The public hearing regarding the vacating of the easement was called to order at 7:02
P.M. by acting Mayor, Dan Spitzer. Clerk read the official notice of the hearing.
Sarah Mardell was present as attorney for Thomas Clark. A petition had been pre—
sented with a majority of signatures to approve the vacating of the easement. Mr.
Clark purchased 32 acres, and owns all the land abutting the easement on the south.
Howard Kuusisto advised that the request be approved. The public hearing was closed
at 7:10 P.M.
The regular City Council meeting was called to order at 7:11 PM, by acting Mayor,
Dan Spitzer.

Page 3, 1st. paragraph — Mr. LaValle will try to set up a meeting

Page 4 (Resolution 1977-5) — correct spelling to be REMUNERATION
Page 5 — install signs at Ivan Avenue North and 122nd Street North

5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES
5.1 Bramstedt Complaint Result
Robert Barth submitted a report stating that Mr. Dale Palmer is in violation of the
City Code. He had six unlicensed vehicles on his premises.
MOTION: Spitzer made motion, seconded by Irsfeld, that the City Council direct
the Chief of Police to issue an abatement notice to Mr. Dale Palmer
because of violation of City Code. Police to deliver the notice and
follow-.up within 14 days to see if vehicles are removed.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

5.2 Fence Complaint
Matter tabled until the next regular meeting, June 6, 1977.
5.3 Neil Buschmann Complaint
Mr. Buschmann claims he has only two unlicensed vehicles on his premises. Howard Schletty
will check on and report at the meeting of June 6, 1977.
5.4 George Jungblut — Subdivision
Mr. Roy Stanley presented the final plat to the City Council for their approval. The
Planning Commission approved the final plat on May 11, 1977. Spitzer requested that
the folloting be made part of the minutes: For the purpose of the calculation of the
parkland assessment, the plat as submitted, with the specific exception of Outlots H,
I, and J, will be considered it is estimated for this purpose that the amount of
platted land is 7.2 acres.
MOTION: Schletty made motion, seconded by Irsfeld, that the final plat of George
Jungblut, Lake Estates, be accepted as submitted. Park land dedication
of $720.00, including the covenants as submitted.

5.5 George Indvkiewicz - Extension of mining permit
Mr. Indykiewicz submitted a letter asking the permit be extended to October. The
Planning Commission approved the extension at their meeting of May 11, 1977. Mr.
Kuusisto had no problem with the extension.
MOTION: Schletty made motion, seconded by Vail, to extend the ispection of
George Indykiewicz minimg permit until October 15,1977.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

6.0 ORDINANCES AND RESOLUTIONS
MOTION: Irsfeld made motion, seconded by Vail, to table the vacating of the
easement until the next regular meeting of June 6, 1977. Clerk will
get cost of publication, attorney and engineering fees, to Sarah Mardell
for payment prior to that meeting.
VOTING FOR: Spitzer, Schlatty, Irsfeld, and Vail.

Mr. Spitzer had asked attorney Johnson to draft a letter to the Metro Council re-
questing a time extension on the adoption of the Draft Systems Statement.
MOTION: Schletty made motion, seconded by Vail, to direct the Mayor to re-
quest an extension of time to October 1, 1977, on the Metro Council
Systems Statement.
VOTING FOR: Spitzer, Schletty, Irsf:ld, and Vail.

The Hugo Slow Pitch Tournament will be held on June 4 and 5, 1977.
MOTION: Schletty made motion, seconded by Irsfeld, to grant an On Sale Non-
Intoxicating Liquor and Soft Drinkl,icense to Hugo Slow Pitch Team,
in the amount of $15.00.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

7.1 Charles Johnson review of apts. in SFU zoning - 1st. draft
Mr. Johnson stated that there were a number of discrepancies with the proposed
ordinances and the existing ordinances. He submitted a letter stating the different
issues that would have to be reviewed.
MOTION: Irsfeld made motion, seconded by Schletty, that the draft be sent to the
Ordinance Committee to resolve the discrepancies as noted in the letter
submitted by Mr. Johnson.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

7.2 RR crossing - move from 130th to 128th Street
Howard Schletty could not get in contact with the right people, so no action had been
taken. Mr. Ken Tschida was directed to give the names of the gentlemen to contact to
Mr. Kuusisto and Mr. Schletty. City Clerk directed to place the matter on the agenda
for June 6, 1977. City attorney will review the resolution as submitted by Grace Develop-
ment, and Kuusisto and Schletty will contact the railroad personnel.
2.23 Waterline extension (Valley View)
Grace Development submitted a petition that was signed by Mr. Koecher and Grace Develop-
ment. Councilman Vail stated that the two signees constituted over the required 356.
MOTION: Irsfeld made motion, seconded by Schletty, to hold a public hearing
on June 6, 1977, at 7:00 P.M., to review the matter of waterline ex-
tension for Valley View. Clerk directed to make all necessary publica-
tions.

