ORDINANCE NUMBER 125
AN ORDINANCE REGULATING DOGS AND PRESCRIBING PENALTIES FOR
THE VIOLATION THEREOF.
The City Council of the City of Hugo, Washington County,
Minnesota ordains as follows:
30-1. DEFINITIONS. As used in this Ordinance, the
following terms shall mean:
Subd. A. Owner. Any person, group of persons or
corporation, firm or partnership, owing,
keeping or harboring a dog or dogs. The
"harborer" of a dog shall mean any person
who has custody of any dog, or knowingly
permits the same to be kept or to stay
on his premises.
Subd. B. Animal Warden. The police officers of the City
of Hugo and/or any firm, dog warden, agency or
company hired by the City of Hugo to assist the
police in the performance of their duties with
regard to enforcement of this Ordinance.
Subd. C. Dog. The term dog includes both male and
female of the canine species.
30-2. CONFINEMENT. The owner shall confine within a
building or secure enclosure any fierce, dangerous,
or vicious dog, except when under restraint by a
competent person. Every female dog in heat shall
be confined in a building, secure enclosure,
veterinary hospital, or boarding kennel, or shall
be controlled on a leash while being exercised.
30-3. PUBLIC NUISANCE. Any dog is a public nuisance that
has done any of the following:
(a) Has destroyed property or habitually trespasses
in a damaging manner on property of persons other
than the owner.
(b) Has attacked or bitten a person outside the
owner's or custodian's premises.
(c) Has shown vicious habits or molested pedestrians
or persons riding or driving on the public streets or
on highways.
30-4. ANIMAL WARD*. The City Council may appoint
an Animal Warden to enforce the provisions of
this Ordinance, or may designate that the duties
of the Animal Warden will be performed by a named
employee of the City of Hugo, and the City Council
may require that any person serving as Animal Warden
be bonded to secure the safe handling of any funds
or fees as herein required.
30-5. OBSERVATION OF DOG AFTER BITING. Any person know-
ing of a case of a human being bitten by a dog shall
immediately notify the dog warden or police, who
shall then order said dog impounded and quarantined
for.a period of fourteen (14) days, at the expense
of the owner. If the owner has adequate facilities,
the dog warden or police may allow the owner of the
dog to impound it in said facilities.
30-6. IMPOUNDMENT: Dogs found running at large or creating
a nuisance as defined, herein, shall be taken up by
the animal warden and impounded in a humane manner
in shelter designated as the City animal shelter.
Impounded dogs may be claimed by the owner within a
five (5) day period by payment of impounded fees.
After five (5) days all unclaimed animals become the
property of the City of Hugo and may be disposed of
in a humane manner, sold, or given away. Owners may
repurchase their dog after the five (5) days period
if their dog is still impounded in the animal shelter
by payment of impounding fees.
Immediately upon impounding dogs or other animals,
the Animal Warden shall make a reasonable effort to
notify the owners of such dogs so impounded and
inform such owners of the conditions whereby they
may regain custody of such animals. Failure of notice
shall not alter the rights or duties of the City, or
the provisions of this Ordinance.
30-7. IMPOUNDMENT FEE: Any animal impounded hereunder may
be reclaimed as herein provided upon payment by
the owner to the City of Hugo the sum of ten dollars
($10.00) for each dog, and the additional sum of
four dollars ($4.00) for each day such dog is
impounded.
30-8. FEE HANDLING. All impoundment fees shall be paid
to and collected by the Animal Warden if the City
Council has acted to appoint an Animal Warden, or by
the City Clerk if no Animal Warden has been appointed.
Every person collecting fees under this Ordinance shall
render an account thereof to the City at least monthly
and shall turn over to the City all funds collected to
the date of the account.
30-9. IDENTIFICATION TAGS. The City shall provide
identification tags that may be purchased by resi-
dents of the City for identifing their dogs as
to ownership, and shall maintain records of the
owner's names, and last -known address, and a descrip-
tion of the dog, for notification purposes in the
event any dog bearing an identification tag is im-
pounded. The charge for such identification tags
shall be established by Resolution of the City Council
from time to time. The issuance of Identification
Tags is for the benefit of the public and as a
means to assist dog owners in training or locating
their dogs, and shall not impose any greater burden
on the City or the Animal Warden regarding notifica-
tion than would otherwise be required under this
Ordinance, and shall not give any owners any superior
right by reason of havng purchased such Identification
Tag.
30-10. KILLING DOGS PROHIBITED, EXCEPT IN CERTAIN CASES.
It shall be unlawful for anyone to intentionally
injure or kill any dog of another, except an owner
or caretaker may kill any dog found chasing, injur-
ing, or worrying sheep or other livestock or poultry
owned by him or in his care, on lands or premises
controlled by him; or except any person may kill any
dog that attacks while he is peacefully walking or
riding and the dog is not on the premises of its
owner; or except as otherwise may be permitted by
Minnesota Statutes.
30-11. PENALTIES. Any person who shall violate any of the
terms and provisions of this Ordinance shall be guilty
of a misdemeanor and, upon conviction, shall be punish-
ed by a fine of not more than $300.00 or by imprison-
ment for not to exceed ninety (90) days, or both.
30-12. VALIDITY. The invalidity of any part of the
Ordinance as declared by a Court of competent
jurisdiction shall not affect the validity of
the remainder thereof.
30-13. EFFECTIVE DATE. This Ordinance shall take effect
and be in force from and after its passage and
publication.
This Ordinance shall be incorporated in the Hugo
City Code as Chapter 30, and have the title
"Animals and Animal Control."
