ORDINANCE NUMBER /4/ 7e
AN ORDINANCE REGULATING DRIVEWAYS AND PRESCRIBING PENALTIES FOR
THE VIOLATION THEREOF.
The City Council of the City of Hugo, Washington County, Minnes-
ota ordains as follows:
82-1. PURPOSE AND DEFINITIONS.
Subd. A. Purpose. The purpose of this regulation is
to establish certain optimum design specifi-
cations for driveways providing a means of
ingress and egress from private property
located along and adjacent to the right of
way of the city street system of Hugo, Minn-
esota.
Subd. B. Definitions. For the purposes of these regu-
lations the terms shall have the meanings
given them:
(1) City Street System. This shall include
all City Roadway systems under the juris-
diction of the City of Hugo.
(2) Street Classification. In the absence of
an established classification, the follow-
ing definitions shall govern.
(aa) Urban District. Urban district means
those properties contiguous to the
City Street system of Hugo, Minnesota,
including any street, that are built
up with structures devoted to busi-
ness, industry or dwelling houses
where such structures are situated
at intervals of one hundred (100) feet
or less, for a distance of one quarter
(1/4) of a mile or more.
(bb) Rural District. Rural district means
all other locations not meeting the
urban district definition.
(cc) Major Street. Any road that has an
average annual daily traffic volume
of one thousand (1000) vehicles or
greater.
(dd) Minor Street. Any road that has an
average annual daily traffic volume
less than one thousand (1000) vehicles.

(3) Frontage. The length along the street
right-of-way line of a single property
tract between the edges of the property.
Corner properties have a separate front-
age along each street or road.
(4) Frontage Boundary Line (F.B.Line) . A line
normal to the street centerline, at the
end of the frontage, extending from the
right-of-way line to the edge of the
traveled way.
(5) Buffer Area. Buffer area is the area
along the frontage between the traveled
way and the right-of-way line and within
the frontage boundary lines. The traveled
way is that portion of the roadway used
for the movement of vehicles, exclusive
of shoulders and auxiliary lanes.
(6) Driveway Width (W) . Driveway width is
measured normal to the driveway at the
narrowest point (between parallel edges) .
The widths shown are the usuable surfaces
including gutters if present. (See Table
I)
(7) Corner Clearance (C) . At an intersecting
highway, street or road, corner clearance
is the dimension measured along the edge
of the traveled way between the frontage
boundary line opposite the intersection
of the two right-of-way lines and the tan-
gent projectionof the nearest edge of the
driveway.
(8) Driveway Angle (Y) . Angle Y is the angle
of 90° or less between the driveway center-
line and the edge of the traveled way.
(9) Edge Clearance (E) . Edge clearance is
the dimension measured along the edge of
the traveled way from the tangent projec-
tion of the nearest edge of the driveway
to the common frontage boundary line with
the adjacent property.

,82-2. PERMIT REQUIRED. No driveway shall be repaired,
altered, or constructed from or to a city street
until a Driveway Permit has been obtained from
the City of Hugo, as herein required.
82-3. PERMIT APPLICATION. A Driveway Permit applica-
tion shall be filed by or on behalf of the owner,
on forms supplied by the City of Hugo prior to
commencement of any driveway construction, alter-
ation, or repair, and shall include the following.
Subd. A. Permit Fee. A permit fee of $15. 00 shall
be deposited with the application for Drive-
way Permit.
Subd. B. Security Deposit. The City, on advice of
the City Engineer, or the Building Inspec-
tor, may require the applicant, or their
contractor, to furnish a deposit in the form
of a letter of credit, cashier' s check, cer-
tified check, a surety bond on corporate
undertaking, in favor of the City of Hugo,
for any expense incurred by the City in the
repairing of damage to any portion of the
City Street right-of-way caused by work per-
formed under the permit for construction,
including any out of the ordinary engineer-
ing supervision and inspection expense pro-
vided by the City. In those instances,
wherein a deposit is required, the amount
of the deposit shall be specified in the
Special Provisions of the permit. If a check
is furnished, any monies remaining over and
above such expense shall be returned to the
applicant.
Subd. C. Information Required. The application shall
include at least the name of the owner of
the property; the property address, the legal
description of the property; together with such
other information as may be requested on the
application form provided by the City.
Subd. D. Driveway layouts. As a part of the permit ap-
plication, a driveway layout of the property
and proposed driveway (a) shall be submitted
with the application to the City Clerk. The
driveway layout shall include buildings or

