PRESENT: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION: Vail made motion, seconded by Irsfeld, to approve the minutes of April 18, 1977, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to the minutes of April 26, 1977, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the general claims of May 2, 1977, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, to approve the utility claims of May 2, 1977, after changing claim #2 to read Special Assesments. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.0 ri'rIT10NS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Joe Zaspel — Mobile Home Renewal MOTION: Schletty made motion, seconded by Spitzer, to renew the Mobile Home Permit for Joseph Zaspel, 17205 Forest Blvd. North, Hugo, Minnesota under Chapter 40, Article III, Subdivision D, for ninety days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.2 Hugo Lions Club The Lions Club submitted application for non—intoxicating malt liquor, bingo, and soft drdak license for Good Neighbor Days, June 10, 11, and 12, 1977. MOTION: Spitzer made motion, seconded by Irsfeld, that the applications for non—intoxicating liquor, soft drink, and bingo be granted to the Hugo Lions Club, in the amount of $15.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Mayor LaValle read the proclamation declaring that the weekend of June 10, 11, and 12 be hereby designated as the 9th annual Good Neighbor Days, and that all g000d citizens join in the fun of making this annual event a success in beautiful downtown Hugo. 5.3 Jim Branstedt — Complaint Mr. Branstedt has filed a written complaint against Dale Palmer in regard to Mr. Palmer's storing of old automobiles on his property. MOTION: Spitzer made motion, seconded by Schletty, that the City Council direct the Chief of Police to check on the Bramstedt complaint, and see if any ordinances are being violated. To report before May 16, 1977. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.5 Stroman Complaint Mr. & Mrs. Stroman filed a written complaint against Will Riopel stating that Mr. Riopel was storing garbage on his property to feed his pigs, and burning trash. Hugo's Health Officers, Vail and Irsfeld, inspected the site and stated that Mr. Riopel was not violating any ordinances. MOTION: LaValle made motion, seconded by Spitzer, that the clerk send a letter to Mr. Stroman stating that the city has investigated the matter, and do not feel there is a problem. Mr. Riopel is within the scope of the ordinance. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.5 Joe Glamos — Site Plan Approval Mr. Glamos presented his site plan that had already been approved by the Planning Commission. MAY 2, 1977 37 r MOTION: Spitzer made motion, seconded by Schletty, that the Joe Glamos site plan be approved subject to parking lot blacktopping restriction. VOTING FOR: LaValle, Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED Mr. Irsfeld acted as a fence viewer in compliance with a complaint submitted by Mr. Schadl against Mr. Loring Johnson. Mr. Schadl has paid a $5.00 fee. Allegedly, Mr. Johnson is not willing to partake in the cost of the construction of the fence. Mr. LaValle will try to set up a meeting with Mr. Johnson, and Mayor LaValle will accom- pany him. Matter to be placed on the agenda for May 16, 1977. 6.0 Reports OF OFFICERS & COMMITTEES 6.1 Ordinance Committee The ordinance committee has gone over the subdivision ordinance At this time, there are several items that have to be referred to the City Attorney. 6.2 Planning Commission At the Planning Commission meeting of April 27, 1977, a recommendation was made re- garding apartments in SFU zoning. MOTION: Spitzer made motion, seconded by Schletty, that the Planning Commission recommendation be turned over to the City Attorney for drafting into ordinance form. Report to be made at the City Council meeting of May 16, 1977. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.3 Water Superintendent - No discussion. 6.4 Building Inspector Mr. Crever submitted his written report. Tom has received an application for a building permit from Mr. Howard Phillips. Property located on Sunset Lake. Mr. Crever stated that he would have to deny the request because of a lack site for an adequate septic system. MOTION: Spitzer made motion, seconded by Schletty, that the Building Inspector be directed to deny the building permit for Mr. Howard Phillips on the Southwest shore of Sunset Lake; Lot 8, Block 1, Royal Haven Estates, unless and until adequate information proving the existence of a building site can be supplied. