PRESENT: LaValle, Schietty, Irafeld, and Vail. ABSENT: Spitzer 5.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by LaValle, to approve the min- utes of February 6, 1978, after the following change is made: Page 4 (6.8) - The DNR has not granted a permit to the White Bear Rod and Gun Club to fill some land on their property. They do not feel a permit is necessary. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Irafeld made motion, seconded by Vail, to approve the min- utes of February 15, 1978, as presented. VOTING FOR: LaValle, Schietty, Irsfeld, and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irafeld made motion, seconded by Vail, to approve the gen- eral claims of February 21 , 1978, after the following changes are made: Item 13 (George Koland) - $34.20 of this claims should be taken from utility claims. Item 16 (NSP) - This billed should not be paid until check- ed further VOTING FOR: LaValle, Schietty, Irafeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the util- ity claims of February 21 , 1978, with the addition of Item 8 (George Koland) in the amount of $34.20. VOTING FOR: LaValle Schietty, Irsfeld, and Vail MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.4 Robert McCullough - Special Use Permit Mr. McCullough is asking for a Special Use Permit to build a greenhouse and nursery. Retail selling will be the major concern of his business. FEBRUARY 21 , 1978 I) 5 .4 Robert McCullough - Special Use Permit Con't The land is presently zoned Agriculture, but this is a request to have the land rezoned to RB. Mayor LaValle felt that the Council should not take any action on this request until the rezoning matter has been resolved. If the land is rezoned. to RB, Mr. McCullough might not need a Special Use Permit (permitted use in RB zone). MOTION: LaValle made motion, seconded by Schletty, to table the re- quest of Mr. Robert McCullough for a Special Use Permit until the City Council meeting of March 6, 1978. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED '.2 Oneka Hill Farms - Rezoning and Variance Oneka Hill Farms is requesting rezoning from RB to CB inorder to build a country store in Withrow. CB is recommended to comply better with set- backs requirements. MOTION: LaValle made motion, seconded by Irsfeld, that the rezoning request from RB to CB made by the Oneka Hill Farms be grant- ed. Legal description of property as follows: Pt SE4 of SE* of Section 36. Zoning map to be amended to show that zoning is CB. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. ABSENT: Spitzer MOTION CARRIED Oneka Hill Farms requested that a variance be granted to allow for a gravel parking lot. Parking would be used in conjunction with Stan's Bar parking lot. Mayor LaValle felt that rather than granting a variance, the city should waive the blacktopping requirement at this time. MOTION: Irsfeld made motion, seconded by Schletty, that the City of Hugo waive the blacktopping of the parking area of the Oneka Farm's country store in Withrow until such time as there is a change in the use or ownership. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED 5 .5 Joseph Gregoire - Mobile Home Renewal Mr. Gregoire's permit was given an annual review at this time. Mr. Gregoire was present and stated that he farms 360 acres, and his son is living in the mobile home. A new septic system has been installed. MOTION: LaValle made motion, seconded by Schletty, to grant the re- newal of the Mobile Home Permit for Joseph Gregoire, 7600 165th Street North, Hugo, Minnesota, under Chapter 40, Article III, Subdivision D, for ninety days. MOTION CARRIED 5.6 Jerry Beach - Diseased Tree Program Mr. Beach was present and stated that he would like to eliminate the Bald Eagle Lake area from the controlled zone. He stated that there is no way to control or contain the Dutch Elm disease. The removal of these trees in wooded areas is causing quite a bit of grief to many people in this area. Mr. each requested permission to meet with the Department of Agriculture to discuss this matter. MOTION: Schletty made motion, seconded by Irsfeld, that Mr. Jerry Beach be authorized to discuss the elimination of the Bald Eagle Lake area as a controlled zone for Dutch Elm. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED Mr. Beach stated that he will come before the City Council again in the summer time to request assistance in controlling the oak wilt problem. Councilman Deane Vail will work with Mr. Beach to investigate the state funds available to Hugo for a replanting program for 1978. 5.7 Bob Rosenauist - Letter of resignation MOTION: LaValle made motion, seconded by Vail, that the City of Hugo accept the letter of resignation from Planning Commis- sion member, Bob Rosenquist. Planning Commission secretary asked to inform the Commission to make a recommendation to fill this position. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.1 James Brevis - Special Use Permit Mr. Brevig was present and stated that he would like to construct a 50x 100 pole barn to house antique cars, and various other items. He stated that he contacted all property owners within 350' of his property, an no one .ob- jected. Mayor LaValle stated that the Planning Commission recommended den- ial, and the Council reviewed the various chapters of the ordinance as listed by the Planning Commission. MOTION: LaValle made motion, seconded by Irsfeld, that the City Council grant a Special Use Permit to Mr. James Brevig to construct a 50 x 100 pole barn. The building is not to be used for rental purposes. The particular use is for storing antique cars and recreational vehicles. Mr. Brevig is to post a bond with the City of Hugo in the amount of $1 ,000.00 guaranteeing that that use does not change. At such time as use changes, the Special Use Permit is null and void. The bond and permit is to be renewed on an annual basis. VOTING FOR: LaValle, Schletty, and Vail. VOTING AGAINST: Irsfeld MOTION CARRIED FEBRUARY 21 , 1978 5 7 6.0 ORDINANCES AND RESOLUTIONS MOTION: LaValle made motion, seconded by Irsfeld, to adopt RESOLUTION 1978-22, A RESOLUTION THAT THE ACT TO EXPAND THE WASHINGTON COUNTY BOARD OF COMMISSIONERS FROM FIVE TO SEVEN MEMBERS IS NOT IN THE BEST INTEREST OF THE PEOPLE IN WASHINGTON COUNTY. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 Mr. Burkard — McCarthy Well Mr. Burkard has stated that there will be no inspection of the underground pump until 1979. At that time, he will get bids for the cost of the project. 8.0 NEW BUSINESS No discussion 9.0 CLERK MOTION: Irsfeld made motion, seconded by Schletty, that Renee Larson be bonded as city employee. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED 10.0 MISCELLANEOUS Mr. Charles Shubat was present and stated that he has been unable to get Mr. Clifford Axelson to sign any papers stating his willingness to give a 16i' easement for a road. He has given his oral approval. Mr. Shubat offered his alternatives to resolve the matter. He suggested that the road be jogged slightly and take the 66' from Mr. Schuneman, or grant a variance leaving one rod width on each side. MOTION: LaValle, made motion, seconded by Irsfeld, that the City of Hugo grant preliminary approval of the extension of 130th Street with a temporary turn around and temporary easement. The width has been determined as a cartway, and Mr. Shubat shall show on the plat 33' title to the City of Hugo south of the section line. (An easement for road purposes above and across the North 33' of the NE* of the NWI of Section 33, Township 31 , Range 21 . VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED City Attorney, Johnson, met with Howard Kuusisto, Mr. James Brevig, and Mr. Geck, Brevig's attorney, regarding the Vail/Brevig dike dispute. Mr. Brevig has agreed to allow the city to enter his property to remove the dike. This would be considered as a partial solution to the problem. A permit from Rice Creek will al so have to be obtained. Mr. Brevig has asked that the over flow structure be moved from the center of the dike. He also asked that existing natural foliage tried to be saved. Mr. Johnson FEBRUARY 21 , 1978 ! Q. 10.0 MISCELLANEOUS CON'T. stated that the city would not be involved with any restoration on Mr. Brevig's property. Mayor LaValle stated that the city would have to get some type of easement for Outlot A. Mr. Johnson stated there should be some kind of authority to (1 ) pursue details of the design, (2) determine if and when we have to go to Rice Creek, and (3) authorize further negotiations to get settlement reduced to writing. MOTION: Irsfeld made motion, seconded by Schletty, that City Engineer, Howard Kuusisto spent the amount of time necessary to work on the dike problem, and contact Rice Creek in re- gard to proper permits as needed. Mr. Johnson is to work on settlement agreement. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED Mr. Johnson will work on necessary figures for a proposed response to Mr. Jack Frost, Metro Waste Control Commission, regarding Hugo's reserve capacity. Mr. Kuusisto will work on preliminary easements necessary to complete the 165th Street bridge replacement program. Northwestern Bell has requested permission to bury cable on 132nd Street. MOTION: Irsfeld made motion, seconded by Schletty, that the City of Hugo approve Job #47432 to allow Northwestern Bell to bury telephone lines on 132nd Street. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED Mr. Johnson presented the Council with a preliminary draft of the Grant Township Road Agreement. The matter will be discussed at the meeting of March 6, 1978. Mr. Kuusisto will give Mayor LaValle a call when he has more definite information regarding the installation of water on 148th Street. Mr. Ron Istanovich, Hugo Fire Dept. , was present requesting financial assistance to construct a radio room to eliminate noise from the fire trucks. MOTION: LaValle made motion, seconded by Irsfeld, that the Fire Department be authorized to provide the labor to build a radio room, 5' x 8' outside measurements. The city will provide materials for an amount not to exceed $100.00 VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED Patrolman, John Jackson, submitted a letter stating there is an overflowing septic system on Everton Avenue. FEBRUARY 21 , 1978 6 1 MOTION: LaValle made motion, seconded by Schletty, that the City of Hugo's Health Officers, Irsfeld and Vail, investigate the complaint and report to the City Council on March 20, 1978. VOTING FOR: LaValle, Schletty, Irsfeld, and Vail. MOTION CARRIED Councilman Vail had spoken to Carl Christianson, Shepherd of the Fields Church, and he stated that the church will not submit a letter of credit to the city in the amount of $2,500.00 MOTION: Irsfeld made motion, seconded by LaValle, to adjourn at 10:45 PM.
