AN ORDINANCE AMENDING CHAPTER 150 OF THE HUGO CITY CODE, ENTITLED,
"LIQUOR, BEER & WINES" TO PRESCRIBE REGULATION OF AFTER-HOURS USE
OF LICENSED PREMISES FOR RESTAURANT FACILITY, AND TO AMEND PERMIS-
SIBLE HOURS OF SUNDAY OPERATION AND SALE OF INTOXICATING LIQUOR.
The City Council of the City of Hugo hereby ordains :
(1) Delete Section 150-10, Subd. P, in its entirety
and insert the following in lieu thereof:
"Subd. P. Prohibited After-Hours Occupancy or Use
of Premises. It shall be unlawful for any person
or persons, other than the licensee or employees
of licensee, or independent contractors performing
cleaning or maintenance service under written
contract with licensee, to remain on the licensed
premises after 1 : 30 o'clock a.m. continuing until
the licensed premises is next authorized to re-
open for the sale of intoxicating liquor; provided,
however, that this restriction shall not apply to
any licensed premises so long as it is maintained
open to the public for the service of food and
while the kitchen and cooking facilities are
staffed and in operation for preparing food to
be served and personnel is available to service
the food so prepared, and for one-half hours after
the licensed facility is closed to the public or
the kitchen facility is no longer functioning to
prepare and provide food, whichever occurs first,
unless then authorized to sell intoxicating liquor
as herein provided. There shall be no consumption
of any intoxicating liquor on any licensed premises
by any person or persons, including the licensee
and employees of licensee, after 1 : 30 o 'clock a.m. ,
and prior to the next authorized opening for sale
of intoxicating liquor as herein provided. "
(2) In Section 150-14, Subd. C, entitled "Hours" , change
"12 : 00 o'clock noon" to "10: 00 o'clock a.m. " .
(3) The official copies of the Hugo City Code shall be
corrected to reflect the within changes upon passage and
publication of this Ordinance.
(4) The provisions of this Ordinance shall be effective
immediately upon adoption and publication as required by
law.
