sixty (60) minutes
per inch in the twenty-four (24) inches below the
sand layer.
d . Mounds shall not be located on slopes exceeding �
six (6) percent where the Percolation Rate is ^ -
slower than thirty (30) minutes per inch in the
twenty-four (24 ) inches below the sand layer .
(2) Soil surface preparation .
a. The discharge pipe from the pump to the mound area
shall be installed prior to soil surface
preparation . The trench shall be carefully
backfilled and compacted to prevent effluent
seepage.
b' The total area selected for the mound , including
the dikes, shall be plowed to a minimum depth of
eight (8) inches or the sod layer broken and
roughened by back hoe teeth. Furrows shall be
thrown up slope and no dead furrow shall be
permitted under the mound . The soil shall be
plowed or broken only when soil moisture to a
depth of eight (8) inches is below the plastic
limit.
c . Where soils in the top eight (8) inches of the -`
natural surface have percolation rates faster than
fifteen ( 15) minutes per inch, disking may be used
for surface preparation '

'- ! d . A rubber tired tractor may be used for plowing or
. disking but in no case shall such equipment be used
after the soil preparation is completed in soils having
a Percolation Rate slower than fifteen ( 15) minutes per
inch. A crawler or track type tractor shall be used
for these conditions.
e. Mounds shall not be located on slopes exceeding twelve
( 12) percent under any conditions.
f . Mounds shall be installed only in areas where existing
soil conditions provide a minimum twenty-four (24 ) inch
depth to Water Table or Bedrock .
g. The bottom area of the filter material shall be sized
on the basis of 0.83 square feet per gallon of waste
per day.
h. In no case shall the width of the filter material in a
single bed exceed ten (10) feet.
i . Mound locations shall be subject to setback
requirements listed in Table IV. Distances shall be
measured from the toe of the slope.
Installation of mound systems shall , in all cases,
require installation of water use metering at the
dwelling or facility being served .
k . Mound construction shall proceed immediately after
completion of soil surface preparation.
(3) Mound construction .
a. A minimum of twelve ( 12) inches of Sand (302.01-25)
shall be placed over the prepared surface to the limits
of the proposed filter material . A crawler type
tractor and blade shall be used to move sand into
place, maintaining a minimum of six (6) inches of sand
beneath the equipment to minimize compaction of the
soil surface. The sand layer shall be level when
placement is completed .
b ' Filter material to a minimum depth of nine (9) inches
shall be placed over the sand layer, below the
distribution pipe.
c . Distribution of effluent over the filter material shall
be either by four (4) inch distribution pipe with
gravity flow from a distribution box or by perforated
pipe under pressure from a manifold '

( 1 ) Gravity distribution '
(a ) Four (4 ) inch distribution pipes shall be
rigid plastic with one-half ( 1/2) inch
minimum diameter holes spaced no further than
thirty-six (36 ) inches apart. Pipe shall be
placed with one ( 1 ) row of holes at the
bottom of the pipe.
( b) Distribution pipe shall slope downward , two
(2) inches per one hundred ( 100) feet away
from the distribution box , spaced no further
than five ( 5) feet apart and no further than
thirty (30) inches from the edge of the
filter material .
(c ) The outer ends of the distribution pipe shall
be connected '
(d ) Distribution pipes shall be connected to the
outlets of a distribution box .
(e) The quantity of effluentdelivered to the
distribution system per pump dose shall be at
least twenty-five (25) percent of the daily
sewage flow.
( f ) Gravity distribution shall be permitted only
where soils existing at the mound location
have Percolation Rates of sixty (60) minutes
per inch or faster.
(2) Pressure distribution .
( a) Perforations shall be as required by
Table I . Holes shall be cleanly drilled ,
straight into pipe, and not angled .
( b) Perforated pipe laterals shall be connected
to a two (2) inch diameter manifold pipe,
with ends capped . Laterals shall be spaced
no more than forty (40) inches on center and
no further than twenty (20) inches from the
edge of the filter material .
(c ) The perforated pipe laterals shall be
installed level with perforations downward .
(d ) Manifold pipe shall be connected to the
supply pipe from the pump. Manifold shall be
sloped downward toward the supply pipe.
,
d . A minimum of two (2) inches of filter material shall be �
placed over the top of the laterals or distribution
pipes.