7.4 Estimate clothing needs for Fire Department
Fire Chief, Jim Olson, stated that six coats have to be replaced ($94.50 ea) along
with two pairs of boots ($37.50/pair .
MOTION: Vail made motion, seconded by Irsfeld, to authorize the Fire Department
to purchase personal fire equipment in an amount not to exceed $700.00.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

8.0 NEW BUSINESS
8.1 Lions Club - Electrical Hook-up
Mr. Craig Thaemert was present requesting permission to install 100 amp service for the
Lian's Club building located by City Hall. He requested that the meter be put in the
city's name. Schletty suggested that when the building is dedicated to the city, then
change the meter to the city's name. Lion's Club should incur the cost year around
until arrangements is made.
MOTION: Spitzer made motion, seconded by Schletty, that the Lion's Club be given
permission by the City of Hugo to install an electrical service in their
name and their expense in the existing building.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

Mr. Carl Nordquist inquired if the restrooms located in City Hall would be available
the Wednesday and Thursday prior to Good Neighbor Days, for use by the carnival people.
Schletty stated that there was quite a mess when they were opened to the public in pre-
vious years.
MOTION: Irsfeld made motion, seconded by Schletty, that the restrooms in City
Hall should not be opened during Good Neighbor Days for public use.

8.2 Mr. Burkard - Insulating pipes
Mr. Burkard requested that this matter be held over until the next meeting of June 6, 1977.
9.0 MISCELLANEOUS
Mrs. Ken Wanned submitted a letter requesting the possibility of installing a 4-way stop
at the intersection of 148th and Foxhill. There are children in the afternoon kindergarten
class, and they have to cross the street unassisted. Mr. Vail directed to contact the
principal to see if we can delegate school patrol for the rest of the year.
MOTION: Irsfeld made motion, seconded by Vail, that the petition from Oak Shore
Park for sanitary sewer study be accepted by the city.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

The contract with Washington County Highway Department has been extended for 30 days.
MOTION: Spitzer, made motion, seconded by Irsfeld, that the city give the Legion
$30.00 for Legionville.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.
MOTION CARRIED
MOTION: Vail made motion, seconded by Irsfeld, to grant the renewal of the Mobile
Home Permit for Joseph Gregoire, 7600 - 165th Street North, Hugo, under
Chapter 40, Article III, Subidivision D. for ninety days.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

MOTION: Vail made motion, seconded by Irsfeld, that the city establish an oil pro-
gram. Clerk directed to publish the notice in the paper. Home owner to
defray cost of the oiling.
VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail.

Mr. Schletty received a letter from Barton Contracting stating their position in re-
lation to the gravel pit. Mr. Kuusisto was directed to take an inventory at the pit, and
report on the status of their price quotation to us.

• . Schletty received a bid from LaValle Excavating for summer maintenance for blading
the roads $19.50 per hour for man and vehicle. Their price is very similar to price
from Washington County. Schletty directed to find out from Tom LaValle what he would
contract for road maintenance for 12 months, and contact Charles Swanson to find out if
they would be interested in a part-time maintenance contract for the winter months.
Spitzer stated that the City of Hugo is eligible to participate in the Employees
Assistance Program. All we have to do is inform them that we are interested, and they
will contact the supervisory personnel.
MOTION: Irsfeld made motion, seconded by Vail, that the City of Hugo participate
in the Employees Assistance Program.

The city received a notice of condemnation proceeding from the Metro Waste Control
Commission to be held on June 1, 1977. Attorney Johnson had somedifficulty deter-
mining the legal description as stated. He will contact the MWCC to find out exactly
what they mean. Mr. Johnson will appear at the proceeding if he feels it is necessary.
The clerk stated that there are residents in Hugo who have not as yet hooked up to the
sanitary sewer, nor paid their SAC charge.
MOTION: Spitzer made motion, seconded by Schletty, to direct the City Clerk to
send a certified letter to people who have not hooked up to sanitary
• sewer. They will have 30 days to pay the SAC charge, and pull a permit
for installation of the sewer or will be fined for violation of the
ordinance.