proposed buildings and any other relevant
present or planned appurtenances that would
affect the traffic pattern. Driveway layouts
shall be drawn to the scale of twenty (20) ,
thirty (30) , or fifty (50) feet per inch.
Such driveway layouts shall be drawn in ink and
attached to the permit application form. Four
copies are to be furnished - one each for the
City, the building inspector, the City Engin-
eer and the applicant. Driveway layouts may
be permanent photocopies or blueprints, but
not pencil sketches. Photographs are not ac-
ceptable as a substitute for a driveway layout,
but may accompany a driveway layout for illus-
trative purposes. The requirement for layouts
may be waived by the City Engineer in the case
of farm and residential entrances.
82-4. INSPECTION. Inspections to insure compliance with
the permit shall be made by the building inspector.
82-5. DRIVEWAY DESIGN REQUIREMENTS. Driveways that are
to be repaired, altered, or constructed shall be
designed to satisfy the criteria herein set forth.
Subd. A. District and Street Classification. The dis-
trict and street definitions listed above shall
be used by the City Engineer to classify the
, streets, or roads, and they shall
pertain to the existing environmental condi-
tions of the property site under consideration
on the date of application for the permit to
construct or alter a driveway. In urban areas
where present traffic counts indicate a minor
street, with near future traffic volumes pre-
dicting a major street, the major street class-
ification shall be used by the City Engineer.
Subd. B. Driveway Width Dimensions. The recommended,
minimum, or maximum driveway dimensions for the
property site along a street are set forth in
Table I. In all cases, the driveway must ac-
commodate the types of vehicles using it.
Subd. C. Driveway Profile. The vertical profile of a
driveway shall meet the criteria established
herein.
(1) No street Edge Curb (Cut Section) .

(aa) From the edge of the traveled way
or pavement to the outer edge of the
shoulder, the vertical profile shall
be the same as the pitch of the shoul-
der.
(bb) From the outer edge of the shoulder
to the low point at the ditch line
(or over a culvert) the maximum al-
lowable downward gradient shall be
eight (8 ) percent.
(cc) Beyond the ditch line (or culvert)
the maximum allowable gradient shall
be eight (8) percent for commercial
driveways and fifteen (15) percent
for other driveways.

(3) With street Edge Curb.
(aa) The driveway profile shall slope up-
ward from the gutter to meet the side-
wal, if any, or to a minimum height
equal to the curb height, with a max-
imum difference between the downward
cross slope of the traveled way or
pavement and the upward slope of the
driveway to equal ten (10) percent.
(bb) Beyond outer edge of sidewalk or equiv-
alent, the maximum allowable gradient
shall be eight (8) percent for commer-
cial driveways and fifteen (15) per-
cent for other driveways.

Subd. D. Surfacing. Permanent surfacing may be required
where, in the opinion of the City Engineer, it
is felt that there may be excessive erosion and
maintenance at or near the street.
Subd. .E. Diversion Flume. A drainage flume may be re-
quired for deflecting water from driveway edges
to ditch bottom for preventing erosion. Spec-
ifications to be determined by the City Engineer.
This flume shall be bituminous or concrete.
82-6. CORNER CLEARANCE. The minimum dimensions for corner
clearances are listed in Table I. The City Engineer
shall determine if the presence of bus stops, sepa-
rate turning lanes, skew or complex intersections, un-
usually wide roadways, or heavy traffic generators
warrants greater corner clearances.
82-7. DRIVEWAY ANGLE. Driveway angle "Y" shall not be less
than sixty (60) degrees where two way vehicular traf-
fic is anticipated. Angles between sixty (60) degrees
and forty-five (45) degrees are acceptable for one-
way vehicular traffic where no pedestrian conflict ex-
ists.
82-8 . EDGE CLEARANCE. The minimum dimensions for edge clear-
ances are listed in Table I. All portions of the
driveway should be within the frontage boundary line.
82-9. EFFECT OF CHANGE OF CONDITIONS. In the event of a
change in land use or major change in the traffic
pattern of the existing facility, existing driveways
are not automatically perpetuated and new driveway
access applications shall be submitted.
82-10. EFFECT OF VIOLATION OF PERMIT. If the terms of the
permit are violated, or if the City Engineer deter-
mines that continuance of a driveway access is par-
ticularly hazardous, the City Council may require re-
vision of the access.
82-11. USE OF RIGHT-OF-WAY LIMITED. No part of the right-
of-way of a city street may be used for servicing
of vehicles or the conduct of private business.

82. 12 ACCESS CONTROL - DUAL DRIVEWAYS. The area between
driveways for the same property shall be so con-
structed or improved that traffic on the highway and
on the property will in fact be separated. In plat-
ted areas where a sidewalk extends to the property line,
a curb is required at least four (4) inches wide and
four (4) inches high above the sidewalk along the inside
edge of the lot line and extending for at least the
full distance of the sidewalk. Where no sidewalk ex-
ists, this traffic separation may be obtained by the
planting of a hedge or the construction of an island.
Such an island or planting can only be placed on the
right-of-way under permit from the City.
82. 13 VARIANCE. A variance from the standards set forth
in this regulation may be allowed by the City Council
when the variance will facilitate the safe, efficient
use of the property for a lawful purpose and will not
interfere with the construction, maintenance or safe
and efficient use of the street and its appurtenances
by the public.
82.14 EXISTING DRIVEWAYS. Any existing driveway that does not
comply with the provisions of the regulations herein
set forth and causes damage to the public right-of-way
due to erosion, or constitutes a traffic hazard, shall
be required to be brought into compliance. The owner
of the property having the non-complying driveway
shall be notified by certified mail directed to the
property address, by the City to appear at a meeting
of the City Council to review the situation. The City
shall require the City Engineer or the Building In-
spector to inspect the driveway and present a report
on or before the date of Council meeting at which
the matter is to be discussed with the property owner,
as specified in the notice, or at such other date as
may be agreed upon between the City and the owner. If
after hearing the reports and evidence, the City Coun-
cil determines that the driveway does not comply and is
causing damage or is a traffic hazard, the driveway
shall on motion passed by a majority of the Council
be declared a nuisance and the owner directed to obtain
a driveway permit for alteration and correction of the
condition, and make such corrections or alterations
within a time to be established by the City, the time
being not less than thirty (30) days, nor more than
one-hundred eighty (180) days. Failure of the owner
to appear shall not invalidate the proceeding. The
City shall in all cases send written notification of

