MINUTES OF THE PROCEEDING OF SPECIAL MEETING OF THE HUGO CITY COUNCIL
TIME: 7:05 P.M.
PRESENT: Lease, Leroux, Schletty and Smith.
ABSENT: LaValle.
3.0 APPROVAL OF MINUTES
MOTION: Lease made motion, seconded by Schletty to approve the
minutes of the June 7, 1976 meeting.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
4.0 ArrxuvAL OF CLAIMS
MOTION: ;`with made motion, seconded byLeroux to approve the
General Claims of June 24, 1976.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
MOTION: Schletty made motion, seconded by Smith to approve the
Utility Claims of June 24, 1976.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
5.0 PETITIONS. REQUESTS. COMMUNICATION AND LICENSES
5.1 MINING PERMIT - FISCHER
MOTION: Smith made motion, seconded by Schletty, to approve the
mining permit for Fischer Construction Company on Irish
Avenue with the same conditions as stipulated in the pre-
vious permit, until June 30, 1977.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
MINING PERMIT - BARTON
MOTION: Smith made motion, seconded by Schletty to approve the
renewal of the mining permit for Barton Contracting Com-
pany for removal of the existing stockpile at 8124 North
147th Street, until June 30, 1977.
VOTING FOR: Lease, Leroux, Schletty and Smith

MINING PERMIT - INDYKIEWICZ
Indykiewicz said ditch has been lowered so there is only about one
foot of water there now - needs another year to put the property
into good shape. Kuusisto said operator has indicated his plans
to him - some time limit shoud be set for completion of these plans -
Kuusisto would like to see water holes filled as soon as possible
as they could present a problem. Lease would like to give him three
or four months to see what could be done in that time to remedy
the situation that exists now.
MOTION: Lease made motion, seconded by Smith to renew the Indykiewicz
minimg permit until June 30, 1977 subject to the recommen-
dation of the Planning Commission to increase the inspec-
tion fee to $200.00 and also subject to a report by the
City Engineer by October 4, 1977 regarding filling of the
water holes and progress of his proposed plans.
VOTING FOR: Lease, Leroux, Schletty and Smith.

5.2 DEAN JOHNSON - VARIANCE APPLICATION
MOTION: Lease made motion, seconded by Smith to dismiss the var-
iance application requested by Dean Johnson with no action.
Applicant will comply with City Code.
VOTING FOR: Leas::, Leroux, Schletty and Smith.

66 5.3 JERRY MOE - EXTENSION OF TIME ON PLAT
applicant has made informal request for time extension. Preliminary
plat accepted on January 19, 1976. Applicant has not yet followed
up with formal request.
MOTION: Lease made motion, seconded by Schletty, to extend the
time limit on Jerry Moe's pre-liminary plat approval
until August 2, 1976.
VOTING FOR: Lease, Leroux and Schletty.
VOTING AGAINST: Smith.
MOTION CARRIED
5.4 F. HOVALD - REIMBURSEMENT ON SEWER INSTALLATION
MOTION: Leroux made motion, Schletty seconded, to table the matter
of the Frank Hovald reimbursement matter until the meeting
of July 6, 1976.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
NEIL PELTIER - REFUND ON COMPLIANCE MONEY
MOTION: Lease made motion, seconded by Smith, to refund the $500
bond payment, but property owner is responsible for any
future correction of flooding problems relating to his
project.
VOTING FOR: Lease, Leroux, and Smith.
VOTING AGAINST: Schletty.
MOTION CARRIED
5.6 WILLIAM GREGER - APPOINTMENT TO PLANNING COMMISSION
MOTION: Lease made motion, seconded by Schletty to approve the
appointment of William Greger, 12164 Everton Avenue North,
to fill the remainder of the unexpired term of Harley
Johnson on the Hugo Planning Commission, effecttive immed-
iately.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
6.0 ORDINANCES AND RESOLUTIONS
6.1 AMENDMENT TO CHAPTER 320 - ADD RETAIL MOTOR VEHICLE SALES
MOTION: Lease made motion, seconded by Smith to amend Chapter
320 of the Hugo City Code entitled Zoning in Sec. 320-4,
Subdivision K, regulations for Concentrated Business
District, Sub-paragraph 3 titled "Special Uses' to in-
clude Retail Motor Vehicles Sales and Service, subject
to a special use permit.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
7.0 UNFINISHED BUSINESS
7.1 R. VAIL RE: DRAINAGE AND BLACKTOPPING OF HYDE AVENUE
Vail reported dam is in on north end of pond - will build dam on
south side after diseased trees are burned - PCA will give him
permit to dig hole to burn diseased trees on site and then cover
over. Plans to blacktop this fall after the trees are cover over.
Plans to blacktop this fall after the trees are removed - before
frost sets in. Permit to burn trees expires August 1 , 1976. Bond
expires on October 15, 1976.
7.2 V. PELOQUIN RE: CHURCH STREET
Peloquin reported Surveyor Kurth has provided him with updated
survey - necessary deeds to correct the situation will be presented
to City Attorney - Peloquin informed deed mut be stamped by city
clerk before registration by Washington County .
7.3 J. HUSNIK RE: INDUSTRIAL PARK
Husnik informed his plans must be consistent with the original plan
for the industrial park.

8.0 NEW BUSINESS
8.1 APPROVAL OF C.E.T.A. TIME EXTENSION
MOTION: Lease made motion, seconded by Leroux, to approve the ex-
tension of C.E.T.A. employees George Koland, maintenance
man and James Fure, Patrolman, through September 30, 1976.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
J. HUSNIK. 14070 FLAY AVE. REQUESTING APPROVAL FOR WATER LINE
MOTION: Lease made motion, seconded by Schletty, to approve the
application for water hook up at 14070 Flay Avenue, made
by J. Husnik.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
SUNSET LAKE
Lease presented copies of Rules and Regulations regarding pollution
of Sunset Lake to Council members for their study - Schletty re-
ported had contacted property owners regarding purchasing property
for relocation of septic systems for residents who don't own enough
land to remedy their own pollution problems.
MOBILE HOME PERMIT - JOSEPH ZASPEL
MOTION: Leroux made motion, seconded by Smith, to renew the mobile
home permit for Joseph Zaspel, 17205 Forest Blvd. N. ,
Hugo, Minnesota, under Chapter 40, Article III, Subdivision
D, for ninety days.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
MOBILE HOME PERMIT - JOSEPH GREGOIRE
MOTION: Smith made motion, seconded by Leroux, to deny the applica-
tion of Joseph Gregoire for renewal of a mobile home permit
under Chapter 40, Article III, Subdivision D.
VOTING FOR: Smith and Leroux.
VOTING AGAINST: Lease
ABSTAINED: Schletty.
MOTION FAILED
MOTION: Leroux made motion, seconded by Schletty, to approve re-
newal of a mobile home permit for Joseph Gregoire for ninety
days under Chapter 40, Article III, Subdivision D.
VOTING FOR: Lease
VOTING AGAINST: Leroux and Smith
ABSTAINED: Schletty.
MOTION FAILED
MOTION: Lease made motion, seconded by Smith, to have clerk write
a letter to Joseph Gregoire informing him that his request
for extension of his mobile home permit has been denied,
and that he has sixty days to remove the trailer from the
premises. City code allows mobile home permits in cases
of hardship only; Council doesn't feel this is a true
hardship.
VOTING FOR: Lease, Leroux, Schletty and Smith.
MOTION CARRIED
MOTION: Lease made motion, seconded by Smith, to adjourn the meeting
at 10:10 P.M.
