AN ORDINANCE REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT,
ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY,
EQUIPMENT, USE, HEIGHT, AREA, AND MAINTENANCE OF BUILDINGS OR STRUCTURES
IN THE VILLAGE OF HUGO, WASHINGTON COUNTY, MINNESOTA; PROVIDING FOR
THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING
PENALTIES FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES AND
PARTS OF ORDINANCES IN CONFLICT THEREWITH.
The Village Council.of the Village of Hugo, Washington County, Minnesota,
hereby ordains:
Section 1. ADOPTION OF MINNESOTA STATE BUILDING CODE. For the
purpose of regulating the erection, construction, enlargement, alteration,
repair, moving, removal, conversion, demolition, occupancy, equipment,
use, height, area, and maintenance of buildings or structures in the
Village of Hugo, Washington County, Minnesota, and for providing for
the issuance of permits and collection of fees therefor; and for pro-
viding penalties for the violation thereof; the Minnesota State Building
Code is hereby adopted as filed with the Secretary of State and the
Commissioner of Administration January 6, 1972, and effective July 1,
1972, of which not less than three copies are on file in the office
of the Village Clerk. Said Minnesota State Building Code is hereby
adopted in its entirety.
Section 2. ORGANIZATION AND ENFORCEMENT. The provisions of
Appendix D, entitled.."Organization and Enforcement", said Appendix D
being appended to said Minnesota State Building Code, of which not
less than three copies are on file in the office of the Village Clerk,
is hereby adopted in its entirety, except that paragraph 2 (f), entitled
"Occupancy Violations" be deleted, and paragraph 4, entitled "Board of
Appeals" be deleted.
Section 3. PERMITS AND INSPECTIONS. The provisions of Appendix
E, entitled "Permits and Inspections", said Appendix E being appended
to said Minnesota State Building Code, of which not less than three
copies are on file in the office of the Village Clerk, is hereby adopted
in its entirety, except that paragraph 3, entitled "Fees" be deleted
in its entirety and insert in lieu thereof the following:
3. Fees
A. Fees and charges shall be due and payable upon
initial application for permit, and shall
be collected from the applicant for said permit.
B. In all instances where circumstances require
that applications for permit be denied, a refund
shall be made to the applicant in an amount equal
to the original fee, less the amount of ten ($10.00)
dollars.
C. The valuation for permit purposes shall be
determined by the Administrative Authority and
shall be calculated by multiplying the square foot
area of the proposed structure times the factor
prescribed by the State of Minnesota, Building Code
Division as is in effect at the time of application.
D. Where work for which a permit is required is
started or proceeded with prior to obtaining said
permit, the permit fee shall be doubled, but the
payment of such double fee shall not relieve any
persons from fully complying with existing codes or
ordinances in the execution of the work nor from
any other applicable penalties.
E. The fees and charges listed herein are exclusive
of fees and charges required by the State of Minnesota
pertaining to electrical permits and inspections.
F. At the discretion of the Administrative Authority,
an additional charge, not to exceed actual expenses
incurred, may be required in such instances where
repeated violations of the building codes and ordi-
nances make necessary an excessive number of rein-
spections in order to insure compliance with the pro-
visions of said codes and ordinances. Such charges
shall be payable by the permitee prior to the issuance
of Certificate of Occupancy.
Ge"Fee Schedules

In specific instances where special design or engineering concepts are
involved or other unusual conditions exist, a plan checking fee not to
exceed 25% of the permit fee may be required.
(2) Plumbing Inspection Fees. Fees for plumbing
inspection shall be paid to the Administra-
tive Authority as set forth below:
(a) First fixture - $5.00
(b) Each additional fixture - $2.00
(c) Reinspection - $5.00
(d) Drain field opening - $10.00
(e) Well drilling permit - $7.50
(3) Heating and Appliance Inspection Fees. Fees
for inspection of heating system or appliance
installations shall be paid to the Admini-
strative Authority as set forth below:
(a) Natural Gas
4.00 for each burner using 400,000 B.T.U.

Section 4. PERCOLATION TESTS. Any property for which a building
permit is sought that is not provided with off-site or public sewer
facilities shall be subject to soil and percolation tests to determine
that proposed on-site sewage disposal will meet minimum standards of
health and sanitation, and will accommodate an adequate sewage disposal
system or systems to serve the residence. The soil and percolation
tests shall be made at the expense of applicant, and the results of
said sxil.and percolation tests and a sketch map identifying where
tests were made, together with the proposed plan for on -.site sewage
disposal, shall be submitted to the Administrative Authority for
approval. No building permit shall be issued until the Administrative
Authority approves the proposed on-site sewage disposal system or systems.
Section 5. REPEAL OF CONFLICTING ORDINANCES. Sections 2, 3
4, and 5 of Ordinance Number 1 of Oneka Township, passed the 10th day
of December, 1959, entitled "A By -Law Establishing A Zoning District,
Regulating The Use Of Land Within The District And Requiring Building
Permits"; Ordinance Number 41, entitled "An Ordinance Regulating The
Construction, Alteration, Repair And Type Of Building, And Requiring
A Permit Therefor", passed the 4th day of October, 1954; Ordinance
Number 46, entitled "Uniform Building Code, 1958 Edition, Adopted By
Reference", adopted the 12th day of December, 1960; Ordinance Number
55, entitled "An Ordinance Amending Ordinance Number 41, Regulating
The Construction, Alteration, Repair And Type Of Building", passed
the 13th day of August, 1964; and any and all Ordinances, or parts
thereof, in force at the time this Ordinance takes effect and that
would include provisions that are inconsistent with any provision of
the Minnesota State Building Code, as modified and adopted, are hereby
repealed.
Section 6. EFFECTIVE DATE. This Ordinance shall be and is
hereby declared to be in full force and effect from and after its
passage and publication.