e. Straw or hay, to an uncompacted depth of three ( 3) to
four (4) inches, or other approved permeable material
shall be placed over the entire filter material area
.
f ' Construction vehicles shall not be allowed on the
filter material until backfill is placed .
g . Sandy loam soil shall be placed over the covered filter
material to a minimum depth of twelve ( 12) inches at
the center of the mound and six (6) inches at the
edges.
h. A maximum of two (2) ten ( 10) foot wide beds may be
installed side bY side in a single mound if the soil
Percolation Rate is between five ( 5) and sixty (60)
minutes per inch to a depth of at least twenty-four
(24) inches below the sand layer. Beds shall be
separated by four (4) feet of sand .
i . Where two (2) beds are installed side by side, the
sandy loam covering fill shall be placed to a depth of
eighteen ( 18) inches at the center of the mound and six
(6) inches at the edges.
j . Six (6) inches to topsoil shall be placed on the fill
material over the entire area of the mound and grass
cover established as soon as possible.
k . No shrubs or trees shall be planted on the top of the
mound. Shrubs may be planted on the side slopes and at
the foot of the mound .
I . Side slopes on the completed mound shall be no steeper
than three (3) to one ( 1 ) .
m. Surface run-off from areas adjacent to the mound shall
be diverted away from the mound by construction of
appropriate diversion structures.
502'03- Collector systems. On previously developed sites, where
site and soil conditions do not provide suitable conditions for final
treatment and disposal on an individual Lot, a Soil Treatment System
located on another lot or lots may be employed under terms approved
by the Governing Body.
( 1 ) General conditions.
a. Collector systems designed to serve fifteen ( 15)
dwelling units or five thousand ( 5,000) gallons of
waste per day` whichever is less, shall require
• ! application for and issuance of a state disposal
system permit from the MPCA.

b' Collector systems shall be designed by a
registered Professional Engineer , licensed in the •
State of Minnesota, and certified by the MPCA as
competent in the field of on-site system design '
c . Application to the Zoning Administrator shall be
accompanied by engineering drawings and
specifications and shall demonstrate compliance
with the Zoning Ordinance, Plumbing Code and
issues relating to joint ownership of land , joint
system maintenance responsibilities, homeowners
associations, easements, covenants and such other
items as may apply to the specific proposal .
(2) Design .
a. The size of common Soil Treatment Systems shall be
based on the sum of the areas required for each
• dwelling unit or establishment being served .
b. Sewage Tanks may be either individually installed
at each Dwelling ..Unit or a_common Sewage Tank .
Common Tanks shall be sized using the formula:
one thousand one hundred twenty five ( 1 , 125)
gallons plus seventy-five (75) percent of the
daily sewage flow, except that the minimum size
for any common sewage tank shall be three thousand
(3,000) gallons, and shall be compartmented if a �
single tank .
(3) Sewers.
a. Sewer systems shall be designed for the daily
flows for dwelling units plus flows from other
establishments.
h. The sewer for systems wi±h commoo .Sewage Tanks
shall be so constructed to give mean velocities,
when flowing full , of not less than two (2) feet
per second . The sewer for systems with individual
Sewage Tanks shall be so constructed and designed
to hydraulically conduct the flow for which
designed . In no case shall a gravity sewer be
less than four (4) inches in diameter.
c . Infiltration or exfiltration shall not exceed two
hundred (200) gallons per inch of pipe diameter
per mile per day.
d ' Cleanouts, brought flush with or above finished
grade shall be provided wherever a common sewer
joins an individual Building Sewer or piping from
an individual Sewage Tank , or every one hundred
( 100) feet, whichever is less, unless manhole
access is provided '

e. There shall be no physical connection between 1
sewers and water supply systems' Sewers shall be

