HomeMy WebLinkAbout1977.04.18 CC Minutes :April 18, 1977 Minutes of the Proceedings of the Hugo City Council The meeting was called to order by Mayor LaValle at 7:10 P.M. ruborml: LaValle, Spitzer, Schletty, Irsfeld, and Vail. 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of April 4, 1977, with the following change: Page 5 (9.0 NEW BUSINESS) — should read Howard Schlettv is to check out with NSP and report later. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Schletty, that under claim #12, we include the fee of $203.74 for Michael Jensen. Total of general claims changed to $6835.08. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, to approve the utility claims of April 18, 1977. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTIONS Spitzer made motion, seconded by Irsfeld, that Mr. Barth's request to add Mr. Jensen to the Police Payroll from April 1, 1977 to May 15, 1977, at a rate of $815.00 per month be approved. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED A letter of complaint against W. Riopel from Mr. & Mrs. Gordon Stroman was placed on file. MOTION: Spitzer made motion, seconded by Schletty, that the Stroman complaint be referred to the city attorney for his recommendation. LaValle felt the health officers (Vail and Irsfeld) should look at the situation and make a response. VOTING FOR: Spitzer VOTING AGAINST: LaValle, Schletty, Irsfeld, and Vail. MOTION FAILED MOTION: Schletty made motion, seconded by Irsfeld, that we send our health officers (Irsfeld and Vail) to see what is taking place with the Stroman complaint and report to the City Council. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 JAMES JOHNSON - MOBILE HOME RENEWAL Spitzer felt that Mr. Johnson should submit another prognosis from his doctor indicating Mr. Johnson's liability. He also wanted to know if the permit was to be issued for an indefinite period of time. LaValle stated that the mobile home ordinance reads that the permit has to be appoved every 90 days. MOTION: LaValle made motion, seconded by Vail, to renew the mobile home permit for James Johnson, 7194 - 132nd Street, under Chapter 40, Article III, Subdivision D, for 90 days. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. VOTING AGAINST: Spitzer MOTION CARRIED MOTION: Schletty made motion, seconded by Spitzer, that the City Council investigate the purchase of land by Mr. James Johnson, and the validity of the mobile home permit. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED cl APRIL 18, 1977 J 1 5.2 George Jungblut - Subdivision ' Mr. Roy Stanley represented Mr. Jungblut. He was worried about a possible time proble u as far as getting all the necessary paper work done for the subdivision. MOTION: Spitzer made motion, seconded by LaValle, that the George Jungblut matter be tabled, to refer to the Planning Commission. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Charles Johnson stated that Jungblut has 6 months after the approval of the pre- liminary plan to submit his final' plat. LaValle suggested that Mr. Stanley write a letter regarding the time element, and will take the matter up at the next meeting, May 2, 1977'. 5.3 Jim Olson - Enlargement Mr. Olson presented his plans for a new building in the Peloquin Industrial Park. The building will be rented out to a plastic molding company. Mr. Spitzer suggested that the following be included in the official minutes: crushed limestone to be placed on 30' right-of-way running southerly along east property line running to the south edge of the existing building; thence, westerly approximately 70'. Intention of the applicant that he will put crushed limestone from easterly to west property line for north-south width of 70'. MOTION: Spitzer made motion, seconded by Irsfeld, that Mr. Olsons request be approved, subject to the recommendations of the Planning Commission, as we have the gravel in our current minutes. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS Charles Johnson talked to Mr. Bob Myers of the Pollution Control Agency regarding the fire viewer ordinance. Mr. Myers would like to see a copy of the ordinance before it is adopted by the Council. MOTION: Spitzer made motion, seconded by Schletty, that the fire viewer ordinance be tabled until May 2, 1977, and the City Attorney be instructed to submit a copy to Bob Myers, PCA, for his review. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 7.0 Ui iiul iv BUSINESS 7.1 Bob Barth - Reserve Program Mr. Barth reiterated the procedures to be used for the program. Spitzer asked if it was Barth's intention to keep the staff at a level of 12 men. Barth responded that the number he would probably let it drop down to 6 men. Spitzer asked what authority the reserve officers would have. Barth stated they would have full powers of arrest while on duty. The officers would go through a firearms training program. Charles Johnson stated that because of the increase in numbers the possibility of potential liability would increase. He also said that the type of training will de- termine what risks there would be to the city. Vail spoke to the Cottage Grove Police Chief, and he recommended they should be on duty at least 20 hours per month, and it be mandatory they take state testing. The Oakdale Police Department seems to have a problem with the reserves and full-time officers relating to each other. White Bear seems to have the same problem. MOTION: Spitzer made motion, seconded by LaValle, that we authorize the establishment of the reserve officer program with a membership of 12 officers, individually