HomeMy WebLinkAbout1980.01.21 ORD 1980-165 ]i ORDINANCE NO. 165 AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY REQUIRING SITE PLAN APPROVAL IN THE RB AND CB DISTRICTS. The City Council of the City of Hugo hereby ordains: In Section 320-4, entitled "Use District Provisions and Regulations", Subd. J, entitled "Regulations for the Retail Business District" (RB) , and Subd. K, entitled "Regulations for the Concentrated Business District" (CB, there shall be inserted the following: (4) No land shall be used and no building shall hereafter be erected or structurally altered except for one or more of the following uses allowed under this section, and, only, when the owner has submitted a Site Plan to the City Council and the City Council has approved the plan. The plan shall include the proposed use of the facility; shall include plans for the overall parcel of land; shall comply with the Ordinances of the City; shall include surface drainage plans; sanitary sewer service plans; the nature of any waste that will be discharged in the sanitary sewer; utility plans; parking facilities; and any traffic plans or any other requirements requested by the City. These plans shall be in a form that can be reviewed by the City Engineer. These plans shall be reviewed with regard to these matters and with respect to the Comprehensive Plan, to the use of surrounding property, and to the impact of the proposed facility on the total community. The City Council may refer the plans to the Planning Commission, the City Engineer or the City Planner for recommendations. Site Plan approval shall be granted by the City Council provided the following conditions are satisfied: A. The owner shall file an application on a form to be determined by the City requesting approval of the Site Plan. B. The Site Plan shall be drawn to scale (no less than 1/8" = 1 foot) . C. The Site Plan shall include a drawing of the lot on which the building is to be built. D. The Site Plan and application shall be filed with the Ad- ministrative Authority, along with the required fee. The Administrative Authority shall, then, review the Plan and either: 1 . Issue the Permit 2. Recommend changes in the Site Plan 3. Refer the Plan to the Planning Commission E. If referred to the Planning Commission, that body may hold a public hearing. The Planning Commission shall make recommenda- tions to the City Council within 90 days after referral. Failure of the Planning Commission to submit a recommendation within the prescribed time shall be construed as a recommendation of approval. -> (2) F. Upon receipt of the recommendations of the Planning Commission, if requested, the City Council shall consider the proposed Site Plan and shall: 1 . Approve as requested 2. Deny, giving reasons for denial 3. Approve, subject to conditions as deemed necessary Such decisions shall be rendered within 30 days after receipt of Planning Commission recommendations if such recommendations are requested. An additional 60 day delay in the City Council's decision may be granted at the discretion of the City Council upon written request of the application. G. Fees for such Site Plan considerations shall be established by Resolution of the City Council. EFFECTIVE DATE. This Ordinance becomes effective upon its passage and publication according to law, and upon becoming effective shall be incorporated in the City Code.