, � required for building sewers- (See 404 .01 ) Where
it is not possible to achieve proper separation
distances, the sewer connections shall be
watertight and pressure tested .
(4 ) Pumps and pump stations.
a. Pump stations shall be watertight.
b. Pump stations shall be provided with manhole
access flush with or above grade, with covers
constructed so as to prevent unauthorized entry.
c . Pumps and pump stations shall be sized to handle
peak system flows.
d . Each pumping station shall be provided with an
alarm system which will warn of pump failure,
overflow or other malfunction .
( 5) Maintenance.
a. All property owners using a collector system and
common drainfield shall assure, through use of
personnel or approved equivalent means, that the
system will be adequately maintained throughout
its useful life. The system so maintained
includes but is not limited to common drainfields,
common individual sewage tanks, pumps, pump
stations, and common sewers.
b. The permitting authority shall be provided the
right of access to any and all components of a
common system for the purpose of periodic
maintenance and operational inspection .
c . In the event of uncorrected deficiencies which
pose an immediate hazard to the public health or
welfare, the governing body may take such
corrective actions as are necessary to mitigate
the hazard . Costs incurred in such event shall be
paid by the system owners.
502.04. Sewage osmosis. The electroosmosis system (a
proprietary installation process under U.S. and Canadian patents) may
be considered for installation on previously developed sites or sites
meeting the criteria for experimental systems.
( 1 ) Standards and criteria for approval .
, . a. Sewage osmosis installations shall comply with all
_-: applicable requirements for Standard Systems
contained in this Ordinance as pertain to system

502.05. Sewage Holding Tanks. If approved by the City Council
Sewage Holding Tanks may be considered for installation on previously
developed sites, as a temporary method for periods of up to one ( 1 )
year, during which time measures are being taken to provide municipal
sewer service or the installation of an approved alternative system
as provided in this Ordinance.
( 1 ) Design ..and installation .
a. A Sewage Holding Tank shall be constructed and
installed as specified in this Ordinance for
Sewage Tanks. �
b. Holding Tanks shall be located as required for
Sewage Tanks, Table IV, and at locations readily
accessible by normal pumping equipment.
c . Holding Tanks shall be provided with a clean-out
pipe of six (6) inch minimum diameter extending to
or above the ground surface, capped or sealed to
prevent odors and inflow of surface water.
d . Holding Tanks shall be provided with a manhole of
twenty (20) inch minimum least dimension to within
a minimum of twelve ( 12) inches below finished
grade' Covers shall be secured to prevent
unauthorized entry.
e. When installed in areas of high ground water,
within six (6) feet of the ground surface, Holding
Tanks shall be installed entirely above the ground
water level or shall be installed according to an
engineer' s design to prevent flotation .

(2) Capacity '

a' Sewage Holding Tanks shall have a minimum capacity
of one thousand two hundred ( 1 ,200) gallons or
four hundred (400) gallons times the number of
Bedrooms for a Dwelling Unit, whichever is
greater.
b. For Other Establishments, capacity shall be based
on measured or estimated flow rates. Minimum
capacity shall be equal to at least eight (8)
times the daily flow rate.
c . Water use metering shall be required for each
Dwelling Unit or other establishment served by a
Holding Tank .
3. Service and maintenance.
a. Where Holding Tanks are installed , the owner shall
provide and maintain a contract with a licensed
pumper, providing for regular pumping of the tank.
b. Records of pumping data, to include dates,
quantities and septage disposal location , shall be
maintained by the pumping contractor and reported
quarterly to the Permitting Authority'
c ' Holding Tanks shall be provided with alarm or
warning devices which will activate a signal when
the tank reaches seventy-five (75) percent of its
capacity.
d . The permitting authority shall be provided right
of access to perform periodic maintenance and
operational inspections of the system.
502.06. Floodplain systems. Installation of Individual on-site
Sewage Treatment Systems in areas subject to recurrent flooding is
prohibited except as provided herein .
( 1 ) Where Ten ( 10) Year Flood occurrence data is available
from and/or approved by the State of Minnesota, DNR,
Individual Sewage Treatment Systems may be considered
subject to the following :
a. Every portion of an individual on-site sewage
Treatment System installed in a Floodplain area
shall comply with all other codes, ordinances, and
regulations applicable to Shorelands, Floodplains,
wild and scenic rivers and general Zoning '
b' The soil treatment area shall be a Standard trench
� | System with no pipe or other opening installed
^ ~ between the filter material and the ground
surface.