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Howard Schletty brought up the fact that people are installing blacktdp on existing driveways. Could prove to be a problem as far as water drainage. They are also not taking out permits for work that is being done. Howard Schletty is to talk to these people, and Tom Crever agreed to accompany him. 6.5 Fire Chief Jim Olsen stated that there is a problem with a piece of equipment. He said a new portable pump is needed for the Jeep costing $408.50. Unit would be able to pump 120 gallons a minute, and has a recoil start. Delivery could be made in two weeks. MOTION: LaValle made motion, seconded by Schletty, that the Fire Department be authorized to purchase a portable pump for the Jeep in the amount of $408.50. Records to show money should come from the general fund for an emergency purchase. VOTING FOR: LaValle, Spitzer, Schietty, Irsfeld, and Vail. MOTION CARRIED Mr. Olsen was directed to get a cost estimate for clothing needs for the Fire Department. Matter to be discussed at the City Council of May 16, 1977. Mr. Olsen has been unable to meet with Forest Lake regarding the Mutual Aid Agreement. Mayor LaValle instructed Charles Johnson to send a copy of the agreement to Forest Lake's attorney, John Jergens, and the Fire Chief, Art Jensen, explaining the situation. MOTION: Spitzer made motion, seconded by Irsfeld, to adopt Ordinance No. 1977-142, AN ORDINANCE AMENDING CHAPTER 110 OF THE HUGO CITY CODE, ENTIELED, "FIRE PREVENTION & PROTECTION" TO PROVIDE FOR THE ESTABLISHIKENT OF THE POSITION OF CITY FIRE REVIEWER, ESTABLISH APPLICATION AND PERMIT REQUIREMENTS FOR OPEN nunninu. AND TO PROVIDE FOR THE COLLECTION OF FEES FOR ISSUANCE OF bunmint, PERMITS. 3 QQOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, to adopt Resolution 1977-5, A RESOLUTION ESTABLISHING YhES FOR THE FILING OF APPLICATIONS FOR THE ISSUANCE OF OPEN BURNING PERMITS AND THE ISSUANCE OF OPEN munnint, PERMITS AND THE RENUMERATION OF THE CITY FIRE REVIEWER. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, of the appointment of Don White, 14954 Francesca, Hugo, Minnesota, as fire viewer. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED A letter of notification should be sent to Mr. Whitealong with a copy of the ordinance. He should be requested to come to City Hail and work on the setting up of a form. 6.8 Enxineet Mr. Kuusisto submitted his written report. He stated that the annual roads tour will take place on Monday, May9, at 9:00 A.M. Mr. Kuusisto was asked to review a letter from Mr. Ray Payne, MWCC, regarding the pro— posed Centerville interceptor. Mr. Kuusisto is still working on the Bald Eagle Sewer Study. 6,7 Attorney Mr. Johnson submitted his written report. He stated that the counter claim agaigat Shafer has been answered. The Biesang Road matter was brought up again. Don Lease had been contacted by someone, and they stated that they have gotten approval from the party who was holding out. Don suggested that they contact Howard Kuusisto to find out what was required to set the standard for building the road. Howard Schletty inquired about the Bramstedt complaint agatinst Neil Buschmann. They evidently removed three cars and then replaced them with three more. Mr. Johnson stated that if a forma notice was given to Buschmann, it should be followed up. Howard Schletty will investigate and report at the May 16, 1977, City Council meeting. 6.9 Clerk The City Clerk questioned whether the check from Earl Forsblad for a liquor license should be returned to him. Clerk instructed to return the check. The Washington County Road and Bridge Maintenance Agreement with Hugo expired on April 30, 1977. City Clerk has written requesting a 30 day extension. A lengthy discussion ensued regarding the pros and cons of signing a contract with Washington County for road maintenance, hiring a private contractor, or the city maintaining its own roads. Howard Schletty will try to set up a special meeting with Ehlers to try and initiate some action. MOTION: LaValle made motion, seconded by Spitzer, to name the following de— scribed road as Ivan: The East 60 feet of the West 268 feet, except the North 660 feet there— of, of the Northwest Quarter of the Southeast Quarter of Section 35, Township 31, Range 21, Washington County, Minnesota; AND The South 60 feet of the North 720 feet of the West 162 feet of the East 327 feet of the West 595 feet of the Northwest Quarter of the Southeast Quarter of Section 35, Township 31, Range 21, Washington County, Minnesota. Also, to install signs at the Ivan intersection, and 177th Street and Forest Boulevard, and 177th Street and Greystone. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MAY 2, 1977 39 Virgil Ekbom, heating inspector, stated that Hugo's heating permit was obsolete. MOTION: LaValle made motion, seconded by Irsfeld, that the City Clerk be authorized to secure the necessary heating application for the heating inspector. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Mr. Harvey Carmen has contacted the City of Hugo inquiring as to whether the city would be interested in establishing a counseling program as provided by Washington County Human Services. Program would be available to all city employees and provide a number of different services. Dan Spitzer will investigate. MOTION: Irsfeld made motion, seconded by Spitzer, that a special meeting re— garding the systems statement, be held on May 10, 1977, at 8:00 P.M. Planning Commission and City Council members to attend, along with Carl Dale, Howard Kuusisto, and Charles Johnson. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Howard Schletty discussed the James Johnson land purchase, with Mr. Lundblad who owned the property. Mr. Johnson has not paid anything on the land for two years, and the matter is now in the courts. Mayor LaValle inquired as•..to what can be done to solve the problem on all the old tires lying in Horton's junkyard. Charles Johnson will advise.
