PRESENT: Lease, Smith, Schletty, LaValle, and Leroux 3.0 APPROVAL OF MINUTES Page 3 - Vern Peloquin will not take care of the snowplowing. City will take care of snowplowing. MOTION: Lease made motion, seconded by Schletty, to approve minutes of the October 18, 1976 meeting with the above change. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MCTION CARRIED 4.0 APPROVAL OF GENERAL CLAIMS Leroux made motion, seconded by Schletty, to approve the general claims as presented. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED APPROVAL OF UTILITY CLAIMS Leroux made motion, seconded by LaValle, to approve the utility claims as presented. Also approved LaValle Excavating claim final payment of $583.92, Watermain Improvement 75-2. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES Lease made motion, seconded by LaValle, to grant a license for the collection of garbage and rubbish to Bellaire Sanitation for a fee of $50.00 under Chapter 120 of the Hugo City Code. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED OFF SALE LICENSES MOTION: LaValle made motion, seconded by Leroux, to approve the Off Sale Intoxicating Liquor to Eugene Peltier, Countryside Center, 17205 Forest Blvd. , Hugo. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED MOTION: Smith made motion, seconded by Schletty, to approve the Off Sale Intoxicating Liquor license to Robert Ricci, Ricci's Saloon, 14777 N. Forest Blvd. , Hugo. VCTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED MOTION: Lease made motion, seconded by Schletty, to approve the Off Sale Intoxicating Liquor license to Nick Nitti, Traeger's, 13891 N. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED Clerk instructed to contact Mr. Stan Lynn, Withrow Junction, in regards to his late payment of his liquor license renewal. 6.0 REPORT OF OFFICERS AND COPM9MITTEES 6.1 Ordinance Committee - No discussion 6.2 Planning Commission - No discussion 6.3 Water Superintendent - No discussion 6.4 Sewer Committee - No discussion " 18 6.5 Building Inspector - submitted his written report. 6.6 Fire Chief - no discussion. 6.7 Police Chief - A letter received from Mr. Gressman was read in regards to his demand for what he considers back wages. A Police Chief Bob Barth was read stating that vol- unteer time was agreed at the time of his hiring. All wages have been paid for claims submitted. No action taken at this time. 6.8 Attorney - Charles Johnson submitted 1 -;s written report. Mr. Johnson stated he needs a legal description for the rezoning of LaBelle and Tom LaCasse. The drainage easement for Sunset Lake has been sent to Schletty. Th3 road proposed by Manuel Peloquin was reviewed. LaValle suggested that Mr. Johnson write a letter to Peloquin's attorney in regards to : 1 - the tempory cul-de-sac, 2 - the mortgage companies to sign off, 3 - clarification of legal description of the property, and 4- need a variance for road length. The claim of MarY Ouimet of 3700.00 for damages because of fallen tree was turned downed in 1975. At this time, no insuranceclaims are being processed. Mr. Johnson instructed to send a letter to her attorney. The Minnesota Department of Taxation sent a letter regarding the possible change in liquor ordinance stating that all real estate taxes would have to be paid before license could be renewed. This is one way to assure taxes get paid. Ordiance committee to review. Mr. Johnson stated that there is some scheduling problems with city court cases. More people are now pleading not guilty. They are trying to have the judge schedule cases limiting the amount of time spent going to and from. Fire Chief Mr. Jim Olson presented a mutual aid agreement with the city of Forest Lake. Council questioned Hugo's liability. Agreement submitted to attorney Johnsonfor his reviewal. Mr. Olson also stated that the Fire Department needed new equipment. Some of the 21" hose needs replacement . Requested 200' of 4" light weight hose at $348.00 per 100' length, one 12" nozzle at $161 .46, and two couplings at $50.00 +each. The _are Department has approx- imately $2,000.00 left in their budget. MOTION. Lease made motion, seconded by Schletty, to approve the purchase by the Hugo Fire Department of 200' of 4" hose at $696.00, one nozzle (12") at $161 .46, and two couplings at $50.00 each. Total cost to be $957.46. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED 6.9 Engineer - submitted his written report. Mr. Ken Tschida called regarding his addition on Egg Lake Road. He would like NSP to run a gas main through. The city would not want gas main on the south side until sewer and water are in. Mr. Kuusisto received a call from Aquarius Plumbing in regards to the connecting of Advanced Fiberglass. They were advised to first make locations known before any work started. The attorney has submitted the easements for Sunset Lake. Kuusisto has not heard from Rice Creek Watershed 5.n regards to drainage problem of Sunset Lake. Engineer instructed to contact Rice Creek. NOVEMBER 1 , 1976 119 7.0 Clerk - Washington County CETA held up until November 8, 1976. The city has until January 1 , 1977, to make any ward boundary changes, thereafter, changes in precinct boundaries can be made only after the general election in November and before January 1 , 1977. No changes in precinct boundaries may be made from January 1 , 1977, to January 1 , 1982, except by annexation. In effect, precinct lines are frozen for a period of five years. Possible boundary changes tabled until November 15, 1976. In 1966, Lars Danielson handed an easement on Homestead Avenue to Washington County. The new property owners would now like to have the easement vacated. City attorney, Mr. Johnson, instructed to write a letter to their attorney to follow up on the cost of the vacating proceedings, and have a more accurate description of property in question. Also, Mr. Johnson to inquire about a Street Vacation Petition. City received a letter from the office of the Secretary of the Treasury informing the city that they will be administering an anti-recession assestance. In order to be eligible for payment, the local government must file a statement of assurances with the Office of Revenue Sharing. The clerk has submitted the statement. 7.0 ORDINANCES AND RESOLUTIONS 8.0 UNFINISHED BUSINESS 8.1 Dennis Burdick - Special Use Permit Mr. Burdick's partner was in attendance to represent Mr. Burdick. A performance bond has been filed with Beukle Insurance for $2,000.00 payable to the City of Hugo, to insure the completion of blacktopping. Bond will be delivered to City Hall as soon as completed. Councilman Schletty went on record that he would like to see setback at 5' . MOTION: Lease made motion, seconded by Smith, to approve the Special Use Permit for Dennis Burdick subject to the following: 1 . That a performance bond be posted with the city in the amount of $2,000.00 to insure the comple- tion of blacktopping. Work to be completed by July 1 , 1977. 2. That the site plan as submitted be adhered to with the proposed eleven foot entrance being constructed on the south side of the existing changeable message sign. 3. That the parking area as displayed on the plan on which cars for sale are to be parked is to be black- topped eighty feet back from the property line. 4. That there will be no cars parked in front of the northwest overhead door. 5. That all automobiles on display be a distance of 2' from the sidewalk. 6. That where permissible restraining bumpers shall be installed. VOTING FOR: Lease, Smith, LaValle, and Leroux ABSTAINED: Schletty MOTION CARRIED 8.2 John Tschida - Re: Drainage and Parkin, The lot in fenced area will be graded. Kuusisto said the problem of drainage was between the buildings. Mr. Tschida will fill the north area of the east building and fill and landscape between buildings for natural runoff. He will consult with someone to find 1 20 out exactly what is needed. The front of the building will be land- ll scaped so there will be no parking there. Mr. Kuusisto said the SAC and rec charge will have to be determined at a later date. Aquarius Plumbing will have to be bonded with the city. Mr. Tschida was in- structed to submit his drainage plan to city engineer, Howard Kuusisto, for his reviewal. 8.3 Jim Brevig - Re: Vail Dumping Councilman LaValle checked area in question and stated that there is dumping being done improperly. No permit had been issued to Vail for the dumping. Mr. Brevig stated part of the dumping is being done on his property, and people are now using as a road. Councilman LaValle said the easement would have to be found and some form of barriers erected. The easement will still be owned by Brevig, but the city would have to notify him of any action that would be taken. Tom Fast and Marvin LaValle will check on easement. 9.0 MISCELLANEOUS Howard Kuusisto's engineering bill for work on Shepherd of the Fields was broken down into what was owed by the city, Vern Peloquin, and Shepherd of the Fields. City - $98.00 Peloquin - $506.00 Shepherd of the Fields - $1 ,055.35 Mr. Kuusisto will sumit an adjusted invoice to clarify payments due. Councilman LaValle stated that the city will have to absorb some costs, because we did commit ourselves. Schletty noted that there is a car parked on Ingersoll Avenue in front of Joe Card's house that has been there for some time. Clerk instructed to notify police. Schletty will contact principal of Hugo Elementary School in regards to the stop sign at Foxhill and 148th. Children are evidently crossing without any protection. PMMOTION: Lease made motion, seconded by LaValle, to call a special meeting on November 4, 1976, for the Canvas Board.
