PRESENT: Lease, LaValle and Leroux ABSENT: Schletty and Smith. 3.0 APPROVAL OF MINUTES MOTION: Lease made motion, seconded by Leroux, to approve the minutes of the June 24, 1976 meeting after changing John Jackson to James Fure on page 4 and changing the word extension to hook-up regarding Husnik on page 4. VOTING FOR: Lease, LaValle and Leroux. MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to approve the minutes of the special meeting of June 30, 1976. VOTING FOR: Lease, LaValle and Leroux. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: LaValle made motion, seconded by Leroux, to approve the General Claims of July 6, 1976 after deleting Item #4 - Washington County Highway Department - which will be approved at a later date, and changing Item 16 to read $240.00 in- stead of $280.00. VOTING FOR: Lease, LaValle and Leroux. MOTION CARRIED MOTION: Lease made motion, seconded by Leroux, to approve the Utility Claims of July 6, 1976. VOTING FOR: Lease, LaValle, and Leroux. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS AND LICENSES MOBILE HOME PERMIT RENEWAL - ROBERT MCCLOUD MOTION: Lease made motion, seconded by LaValle, to approve the application of Robert McCloud for renewal of a mobile home permit for ninety days, under Chapter 40, Article III, Subdivision D. VOTING FOR: Lease, LaValle, and Leroux. MOTION CARRIED MOBILE HOME PERMIT RENEWAL RECONSIDERATION - JOSEPH GREGOIRE Gregoire stated he thought it was agreed upon that he had a year to have a trailer on his property - then review would be made - has installed a new septic system, telephone and electric - in view of expenses feels it is unreasonable to deny renewal after ninety days. Leroux said she didn't attend meeting where approval was first given and didn't realize it was with the understanding that it would be reviewed in one year. Mayor Lease stated there is no guarantee that a mobile home can remain on property for an indefenite period of time, that is why there is a renewal every ninety days for an evaluation of present conditions. MOTION: Leroux made motion, seconded by Lease, for reconsideration of denial of the mobile home permit renewal for Joseph Gregoire that was passed on June 24, 1976, as she was one of the persons voting for the denial. VOTING FOR: Lease, LaValle, and Leroux. MOTION CARRIED MOTION: Lease made motion, seconded by LaValle, to approve the renewal of the mobile home permit for Joseph Gregoire, under Chapter 40, Article III, Subdivision D, for ninety days. VOTING FOR: Lease, LaValle, and Leroux. MOTION CARRIED to 1.0 ORDINANCES AND RESOLUTIONS Off, 6.1 ORDINANCE COMMITTEE No . report. 6.2 PLANNING COMMISSION Leroux reported the Planning Commission is still short one member. 6.3 BUILDING IASPECTOR Presented report - asked for clarification regarding Agricultural zoning - reports people residing on ten acre tracts feel they are exempt from needing building permits - says it is his opinion that they are not agricultural simply because they have either a pony or a horse - Council agreed stating that they are not exempt unless they are earning their livlehood on the premises through an agricultural endeavor. 6.4 FIRE CHIEF No report. 6.5 POLICE CHIEF MOTION: Lease made motion, seconded by LaValle, to accept the monthly police report. VOTING FOR: Lease, LaValle, and Leroux. MOTION CARRIED 6.6 ATTORNEY HORTON - bond has been received - case can now be dismissed. Shepherd of the Fields Church - Deed is now acceptable - Possession of deed to roadway easement has not been received yet so there is no access to property at this time - has been reviewed with the church's attorney and they are aware of it. Septic System Ordinance - has not reviewed yet. Dennis Burdick - LaValle questioned whether the body shop was grand- fathered in. Lease said he told Burdick it was not. 6.7 ENGINEER Evergreen Hills 2nd & 3rd Plat - Vail told Engineer he had done considerable work regarding drainage and ponding, and was supposed to get designs and structures to turn in to Rice Creek Watershed District. Regarding road surfacing - $15,000.00 bond is in effect until October 15th. Lease asked Engineer to obtain measurements and estimate the blacktopping job. 6.8 CLERK A&W ROOT BEER - Last year wefe told to try to obtain drainage easement between the two property lines - at this time are having no trouble with dry well - Council feels they will not be able to obtain easement alternative would be to get a ditch system going over to 148th Street. LaValle felt bond should be released. Clerk requested to send them letter requesting them to renew their bond through