PRESENT: LaValle Spitzer, Schletty, Irsfeld, and Vail MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of August 15, 1977, with the following change: Page 2 (5.3) item 1 — highway screen (delete one/double entry) VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the general claims of September 6, 1977 as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, to approve the utility claims of September 6, 1977 as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Fred FulbriRht — RezoninK Mr. Johnson, City Attorney, stated that he was satisfied with the proof of ownership presented. Mr. Fulbright is requesting the rezoning of approximately 142 acres from RB to SFE as indicated on Exhibit 3, on file at City Hall. MOTION: Spitzer made motion, seconded by Schletty, to amend the zoning ordinance, Chapter 320, and the zoning map as recommended by the Planning Commission, for the rezoning request of Fred Fulbright from RB to SFE (approximately 142 acres) with legal as follows, Ordinance 148* That part of the S20 acres of the Ni of NW4 of Sec. 29, T31N, R21W, in the City of Hugo, Washington County, Minnesota, lying East of Minnesota Trunk Highway No. 61, as now widened to 111ft., described as follows: Commencing at the intersection of the North line of South 20 acres of the North 2 of NW4 of Sec. 29, with the East line of Minnesota Trunk Highway NO. 61; thence East along said North line of South 20 acres for 400 ft. to the point of beginning of this description; thence continuing East along said North line of 20 acres for 1370 ft. to the East line of NWW of Sec. 29; thence South along said East line of NW* for 488.2 ft; thence West and parallel with said North line of 20 acres for 1215 ft; thence North at right angle for 270.2 ft; SEPTEMBER 6, 1977 73 Fulbright - cont. thence West at right angle for 150 ft; thence North at right angle for 218 ft. to the point of beginning. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED 5.2 St. John the Baptist Church - On-Sale Liquor License (non-intoxicating) MOTION: LaValle made motion, seconded by Spitzer, to grant an On-Sale, non-intoxicating Liquor License to St. John the Baptist Church, for a fee of $10.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to grant a Soft Drink License to St. John the Baptist Church, for a fee of $5.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED The White Bear Rod & Gun Club applied for an On-Sale Non- Intoxicationg Liquor License, Cigarette License, and Soft Drink License. Mayor LaValle stated that he felt these licenses could not be issued until the matter of whether the facility could be used for interior rifle range was in fact legal. Attorney Johnson is to review the Special Use Permit and the court decision, and advise the Council. MOTION: Spitzer made motion, seconded by Vail, to approve the purchase of 12 water meters by Water Superintendent, Robert Burkard, for a total of $594.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED Flood Insurance Program There will be an informational meeting regarding flood plain areas heldat Hugo City Hall on September 13, 1977, at 2:00 PM. There will be a news relealse in the Forest Lake Times to this effect. Public Hearing - Revenue Sharing The public hearing was called to order at 7:32 PM. The City of Hugo has been allocated $15,996.00 from revenue sharing for the year 1978. This money will go to the city's Public Safety Department. The hearing was closed at 7:33PM. 5.3 Mr!, Shelffo (Mr. Tourist Camp) - Expanding use of trailer park Mr. C. B. Schneider, Department of Health, submitted a letter of Mr. Johnson stating the camp was in violation of the license issued to them. They are harboring 5 mobile homes and the license allows for only one mobile home. Orders were issued to remove four of the mobile homes with a compliance date of September 1, 1977. Mr. Shelffo was 7 4,3 Mr. Shelffo cont. present and stated that his lawyer told him he was acting within the bounds of the license. He sated Vat all the vehicles were licensed for over the road, and no units were skirted. Spitzer stated that he would recommend that Mr. Shelffo apply for a Special Use Permit with the city, then we would know where Mr. Shelffo stood, and he would know the position of the city. Mr. Shellffo stated that to make a go of the operation financially, he would need permission for some permanent residency. LaValle felt it was the general ooncensue of the Council to wait until we get more information from Mr. Schneider of the Health Department. Mr. Shelffo was also in— structed to apply for a Driveway Permit that was installed prior to his purchasing of the camp. SQUAD CAR — BID OPENINGS (8:02 PM) The following bids were opened: McMillan Dodge 35527.32 (400 cubic inch engine) —900.00 trade in 4627.32 Northdale Ford 35889.06 (400 cubic inch engine) 6004.02 (460 cubic inch engine) 500.00 trade in credit MOTION: LaValle made motion, seconded by Spitzer, that the bids be referred to the Police Chief to come up with a recommendation to the City Council. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED (Closed 8:10 PM) 6.0 REPORTS OF OFFICERS & COMMIWEES 6.1 Ordinance Committee — No report. 6.2 Planning Commission MOTION: Spitzer made motion seconded by Irsfeld, that the City Council authorize the hiring of a Planning Consultant from Washington County Planning Commission, to be here for two days a month, three hours per day, time to be mutually agreed upon by planner and clerk's office, at $10.00/hour for the balance of the year 1977. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED 6.3 Water Superintendent — No report. 6.4 Building Inspector Schletty suggested Mr. Crever review the 20 ft length of culverts now being used for driveways. He might want to increase that length. 