PRESENT: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION:Spitzer made motion, seconded by Irsfeld, to approve the minutes of September 6, 1977 as presented. VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to approve the general claims of September 19, 1977. VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, to approve the utility claims of September 19, 1977 as presented. VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail. MOTION CARRIED Schletty arrived 5.0 PETITIONS. REQUESTS. COMM[TNICATIONS & LICENSES 5.1 Tarco of Minnesota — did not provide needed certificate of insurance, so could not be acted on. 5.2 Suburban Pickup Service — Renewal of rubbish license MOTION: Spitzer made motion, seconded by Irsfeld, to grant a license for the collection of garbage and rubbish to Suburban Pickup Service, Inc., for a fee of $50.00 under Chapter 120 of the Hugo City Code. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED ,3 Bellaire Sanitation — Renewal of rubbish license MOTION: Spitzer made motion, seconded by Schletty, to grant a license for the collection of garbage and rubbish to Bellaire Sanita— tion, for a fee of 350.00 under Chapter 120 of the Hugo City Code. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED SEPTEMBER 19, 1977 8 J 5.4 Lake Sanitation - Renewal of rubbish license MOTION: Irsfeld made motion, seconded by Vail, to grant a license for the collection of garbage and rubbish to Lake Sanitation, for a fee of $50.00 under Chapter 120 of the Hugo City Code. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.5 Howard Meline - Application for liquor license Mr. Meline is purchasing Nitti's, with a closing date of November 1, 1977. The Articles of Incorporation have to be on file before the Council can act. MOTION: Spitzer made motion, seconded by Schletty, to table the Howard Meline liquor license matter until the Articles Of Incorporation are reviewed by the City Attorney. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.6 White Bear Rod & Gun Club - On-Sale non-intoxicating. cigarette. and soft drink license MOTION: LaValle made motion, seconded by Spitzer, to grant an On-Sale Non-Intoxicating Liquor, Cigarette, and Soft Drink License to the White Bear Rod & Gun Club for a fee of $43.32. VOTING FOR: LaValle, Spitzer, Irsfeld, and Vail VOTING AGAINST: Schletty MOTION CARRIED 5.7 Thomas Frampton - Special Use Permit Mr. Frampton is purchasing 30 acres from Reynold Arcand, and would like to build a greenipuse and sell nursery stock from'.the premises. LaValle inquired if Mr. Frampton had proof of ownership, and he replied that purchase depends on whether or not he could get a Special Use Permit. He had a copy of the earnest money contract at the Planning Commission meeting of September 14, 1977, but no-record of that was on file. MOTION: Spitzer made motion, seconded by Irsfeld, to grant a Special Use Permit to Thomas Frampton in concurrence with request 1977-26-SUP, subject to the following: 1. Special Use Permit shall be null and void unless Mr. Frampton consummates purchase of the affected property no later than December 1, 1977. 2. The first greenhouse structure to be built of an aluminum frame material, concrete footing, and that the building be covered entirely with rigid type material. 3. The second greenhouse may be of a poly type material. 86 4. At no time subsequent to the construction of the first • greenhouse will there be more than one greenhouse constructed of poly type material. 5. This does not prohibit using poly type material over rigid material for an insulation value. 6. The commercial endeavor shall be restricted to the sale of grown products, and auxiliary supplies, excluding those commercial chemical preparation and excluding mechanical im— plements. 7. Construction of a lath house shall be permitted provided such house shall not exceed 50' x 50'. 8. 6" well will be subject to a DNR permit. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED BIDS FOR WATERMAIN EXTENSTION ( 147th Street) WERE OPENED AT 7:38 PM. FOR PROJECT 77-29. Engineer Kuusisto proceeded to read the following bids submitted for Project 77-29: McLean Construction Company — $14,900.00 LaValle Excavating — $12,325.52 Walhunt Construction, Inc. — 5$15,783.72 E. Montgomery Construction — $16,305.00 Engineer Kuusisto wanted to review the bids, and would report later on in the meeting. MOTION: LaValle made motion, seconded by Spitzer, that the bids for the watermain Project 77-29 be given to City Engineer for review and tabulation. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.8 Shepherd of the Fields Church — Special Use Permit to construct a si€n on railroad right—of-sway The Planning Commission recommended approval of the request provided that the church eliminate certain lines from the proposed sign. These lines would change the sign to an advertisement rather than informational. LaValle stated that an advertising sign is only permitted when constructed on the property. MOTION: Spitzer made motion, seconded by Schletty, that the matter of Shepherd of the Field's request for Special Use Permit for a sign be laid over until approval by the railroad is filed with the City Clerk. VOTING AGAINST: LaValle MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that we reopen discussion on the Shepherd of the Field's sign. