PRESENT: Spitzer, Schletty, Irsfeld, and Vail ABSENT: LaValle 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Vail:,: to approve the minutes of October 3, 1977, as presented. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of October 5, 1977, as presented. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Schletty made motion seconded by Irsfeld, to approve the general claims of October 17, 1977 as presented. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Vail made motion, seconded by Schletty, to approve the utility claims of October 17, 1977, with the addition of $19.50 chang— ing the total to $1056.09. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.0 PETITIONS REQUESTS. COMMUNICATIONS & LICENSES 5.1 James Johnson — Mobile Home Permit Renewal MOTION: Irsfeld made motion, seconded by Schletty, to renew the Mobile Home Permit for James Johnson, 7194 - 132nd. Street, under Chapter 40, Article III, Subdivision D, for 90 days. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.2 Joe Zaspel — Mobile Home Permit Renewal MOTION: Schletty made motion, seconded by Vail, to renew the Mobile Home Permit for Joe Zaspel, 17205 Forest Blvd, under Chapter 40, Article III, Subdivision D, for 90 days. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED OCTOBER 17, 1977 1 03 5.3 American Legion — Bingo License The Legion provided the city with a copy of their minutes of July 19, 1977, indicating that LuVerne Marier had been appointed to be the bingo chairperson. The Legion has requested that the bond request be waivered. MOTION: Irsfeld made motion, seconded by Vail, to approve the bingo license for the American Legion with waiver of the bond. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.4 Withrow Tennis Courts — Request for help Toni Fagerhaugh represented the Withrow area stating that they had gone to Grant Township, and wereienied their request for funds. They had also approached May Townslip, and were given $2,000.00. They have personal donations amounting to $200.00. The Withrow Education Association has donated $300.00, making a total of $2,500.00 definitely donated to the cause. City Clerk, Carol Williams, stated that Hugo participated in the amount of $1,950.00 in 1973 in the construction of the city's tennis courts. There was no figure for the amount spent on the hockey rink at the school. Spitzer suggested that the Council should pass a motion that the city would like to contribute and get the clerk and treasurer to get the status of where we stand in regard to the budget, and give Withrow a dollar figure later. MOTION: Vail made motion, seconded by Schletty, that it is the concensus of tf= the City Council that we will assest the Withrow Athletic Association in the construction of their tennis courts in an amount to be determined at the meeting of November 7, 1977. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION C, ' ' ID) 5/5 Mr. Dale Palmer — Nuisance Violation The city had received a written complaint stating the Mr. Palmer had an excess of auto— mobiles stored on his property. Mr. Palmer had stated at a previous meeting that the problem would be resolved at this time. Mr. Palmer was present and stated that he did not havea .building constructed as yet, but would have it done by the middle of November. He stated that he would not need as large a building as originally planned. MOTION: Irsfeld made motion, seconded by Schletty, that the Police Chief review this problem, on or about November 15, 1977, and have a report ready no later than November 21, 1977. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.6 Shirley Duckstad — Special Use Permit Mrs. Duckstad would like to operate a beauty shop in her residence at 6800 177th Street. MOTION: Schletty made motion, seconded by Vail, that we grant a Special Use Permit to Shirley Duckstad, 6800 177th Street, for operating a beauty shop in her home subject to the recommendations as made by the Planning Commission: 1 llev Duckstad Cont. 1. Special Use Permit is not transferable to a new property owner. 2. The beauty shop to be restricted to one operator. 3. Permit one sign on the property within the restrictions of the sign ordinance. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.7 Robert Ricci - Special Use Permit Mrs. Ricci was present and provided the City Council with an irrevocable letter of credit in the amount of $2,400.00, and the exterior design of the proposed building ( consider View A). The city attorney stated that the letter of credit was only good until November 1, 1977, and Mrs. Ricci stated that they hoped to have the work completed by then, or they would have the letter of credit extended. Mr. Johnsen wanted Mrs. Ricci to understand that the ; 2,400.00 is available as a fund to insure that the blacktopping is put on the park- ing lot, and Mrs. Ricci agreed. MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Special Use Permit to Robert Ricci to expand the existing restaurant at 14145 Forest Blvd., with the following conditions: 1. That the building be constructed according to the site plan and building design as submitted and approved by the city. 2. That the driveway and parking lot be blacktopped by November 1, 1977. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.8 Richard Schuh - Amended Mining Permit Mr. Bruce Malkerson, Mr. Schuh's attorney, stated they had no objection to the recommenda- tions as made by the Planning Commission. Engineer Kuusisto reviewed the new contour maps as presented by Mr. Schuh. Kuusisto stated that he inspected the haul road of 152nd Street, and felt that more aggregate was needed on the road. He will inspect the road again later. He also stated that he had received complaints about the dust. MOTION: Vail made motion, seconded by Schletty, to grant an amended Mining Permit to Richard Schuh to operate a hot mix plant and for addition- al mining, with the 19 conditions as stated by the Planning Commission (see attached). VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.9 Lavina Duraine - Amended Special Use Permit MOTION: Irsfeld made motion, seconded by Schletty, to grant an amended Special Use Permit to Lavian Kuraine with the noted change in Item 3 deleting the Project #77-04-018. 1. Extend Special Use Permit until June 1, 1978. OCTOBER 17, 1977 105 5.9 Lavins Duraine - Amended Special-Use-Permit - Cont. 2, Post bond in the amount of 35,000.00 3. The bituminous hot mix plant should be allowed. 4. Special Use Permit to allow for additional mining. 5. All existing trees and natural vegetation bordering the pit area shall be left undisturbed. 6. All top soil in the pit area shall be stockpiled, and at the time the operation is completed, the top soil shall be replaced and seeded to grass cover. 7. Sewer facilities shall be of the portable, chemical holding tank type. 8. Updated contour map to be provided to City Engineer. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.0 Howard Meline - Liquor License Mr. Meline provided a certified copy of his articles of incorporation for the record. Everything else is in order. MOTION: Spitzer made motion, seconded by Irsfeld, that we approve the applications for an OFF SALE INTOXICATING LIQUOR LICENSE, ON SALE INTOXICATING LIQUOR LICENSE, ON SALE SUNDAY LIQUOR LICENSE, CIGARETTE LICENSE, AND A SOFT DRINK LICENSE to Howard Meline, Melody Lounge, Inc., subject to the correction of the defects in signatures on the applications. Total amount of licenses paid is $390.34. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.1 Richard Schmidt - Liquor License (Nashville North) City Attorney, Johnson, stated that the structure is not usable at this time, and Mr. Schmidt responded that they have a commitment to have the repairs made to the roof, electrical and plumbing as needed. The Schmidts' do not want to invest any money in the structure A they cannot get a liquor license. It was recommended to them to have the Building Inspector look over the improvements, and file a report at City Hall. MOTION: Spitzer made motion, seconded by Schletty, that we except the application by the Schmidts' as a valid application for the now vacant liquor license in the city, and shall be considered as • the first filing in case of subsequent filings for a period of 90 days, and that subsequent applications will be considered in order of filing during that 90 day period. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. 106 MOTION CARRIED 6.2 Raymond Olson — Special Use Permit Mr. Olson would like to build a 3—car garage prior to the construction of his home in the spring of 1978. Mr. Olson provided the city with an irrevocable letter of credit in the amount of $5,000.00 and proof of of tership. The deed has been sent to Washington County for recording. Mr. Olson also applied for a Mobile Home Permit to be renewed every 90 days. MOTION: Spitzer made motion, seconded by Schletty, to grant a Special Use Permit to Raymond Olson to construct a 3-car garage at 132nd and Homestead subject to the following conditions: 1. That construction of Mr. Olson's house begin no later than June 1, 1978. 