PRESENT: LaValle, Spitzer, Schletty, and Vail. ABSENT: Irsfeld 3.0 APPROVAL OF MINUTES MOTION: Spitzer made motion, seconded by Vail, to approve the minutes of March 6, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, to approve the minutes of March 10, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED MOTION: Vail made motion, seconded by Spitzer, to approve the minutes of March 13, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Vail, to approve the General Claims of March 20 1978, with the addition of 17.1 for $50.00 (Police Chief's Training Service In- stitute) . VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, to approve the Utility Claims of March 20, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Mrs. Louise Stone - Petition for Mobile Home Permit Mrs. Stone has requested for a mobile home at 12541 Ingersoll Avenue, to house her aging father, Louis Mastroddi. Mrs. Stone was not present at the meeting. MOTION: Spitzer made motion, seconded by Schletty, to table the petition for a Mobile Home Permit. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED 5.2 Jim Husnik - Site Plan Mr. Husnik presented his site plan to the City Council for their review. MOTION: Spitzer made motion, seconded by Vail, to approve the site plan for Mr. James Husnik, with the provision that the parking lot be brought up to the City Enginee1's MARCH 20, 1978 `' 5.2 Jim Husnik - Site Plan cont. standards within 60 days after construction of the building. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED 5..23 Bruce Charpentier - Minor Subdivision and Variance Mr. Charpentier is requesting to subdivide one acre of land and a variance to use a 30' easement as a driveway. Mr. Fred Fuibright owns the driveway, but has given permission to Mr. Pugh and Mr. Charpentier to utilize the easement. This will all be part of the contract when it is signed. MOTION: LaValle made motion, seconded by Vail, to approve the Minor Subdivision as requested by Mr. Bruce Charpentier. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, that the variance request of Mr. Bruce Charpentier, subject to the following: 1 . The dwelling or other buildings to be so located as to permit the additional 30' of roadway in the future and subsequent setback. 2. This 30' driveway is to serve the existing residence and the resident referred to in this application, and no more. 3. Inclusive of easement in the instrument conveying the right to Mr. Charpentier. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED 5.4 Howard Moe - Special Use Permit Mr. Moe is requesting a permit for a used car lot and rental. He also will be doing minor repairs and servicing of the cars he is planning to sell. This service will not be done for the public. Mr. Moe intended to install two gas pumps for self-service use, but was in- formed that he would have to apply for another Special Use Permit. Mr. Moe was under the assumption that the gasoline part of the business was grandfathered in. Gas has not been pumped there since 1975, and the pumps were removed in 1977. Spitzer stated that once the operation stops, the grandfather clause lapses. Mr. Moe presented the Council with a $3,000 letter of credit to insure blacktopping. His insurance agent was not sure what the $5,000 performance bond was to cover, so he would like some clarification. MOTION: Spitzer made motion, seconded by Schletty, to grant a Special Use Permit to Howard Moe to operate a used car sales and rental lot at 14057 Forest Boulevard, subject to the following: MARCH 20, 1978 89 1 . That the access and egress to the business have a minimum of 30' width driveway, hard surfaced. 2. That the area to be blacktopped as proposed in the site plan submitted. 3. An irrevocable letter of credit in the amount of $3,000 be provided to insure blacktopping by October 1 , 1979. 4. That the public restrooms, as required by law, be connected to city sewer no later than October 1 , 1978. 5. That minor body and paint work be allowed subject to all state and federal regulations or codes for work on vehicles owned by the business only. 6. Refer 320-5-M-3 - refers to said regulations for in- operable cars. That the back area of the property be maintained in a neat and orderly fashion. 7. That nor more than three (3) cars be allowed under Condition #6. 8. A performance bond in the amount of $5,000 be provided to insure that all regulations of state codes be met for above body work. 9. That the equipment and materials now stored on the property be removed by July 1 , 1978. 10. The Special Use Permit is subject to annual review. 11 . No more than eleven (11 ) cars allowed for exterior storage. There shall be no cars stored on the eastern 50' of the property. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED 5.5 Urban/rural taxing district The public hearing regarding the abolishing of the rural taxing district was reopened. Spitzer reiterated what took place at the public hearing on March 13, 1978. Vail stated that it was law that all platted property automatically should fall in the urban taxing district. Mrs. Darrel Jacobson 6364 165th Street No - wanted to know that if a senior citizens taxes were frozen, if this change would affect them. LaValle - thought that the mill rate would be the same for everyone. Joanne Jenson 530 11th Ave SE - quoted State Statute 272.67, establishing the rural Forest Lake and urban taxing district. Charles Johnson - up to the governing body to set ratio of service. Howard Schletty - stated that there was no one at the public hearing in favor of the equalization. He also felt that the 90% rural work and 10% urban was incorrect information supplied by the maintenance department, and they were not his figures. Irene Leroux 16629 Elmcrest Ave - wanted to know why the roads were in such poor condition when so much money is spent on maintenance. It is costing the taxpayer alot of money, and they are not getting the service. MARCH 20, 1978 91 LaValle - the Road Committee has been working on the establishment of the city's own road department. The initial cost would be quite high to start up such an operation. MOTION: LaValle made motion, seconded by Spitzer, to appoint Mrs. Irene Leroux to the Road Committee. