'- p • ORDINANCE NO. 149 AN ORDINANCE AMENDING CHAPTER 320 OF THE HUGO CITY CODE, ENTITLED "ZONING" TO PROVIDE REGULATION OF APARTMENTS AND OTHER MULTI-FAMILY USES The City Council of the City of Hugo hereby ordains : 1. In Section 320-4, Subd. H, entitled "Regulations For The Single-Family Urban District (SFU) " , sub- paragraph (3) , entitled "Special Uses" , add as a new special use category, the following - "Apartments and other multi-family uses of three (3) or more family dwelling units. " 2. In Section 320-5, entitled "General Provisions" , add the following requirements: "Subd. Q - APARTMENTS AND OTHER MULTI-FAMILY USES. In recommending the granting of special use permits for structures containing three (3) or more dwelling units, the Planning Commission shall find that the proposed development plan to be in substantial compliance with such approved apartment standards and Community Housing Policies as may be adopted by the City. In no event shall any building housing three (3) or more families in a Residential District have less than ten thousand four hundred (10, 400) square feet of lot area. (1) Special Use Permit Required. A special use permit shall be required for any structure built in SFU zoning prior to issuance of a building permit. The purpose of a special use permit shall be to assure that site and building plans, as well as the impact on the neighborhood, are fully consistent with the intent and purpsoe of the Zoning Regulations and the Comprehensive Plan for the area. All requests for special use permits shall be accompanied by a series of site plans and data showing : A. Building locations, dimensions, and elevations; all signs, structures, entry areas, storage sites, and other structural improvements to the site. B. Circulation plans for both pedestrian and vehicular traffic. C. Fences and screening devices. D. Solid waste disposal provisions and facilities. 1 -f E. Storm drainage plan. F. Fire fighting and other public safety facilities and provisions such as hydrant locations and fire lanes. G. Data pertaining to numbers of dwelling units, sizes, lot area, ratios, etc. H. Exterior wall materials and design information. I . A topographic map showing contour elevations in 2 foor increments, or a contoured site plan showing elevations in 2 foot increments , whichever is applicable. J. A grading plan illustrating the proposes grade changes from the original topographic map. The gradings plan shall specify all grading so as to adequately drain and dispose of all surface water, storm water, and ground water in such a manner as to preclude large scale erosion, unwanted ponding, and surface chemical run-off. K. A recreation plan illustrating in detail all recreational facilities and structures. L. A landscape plan. The landscaping plan shall specify the size, type , and location of all trees and shrubbery and the location of all seeded and sodded areas. M. A soil erosion control plan for the construction period. This plan shall specify all fencing to prohibit heavy machinery and/or materials from being placed on areas not to be disturbed during construction. This shall, at a minimum, include all slopes in excess of eighteen percent (18%) . N. A parking facilities plan. (2) Hearing and Plan Review. The Planning Commission shall review the required plans and shall conduct a public hearing in accordance with Chapter 320-7 . The special use permit shall not be issued until site plan approval is obtained from the City Council . The site plans, when approved, shall be made part of the special use permit and non-compliance with the site plans may be deemed by the City Council as grounds for the revocation of the special use permit. (3) Security. The City Council shall require the developer to post performance security, at least fifty percent (50%) of which shall be cash or an irrevocable letter of credit guaranteeing that street, utility, storm drainage, landscaping, and other individually specified improvements to the building site are completed • as proposed on plans approved by the City Council . (4) Park Fund Dedication. The City Council shall require that the developer dedicate to the City Park Fund, an amount equal to one percent (1%) of the assessed valuation of the vacant land per dwelling unit. The City Council may, at its discretion, accept constructed recreation facilities in lieu of this deposit. (5) Design Requirements. Data submitted in support of the Special Use Permit application shall meet the following criteria: A. Lot Dimensions i. Lot area per dwelling unit shall be 2500 square feet per each unit which contains 2 or less bedrooms and an additional 250 square feet shall be required per bedroom for each unit having more than 2 bedrooms. ii. Minimum lot width at the minimum set back line - one hundred (100) feet. iii. Front yard (setback) - thirty (30) feet on a minor street and fifty (50) feet on a major street. iv. Side yard (setback) Adjacent to another lot - fifteen (15) feet or (3/4) the height of the building, whichever is greater. Adjacent to street - thirty (30) feet. v. Rear yard (setback) - thirty (30) feet. vi. If a site abuts more than one street or planned future street, each street shall be treated as a frontage. B. The circulation plan shall meet the requirements of the City Engineer Department. C. Fences and Screening i. Screening to a height of at least five (5) feet shall be required where (a) any off-street parking areathanparking g contains more six (6) p rking spaces and is within thirty (30) feet on adjoining residential zone, and (b) where the driveway to a parking area of more than six (6) parking spaces is within fifteen (15) feet of an adjoining residential zone. ii. All exterior storage shall be screened. The exterior storage screening required shall consist of a solid fence or wall not less than five (5) feet high, but shall not extend within fifteen (15) feet of any street, driveway, or lot line. iii. Sidewalks shall be provided from parking areas, loading zones, and recreation areas to the entrances of the building. iv. Swimming pools or other intensive recreation shall not be placed within 15 feet of the nearest property line. D. Solid waste disposal provisions and facilities must meet the requirements of the City Engineering Department, City Health Department, E. Storm drainage plan shall meet the requirements of the City Engineering Department. F. Fire fighting and other public safety facilities shall meet the requirements of the City Fire, Police, and Utilities Departments. G. Data pertaining to numbers of dwelling units, and sizes , shall show consistency to other requirements of this Ordinance, proper planning procedures, and good engineering practice. H. Exterior Wall Materials and Design Information. i. Design information shall meet standards set forth in the Building Code and current City Engineering standrads. ii. Each vertical exterior surface shall have a finished appearance and shall be constructed of standard external finished siding material. I. The contour topographic map shall conform to City Engineering standards . • J. The grading plan shall conform to City Engineering standards. K. All constructed recreational facilities, when proposed, shall be shown in detail, including type and manu- s facturer of all components. The plan shall be approved by the City Planning Department. L. Landscape Provisions. i. The site, when fully developed, shall be land- scaped according to a plan approved by the City Council. ii. The design shall make use of all land contained in the site. All of the site shall be related to the circulation, recreation, screening, building, storage, and landscaping , so that no portion of the site remains undeveloped. iii. A minimum of twenty percent (20%) of the site shall be landscaped. M. Soil Erosion Plan shall conform to the City Engineering Department requirements. N. Parking Requirements. i. Two parking spaces minimum per unit, plus one additional parking space per bedroom in excess of one shall be provided on the same site as the dwelling unit. Each sapce shall not be less than 9 feet wide and 20 feet long, and each space shall be served adequately with access drives. ii. Parking spaces shall not be within the front yard, within 5 feet of an adjoining lot line, or within 5 feet of the rear lot line. iii. Bituminous or concrete driveways and parking areas with cast in place concrete curbing shall be required. 3. This Ordinance shall be effective from and after its adoption and publication according to law. 4 .
