AN ORDINANCE ESTABLISHING CHAPTER 220 OF THE HUGO CITY CODE,
ENTITLED, "PARKS" TO PROVIDE FOR THE ESTABLISHMENT OF HOURS
OF USE, PROVISIONS FOR SPECIAL PERMIT, AND PROVIDE PENALTIES.
The City Council of the City of Hugo, Washington County, Minnesota,
hereby ordains:
220-1 . PURPOSE AND DEFINITIONS.
Subd. A. Purpose. The City Council of the City
of Hugo has determined that regulation of the use of
public park property is necessary to protect the health
and safety of persons and property within the City.
Subd. B. Definitions. For the purpose of these
regulations the terms shall have the meanings given them:
(1) Public Park. The term "public park"
shall mean a parcel of land in the City
of Hugo now or hereafter owned or controlled
by the City and dedicated or designated as
park land or recreation area on the Land
Use Map, or as may otherwise be designated
by the City from time to time.
(2) Improved Park. The term "improved park"
shall mean any designated public park now
or hereafter improved for use as a public
recreational facility, camp ground, or
picnic area.
(3) Unimproved Park. The term "unimproved
park" shall mean any designated public park
that is in a natural unimproved state.
220-2 . LIMITATION OF HOURS OF USE. It shall be unlawful
for any person or organization, other than a police officer serving
the City of Hugo either directly or indirectly, to use, occupy, or
pass through or on any public park in the City of Hugo between the
hours of 12: 00 midnight and 6: 00 o 'clock a.m.
220-3. POSTING OF HOURS. The City may cause the limitation of hours
of usage to be posted on each or any public park, but the failure to so post,
or the failure to replace defaced or damaged postings, shall not limit the
scope or applicability of this regulation.
220-4. SPECIAL PERMIT. Upon application in writing by an individual
or organization made to the City Council of the City of Hugo, prior to a
planned event, the City Council may in its sole discretion grant a Special
Permit for more than one (1) day extension of hours for use by that indi-
vidual or organization. The City Council may condition the granting of any
such Special Permit upon specified conditions including, but not limited
to, posting such financial security to protect against damage or clean-up
as may be appropriate; placement of sanitary and/or refuse collection faci-
lities; provision for supervisory or security personnel; clean-up require-
ments; insurance; or such other conditions as may be deemed necessary in
the circumstances. The Mayor, Acting Mayor, or Council member designated
as Parks Commissioner, may issue a permit for one (1) day only subject to
all other conditions of this paragraph being met. There shall be no fee
for a Special Permit.
Upon rejection of any application for a Special Permit for any
applicant, that applicant shall be prohibited from making re-application
for a similar Special Permit for a period of three (3) months after the
date of such rejection.
220-5. PENALTIES. Any person who shall violate the usage regu-
lations herein set forth relating to public parks, shall upon conviction
thereof be guilty of a misdemeanor, and shall be punishable therefore
according to law, plus the cost of prosecution.
220-6. SEPARABILITY. Every section, provision or part of this
Chapter is declared separable from every other section, part of provision;
and if any section, part of provision hereof shall be held invalid, it shall
not affect any other section, part or provision.
220-7. EFFECTIVE DATE. This regulation shall be effective from
and after its date of adoption and publication according to law.