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. VOTING AGAINST: Spitzer MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, that the matter Of Shepherd of the Fields sign be referred to the Planning Commission for resolution of the question of set back and. of the content of the sign, and may not be returned until matter is resolved. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED 5.9 Lavina Duraine - Special Use Permit The Special Use Permit has to be extended to coincide with Richard Schuh's Mining Permit. MOTION: Spitzer made motion, seconded by Schletty, to grant a Special Use Permit to Lavina Duraine, 1976-106-SUP, subject to the following conditions: 1. Original Special Use Permit is hereby extended until June 1, 1978. 2. Post bond in the amount of $5,000.00. 3. The bituminous hot mix plant should be allowed for the duration of Project 77-04-018. 4. All existing trees and natural vegetation bordering the pit area shall be left undisturbed. 5. All top soil in the pit area shall be stockpiled, and at the time the. operation is completed, the top soil shall be re- placed and seeded to grass cover. 6. Sewer facilities shall be of the portable, chemical holding tank type. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS Item 8.2 of the agenda was discussed at this time (Procedure for amending rural & urban service districts in the city). Mr. Johnson stated that the complete ordinance will have to be published. The hearing cannot be held prior to 30 days of publication. The ordinance will have to be published again as it is finally stated. A certified copy will have to be filed with the County Auditor. 8 MOTION: Spitzer made motion, seconded by LaValle, that the ordinance be published, and a public hearing be set for November 7, 1977, at 7:30 PM, at Hugo City Hall. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED Spitzer requested that Engineer Kuusisto tabulate the number of miles of road in Hugo. The Fire Department and Police Department are to tabulate the number of calls from the rural districts in the last year. Attorney Johnson presented a draft of an ordinance to provide regulation of apartments and other multi—family uses, amending Chapter 320 of the Hugo City Code. He had problems with the swimming pool restrictions and parking spaces per dwelling unit. MOTION: Spitzer made motion, seconded by Schletty, that the draft ordinance amending Chapter 320 providing for multi—family uses be referred to the Planning Commission for their review. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Mr. Johnson will be holding off further consideration and preparation of any Ordinance relating to industrial user strength charge until he has the comments and requirements of Mr. Kuusisto. LaValle thought that there might be a time deadline of January 1, 1978. Mr. Spitzer stated at this time the Ordinance Committee is short onemember, and a replacement is needed. Enineer Kuusisto reviewed the bids, stating that LaValle Excavating was low bidder, at $12,325.52, and suggested that they be awarded the contract. MOTION: Spitzer made motion, seconded by Irsfeld, that the contract be awarded to LaValle Excavating, with a bid of $12,325.52, to complete Project 77-29, watermain extension. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail ABSTAINED: LaValle MOTION CARRIED A hearing in regard to assessments for this watermain extension Project 77-29, cannot be held until the project is completed. LaValle can only charge for materials actually used for the project. The City Clerk checked with Washington County, and they said we could certify as late as November 15, 1977. 7.0 UNFINISHED BUSINESS Chief Barth reviewed the bids for a new squad car, and investigated the possibility of leasing a car for a year. McMillan Dodge quoted a price of $6,600.00 to lease a car. Their orginal bid was for X5.,527.32 with a trade in price of $900.00 leaving a total of $4627.32 if the City were to lease, McMillan Dodge would coyer any breakdowns, SEPTEMBER 19, 1977 89 7.0 UUFINISHED BUSINESS CONT. provided the maintenance agreement was complied with. Northdale Ford submitted a bid of $5389.06 total. Mr. Barth's recommendation was to purchase the car from McMillan Dodge. MOTION: Spitzer made motion, seconded by Irsfeld, to purchase a squad car from McMillan Dodge, and trade in old car. Bid price of $4627.32 with a delivery time of 90 days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED Chief Barth stated that he could stretch the red light and siren for one year, but definitely needs a new cage (safety shield). MOTION: LaValle made motion, seconded by Spitzer, that the bid from Northdale Ford and 5% check be returned to them. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that the Police Chief be authorized to transfer the present safety equipment from the present car to the new car, and that he purchase necessary safety shield to be installed in new car at a cost of approximately $200.