certified by the Police Chief. The City Council to give their aryi.r.el prior to granting any authority beyond that of citizen assist to the Police Department. Further portion of this motion that the City Council direct the Police Chief to set as an objective to keep the membership of this reserve force at 12 qualified individuals. Reserve officers are to be non paid. Vail did not agree with the setting of 12 reserve officers. He felt six officers would be sufficient. VOTING FOR: Spitzer and Irsfeld j VOTING AGAINST: LaValle, Schletty, and Vail MOTION FAILED 3�}} MOTION: Vail made motion, seconded by Spitzer, that reserve program start t7 at 12 officers, and maintain a maxima of six men. VOTING FOR: Vail and Schletty VOTING AGAINST: LaValle, Spitzer, and Irsfeld MOTION FAILED MOTION: Spitzer made motion, seconded by Irsfeld, to renew original motion as previously stated. VOTING FOR: LaValle, Spitzer, and Irsfeld VOTING AGAINST: Schletty ABSTAINED: Vail MOTION CARRIED 7.2 Seminar of solid waste management. May 3 & 4 MOTION: LaValle made motion, seconded by Schletty, that the City of Hugo pay the registration fee of $10.00 for Dan Spitzer to attend the Solid Waste Management Seminar, Brooklyn Park Sheraton Inn, on May 3 and 4. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Recessed 9:00 P.M. Reconvened 9:10 P.M. 8.0 NEW nua.0 SS 8.1 Manuel Peloauin — Name of street A letter is to be sent to Washington Officer Surveyor's Office requesting the naming of the street. MOTION: Irsfeld made motion, seconded by Schletty, that the City Council re— quest the Washington County Surveyor's Office to affix an appropriate name to Peloquin road. The county to erect appropriate sign on Peloquin road and Mugg's subdivision. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 8.2 Lighting — 147th. 148th and Freeland MOTION: LaValle made motion, seconded by Spitzer, that the City of Hugo write Frank Graham, NSP, authorizing the installation of lights on 147th and Freeland, and 148th and Freeland, Locations as discussed in the field. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 8.3 Recommendation from Planning Commission for rumble strips. and or. a caution light on 170th Street and Highwav 61., LaValle stated that the state and county are reluctant to do anything on 170th and Highway 61. LaValle thought there was no installation being made of blinking lights. Kuusisto stated that there has been no maintaining of rumble strips. Schletty has talked to Mr. Bennet, Anoka Electric, and they will work with the existing poles on the west side of the highway. Anoka thought a 175 watt light (mercury vapor) would sufficient lighting. They will not install a high pressure sodium light because they would have to set up a whole new program for one light. Mr. Spitzer is now in charge of the light project on 170th and Highway 61. Matter to be placed on May 16th agenda. LaValle suggested the city write the Washington County Highway Department asking them if they have considered any further precautions or any design changes in re— gard to 170th and Highway 61. 9.0 MISCELLANEOUS A petition was received for a sewer study to be done on Ethan Avenue.North in Oak Shore Park along the east side of Bald Eagle Lake. Howard Kuusisto will look at, and give a report at the next City Council meeting, May 2, 1977. APRIL 18, 1977 33 Letters were received from Minnesota Pollution Control Agency and Washington County Board of County Commissioners regarding a proposed chemical waste disposal facility. A meeting will be held for Washington County at 7:30 P.M., Monday, April 25, 1977, to inform local officials of the site selection process. Mayor LaValle and Dan Spitzer will be attending. The Brevig dike matter will be discussed at a later date after more study is done by Mayor LaValle and Howard Kuusisto. Mrs. Wanned was present on behalf of the Hugo Brownies. They would like permission to plant two evergreens on the northwest corner of the park. They would also like permission to build a fire for the girls for May 14th, so they can roast hotdogs. MOTION: LaValle made motion, seconded by Spitzer, that the Girl Scouts be allowed to plant trees on the northwest corner of the park. Mr. Vail to contact the railroad regarding the upgrading of the *racks on 145th Street and County Road 4. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED An aggregate seminar will be held on April 27, 1977, form 9:00 A,M. to 4:00 P.M. at McGuire's in Arden Hills. Barton Contracting would pay the fee for whoever would like to attend. Howard Kuusisto will contact Howard Schletty about their attending this seminar. The Goiffon gravel pit should be placed on the May 2, 1977, City Council for further discussion. MOTION: LaValle made motion, seconded by Spitzer, that the Board of Review will meet at Hugo City Hall on May 20, 1977, from 9:30 A.M. to 3:00 P.M., and all City Council members are urged to attend. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that Mr. Vail be authorized to purchase 120' of 6' fence and aggrelime for the ballfield. Price not to exceed $300.