2. The irrevocable letter of credit ($5,000.00) to be released when a Building Permit for a residence is obtained. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the request for a Mobile Home Permit to Raymond Olson, under Chapter 40, Article III, Subdivision D, for 90 days. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED RECESSED 8:25 PM RECONVENED 8:45 PM 6.0 ORDINANCES AND RESOLUTIONS MOTION: Irsfeld made motion, seconded by Vail, to adopt RESOLUTION 1977-19, A RESOLUTION OF THE GOVERNING BODY TRANSMITTING THE ATTACHED APPLICATION FOR A LOCAL PLANNING ASSESTANCE 1RANT AS PER THE METROPOLITAN COUNCIL ADOPTED GUIDELINES FOR THE APPLICATION, AWARD AND DISBURSEMENT OF SAID FUNDS AS AUTHORIZED BY PROVISIONS OF THE METROPOLITAN LAND PLANNING ACT ADOPTED BY THE STATE LEGISLATURE. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 Recommendation from Planning Commission regarding commercial/recreation activities in Ag and Cons Districts The Planning Commission recommended that the Zoning Ordinance stand as is, and the activities to be handled by Special Use Permit. OCTOBER 17, 1977 1. 0 7 7.1 Recommendation from Planning Commission regarding commercial/recreation activities in Am and Cons Districts cont. MOTION: Spitzer made motion, seconded by Vail, that it is the concensus of the City Council that commercial/recreation activities in the Agriculture and Conservancy Districts stand as printed in the current Zoning Ordinance. All requests will be handled by Special Use Permit. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 7.2 Reschedule public hearing for abolishing the rural tax district MOTION: Schletty made motion, seconded by Vail, to schedule a public hear- ing and special meeting of the City Council for November 28, 1977, at 7:00 PM, at the Hugo Elementary School, 14895 Francesca Avenue, to consider the abolishing of the rural tax district. Location has been verified by City Clerk. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 7.3 Contract for fire fighting - Forest Lake Fire Chief, Jim Olson, reviewed the contract that has been signed by Forest Lake, dated September 21, 1977. Mr. Johnson stated that if the Fire Department felt everything was in order, we could go ahead with the contract. MOTION: Spitzer made motion, seconded by Vail, to ratify the Mutual Aid Agreement between the Hugo Fire Department and the Forest Lake Fire Department. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED The Council reviewed Mr. Johnson's report of October 3, 1977. Mr. Johnson stated that the Beisang Road was now under construction, and a draft of the road agreement with Grant Township is now being compiled. Mr. Johnson responded to the letter regarding whether blacktop plants are included in the Mining Permit. They are included as part of the processing, but each should be considered on an individual basis. Mr. Johnson will verify this in writing to the Planning Commission. 8.0 NEW BUSINESS 8.1 Approval for screening (Horton & Noack) MOTION: Irsfeld made motion, seconded by Vail, to table the matter until November 7, 1977, for review by the City Engineer, VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 1SDefine service area for sanitary sewer — Bald Eagle Howard Kuusisto presented a preliminary plan for the proposed sewered area. Irsfeld asked that if we went ahead with the improvements,what the problems would be with assessments if land went to Open Space. Mr. Johnson stated that he was certain the city would be making the improvements at their own risk. Vail agreed to attend a meeting at Lino Lakes on Tuesday, October 18. The meeting will be with the subcommittee on Open Space. MOTION: Spitzer made motion, seconded by Schletty, to direct the City Clerk to write a letter to the Project Director, Ramsey County, asking that if they had permission to negotiate for acquisition of property in the proposed Bald Eagle park area, what would their position be in regard to assessments or city improvements. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 9.0 CLERK MOTION: Schletty made motion, seconded by Vail, to extend the snowplowing contract with Washington County until April 30, 1978. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, that the City Clerk be . instructed to sign the Watermain Improvement 148th Street Loop Closure. VOTING FOR: Spitzer, Schletty, Irsfled, and Vail. MOTION CARRIED Mrs. Russett is interested in selling her property, and contacted City Attorney, Johnson, regarding the possibility of having two parcels of property, one 10 acres and one 75 acres, in the Conservancy District. There is an existing parcel consisting of five acres. It was suggested to Mrs. Russett that she have one parcel deeded 15 acres, and leave the balance of 70 acres on a contract for deed. Howard Schletty received a letter from Jr. Stanek asking that the City improve or construct a road between County Road 4 and 56 for possible development. There is a 661 easement on the property, but has not been maintained for approximately 35 years. Mr. Johnson felt that after all this time, the city would not have to bear in the responsibility of creating a road. Mr. Schletty received a call from the City clerk of May Township stating that the City of Hugo has not contributed in the maintenance of Keystone Avenue, between 170th and 180th Streets for a number of years. The scope of the Mining Permit shall be limited to the terms included in the Application for Mining Permit dated October 27, 1975, a copy of which is attached hereto and incorporated herein by reference, it being understood that - 4 the permit is limited to stockpiling and hauling away the 4 existing stockpile of granular material and asphalt mix and restoration of the area, and that no material may be hauled to the site except for approximately 4,500 tons of 5/8" crushed rock to blend with the existing material on the property, and the excavation, crushing, stockpiling and hauling away of material shown on the contour map. 3. No top soil or overburden shall be removed from the site. II 4. Haul roads shall be Irish Avenue South to County Road 8A, and 152nd Street east to Jeffrey Road, only. 5. The inspection fee shall be deposited in the amount of $500.00, and engineering and legal inspection shall be done as needed. 7. The contractor shall provide and maintain both a 310,000.00 bond and a 125,000.00 irrevocable letter of credit for the maintenance and/or reconstruction of the haul roads, and to insure compli- ance of all conditions of the permit. 8. Recommendations of the Engineer of the City of Hugo, as they may be made from time to time, shall be made a part of this . permit. 9. Inspection to insure compliance with this permit will be done by the Engineer of the City of Hugo, and he may request that the assistance of such other persons or organizations as he may deem necessary. 10. Any violations of the terms or conditions of this permit shall be grounds for immediate termination in accordance with the City Ordinance. 11. Haul roads shall be periodically inspected by the City Engineer • and maintained by the contractor in accordance with his recommen- dations. 12. A speed limit of a maximum of 45 miles per hour be maintained by the contractor gravel trucks when operating on the haul roads . on City Streets. On those days when school is in session, a speed limit of a maximum of 30 miles per hour be maintained by the gravel trucks when operating on haul roads on city streets between the hours of 7:00 and 7:30 A.M. 13. Any additional limitations or specifications for the haul routes which shall be deemed necessary for the health and safety reasons by the City Engineer and City Attorney. 14. The hours on mining operations shall be 7:00 A.M. to 7:00 P.M. Monday through Saturday. 15. There shall be not trucking or hauling in of material except as noted herein without an amendment of this Mining Permit. 16. The sight distance along the haul routes shall be improved at the expense of the permit holder according to the requirements of the Engineer for the City of Hugo. 17. A temporary portable asphalt plant may be placed on the property. The plant shall comply with PCA requirements and have a valid PCA number prior to operation. 18. Updated contour map be filed with City Engineer no later than 10/3/77= 19. Project #77-0-418 be removed from the Mining Permit. OCTOBER 17, 1977 109 MOTION: Schletty made motion, seconded by Irsfeld, to direct the City Clerk to write to May Township stating that the City of Hugo would pay $150.00, starting in 1978, to maintain Keystone between 170th and 180th Streets, and would like an estimate of the anount of gravel that is needed. VOTING FOR: Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Vail made motion, seconded by Schletty, to purchase two (2) automatic garage door openers for the Fire Department for $666.00, and contract to have an electrical firm wire the door openers in an amount not to exceed $240.00.
