ABSENT: LaValle 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of February 22, 1977, as presented. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Schletty, to approve the general claims of March 7, 1977, as presented. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Schletty made motion, seconded by Irsfeld, to approve the utility claims of March 7, 1977, as presented. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Tree Inspector 1977 Contract MOTION: Schletty made motion, seconded by Vail, to enter into a contract with Gerald Beach, for the year 1977, contract price of $2400.50 for the control of diseased trees. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.2 Brali}stedt Complaint No action needed by the Council. 6.0 REPORTS OF OFFICERS & COMMITTEES 6.1 Ordinance Committee The Ordinance Committee met February 28, and at that time, worked on the zoning ordinance. Their next meeting is scheduled for March 16, at which time they will work on the subdivision and dog ordinances. 6.2 Planning Commission The Planning Commission meeting of February 23 was cancelled due tothe weather. Their next meeting is scheduled for March 9, 1977. 6.3 Water Superintendedt No discussion. 6.4 Building Inspector Will appear later on in meeting. 6.5 Fire Cheif Jim Olson presented copies of the by—law of the Capitol City Mutual Aid Agree— ment. City Attorney, Charles Johnson, will review and discuss matter with Mr. Olson. Mr. Olson stated that there is a problem in Evergreen Hills with faulty constructed fireplaces. The City Council authorized the purchase of sone fire hose in 1976, but the purchase was never made. Mr. Olson would now like approval to purchase 200' of 4" plastic hose. Acting Mayor, Spitzer, suggested that Mr. Olson take a look at his budget and reconcile it & then come back to the next meeting and make a recommendation for the purchase of hose, show how they are going to stay within the budget. Mr. Olson stated that the purchase of the hose takes toppriority. MOTION: Schletty made motion, seconded by Irsfeld, that the Fire Department be authorized to purchase 200' of 4" hose and couplings, in an amount not to exceed 31000.00 VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED The matter of a fire viewer was discussed. Spitzer has spoken with Mr. Myers Pollution Control Agency, and they are not going to delegate permits to the city at this time, but will work with us. It was suggested that a fee be charged at the original on—site inspection, and a fee for inspection of the site after the fire. The only person Spitzer has spoken to at this time is Mr. Don White. Mayor LaValle has spoken with the Police Department, and they have agreed to make the fire inspections. Mr. Johnson stated that if you are collecting a fee, the city should adopt an ordinance, and set the fee by resolution. 1 8 MOTION: Vail mane motion, seconded by Schietty, to refer the matter of fire viewer to the Ordinance Committee frr the adoption of a fire viewer ordinance. VOTING FOR: Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED 6.6 Police Chief Robert Barth submitted his written report. MOTION: Vail made motion, seconded by Irsfeld, to accept the Police Report as submitted. VOTING FOR: Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schietty, to accept the Fire Chief's Report, as submitted. VOTING FOR: Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED 6.7 Attorney Charles Johnson submitted his written report. Mr. Johnson spoke to Sarah Mardell in regard to the vacation of the easement. Asked her for written agreement stating they will incur the costs of the attorney and engineer. Matter to be placed on the agenda of March 21. MOTION: Vail made motion, seconded by Schietty, to accept the Attorney's report, as submitted. VOTING FOR: Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED 6.8 Engineer Mr. Kuusisto submitted hi:s written report. Hugo has sent the plan they desire concerning the Centerville interceptor, to the Metro Waste Control Commission. The MWCC has chosen to go along the southern route and obtain easements where necessary. MOTION: Irsfeld made motion, seconded by Schietty, to accept the Engineer's report, as submitted. VOTING FOR: Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED 6.4 Building Inspector Mr. Tom Crever submitted his report stating he had checked the fireplace of Mr. Dan Goeltl, 14481 Hyde Avenue North, and stated a fire had taken place because of fault construction. MOTION: Schietty made motion, seconded by Irsfeld to accept the Building Inspector's report and place on file. VOTING FOR: Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED Mr. Jim Vomela, 142621 Hyde Avenue North, stated he would like to have the Building Inspector check on fireplaces built by this contractor. Mr. Spitzer stated that he does not want the city to be put in the middle of a dispute between home owners and the contractor. He also stated that when an inspection is made, every minute detail is not inspected. The Building Inspector does not necessarily have to inspect every detail of every building. Mrs. Goeltl, 