PRESENT: Lease, Smith, Schletty, LaValle, and Leroux 3.0 APPROVAL OF MINUTES MOTION: Lease made motion, seconded by Leroux, to approve the minutes of November 15, 1976 as presented. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED Motion: Lease made motion, seconded by Schletty, to approve the minutes of November 22, 1976, after changing the wording in Ward III to read - north on Illies to 125th, then west to Hilo. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Schletty made motion, seconded by Smith, to approve the payment of claims of December 7, 1976, as presented. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED APPROVAL OF UTILITY CLAIMS MOTION: LaValle made motion, seconded by Leroux, to approve the Utility Claims of December 7, 1976 as presented. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTIOT CARRIED 5.0 PETITIONS. REQUEST. COMMUNICATIONS & LICENSES MOTION: Lease made motion, seconded by LaValle that the following license be issued to Interstate Lumber Company: Soft drink in the amount of $5.00. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED MOTION: Schletty made motion, seconded by Lease, that the following licenses be issued to COUNTRYSIDE CENTER: On Sale Intoxicating Liquor, On Sale Sunday Liquor, Cigarette, and Soft Drink in the amount of $1717.00. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED MOTION: Leroux made motion, seconded by LaValle, that the following licenses be issued to CARPENTER'S: On Sale Intoxicating Liquor, On Sale Sunday Liquor, Cigarettes, Soft Drink, Pool Table, and Off Sale Non-Intoxicating in the amount of $1747.00. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED MOTION: Smith made motion, seconded by Schletty, that the following licenses be issued to RICCI's: On Sale Intoxicating Liquor, On Sale Sunday Liquor, Cigatettes, Soft Drink, and Pool Table in the amount to $1722.00 VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED MOTION: Lease made motion, seconded by Smith, that the following licenses be issued to GRANGER'S DX: Soft Drink and Cigarettes in the amount of $17.00. VOTING FOR: Lease, Smith, Schietty, LaValle, and Leroux MOTION CARRIED The license approval of TRAEGER'S and Stan Lynn's WITHROW JUNCTION was tabled until the City Council meeting of December 20, All their papers were not in order. Due to a typographical error, CARPENTER'S should be reimbursed $10.00 The pool table license is $5.00 and not $15.00 as stated. 5.2 BILL HAYS - MOBILE HOME PETITION Mr. Hays did not appear again. A building permit has been issued to Mr. Hays for a dwelling and a pole barn, however, he rias failed to appear before the council for the Mobile Home Permit. Tabled (Dec. 20) . 5.3 LITTLE LAMB'S PRESCHOOL - SPECIAL USE PERMIT Jim Olson, Hugo Fire Chief, and the state fire marshall have gone through the building. However, at the time of the City Council, Mr. Olson had failed to submit a written report with his approval or denial. Mrs. June Smith stated that most day care centers in Washington County had a maximum number of 29 children, and an unlimited number of teachers or volunteers. She stated that if number held at 26, 916 Vo-Tech would not be able to send students there for training. LaValle agrees that instructors should not be included just go by the number of children. MOTION: Lease made motion, seconded by Smith, to approve the Special Use Permit for Little Lamb's Preschool at Shepherd of the Fields Church with the following limitations: 1 . Maximum number of chilren not to exceed 29. 2. Preschool to meet the fire codes for the City of Hugo and the State of Minnesota. VOTING FOR: Lease, Smith, Schietty, LaValle, and Leroux. MOTION CARRIED 5.5 JOSEPH GREGOIRE - RENEW MOBILE HOME PERMIT MOTION: Lease made motion, seconded by LaValle, to approve the renewal of the Mobile Home Permit for Joseph Gregoire for a period of 3 months, under Chapter 40, Article III, Subdivision D. VOTING FOR: Lease, Smith, Schietty, LaValle, and Leroux. MOTION CARRIED .5.4 GEORGE JUNGBLUT - PRELIMINARY PLAN (SUBDIVISION) Mr. Jungblut and Mr. Stanley presented a revised preliminary plan for the council's reviewal. City Engineer, Howard Kuusisto, summarized his written report as presented to the Planning Commission. Lease recommended to Mr. Jungblut to check with Rice Creek in regards to his subdivision. MOTION: Lease made motion, seconded by LaValle, to approve the Preliminary Plan for subdivision as submitted by George Jungblut, subject to the following: 1 . That Outlots C andJ shall be left in unimproved state until Outlots H and I are developed, at which time Outlot J shall be improved to appro- priate road standards, and Outlot C shall be so improved as to provide only walking access to the Lake. 2. Additional surface drainage and utility easement should be shown on back lot, Blocks 1 and 2. 3. Proof of ownership. 1 9 4. Restrictive covenants �7 5. Outlot lines for Outlot J should be corrected to show that Outlot J will extend to the east line then 30 feet wide running north to the north line, and 30' running south to the south line. 6. Park land dedication will be paid in the amount to be determined by the City Council. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux. MOTION CARRIED 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee LaValle requested that clerk get a copy of Forest Lake's ordinance in regards to parking during snow emergency. 