Minutes for the Planning Commission Meeting of August 27, 2015 <br />Chair, Kleissler called the meeting to order at 7:02 p.m. <br />PRESENT: Arcand, Kleissler, Lessard, Rosenquist <br />ABSENT: Knauss, McRoberts <br />STAFF: Bryan Bear, City Administrator <br />Rachel Leitz, Community Development Assistant <br />Approval of Minutes for the Planning Commission Meeting of July 23, 2015 <br />Commissioner Arcand made a motion, seconded by Commissioner Lessard, to approve minutes for the <br />meeting of July 23, 2015. <br />All Ayes. Motion carried. <br />National Recycling Inc. —15717 Forest Blvd. N. — Zoning Ordinance text amendment and <br />conditional use permit (CUP) amendment <br />City Administrator, Bear, presented on a proposed conditional use permit (CUP) amendment and <br />ordinance text amendment for National Recycling, Inc. He stated that the CUP amendment would have <br />revisions to the original conditions and site plan while the ordinance text amendment is related to the <br />City's standards for recycling centers. <br />Bear stated the use as a scrap yard in the commercial zoning district is a nonconforming use. The City <br />sent a code violation letter to NRI in 2010, which set about a process. The property owner submitted an <br />application for a CUP and it was approved in 2011 for the use of a "recycling center." The site was <br />required to be cleaned up and redeveloped so a site plan was also approved along with the CUP. A <br />timeline and a transition plan were similarly approved, which outlined all of the steps that needed to be <br />completed with a deadline attached. All of this was also dependent on the creation of a second site, <br />which came to fruition in Cambridge. The original idea behind the creation of a second site was that no <br />scrap would touch the ground on the Hugo site because it would be immediately loaded and brought to <br />the Cambridge site where it could be sorted, processed, and shipped out. <br />Bear stated that the City Council received an update on the site on May 18, 2015. Staff presented to the <br />Council that the site was still out of compliance with the approved CUP. The City Council then directed <br />staff to schedule a hearing for possible enforcement action, with direction to bring the site back into <br />compliance with the CUP. The Council held a hearing and took no action and encouraged the applicant <br />to proceed to the Planning Commission with new applications. <br />Bear then discussed the proposed applications, starting with the proposed text amendment. The section <br />of the code related to recycling centers asks for the site to be clean and sanitary, recycled materials to be <br />screened from view, materials to be stored in a building or container with a lid or cover, and for no <br />accumulation of loose material. Bear encouraged the Planning Commission to think back to the site plan <br />that was approved in the original CUP. Through the approval of the original CUP, the Planning <br />Commission believed the site fit the intention of the code for a recycling center. Bear asked the <br />Planning Commission to review the proposed text revisions and stated that the changes allow the City to <br />approve alternatives for storage with a method approved by the City. Bear stated that the applicant <br />would still have to address the visual and noise impacts. Bear then moved onto the proposed CUP <br />