6.5 Fire Chief — No report. Mew — 6, 1977 7 55 Richard Schuh — Amended Mining Permit Mr. Schuh's attorney, Bruce Malkerson, presented the case to the Council. They had met with City Engineer, Kuusisto, to inspect the roads leading to the site. Mr. Malkerson felt that the $10,000bond and $10,000 letter of credit was sufficient to comply with anything asked of Mr. Schuh. Malkerson stated that there will be 9000 tone of blacktop hauled out, and 4500 tons of rock brought in on 152nd Street. The haul roads would be .aintained in compliance with recommendations of the City Engineer. The general contractor, Brainerd Blacktopping, would be responsible for dust control. LaValle stated that Fischer Contracting will be blacktopping Irish Avenue so there will be two parties using the same road. LaValle felt that an additional amount of letter of credit would be in order because of the blacktop road. The additional amount would cover additional liability. LaValle felt that an additional $15,000 would not be out of line. Kuusisto stated 152nd Street to County Road 57 was not in the best condition. There would have to be grading, excavation, and shaping prior to any hauling. Chloride would have to be added for dust control. Malkerson stated they do not have any Class 5 left. Would the Council agree to Class 3? Kuusisto stated that if the class 3 was not sufficient, Schuh would be asked to bring in Class 5 gravel. MOTION: LaValle made motion, seconded by Spitzer, that we amend the Mining Permit for Richard Schuh with the following changes: Item 4 — iaul roads shall be Irish Avenue South to County Road 8A and 152nd Street east to Jeffrey Avenue only. Item 7 — The contractor shall provide and maintain both a $10,000.00 bond and $25,000.00 irrevacable letter of credit for the maintenance and/or reconstruction of the haul roads, and to insure compliance of all conditions of the permit. Item 12 A speed limit of a maximum of 45 miles per hour be maintained by the contractor gravel trucks when operating on the haul roads on city streets, except a 30 mile per hour speed limit shall be maintained from 7:00 — 7:30 AM. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED Recess 9:20 PM Reconvened 9:31 PM 6.6 Police Chief Chief Barth submitted his monthly report. He stated that the reserve officers have completed their firearms training, and inquired as to the possibility of the reserves carrying firearms. LaValle felt it was too soon. They should be given as much training that is possible to give thim in the whole aspect of policing. Irsfeld agreed, stating the reserves should have more training and experience. Chief Barth is to supply the clerk's office with a roster of the reserves. 7 TION: LaValle made motion, seconded by Spitzer, to table the letting of squad car equipment bids until the next meeting of September 19, 1977. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED 6.7 Attorney Mr. Johnson submitted his written report. The City Council was instructed to have their comments regarding their appeal of the Systems Statement ready for the meeting of September 19, 1977. Mr. Johnson suggested that the city take a neutral attitude in regard to the applicaion of the full—time police officers to join the union. If there is any plan for any wage increases, they should not be considered at budget time. Mr. Schletty stated that there are persons using the White Bear Rod & Gun Club for shooting hand traps. Mr. Johnson will review the Special Use Permit as it was reissued, and the court order. It wasdetermined that this would be considered a civil matter. 6.8 Engineer The Metro Waste Control Commission has contacted Mr. Kuusisto asking for permission to realign there construction on Elmcrest Avenue between the trees and the road, for the Centerville interceptor. They claimed the realignment could be done without des— troying any trees. MOTION: Spitzer made motion, seconded by Irsfeld, to extend time of adjournment for 2 hour. All aye. Motion carried. Engineer — cont. LaValle stated that the letter of credit for $25,000.00 will not put the road back into its same condition. It was felt that the realignment would extend into the road surface. Mr. Kuusisto was instructed to inform the Metro Waste Control Commission that they would be liable for the following: 1. Road restroration 2. An additional letter of credit of $25,000.00 3. Maintenance of traffic 4. Supervision 5. All excavation to be hauled off the site, and additional granular material be brought in. 7.0 ORDINANCES AND RESOLUTIONS — no discussion 8.0 UNFINISHED BUSINESS 8.1 Barton Contracting Councilman Schletty stated that Barton has agreed with the city's second proposal. MOTION: LaValle made motion, seconded by Vail, that the City of Hugo enter into a contract with Barton Contracting for the purchase of gravel. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED SEP a nm. 6, 1977 I 1 MOTION: Spitzer made motion, seconded by Vail, that the City Council direct Howard Schletty to notify Lino Lakes that the City of Hugo will assume responsibility for alternate week grading on Elmcrest Avenue north of Frenchman Road to 170th Street. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, to adopt RESOLUTION 1977-12, A RESOLUTION ESTABLISHING COOPERATION BETWEEN THE CITY OF HUGO AND LINO LAKES IN THE MATTER R OF THE OTTER LAKE REGIONAL PARK. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, that we accept the extension of the CETA program from December 1, 1977, to May 31, 1978. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, that we approve the hiring of Bernard Eugene Tschida, 503 Neal Avenue North, Stillwater, Minn., under the extended CETA contract. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, that we accept CETA Special Project contract to run from September 1, 1977 to August 31, 1978. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, that we approve the hiring of Gary Donald Buckles, 6840 7th Street North, Oakdale, Minn., under the Special Project CETA contrast.