The trench system shall be located on the highest
feasible area of the lot and shall have location
precedence over all other improvements except the
water supply well .
d . The bottom of all trenches shall be at an
elevation no lower than the elevation designated
as the ten ( 10) year flood occurrence.
e. Where topography permits, sewage tanks may be
installed to provide gravity flow to the soil
treatment area.
f . Pumping stations shall be installed so as to
prevent the pump from operating when inundated by
flood waters.
g . On Lots where the principal structure complies
with requirements for a floodproofed building ,
fill may be placed to bring the soil treatment
area up to the required elevation . Provisions of
501 '02 shall apply to fill .
h. When the top of the Sewage Tank is inundated
during floods, the dwelling must cease discharge
of Sewage into it. This may be accomplished by
temporary evacuation of the dwelling until flood
waters recede or by diverting sewage to a Holding
Tank sized and installed according to the
requirements of 502.06 ( 1 ) j .
i . The Building Sewer shall be designed to prevent
back flow of liquid into the building when the
system is inundated . If a Holding Tank is
installed for temporary diversion use, the
Building Sewer shall be designed to provide rapid
diversion of Sewage into the Holding Tank when the
system is inundated .
j . Where a Holding Tank is used under provisions of
this section , its capacity shall be equal to one
hundred ( 100) gallons times the number of Bedrooms
times the number of days between the ten ( 10) year
stage on the rising limb of the Regional Flood
Hydrograph and the ten ( 10) year stage on the
falling limb, or one thousand ( 1 ,000) gallons,
whichever is greater.
k . Whenever the water level has reached a stage above
the top of the Sewage Tank , the tank shall , before
being returned to use, be pumped to remove all
solids and liquids.

SECTION 6' OPERATION AND MAINTENANCE
.
/ 601 ' General Requirements.
`
601 .01 . Each Individual Sewage Treatment System currently
existing as well as those installed under this Ordinance shall be
operated and maintained according to the provisions of this section .
601 .02. Responsibility for proper operation and maintenance of
Individual Sewage Treatment Systems shall be as follows:
( 1 ) The owner of each Dwelling Unit or Other Establishment
served by an Individual Sewage Treatment System shall
be responsible for the proper functioning and
maintenance of the system.
(2) The Zoning Administrator shall be responsible to
ensure, through routine periodic monitoring,
investigation of complaints, and other appropriate
means, that corrective action is ordered to protect the
health, safety and welfare of the city in the event
that the responsible owner is negligent or fails to
take action as required by this Ordinance.
601 .03. Maintenance inspection shall be performed annually by
, the owner or an individual or firm certified and licensed to provide
maintenance services if required by the zoning administrator. Such
, inspection shall include, but is not limited to:
( 1 ) Measurement of accumulated sludge and scum in the
septic tank .
(2) Inspection of effluent levels in Soil Treatment Systems
which are provided with inspection wells.
(3) Inspection of pumps and pump stations when included as
part of the system.
(4) Inspection of distribution devices, valve boxes and
drop boxes.
601 .04 . Whenever inspection of the Septic Tank discloses that
the accumulated sludge in the bottom of the tank has reached a point
twelve ( 12) inches or less from the bottom of the outlet baffle
device, or that the bottom of the floating scum layer is less than
three (3) inches above the bottom of the outlet baffle device, the
owner shall have the tank promptly pumped to remove all accumulated
septage.
_ � Exception : Where a conforming Septic Tank serving a Dwelling is
' regularly pumped on an annual basis, the annual inspection of
sludge and scum accumulation is waived .

depth of liquid in each Seepage Pit or Drywell shall be
measured .
(2) When such measurement indicates a liquid level one ( 1 )
foot or less below the inlet ' invert, a second
measurement shall be made eight (8) to twelve ( 12)
hours after the first measurement, during which time no
discharge of liquid to the tank is permitted .
(3) When the second measurement indicates a drop in liquid
level of less than two (2) feet during the indicated
period of time, the system shall be considered
inadequate.
. (4) The owner shall be responsible to provide adequate
expansion or replacement of any Soil Treatment System
�
found to be inadequate as a result of (3) above. .
601 .07' Pumping of Sewage Tanks and other components of Sewage
Treatment Systems shall be performed only by contractors licensed by
the City of Hugo or Washington County to provide such services.
601 .08. Septage shall be disposed of only by approved means as
follows:
( 1 ) Where practicable, into a municipal Sewage treatment
system.
(2) When municipal facilities are not available, at a land
disposal site approved by the Zoning Administrator'
(3) In no case shall Septage be discharged to any body of
water or to the ground surface at locations which have
not been approved for surface application .
301 .09. Records and Reports- Licensed contractors shall
maintain accurate records of pumping activity and shall report such
data quarterly to the Zoning Administrator on forms provided by him.