January 1 , 1977. At that time, the Council will be in a better position to take the matter of elimination of the bond under advisement. Unemployment benefits - Clerk stated that cities do not pay into unemployment funds so when a city employee files a claim for benefits and the total claim is paid out, the city must re-imburse the state. A former police department part-time employee was paid $1 ,575.00 and the city has now been asked to re-imburse. MOTION: :!:laValle made motion, seconded by Leroux, to notify the Minnesota Department of Employment Services that the City of Hugo did not anticipate this expense and did not budget for it. Inform them he was a part-time employee and ascertain whether he was qualified to obtain unemployment compensation, and if so, ask if there are any emergency funds available. VOTING FOR: LaValle and Leroux. VOTING AGAINST: Lease. MOTION CARRIED 7.0 ORDINANCES AND RESOLUTIONS 7 f 8.0 UNFINISHED BUSINESS 1 8.1 148th Street Water Extension - LaValle said church wants 12" water tap - Engineer said saddle will have to be used. Attorney said until the street and utility easement is established, no decision can be made. LaValle feels water should be dug in to the property line and then stop. Kuusisto said the distance is about 165 feet and would cost approximately $10 per foot. Lease and LaValle said possibly a public hearing should be held to find out what the people want. Attorney said when the proper deeds for the road easement are received, then we can proceed with putting in the water. LaValle asked if it could be done on an assessment basis. Kuusisto said that up to this time, this type of arrangement has not been made - the developer must pay the entire amount upon installation. Lease said city will pay up to $2,200.00 and church must pay the balance. Kuusisto suggested bids. Lease said bids would be called for as soon as the street matter is straightened out. Axin Products. Inc. - George Nixa, a building material wholesaler, appeared. He is preparing to purchase property in the Bald Eagle Industrial Park; it is a residual parcel - the north part of Lot 3, Block 2. He plans on using the property for distrubutorship of his business - warehouse, showroom and possibly some assembling. He plans on remodeling the interior and fixing up the exterior. Building inspector informed him any remodeling has to be approved by the Council since it is in an industrial district. Nixa told to present a site plan, giving legal description of property - showing buildings, parking lot and drainage plan. Nixa said some filling will be necessary on the property. Applicant to meet with City Engineer regarding filling and drainage plan. Applicant told he will not need Special Use Permit - it is accepted use in that district. Sunset Lake - Several residents appeared with questions regarding pollution resolution proposed by City. Council stated this is just first draft and was sent to Rice Creek Watershed for review and comments. Resident asked why eight years ago drain-field could be built only four feet from the lake - Lease said there was no building code eight years ago. LaValle said he doesn' t feel there is anyone on that lake that isn't contributing to the pollution problem - some contribute more than others. Lease said people on the east and north sides of the lake are the primary contributors. PCA will OK the systems on the west side of the lake temporarily. Crever said there are several people who don't own enough land to solve their problems by themselves. Lease said the city is looking into buying available land to buy to use for their septic systems. Resident asked if it was OK to start repairing their systems. Lease said that new systems should not be installed until an agreement is reached with Rice Creek Watershed District regarding requirements. Crever asked if it would be necessary to do perc tests on every lot - Lease said yes, except for those lots that are too small to put a new system on. 9.0 NEW BUSINESS 9.1 CLERK'S SALARY REVIEW MOTION: Lease made motion, seconded by LaValle, to increase the clerk's salary from $800.00 per month to $875.00 per month, effective July 1 , 1976. VOTING FOR: Lease, LaValle and Leroux MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to increase the salary of the clerk's secretary from $3.00 to $3.25 per hour, effective July 1st, 1976. wr OpLY 6, 1976 4 VOTING FOR: Lease, LaValle, and Leroux. MOTION CARRIED MOTION: LaValle made motion, seconded by Leroux, to appoint Mary Jane Babcock as Deputy Clerk, effective immediately. VOTING FOR: Lease, LaValle and Leroux.