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, that the bills associated with the Police squad car be turned over to Police Chief for verification and accounting of all expenses incurred to date and to be incorporated as a future practice for the Police Chief. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED Police Chief Barth to check with Motorola to see what it would cost to replace the visi-bar of squad car. 7.2 Comment from Council members regarding system statements LaValle stated that Carl Dale is working on the grant to receive money for the Land Planning Act. Council members discussed questionable areas regarding Hugo's system statements. Attorney Johnson made note of these areas for incorporation into Hugo's appeal with the Metro Council. City Clerk stated she would investigate the Metro Council's definition of benefits pertaining to free standing growth area and rural service area. Counciman Irsfeld is to set up a meeting to be attended by Attorney Johnson, Engineer Kuusisto, Carl Dale, and a City Council member. 90 8.0 NEW BUSINESS 8.1 Gerald Beach — Report on diseased trees — Cancelled 8.3 Horseshoe Lake Report Mayor LaValle met with Rice Creek Watershed September 14, 1977, and he stated that there was a good representation from Hugo at the meeting. Rice Creek has proposed to go out in the field to determine which way the water runs. This is to be done at Rice Creek's expense. The city has accummulated administrative costs of $11,000. Everyone in the effected area is against the project, and claim they will receive no benefits. LaValle stated that the benefits do not out weigh the costs to be incurred. Spitzer felt that the project should not be abandoned, because in a couple of years, the same problems could arise. LaValle stated that the reasonable approach would be to get the cost down or get someone to help contribute some money. Schletty stated that Jerry Riople was the only person stating that he was not in objection to the project. LaValle will draft a letter to Rice Creek asking if the cost was justified, and if Rice Creek would be willing to help out financially on the project. 8.4 Flood Insurance Report LaValle stated that he will put together a report indicating that he met with the Federal Insurance Administration people. The City of Hugo will be required to adopt and enforce a flood plain ordinance to regulate all new construction and substantial rehabilitation in the flood hazard areas designated in the report. 9.0 MISCELLANEOUS MOTION: Spitzer made motion, seconded by Irsfeld, to hire Renee Larson 14220 Ostlund Trail North, Marine, Minnesota under Special Projects, CETA. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MAYOR LaValle had sent a letter to Building Inspector, Tom Crever, regarding the safety hazard at the Stewart Bogart residence. Last fall they had a fire, and the home has not been remodeled, leaving broken glass and other debris. Mr. Crever con— tacted Bogart's insurance company, who in turn, gave him their attorney's name. The attorney said that Mr. Bogart has not provided them with a statement of loss. LaValle is going to handle the matter through the nuisance procedure. MOTION: LaValle made motion, seconded by Spitzer, that the City Clerk send Mr. Bogart a registered letter asking him to appear at the next City Council meeting, October 3, 1977, at 7:30 PM. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED SEPTEMBER 19, 1977 9 i- MOTION: Schletty made motion, seconded by Spitzer, to extend the meeting past 11:00 PM. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail ' MOTION CARRIED The letter to Crever also asked whether there was any construction being done at the Bald Eagle Sportsman Club. Mr. Crever stated that the gates were locked, and he wasn't Going to trespass. Chief Barth stated that he had a key to the club, and he would be willing to take Mr. Crever in there. LaValle scheduled a Special Meeting to discuss the City Budget for September 23, 1977, at 7:00 PM. There will be a meeting at Washington County, September 28, 1977, at 10:00 AM, regarding the petition from the Police Department to join the Teamster Union. Attorney Johnson has reviewed the land registration for Wilfrid Riopel with the City Engineer. It does not appear that the roadway mentioned in the registration proceeding is involved with either the road system for the City of Hugo, or in the drainage system for the City of Hugo. MOTION: LaValle made motion, seconded by Schletty, that the City Attorney be directed to respond to Wilfrid Riopel's attorney, • in the respect that the City of Hugo does not have any objection. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Engineer Kuusisto stated that the documents regarding the watermain extension Project 77-29 be signed after the attorney's review. The city is to hold the three low bids, and send E. Montgomery Construction bid back to them. MOTION: Spitzer made motion, seconded by Schletty, that the Mayor and City Clerk be directed to sign the contract with LaValle Excavating for the watermain Project 77-29. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail ABSTAINED: LaValle MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, to adjourn at 11;27 PM. All aye. Motion carried. (lAitt.A.