SECTION 7. ADMINISTRATION
701 . Applicability.
701 .01 . The Ordinance shall apply and be in effect for the stated
purposes within the corporate limits of the City of Hugo.
701 .02. Enforcement.
( 1 ) The City of Hugo and/or its authorized agent
representative shall be responsible for administration
and enforcement of this Ordinance.
(2) The Zoning Administrator or his agent shall be qualified
and certified by the MPCA as competent in the design ,
evaluation and inspection of Individual Sewage Treatment
Systems.
701 .03. Board of Adjustment and Appeals.
( 1 ) The Hugo City Council shall hear and decide appeals and
review any order, decision or determination made by the
Zoning Administrator regarding the enforcement of this
Ordinance.
(2) The City Council shall hear and act upon all Variance
requests where provisions of this Ordinance are
specifically variable.
(3) An appeal of an administrative decision or determination
may be filed by any person or governmental agency with
the City Clerk .
701 .04. Permits shall be required for Individual Sewage Treatment
Systems as follows:
( 1 ) All new installations of Sewage Tanks, Treatment Systems
and components thereof .
(2) All repair, extension , replacement or modification of
existing Sewage Treatment Systems and components.
(3) Any change in use of a facility served by an existing
Sewage Treatment System.
(4) Permits shall not be required for normal routine
inspection and maintenance of Sewage Treatment Systems.
(5) No building permit shall be issued for construction ,
alteration , expansion or remodeling of any Dwelling Unit
or Other Establishment served by an Individual Sewage
Treatment System until the permit required for the
treatment system has first been issued if it is
determined by the Zoning Administrator that the existing
system is inadequate.

( 6 ) Where work requiring a Permit under this Ordinance has
been commenced without first having obtained a Permit,
work shall be ordered to stop until the Permit
requirement has been satisfied .
(7 ) Permit Applications shall be available at Hugo City
Hall and shall be approved by the Zoning Administrator.
701 .05. Inspection as required to determine compliance with this
Ordinance shall be performed by the Zoning Administrator or his
authorized agent under the following circumstances:
( 1 ) Site inspections to verify and evaluate soil and site
conditions and to determine suitability of soils and
Sewage Treatment System design .
(2) Installation inspections shall be made at each
installation, prior to any work having been covered by
backfill '
a. The Applicant shall be responsible to notify the
Zoning Administrator a minimum of twenty-four (24)
hours prior to the time work is ready for
inspection or reinspection '
b. Work which is backfilled prior to required
inspection may be ordered to be uncovered whenever
necessary to determine compliance.
c . When , upon inspection, any part of the system is
(
determined not to be in compliance with this
Ordinance, written notice shall be provided by the
Zoning Administrator indicating the deficiency and
the required corrections.
d . Noted deficiencies shall be properly corrected and
reinspected before any other work on the project
is continued .
e. No system shall be placed or replaced in service
until final inspection and approval of the
installation.
f . Contractor, upon completion of installation , shall
file with the Zoning Administrator, as-built
drawings indicating the location of system
components dimensioned from a permanent reference
point.
(3) Operation and maintenance inspections shall be
performed by the Zoning Administrator as required to
insure compliance with this Ordinance.

4) The Owner or occupant of a property shall be
responsible to provide access at reasonable times, to
the Zoning Administrator or his agent, for the purpose
of performing inspections required under this
Ordinance.
( 5) Fees for inspections, reinspections, or other services
rendered under this Ordinance shall be as set by
resolution of the City or it' s Authorized Agent from
time-to-time.

SECTION 8. CERTIFICATION, LICENSES AND PERMITS
801 . Certification .
801 .01 . Effective April 1 , 1989, any person , firm or corporation
proposing to engage in the business of soil testing , design ,
construction , installation ., or pumping of on-site sewage treatment
systems within the jurisdiction of this Ordinance, shall be required
to provide to the Zoning Administrator, proof of certification by the
MPCA.
8C)2. Licensing .
802.01 . All persons, firms, or corporations proposing to engage
in the business of installation , constructing, pumping , or providing
maintenance services for Individual Sewage Treatment Systems within
the City shall first obtain an annual license to carry on such work .
802.02. Annual licenses shall be in effect from January 1 to
December 31 and shall be valid only during the year for which issued.
802.03. License applications shall be submitted to the Zoning
Administrator and shall contain the following:
( 1 ) Name of individual , firm, or corporation seeking
license.
{ (2) After April 1 , 1989, proof of certification by the
MPCA.
(3) Documentation indicating insurance coverage which shall
remain in effect during the license term and
noncancel lation provisions which provide a minimum ten
( 10) day notice to the Zoning Administrator prior to
cancellation , as follows:
a. Public liability insurance, not less than one
hundred thousand dollars ($100,000.00) for
inJuries including accidental death to any one ( 1 )
person and subject to the same limit for- each
person in an amount of not less than three hundred
thousand dollars ($300,000.00) on account of any
one ( 1 ) accident.
b. Property damage insurance, not less than fifty
thousand dollars ($50,000.00) for each accident
and not less than one hundred thousand
($100,000.00) aggregated .
c . Workmen ' s compensation insurance coverage of
employees as required by Minnesota Statutes.

