PRESENT: LaValle, Schletty, Spitzer, Irsfeld, and Vail. 3.0 APPROVAL OF MINUTES Page 4 — motion stating Item 3 of original motion was lost is incorrect. Should read as follows: MOTION — Spitzer made motion, seconded by Schletty, that the Planning Commission give serious research and consideration to the inclusion of commercial — recreational activities as otherwise defined in the ordinance as permitted special uses in the Agricultural Districts. All voting in favor. MOTION CARRIED, MOTION: Spitzer made motion, seconded by Schletty, to approve the minutes of January 179 1977 with the above correction. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED APPROVAL OF MINUTE'S — JANUARY 31, 1977 The bottom of Page 1 — motion incorrect. MOTION: Spitzer made motion, seconded by Irsfeld, to accept the general receipts for 1976 noting that a 100; audit was not performed. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the minutes of January 319 1977, with the above correction. VOTING FOR: LaValle, Schletty, Spitzer Irsfeld, and Vail. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by LaValle, to approve the general claims of February 79 1977 as presented. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to approve the utility claims of Februraxy 7, 1977 as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail to approve the utility supple— mental claims of the Frozen Water Tower Project as presented. MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 5.1 Joseph Zaspel — Mobile Home Renewal MOTION: LaValle made motion, seconded by Spitzer, to renew the mobile home permit for Joseph Zaspel, 17205 Forest Blvd, N., Hugo, under Chapter 40, Article III, Subdivision D, for 90 days. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED 5.2 James Johnson — Mobile Home Renewal Mr. Johnson was asked to present a statement from his Doctor stating his inability to do heavy work, which he did do. MOTION: Spitzer made motion, seconded by LaValle, to renew the mobile home permit for James Johnson, 7194 — 132nd Street, under Chapter 409 Article III, Subdivision D. for 90 days. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED 5.3 Millard Rehbein — Irrigation Permit 1r. Rehbein would like to place an, irrigation well in the middle of his farm land for center pivot irrigation. Well to have 12" casing. Mr. Rehbein will will have to get City approval, Rice Creek Watershed approval, and DNR approval. Permit will last only one year. Mayor LaValle received a letter from John Boland stating the Mayor will be receiving a metropolitan "systems statement" from the Metropolitan Council. This statement is a necessary first step in the implementation of the Metro— politan Land Planning Act of 1976, and they would like the community to de— signate a contact person with whom they can work in connection with this process. Councilman Larry Irsfeld was designated as this person. Mayor LaValle received a letter from Charles Swanson, County Engineer. re— garding a study on solid waste disposal sites in Washington County. City Clerk, Carol Idilliams, was instructed to make copies of the letter for the Planning Commission to review. The League of Minnesota Cities sent a letter to the City of Hugo stating that there will be a mid-session Legislative Conference to be held at the Permanent Collection Gallery of the Minnesota Museum of art. LaValle stated that any- one who is interested in going, should attend. The League of Municipalities gives an awzxd for outstanding service to a community. LaValle felt that 'Water Superintendent, Mr, Robert Burkard, would be an excellent candidate. Councilman Deane Vail was instructed to fill out form for completion. Mayor LaValle expressed his thanks to Howard Kuusisto, City Engineer, for all his help in working on the frozen water tower. MOTION: Spitzer made motion, seconded by Schletty, that the City Council express its gratitude to those people who helped work on the water tower. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED There will be a msiting in Lino Lakes, February 99 in regards to the Center- ville interceptor. LaValle stated that Hugo was concerned with: (1) that the interceptor should have gone on the right-of-way as first indicated instead of going through Hugo with another easement, (2) there would be no value to Hugo, and (3) interceptor would only be temporary, and Hugo would like to use it at some future date. The fact that we were not notified was not our main concern. MOTION: LaValle made motion, seconded by Spitzer, that the utility claims be amended to include payment to Jim Wisner for 0170.00 for work on the frozen water tower. City Clerk, Carol Williams, and Deputy Clerk, Mary Ann Creager, attend the finance seminar on March 16,17, and 18, 1977. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED Jeanette Charpentier, Police Secretary, will fill in, in the clerk's absence. 6.0 RFPORTS OF OFFICERS & C0141ITTEES .1 Ordinance Committee The Ordinance Committee had a meeting on February 3, 1977, and will meet again on February 28th. They hope to have the ordinances ready by May. The Ordinance Committee would like (1) to have some consensus on what ordinances they would like to have placed before them, and (2) assistance in copying of ordinance drafts and minutes to be administered to members. MOTION: Spitzer made motion, seconded by Vail, that the City Clerk get copies as necessary for the conduct of the Ordinance Committee. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.2 Planning Commission 6.2.1. Amendment to SFU zoning to include apartments Mr. Ronald Granger has a request in to build an apartment on land presently zoned SFU. MOTION: Spitzer made motion, seconded by Schletty, that the Planning Comm- ission be directed to draft an amendment to zoning ordinance to permit apart- ments in SFU by Special Use Permit with appropriate retrictions attached. VOTING FOR:. LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.2.2 Should road easements be considered in calculating mirti.mum lot size? Spitzer stated that it is generally accepted despite easements. Charles Johnson said that town roads are joist considered as easements. Planning Commission member Mike Gillen asked if it would be possible to have a formula for deter- mining acreage. He suggested that Hugo should have something very fine, and not arbitrary. LaValle said he feels matter needs some work and study. Instead of asking for an opinion, the Planning Commission should have drawn up a re- commendation for the council's consideration. MOTION: Spitzer made motion, seconded by Schletty, that the Planning Commission be directed to develop a policy statement in which road easements should be counted as minimum area. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED FEBRUARY 79 1977 1 6,3 Water Superintendent — No discussion, 6.4 Builling Inspector = submitted written report. Mayor LaValle instructed Tom Crever to check in to the recent fire in Evergreen Hills — residence owned by Mr, Daniel Goeltl. There have been problems with fireplaces, and LaValle would like to have the inspector look into it. 6.5 Fire Chief — No discussion. 6.6 Police Chief — Police Chief Barth submitted his written report. No dis— cussion. The Willard Rehbein application for Irrigation Permit was again discussed. Spitzer wanted to know if the permit was reviewed annually by the city. LaValle stated that as far as he knew, they were not. MOTION: LaValle made motiont seconded by Schletty, that the Irrigation Permit for Emerald Groves (Willard Rehbein) be approved with a cover letter included to the Department of Natural Resources that the City of Hugo would like to be notified on a yearly basis so we can approve or disapprove, VOTING FOR: LaValle, Schletty, Spitzer,, Irsfeldt and Vail. MOTION CARRIED 6.7 Attorney Mr, Johnson stated that he still has as open file on some reloning requests that needed corredted legal descriptions. Spitzer will try to clarify the matter with Bill Schwab, The Brevig rezonirko, request was discussed, and Mr, Johnson said the matter should be handled with present zoning ordinance. You cannot go back. The Mutual Aid Agreement with Forest Lake is just sitting because of lack of information from Jim Olson, Fire Chief, The Sunset Lake matter is dormant at this time. Mr. Johnson appeared in Supreme Court in regard to the LaValle ­vs— Bayless ­vs— Hugo. There will be no ruling for a couple of months. 6,8 Engineer Mr. Kuusisto submitted his written report, Zoning maps will be changed as soon as zoning requests are validated. City hall should make zoning changes in red on their map. Recessed 8:33 P.M. Reconvened 8:50 P,M, 6.9 Clerk 6.9.1 Lars Danielson — Vacation of easement There is a request from attorneyp Sarah Mardellt requesting to have the notice published. If the council starts proceedings9 the vacating of easement will have to pass with a 4/5's vote. It is not required to notify the abutting land ownerst but Mr. Johnson would recommend it, Howard Kuusisto showed the easement on an aerial map of the land in question. He stated there is some merit to having contoured streets. He also said it might be a good idea to hold on to part of the easement. The new property owners plan on using a small trail from 132nd to get to their property. As of yet, no soil borings have been submitted. MOTION: Spitzer made motion# seconded by Schletty, to table the Lars Daniel— son matter until the next meetingg February 22, 1977. VOTING FOR: LaValle, Schlettyt Spitzer, Irsfeld, and Vail, MOTION CARRIED City Attorney and Engineer will submit a cost estimate. 6.9.2 Change of salary payments Full time employees that work for the city would like to be paid 26 times a year. Spitzer questioned the legality of the change, Charles Johnson will check out and report at a later date. 6.9.3 Workman's CompensationInsurance The clerk recommended that the city should have Workman's Compensation In— surance covered with the same company that provides all our insurance. The city could receive a dividend returned on all premium payments amounting to 3200 — $300, depending on payment. Spitzer recommended leaving everything 14 the way it is now, and review at the end of the year. The Beulke Insurance Agency now handles Hugo's insurance — the policy running for a period of three years. MOTION: Irsfeld made motion, seconded by Spitzer, that the City of Halo change its Workman's Compensation Insurance to the Beulke Insurance Agency. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED 7.0 ORDINANCES AND RESOLUTIONS — No discussion. 8.0 UNFINISHED BUSINESS 8.1 Appointments to Committee for Metro Council Mayor LaValle is still working on the matter. 8.2 Fire Viewer Councilman Spitzer is working on the matter. 9.0 NEW BUSnQESS 9.1 Change Council MeetDate from Feb 21 to February 22 (February 21 —_ legal l holiday MOTION: LaValle, made motion, seconded by Spitzer, to change the next City Council meeting from February 21 to February 22, 1977, VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED Planning Commission Mike McAllister would like to have copies of the city code book made available for members use on a no charge basis. The book to be returned when their term expires. The clerk stated that the books are printed at a cost of $35.009 and City Hall has to have four copies that are updated. McAllister feels he should not have to come to City Hall every time he would like to look something up. MOTION: Spitzer made motion, seconded by Schletty, that the City Clerk find out what it would cost to print an additional 25 copies of the code book. VOTING FOR: LaValle, Schletty, Spitzer, Irsfeld, and Vail. MOTION CARRIED MOTION: LaValle, made motion, seconded by Spitzer, to adjourn at 9:24 P.M.