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Larry Irsfeld inquired as to whether the council would be interested in subscribing to the Small Towns Institite at a cost of $25.00 a year. MOTION: Irsfeld made motion, seconded by LaValle, that the City of Hugo subscribe to Small Towns Institute for a period of one year to judge its benefits. VOTING FOR: Spitzer, Vail, and Irsfeld VOTING AGAINST: LaValle ABSTAINED: Schletty MOTION CARRIED Larry Irsfeld will act as coordinator to try to set up a special meeting to review the Systems Statement as presented by Metro Council. A tentative date of April 26, 1977, was selected. Carl Dale is to be informed of the date officially chosen. George Koland is to dig a ditch to the east of 14255 Hyde Avenue, as well as on 142nd Street. Grace Development presented a petition requesting the extension of water to four lots on County Road 8A. LaValle stated that the usual procedure would be to do a prelimanary estimate of what it would cost, and then go through the necessary public hearings. Williams, Clerk City of Hugo ,APRIL 26, 1977 MINUTES OF THE PROugigivimA OF THE SPECIAL MEETING "SYSTEMS STATEMENT" The meeting was called to order by acting Mayor, Dan Spitzer, at 7:15 P.M. PRESENT: City Council - Irsfeld, Spitzer, and Vail Planning Commission - Ehret, Rosenquist, Greger, Peloquin, Peltier, Gillen, and McAllister City Attorney - Charles Johnson City Engineer - Howard Kuusisto Planner - Carl Dale ABSENT: Mayor LaValle and Schletty Carl Dale's general comments were that the City of Hugo has a comprehensive develop- ment plan which has been accepted by the Metropolitan Council and is, in fact, being used as a model by Metro for comprehensive planning in communities of need. The overall systems statement has been compiled on erroneous information. The City of Hugo should forward updated ordinances/resolutions on controls andregu].ations regarding building and planning to Metro Council. The systems statement was based on comparable cities that do not enforce or impose controls. Specific objectives, such as regabilita- tion or substandard housing, should be clearly defined by Metro so Hugo can comply. At this time, he felt the city neither agrees nor denies the pending systems statement. Other questionable issues to be interpreted for Hugo by Metro Council are as follows: POPULATION - There is general concern regarding the impact of the projected growth population. These projections were made in 1973, but are to be re-evaluated this year. HIGHWAYS - TRANSPORTATION POLICY PLAN - What plans are projected for Forest Lake transportation? City of Hugo could utilize their system. -- - Question statement that no additional access is currently planned for 1-35 is there a possibility that a feeder road could traffic east. - - - GENERAL PLANNING ON TRANSIT _ _ _ Regarding the 25,500 person trips beginning or ending in Hugo not a realistic figure. - - - Stated Metro will need to receive population household and employ- ment data from Hugo by traffic assignment zone - clarify. - - - Regarding population, who bears the cost or a census survey? AIRPORTS - - - Questioned whether Oneka Lake would qualify as a seaplane operations. INTERCEPTORS AND TREATMENT PLANTS - - - lugo has an interceptor plan which was already accepted by Metro, but question the MWCC statement they shall not issue permits for connection to sewer facilities by any development in the Rural Service Area un- less action is consistent with local comprehensive sewer plan as approved. Hugo feels the MWCC is inconsistent. - - - Why isn't Hugo in the area of Planned Urbanization? - - - Hugo questions the result in downstream interceptor - - Could we be cut off from sewer? - - What about Hugo's guarantee capacity? - - Hugo has paid for sewer usage, now Metro says we can't use. - - - What modifications do they want in our stage development plan? Laivrrinvu,LE INTERCEPTOR - - - No excess force main for South Frenchman Road. - - - Hugo derives no benefit from the interceptor. - - - Question site location of Centerville interceptor. - - - What is the capacity of the Centerville sewer line? - - - Sewered residential population 2500 by 1990 - - Should Hugo re-negotiate rate structure? - - - Howard Kuusisto to submit plans. ON-SITE DISPOSAL - - - On-site sewage disposal system is governed by Hugo Ordinance 1976-132. STORM WATER - - Hugo has a storm sewer, and in outlying areas, control water by ditching and ponding. RESOLUTION Whereas, Ramsey County presented a plan for acquiring and developing a park in the city of Hugo and Washington County in the Fall and 'winter of 1976 to be called Otter Lake Park; Whereas, The people in the area of the proposed park reasonably and vigoruosly opposed the acquistion and development of a park in this area. To assure that their sentiments were known and that thegr understood the plan, these people attended and testified before the Lugo City Planning Commission and the Hugo City Council; Whereas, The Hugo City Planning Commission listened to the Ramsey County plan for acquiring and developing a park, considered the views of the residents of the area and the people of Hugo, and unanimously voted to recommend that the Hugo City Council deny the acquistion and development of the portion of Otter Lake Park in Hugo and Washington County; Whereas, The Hugo City Council carefully reheard the Ramsey County plan for acquiring and developing a park, considered the views of the residents of the area and the people of Hugo, and the unanimous recommendation of the Hugo City Planning Commission, and voted unanimously to deny the acquistion and development of the portion of Otter Lake Park in Hugo and Washington County; now, therefore, be it Resolved, That the Hugo City Planning Connuission requests that the Metropolitan Council and the Metropolitan Parks and Open Space Commission stop further attempts to acquire and develop an Otter Lake Park in Hugo and Washington County and delete the Otter Lake Park in Hugo and Washington County from the Metropolitan System Statement.