(4) No work shall be performed under any license unless and
until required proof of insurance is filed with and
approved by the Zoning Administrator.
( 5) The Zoning Administrator may revoke, or refuse issuance
or renewal of a license for cause, as follows:
a. For installation , construction , alteration , repair
or pumping of any Individual Sewage Treatment
System in violation of this Ordinance.
b. For failure or refusal to correct defective work
cited under the provisions of this Ordinance.
c . Before any license is refused or revoked , the
applicant or licensee shall be granted a hearing
before the Hugo City Council or designated agent
to show cause why such license should not be
refused or revoked .
(6) The annual license fee shall be as established from
time-to-time by resolution of the City of Hugo and/or
Washington County Board of Commissioners.
803. Permits.
80=:.01 . No person, firm, or corporation shall install , alter,
repair or extend any Individual Sewage Treatment System in the City
of Hugo without first having obtained a permit therefor from the
Zoning Administrator for the specific work , and having paid the fee
prescribed for such permit as determined from time to time by
resolution of the City and/or the Washington County Board of
Commissioners.
803.02. Permit application shall be made in writing upon forms
provided by the Zoning Administrator and shall contain data
including , but not limited to the following :
( 1 ) Correct legal description of the property on which the
proposed work is to take place.
(2) Site plan , drawn to scale, showing the location of all
proposed and existing structures, property lines, water
supply wells, terrain features such as bluff lines,
water bodies or water ways, buried utilities, easements
and other unique features of the site.
( ) Soil test data, including soil boring logs, percolation
test data with field notes, and location and
identification of test area.
(4) Plans and details of the proposed installation or work ,
including engineering data when required .

( 5) Building plans showing existing and proposed room
arrangement and uses.
(6) For other than dwellings, calculated or measured water
use rates occupancy and occupant load .
(7) Evidence of compliance with state or other jurisdiction
regulations where applicable.
803.05. Permits shall be valid upon issuance, for a period of
six (6) months and may be renewed , when no changes are proposed , upon
application for renewal and payment of the fee prescribed .
803.06. Permits issued under this Ordinance may be revoked upon
written notice of the Zoning Administrator when such permit has been
issued based upon erroneous or inaccurate application data.

SECTION 9' ENFORCEMENT
901 . Violations and Penalties.
901 .01 . It is hereby declared unlawful for any person , firm or
corporation to violate any term or provision of this Ordinance.
Violation thereof shall be a misdemeanor. Each day that a violation
is allowed to continue shall constitute a separate offense.
901 .02. In the event of a violation or a threatened violation of
this Ordinance, the Zoning Administrator, in addition to other
remedies, may request appropriate actions or proceedings to prevent,
restrain, correct, or abate such violations or threatened violations
and it shall be the duty of the City prosecutor to initiate such
action .
901 .03. Any firm, person or corporation who violates any of the
provisions of these regulations, shall be guilty of a misdemeanor.
Each day that a violation is permitted to exist shall constitute a
separate offense.

SECTION 10. EFFECTUATION
1001. Separability.
1001 _01_ It is hereby declared to be the intent that the several
provisions of this Ordinance are separable in accordance with the
following:
(1) If any court of competent jurisdiction shall adjudge
any provision of this Ordinance to be invalid, such
judgement shall not affect any other provisions of this
Ordinance not specifically included in said judgement.
(2) If any court of competent jurisdiction shall adjudge
invalid the application of any portion of this
Ordinance to a particular property, building or other
structure, such judgement shall not affect the
application of said provision to any other property,
building , or structure not specifically included in
said judgement.
1002.01 Effective Date. This Ordinance shall be effective upon
it's adoption by City and publication as required by law.
