Schletty arrived 7:09 P.M. 3.0 APPROVAL OF MINUTES MOTION: Lease made motion, seconded by Smith to approve the minutes of the May 17, 1976 meeting. VOTING FOR: Lease, LaValle, Leroux and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by Smith to approve the minutes of the special meeting on May 20, 1976. VOTING FOR: Lease, LaValle, Leroux and Smith MOTION CARRIED 4.0 APPROVAL OF CLAIMS Clerk to ask County for advance of $15,000.00. Transfer Gerald Beach from Utilities to General Claims. MOTION: Lease made motion, seconded by Leroux, to approve the General Claims of June 7, 1976, provided proper financing can be arranged by Treasurer. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED MOTION: Lease made motion, seconded by Smith that Item No. 10 be stricken from. the General Claims. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED APPROVAL OF UTILITY CLAIMS MOTION: Smith made motion, seconded by LaValle, to approve the Utility Claims of June 7, 1976. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS AND LICENSES 5.1 LAVALLE EXCAVATING RE: INSTALLATION FEE Water superintendent said $300 fee discussed at last council meeting was based on a 50' service - fee charged actually figures at $8.50 per foot. Lease said there should be a job order previous, so that price may be determined. MOTION: Lease made motion, seconded by Smith to approve the payment of $2,519.42 for the extension of water main service on Flay Avenue. VOTING FOR: Lease, Leroux, Schletty and Smith. LaValle abstained. MOTION CARRIED 5.2 MINING PERMITS MOTION: LaValle made motion, seconded by Leroux, to approve the minimg permit for Bur Lar on County 8A and 132nd Street until June 30, 1977. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Smith made motion, seconded by Leroux, to approve the minimg permit for LaValle Excavating to be renewed until June 30, 1976. VOTING FOR: Lease, Leroux, Schletty and Smith. ABSTAINED: LaValle. MOTION CARRIED INDYKIEWICZ Engineer said several excavationsare ponding water and it doesn't appear any effort is being made to drain these ponds - would like to see a plan. JUNE 7, 1976 59 MOTION: Lease made motion, seconded by LaValle, to table the matter of the Indykiewicz mining permit until the meeting of June 21 , at which time Mr. Indykiewicz is requested to appear. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: LaValle made motion, seconded by Smith, to table the matters of renewal of mining permits for Barton and Fischer until the proper information is furnished. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED 5 ,3 DEZIEDL - LAND DIVISION MOTION: LaValle made motion, seconded by Smith, to approve land division for Vernon DeZiel for Tracts A thru G, Government Lot 2, Section 16, T31N, R21 , Washington County, based on the certificate of survey by Don Hult, dated August 2, 1974. VOTING FOR: Lease, LaValle, and Smith VOTING NO: Leroux and Schletty MOTION CARRIED 5.4 VAIL RE: DRAINAGE MOTION: LaValle made motion, seconded by Leroux, to place matter of blacktopping Hyde Avenue on the agenda for the June 21 , 1976 meeting. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by LaValle, to write Richard Vail a letter asking him to appear at the June 21st council meeting and be prepared to discuss with the Council the flood problem in Evergreen Hills and his anticipated sch- edule for alleviating the problem. Copies to City Engineer and Rice Creek Watershed District. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED 5.5 HORTON - SPECIAL USE PERMIT Attorney advises lawsuit taken off the court calendar - discussed the terms of settlement and terms that would be agreeable to both the City and the applicant. Condition #8 is being questioned but everything else is in agreement. On site drainage or ponding has been discussed and Horton is looking into it. MOTION: Lease made motion, seconded by Smith to tenatively approve the Special Use Permit for Norm Horton, subject to receipt of the bond by the city; also tenative on the agreement to dismiss the lawsuit between the City of Hugo and Norm Horton Sr; striking the first sentence of Item #8, but leaving the second sentence. Clerk to check the payment of the permit fee. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED STOLTZMAN DUMP Mrs. Laura Stoltzman appeared - would like letter from City of Hugo stating City has no objection to their operating a demolation dump - they need approval from City of Hugo, Washington County, Rice Creek Watershed District and PCA. Lease said they can no longer have a land fill operation - Stoltzman said they are seeking permission for demolition dump only - no garbage allowed - Lease said he has no objection to the transfer part of the operation. MOTION: LaValle made motion, seconded by Lease to write a letter to Mr. Wolters of PCA, and ask what they want from the City of Hugo to try to resolve the Ltoltzman situation. f ()uNE 7, 1976 VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED 5.6 HIRE SUMMER YOUTH - STATE PROGRAM Two applications-received. Job description reported as summer re- creation director - Council would prefer to use person for helping with mi:g ellaneous duties - park trimming, maintenance, under direct- ion of George Koland. MOTION: Smith made motion, seconded by LaValle, to approve the Work Experience Program from Washington County for a six week program at $2.30 per hour for a thirty-two hour week. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Leroux made motion, seconded by Smith, to hire Harry Patrick Cunningham, 5646 N. 141st Street, Hugo, in the slot allo- cated by the state for a summer program, under the direc- tion of George Koland, effective June 15, 1976. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED• 6.0 REPORTS OF OFFICERS AND COMMITTEES 6.1 ORDINANCE COMMITTEE Smith reported first draft is completed on the Septic System Or- dinance - Attorney passed out copies of Driveway Ordinance - noted that if existing driveways are problem regarding excessive erosion, traffic, etc. they can be declared a nuisance - person charged and billed on their taxes, when city repairs. MOTION: LaValle made motion, seconded by Schletty, to approve Ordinance No. 1976-131 , an ordinance amending Chapter 110, of the Hugo City Code, entitled, Fire Prevention and Pro- tection, to prohibit open burning, eliminate fire wardens, and adopt pollution control agency regulations by reference. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED 6.2 PLANNING COMMISSION MOTION: LaValle made motion, seconded by Lease, to deny the request of the Planning Commission to amend Chapter 240 of the City Code, Chapter 240-4 titled Vacancies. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: LaValle made motion, seconded by Smith, to deny the re- quest by the Planning Commission for a chair cushion for their distaff member. VOTING FOR: Lease, LaValle, Leroux, and Smith. ABSTAINED: Schletty MOTION CARRIED 6.4 BUILDING INSPECTOR Building Inspector's report accepted. 6.5 FIRE CHIEF Presented report - wants authorization to bill the Soo Line Railroad for 1 ,500 gallons of water delivered to their railroad crew - also to bill Soo Line for five hours fire fighting railroad fire near Withrow. Clerk and Fire Chief instructed to send bill for $25 for water and a separate bill for fire fighting. Annual Fire Righter's Convention to be held at Morris on June 17 thru 19th - would like authorization to send two members. MOTION: Lease made motion, seconded by Leroux, to authorize the sending of two men to Morris, Minnesota for the Annual Fire Fighter's Convention on June 17th: thru 19th, 1976, and authorize payment of the registration fee, and mileage; also two nights lodging and meals, not to exceed $30 per day per person. JUNE 7, 1976 ' VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED 6.7 ATTORNEY Re: Sunset Lake: Lease said three firms, Soil Test Engineering, Twin City Testing and Geo-Technical, have been requested to present proposal based on at least fifteen investigations. West side of Lake is eliminated - MacLennon, Rice Creek engineer is satisfied they comply - main concern is east side of lake plus Day and Friel pro- perties. Clerk to notify Rice Creek, City would like to be on their June 23rd agenda regarding regulations on Sunset Lake. Schletty to contact Mastrodi to see if he has land available, if necessary, to run sewage from three or four homes; also to see if it is feasible to do this - find out how much road frontage he has. Attorney in- structed to draw up resolution regarding the drainage problem - violation of nuisance ordinance. Shepherd of Fields: No reconciliation on legal description at this time. Survey unacceptable - doesn't correspond with recorded surveys. MOTION: Lease made motion, seconded by LaValle, to notify Vern Peloquin and Shepherd of Fields Lutheran_.Church that Certificate of survey by James Kurth is unacceptable as it is unclear as to ease- ments we already own. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED RECESS - 10:20 P.M. - RECONVENE - 10:31 P.M. MOTION: Lease made motion, seconded by Smith to amend the approval of the general claims to include $6,616.25 to LaValle Excavating for additional road fees on Europa, Elmcrest and Everton Avenues. VOTING FOR: Lease, Leroux, Schletty and Smith ABSTAINING: LaValle MOTION CARRIED 6.8 ENGINEER Europa and Elmcrest need Class 5 only. Lease feels Hugo should be responsible for repairing stretch of Elmcrest in disrepair. LaValle will talk to Lino Lakes regarding the matter. Engineer instructed to use Schafer's prices in computing prices for blacktopping Hyde Avenue. Storm Sewer pro,iect almost completed, he said. MOTION: Leroux made motion, seconded by Smith, to extend meeting beyond 11 :00 P.M. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED 6.9 CLERK 6.9.1 NO PARKING ON HWY 61 MOTION: Lease made motion, seconded by LaValle, to inform the Minnesota Highway Department that the City of Hugo recomm- ends no on-street parking along Hwy. 61 in the City of Hugo from the curb just south of the Catholic Church going north to 148th Street, and to accept their proposals. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED.. 6.9.2 MOTION: LaValle made motion, seconded by Leroux, to place Revenue Sharing Funds in the amount of 6,483.00 in the Public Safety Operating Maintenance Fund. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED NE7, 1976 6.9.3 MOTION: LaValle made motion, seconded by Smith, to write Robert BE..rth, Hugo Police Chief, a letter stating that regarding the letter received from MAPSI, Hugo is accepting the services of MAPSI. He should use their services only in cases of extreme emergencies, only after all other efforts have failed. VOTING FOR: Lease, LaValle, Leroux, and Smith. VOTING NO: Schletty MOTION CARRIED 6.9.4 MOTION: Lease made motion, seconded by LaValle, to have City Attorney write Marvin Rehbein a letter outlining the expenditures incurred in the matter of his inspection fee while his minimg operation was active. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED 6.9.5 MOTION: LaValle made motion, seconded by Smith, to approve the electric service agreement with Northern States Power Company for the year 1976 for electric service for the sewage pumping station. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED 6.9.6 GORDON RUSSETT - MOBILE HOME PERMIT MOTION: LaValle made motion, seconded by Leroux, to have Clerk send Gordon Russett a letter informing him that as long as his mobile home is unoccupied and for sale that he doesn't need to apply for any more permits and no further fees are required. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED DATA PRIVACY ACT riurluiv: Lease made motion, seconded by LaValle, to apply for the emergency classification on individuals, whether they are employees, elected officials or members of the public. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED NEIL PELTIER Has requested return of $500 deposit. City will look into matter when making street inspection - if everything is in order will re- turn $500.00. DUST CONTROL MOTION: Lease made motion, seconded by Schletty, to place an ad in the Peach advertising for dust control, limited to re- sidents of Hugo only. Permit will cost $20, will oil 12' wide strip 150' long. Checks must be made payable to City of Hugo. A minimum of thirty applications must be received or money will be refunded. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED WORKMEN'S COMP MOTION: LaValle made motion, seconded by Smith to approve Resolu- tion No. 1976-46, a resolution including the elected and appointed officials, as defined in Minnesota statutes 176.011 , Subd 9, Para. 5, of the City of Hugo, under the coverage of the Workmen's Compensation Act while they are engaged in City Business. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith MOTION CARRIED MOVING OF HYDRANT LaValle requested permission to move fire hydrant, underground JUNE 7, 1976 6 " MOVING OF FIRE HYDRANT CONT. telephone lines and street light now located in the driven portion of the street right of way on the corner of 142nd Street and Fondant. VOTING FOR: Lease, LaValle, Leroux, Schletty and Smith. MOTION CARRIED MOTION: Lease made motion, seconded by Smith, to authorize Marvin LaValle to stub the water off, rather loop it, in the Shepherd of Fields project on 147th Street.