the findings and action of the Council to the property
owner by certified mail. Failure of the owner to seek
a driveway permit and correct the condition within the
time limit specified by the City, without having re-
quested and received a Variance as herein provided,
shall result in the City having the authority to cor-
rect the condition in the right-of-way and to certify
the expense of such correction, including engineering,
legal, and fiscal expenses, to the County Auditor to
be included for collection with the real estate taxes
for the property. The City may elect to pursue legal
remedies other than abatement of the nuisance herein
described.
82. 15. VIOLATIONS. Violation of any provision of this Chapter
shall constitute a misdemeanor punishable as provided
in Chapter 230 of the Hugo City Code.
82. 16. EFFECTIVE DATE. This ordinance shall be effective from
and after its adoption and publication as required by
law.
The official copies of the Hugo City Code shall be
corrected to reflect the within changes upon passage and publication
of this Ordinance.

:WAY ANGLE.Driveway angle"Y"shall not be less than sixty(60)
agrees where two y vehicular traffic is anticipated.Angles between sixty(60)
degrees and forty-five(45)degrees are acceptable for one-way vehicular traffic
where no pedestrian conflict exists.
82-8.EDGE CLEARANCE.The minimum dimensions for edge clearances are
listed in Table I.All portions of the driveway should be within the frontage bound-
ary line.
82-9.EFFECT OF CHANGE OF CONDITIONS.In the event of a change in land
use or major change in the traffic pattern of the existing facility,existing drive-
ways are not automatically perpetuated and new driveway access applications
shall be submitted,
82-10.EFFECT OF VIOLATION OF PERMIT. If the terms of the permit are
violated,or if the City Engineer determines that continuance of a driveway access
is particularly hazardous,the City Council may require revision.of the access.
82-11.USE OF RIGHT-OF-WAY LIMITED.No part of the right-of-way of a city
street may be used for servicing of vehicles or the conduct of private business.
82.12 ACCESS CONTROL-DUAL DRIVEWAYS.The area between driveways
for the same property shall be so constructed or improved that traffic on the high-
way and on the property will in fact be separated. In platted areas where a
sidewalk extends to the property line,a curb is required at least four(4)inches
wide and four(4)inches high above the sidewalk along the inside edge of the lot
line and extending for at least the full distance of the sidewalk.Where no sidewalk
exists,this traffic separation may be obtained by the planting of a hedge or the
construction of an island.Such an island or planting can only be placed on the
right-of-way under permit from the City.
82.13 VARIANCE.A variance from the standards set forth in this regulation may
be allowed by the City Council when the variance will facilitate,the safe,efficient
use of the property for a lawful purpose and will not interfere with the construc-
tion,maintenance or safe and efficient use of the street and its appurtenances by
the public.
82.14 EXISTING DRIV WAYS. Any existing driveway that does not comply
with the provisions of the tegulations herein set forth and causes damage to the
public right-of-way due to erosion,or constitutes a traffic hazard,shall be required
to be brought into compliance.The owner of the property having the non-comply-
ing driveway shall be notified by certified mail directed to the property address,
by the City to appear at a meeting of the City Council to review the situation.The
City shall require the City Engineer or the Building Inspector to inspect the drive-
way and present a report on or before the date of Council meeting at which the
matter is to be discussed with the property owner,as specified in the notice,or at
such other date as may b agreed upon between the City and the owner.If after
hearing the reports and e thence,the City Council determines that the driveway
does not comply and is cau ing damage or is a traffic hazard,the driveway shall on
motion passed by a major ty of the Council be declared a nuisance and the owner
directed to obtain a drive y permit for alteration and correction of the conditio.

eighty(180)days.Failure f the owner to appear shall not invalidate the proceed-
ing.The City shall in all ca es send written notification of the findings and action'of

driveway permit and correct the condition within the time limit specified by the
City,without having requsted and received a Variance as herein provided,shall
result in the City having tie authority to correct the condition in the right-of-way
and to certify.the expense f such correction,including engineering,legal,and fis-

82.16 EFFECTIVE DA E.This ordinance shall be effective from and after its
adoption and publication s required by law.