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, to appoint Mr. Tom Pogreba to the Road Committee. VOTING FOR: LaValle, Spitzer, Schletty, and Vail. MOTION CARRIED Marvin Christianson 6178 Oneka Lake Blvd - all land owners cannot sell the same amount of land. Mrs. Laurene Meyer 6358 145th St No - wanted to know what account light repair and water tower work was paid from. LaValle - the city has two accounts and this work is paid for from the utility account. MOTION: Spitzer made motion, seconded by Schletty, to close the public hearing at 9:06 PM. VOTING FOR: LaValle, Spitzer, Schletty, and Vail MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS MOTION: LaValle made motion, seconded by Vail, that the City of Hugo adopt Ordinance For Chapter 100, Hugo City Code, A PROPOSED ORDINANCE ABOLISHING ALL RURAL TAXING DISTRICTS WITHIN THE CORPORATE LIMITS OF THE CITY OF HUGO, MINNESOTA. It was determined that more information is needed before this proposed ordinance could be adopted. VOTING FOR: Vail VOTING AGAINST: LaValle, Spitzer, and Schletty MOTION FAILED RECESSED 9:20 PM - RECONVENED 9:38 PM Councilman Schletty left the meeting at this time. Mayor LaValle stated that before the City Council considering adopting any modification of the proposed ordinance, advanced notice would be published in the paper. He also asked that any comments or suggestions, be sent to City Hall. MARCH 20, 1978 [, ,� Screening of salvage yards �7 The Highway Department rejected the first proposal as submitted to the city. A new proposal has been submitted, and has been referred to the Planning Commission for their review. MOTION: LaValle made motion, seconded by Spitzer, that the Planning Commission consider the request of the City Council to include the item of screening of salvage yards in Hugo. VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that the Board of Review be set for May 9, 1978, Hugo City Hall, from 9:30 AM - 3:00 PM for the purpose of considering the review of the Washington County tax assessments. VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 Health Officers Report on Simpson The officers could not report at this time, but will inspect the site at a later date. The Simpsons' property is being checked for possible sewer problems. 8,0 NEW BUSINESS 8.1 Fill vacancy on Planning Commission MOTION: Spitzer made motion, seconded by LaValle, to appoint Dave Woeltge to fill the vacancy on the Planning Commission. VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED 9.0 CLERK - no discussion 10.0 MISCELLANEOUS Mr. Johnson stated that there was a public hearing held in Stillwater dealing with the condemnation of land for power lines. The objections of the city were noted at the hearing. There is a descrepancy in where the city feels the easment lies and where NSP thinks it is. Mr. Johnson stated that there is still work to be done on the systems state- ment. He felt that the Council should review all of the suggested changes. Another meeting will have to be set up with Metro Council, and Lino Lakes regarding Open Space. A resolution was sent to Metro Council, but the city has not received a reply from them. MOTION: Spitzer made motion, seconded by LaValle, to direct the City Clerk to send a letter to Metro Council, Mr. Bob Nethercutt, as to the status of the resolution sent regarding Open Space. MARCH 20, 1978 95 VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that the Burning Permit fees be amended to $3.00 for application and $3.00 for the permit, Resolution 1978-25. VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, that the city authorize the Police Chief to attend the Police Chief's Training Service Institute, March 28 - 30, and that the tuition be paid in the amount of $50.00. VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED Mr. Carl Nordquist, President of the Hugo Lions Club, was present trying to ge the Council's feelings for the possible installation of public restroom facilities separate of City Hall. The club pays about $500 to have portable facilities provided during Good Neighbor Days. Mayor suggested that the club get in touch with Howard Kuusisto to try and resolve some of the problems. Councilman Deane Vail will assist in this matter. The City Council agreed tia t there was a need for this project. Richard Busse MOTION: LaValle made motion, seconded by Spitzer, directing the City Clerk to send a letter to Richard Busse stating that the city is not interested, at this time, in obtaining land from him for road easements. VOTING FOR: LaValle, Spitzer, and Vail MOTION CARRIED The City Clerk was instructed to contact Mr. Charles Swanson, Washington County, regarding the condition of the road on 145th Street and High- way 61 .