14481 Hyde Avenue North, asked Mr. Crever what he thought of their basement fireplace. Mr. Crever said he could not make a judgment be— cause he did not see it constructed. Mr. Jim Ranacier, 14501 Hyde Avenue North, stated he would also like to see an inspection made of the fireplaces built by that certain contractor. Mr. Irsfeld asked Mr. Crever if he would be able to determine if the fireplace was safe, seeing he wasn't there when it was constructed. Mr. Crever replied likely not. Mr. Crever stated that fireplaces are not required inspections. He will try to check on them when they are constructed in the future. Mr. Johnson summarized that the matter was a private one between the home owner and the contractor. There has been a problem of people not applying for plumbing, heating, and well permits. MOTION: Vail made motion, seconded by Schietty, that the City Clerk make a check list for the purpose of applying for building, heating, plumbing, and well permits. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MARCH 7, 1977 RECESSED 9:03 RECONVENED 9:13 19 6.9 Clerk The NSF utility rate will change when new lights are installed along Highway 61. The city will realize a savings of $507.60. MOTION: Schletty made motion, seconded by Irsfeld, to direct the City Clerk to sign the necessary papers for lighting on Highway 61 from fluor— escent to high pressure sodign. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail, MOTION CARRIED Spitzer asked that the City Clerk check on the possibility of installing lighting on County Road 4 and Highway 61. The DNR sent copies of applications submitted by Mr. Jim Carroll and Mr. Bill Greger for the purpose of placing sand along Bald Eagle Lake. Mr. Carroll's application justified the dumping of the sand to allow the lakeshore to be applicable to swimming and boating. Rice Creek Watershed needs the city's approval for this application. MOTION: Schletty made motion, seconded by Irsfeld, that the City of Hugo approve the application 'f Mr. Jim Carroll to place sand on Bald Eagle to use as a beach. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED The application of Bill Greger is refused until the application is fully com— pleted. Mr. Darrell Tavernier applied for licenses to be used at the Lakeview Inn & Marina, 4444 129th Street North. The license fee is in order, and will run from April through December, 1977. MOTION: Schletty made motion, seconded by Vail, that we issue an Off Sale Non—Intoxicating Liquor, On Sale Non—Intoxicating Liquor, Cigarette, and Soft Drink License to Darrell Tavernier, Lakeview Inn & Marina, for a total fee of $104.31. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Mr. George Koland will attend a meeting March 8th in regard to the new CETA program. MOTION: Schletty made motion, seconded by Vail, to accept the clerk's report, as submitted. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.10 Roads Committee They will meet again on March 11, 1977, and hope to have some recommendations to make to the City Coundil. Schletty talked to a representative from CETA regarding the !iring of some part—time men. Applications are to be in by March 15. The men could work for six months with George Koland as foreman. A specific project is required. City would not be liable for unemployment if project ends ahead of time. CETA will allow $100 for tools per city. They would also prefer we hire local people. Schletty stated that help is needed for brush and tree cutting, and have all culverts cleaned and marked. MOTION: Spitzer made motion, seconded by Schletty, that the City of Hugo apply to the CETA program for four additional men for at least six months. VOTING FOR: Spitzer, Schletty, and Irsfeld. VOTING AGAINST: Vail MOTION CARRIED 7.0 ORDINANCES AND RESOLUTIONS MOTION: Spitzer made motion, seconded by Irsfeld, that we adopt Resolution 1977-2, THAT THE NAME OF ROBERT E. BURKARD, WATER SUPERIDIT nDEAT FOR THE CITY OF HUGO, BE SUBMITTED FOR THE HONOR OF RECEIVING THE C. C. LUDWIG AWARD FOR OUTSTANDING SERVICE TO A COMMUNITY THIS BEING IN ACCORDANCE WITH A RECOMMENDATION BY THE CITY COUNCIL OF HUGO AT THE MEETING ON FEBRUARY 7, 1977. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 8.0 UNFINISHED BUSINESS 8.1 Shafer Matter The Shafer-Construction has filed a Notice of Claim for a substantial amount 20 of money. HOWard Kuusisto will check on all unfinished item. Charles Johnson will then consult with Mr. Kuusisto, and talk with Shafer's attorney. The rezoning applications for Myers, Mellinger, Peloquin, and Grace Develop— ment were turned over to Charles Johnson for his reviewal of the legal descrip— tions. If Mr. Johnson is not satisfied, he should call lis. Spitzer, and he will contact Planning at Washington County. There will also have to be changes made on the new zoning map. There is no GB zoning in Hugo. There is no money available from the Highway Department for the construction of bridges in Hugo because of the length. Howard Kuusisto to check with the DNR to see if money is available from them. The City Clerk is to check on the price of printing 25 code books.
