HomeMy WebLinkAbout1972.04.17 ORD 1972-105ORDINANCE NUMBER 145 AN ORDINANCE ADOPTING BY REFERENCE CERTAIN PROVISIONS Or THE HICH'4AY TRAFFIC REGULATION ACT AND DRIVERS LICENSES ACT OF THE STATE Or MINNESOTA. The Village Council of the Village of Hugo hereby ordains: Section 1. ADOPTION BY REFERENCE - ?MINNESOTA IIIGHWAY TRAFFIC REGULATION ACT. The Minnesota Highway Traffic regulation Act, being Chanter 169, Minnesota Statutes, and all amendments and revisions thereof, be and the same is hereby adopted and incorporated by reference as an Ordinance of the Village of Hugo, and all the pro- visions therein set forth shall he as much a part of this Ordinance as if they had been set out herein in full. Section 2. ADOPTION BY REFERENCE - DRIVERS LIC:I*?SE ACT. The Drivers License Act, being Chapter 171, Minnesota Statutes, relating to the licensing of drivers, and all amendments an(l. revisions thereof, be and the same is hereby adopted and incorporated by reference as an Ordinance of the Village of Iiugo, and all the provisions therein set forth shall be as much a part of this Ordinance as if thev had been set out herein in full. Section 3. COPIES OF ACTS. Three conies of the Minnesota highway Traffic Regulation Act, Chapter 169, Minnesota Statutes, and three conies of the Drivers License Act, Chanter 171, Minnesota Statutes, as published respectively by the State of. !4innesota, shall be marked by the Village Clerk as official conies, and filed for the use and examination by the public in the office of the Village Clerk. Section 4. PENALTIES. Any person, firm, or corporation violating any of the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine of not more than three hundred dollars (;300.00), or by imprison- ment in the county jail for not more than ninety (90) dans, or both., but if any minimum fine or imnrisorment is prescribed by the Hich,.ay Traffic Regulation Act for an offense, said :prescribed minimum fire or imprisonment shall apply to a person convicted or pleading guilty of the same offense under this Ordinance. Section 5. Hugo, Minnesota, and innosi n:- penalties thereof" nassed the 26th day of Sentember, 1917; and Hua' Ordinance No. 43, entitled "An Ordinance requlating the use of highways within the City (Vi.11ace) of I'uao, incornoratinn nrovisi.ons of the State Ilighwav Traffic Regulation Act by reference, and imoosinq a penalty for the violation thereof" passed tle 4th day of Tune, 1956; and Hugo Ordinance No. 57, entitled "An ordinance regulating the use of highways within the Village of Hugo, incorporating provisions of. the Minnesota Motor Vehicle and Traffic Laws and Motor Carrier Laws 1965-1966 by reference and imposing a penalty for the violation thereof", passed the 3rd day of April, 1967; and Hugo Ordinance No. 71, entitled "An Ordinance relating to the Highway Traffic Regulation Act of the State of Minnesota and the licensing of drivers in the State of Minnesota and adopting by reference provisions thereof", passed the 1st day of March, 1971; together with any other Ordinances, or portion thereof, that is in conflict with any provision of this Ordinance, are hereby repealed. Section 5. EFFECTIVE DATE. This Ordinance shall take effect and be in force from and after its passage and publication. Passed and approved this l7thday of April, 1972. Johnson being a duly sworn officer of White Bear Press Publishing, Inc., on oath says he is and during all the times herein stated has been the publisher and printer of the newspaper known as The White Bear Press and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed In the English language in newspaper format and In column and sheet form equivalent inprinted space toat least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely ofpatents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local post -office. (5) Said newspaper purports to serve the city of White Bear Lake in the Counties of Ramsey and Washington and it has its known office of issue in the city of White Bear Lake in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by Eugene D. Johnson or persons in its employ and subject to his direction and control during all regular business hours and at which said news- paper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper has complied with all the foregoing conditions for at least two years preceding the day or dates of publi- cation mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit In the form prescribed by the Secretary of State and signed by Eugene D. Johnson and sworn to before a notary public stating that the newspaper is a legal newspaper.