6.2 Planning Commission After the year, there will be vacancies in the Planning Commission. LaValle stated that a Mr. Larry funk is interested in applying for membership to the Planning Commission. He should be instructed to attend the meeting of Wednesday, December 8. 6.3 Water Superintendent - No discussion 6.4 Sewer Committee Marvin LaValle to meet with Metro Waste Control Commission in regards to our bill for 1977. 6.5 Building Inspector Mr. Crever submitted written report. EPA located in the Bald Eagle Industrial Park, contacted Mr. Crever stating that Mr. Ken Tschida has not fulfilled the contract with them. LaValle instructed Mr. Crever to investigate the situation and report to the City Council. 6.6 Fire Chief - No discussion 6.7 Police Chief Police Chief Robert Barth applied for vacation, dated to include December 23, 27, 28, 29, and 30 to be deducted from annual earned vacation. City Council has no objection. 6.8 Attorney Mr. Johnson submitted his written report. The Manuel Peloquin road is now ready for reprocessing. Mr. Johnson reviewed the mutual aid agreement with Forest Lake. Should have matter ready for next meeting. MOTION: LaValle made motion, seconded by Lease, that 177th Street from Greystone to Highway 61 be taken over for winter maintenance. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED 6.9 Engineer Jim Muggs' bond for $10,000.00 can be reduced at this time. A letter should be sent to Mr. Muggs to have him post a bond in the amount of $2,000.00 to protect the city during the construction stage of the homes. MOTION: LaValle made motion, seconded by Lease, to send letter to Jim Muggs requesting a $2,000.00 bond for 1977 for 177th Street to protect the city during the construction stage of the homes. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED 7.0 Clerk There will be a meeting with Shafer Construction at 10:00 AM, Dacember 7, at City Hall to finalize the road project. A letter from Al Ebeling, Hugo Fire Department, was read regarding the fire siren. They made a motion recommending that the City Council make the decision as to if one of the soundings should be eliminated. They stated that the alarm has to be sounded at least once a day. DECEMBER 6, 1976 3 ti 3 MOTION: LaValle made motion, seconded by Leraux, that emergency alarm should continue to be sounded at 12 :00 noon and 10:00 P.M. VOTING FOR: Lease, Leroux, and LaValle AGAINST: Smith and Schletty MOTION CARRIED Recess 9:28 Reconvened 9:43 MOTION: LaValle made motion, seconded by Leroux, to give authority to George Koland to remodel clerk's office at a cost of $200.00. VOTING FOR: Lease, Smith, Schletty, LaValle, and Leroux MOTION CARRIED An unemployment claim in the amunt of $1969.00 was received for Mr. Lelle. If city is liable, we have to pay it. Money to come from police budget. Irene Leroux requested that city clerk send a letter to Metropolitan Council (Mr. John Boland) stating that the new Public Works 13-j _huotE will have no effect on the City of Hugo. Vail blacktopping bond is to be release. Bonding company to be notified. 8.0 Unfinished Business 8.1 Vail removing dike on Brevig Property Mr. Richard Vail appeared and stated that he put the dike in per instruction from the Rice Creek Water Shed. He stated he has no intention of removing the dike. LaValle stated the dike should be on the easement and not on private property. City is aware of problem: Rice Creek has nothing on file as far as issuing a permit for in— stallation of the dike. It would not be economical to move the dike at this time. Vail — If the government told me where to put the dike, they should remove it. LaValle — The dike is now being used as a road. Lease — asked City Attorney, Mr. Johnson, what to do now. Johnson — If the dike is on private property, it is a matter between the property owner and the developer. The city could block the right—of—way from being used as a road. Kuusisto — Matter was discussed by the City Council. Council was to make suggestions to Rice Creek. Johnson —One alternative would be to negotiate with land owner to m've easement. LaValle — Will check further in our minutes, and with Rice Creek. Nothing can be done now. Brevig — would like to sell back two acres of property. The dike has defaced and devalued the back property. Lost rental in my garage, and encourages snowmobiling. Brought this matter up three months ago, and nothing has been done since. c ase — I would like to table this matter until we look at our 10A-cords and check with McClellan at Rice Creek. Lease — your biggest problem selling the two acres will not be with the drainage but with our Comprehensive Plan. LaValle — The city can put a snow fence across the dike. Brevig — How long can I anticitpate this matter will be tabled? Lease — Not until we can check with all sources. We cannot do anything this winter. Hopefully, everything will be negotiated this spring. 10.0 Miscellaneous Vern Peloquin's letter of credit expires December 31 , 1976. Mr. Peloquin stated he was not responsible for whole road. Shepherd of the Fields liable for half. Bond is for $7500.00 and would not cover blacktopping. Mr. Peloquin will attend the December 20th meeting with Church representatives. Mr. James Husnik presented plans for road approval in Peloquin Industrial Park. Kuusisto stated the plan looks good, but he has not as yet inspected. Mr. Husnik to supply a deed for easement and drainage, and a dedication of the road. Copies of which to go to Howard Kuusisto and Charles Johnson.
