PRESENT: LaValle, Spitzer, Schletty, Irsfeld, and Vail. 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes of April 3, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the minutes of April 10, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Irsfeld, to approve tle General Claims of April 17, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims of April 17, 1978, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Ray Olson — Mobile Home Renewal The Building Inspector has Mr. Olson's application, and it has been approved. MOTION: Spitzer made motion, seconded by Irsfeld, to renew the Mobile Home Permit for Raymond Olson, 7800 132nd Street North, under Chapter 40, Article III, for a period of 90 days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.2 James Johnson — Mobile Home Renewal Mr. Johnson informed City Hall that his mobile home has been sold, and that it will be removed from the property by May 1 , 1978. MOTION: Spitzer made motion, seconded by Schletty, to renew the mobile home permit for James Johnson 7194 132nd Street, under Chapter 40, Article III, Subdivision D, for 90 days. MOTION CARRIED 5.4 James Leroux - Farm Site Plan Mr. Leroux has constructed a 24 x 40 pole barn to use as a garage and work shop. MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Farm Site Plan of James Leroux, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.5 Harold Bramstedt - Farm Site Plan Mr. Bramstedt has constructed a 48 x 108 pole barn. MOTION: Irsfeld made motion, seconded by Spitzer, to approve the Farm Site Plan of Harold Bramstedt, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.6 Raymond Pribnow - Farm Site Plan Mr. Pribnow requested permission to construct a 30 x 56 barn. The land is zoned RRI. MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Farm Site Plan of Raymond Pribnow, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.7 Howard Moe - Recalculate footage Water Superintendent, Mr. Burkard, recalculated the figures and determined that the assessment was correct at 300' . MOTION: Spitzer made motion, seconded by Schletty, to certify the assessment for Project 77-29 at $9.00 per foot, as submitted by the City Engineer. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, that the assessment be certified after 30 days for a term of five (5) years at 8% interest. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED APRIL 17, 1978 149_ 5.8 Vern Peloquin - Minor Subdivision Mayor LaValle had spoken to Howard Kuusisto regarding the sewer service for this piece of land. Mr. Peloquin was informed that he could use 6" pipe and could tie the two lines together. Mr. Peloquin will contact Mr. Kuusisto as he proceeds with the project. MOTION: LaValle made motion, seconded by Spitzer, to approve the Minor Subdivision as submitted by Vern Peloquin for the Wi of NE+ of NW+ of NE4 of Section 20. Mr. Peloquin to be allowed to connect the sewer at his expense to the manhole on 148th and Geneva with a 6" lateral. The lateral design to be approved by the City Engineer. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 5.3 Stewart Bogart - Nuisance violation Mrs. Bogart contacted City Hall and stated that Inter-State Lumber purchased the home at 7607 128th Street, and that they are no longer responsible. Mr. Hiniker, attorney for Inter-State, stated that nothing would be done on the property for one year because the Bogart's have the option to purchase the property within that time. There was noone present at the meeting representir the Bogarts. MOTION: LaValle made motion, seconded by Spitzer, that the City Clerk take the next step in the nuisance procedure to abate said nuisance. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to add $58.40 (sales tax) to the Utility Claims. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 6.0 ORDINANCES AND RESOLUTIONS MOTION: Spitzer made motion, seconded by Vail, to adopt RESOLUTION 1978-26, A RESOLUTION INCLUDING HUGO IN THE SHADE TREE PROGRAM BUDGET FOR SANITATION AND REPLANTING OF TREES FOR THE CALENDAR YEAR 1978 AND THAT THE CITY SHARE OF SAID BUDGET IS AVAILABLE IN THE GENERAL FUND. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED The draft of the subdivision ordinance was distributed. The Council is to review•and the matter will be discussed at the meeting of May 15, 1978. Mayor LaValle requested that the Ordinance Committee review the ordinance relating to the control of dogs in the city. 7.0 UNFINSHED BUSINESS APRIL 17, 1978 121 7.1 Simpson Complaint Health officers, Irsfeld and Vail, inspected the property on Everton Avenue, and were unable to detect any problem. LaValle suggested that the health officers get together with Tom Crever and Mr. Simpson to try and resolve the problem. LaValle had received complaint about the sewage problem at the home of Gerald Ensign, 5764 150 Street. He has not as yet hooked up to city sewer as required by ordinance. MOTION: LaValle made motion, seconded by Spitzer, that the City Clerk be directed to send a letter to Mr. Ensign stating that he has until May 1 , 1978 to bring into City Hall, a signed contract stating that he will hook up to city sewer by June 1 , 1978, or the city will install the sewer and certify the cost to him. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, that the Clerk's office send letters to all other people in violation of the sewer ordinance, requiring them to funish the city with signed contracts prior to June 1 , 1978 for sewer connection to be accomplised by August 1 , 1978. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIEDD 5.9 Ken Tschida - Extension of sewer and water Lot 12. Valley View Mrs. Jackson was present requesting permission for a variance to hookup to sewer prior to city approval for the extension. Mr. Tschida has contacted the City Engineer regarding the proposed project. MOTION: Spitzer made motion, seconded by Irsfeld, that Grace Development must submit a passable pert test or a letter of credit in the amount of $2500.00 before a building permit can be issued for Lot 12, Block 1 , Valley View. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED 8.0 NEW BUSINESS Washington County has given the city of Hugo the option to purchase a 1970 Chevrolet Dump Truck for $3,650.00 including the plow and sander. MOTION: LaValle mde motion, seconded by Spitzer, that the City of Hugo purchase the 1970 Chevrolet Dump Truck from Washington County in the amount of $3,650.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED APRIL 17, 1978 9 .0 CLERK 9.1 Part—time Tax Assessor The clerk's office only had one response to its ad for a part—time assessor and that was Mr. Langer. Mr. Langer has already been certified. MOTION: Spitzer made motion, seconded by Schletty, that the City Clerk be directed to ask the applicant to come to the City Council meeting of May 1 , 1978, to discuss the assessor's duties. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED The City Clerk informed the Council that the Governor had signed a bill on March 27, 1978 that removes CETA participants from PERA coverage. MOTION: LaValle made motion, seconded by Irsfeld, that James Fure and Jeffrey Klarich, Hugo Police Department, be retained on the PERA program. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, that George Koland be carried under PERA. The City of Hugo will. pick up part that CETA doesn't. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, that PERA on balance of employees that are covered by Social Security be dropped. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, that we table the outside audit until budget time, and let for bids again in August. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail. MOTION CARRIED Jim Leroux — Mobile Home Petition Mr. Leroux would like to have a mobile home installed on his property to help care for his in—laws. He will construct a separate sewer system for the mobil- home, and will hook up to the present water system. MOTION: Spitzer made motion, seconded by Irsfeld, that a public hearing be set for May 1 , 1978, Hugo City Hall, at 7:30 PM, to consider the request of Jim Leroux for a Mobile Home Permit, under Chapter 40, Aricle III, Subdivision D. VOTING FOR: LaValle, Spitzer Schletty, Irsfeld, and Vail. MOTION CARR APRIL 17, 197815 5.10 Bald Eagle Sportsman Association - Special Use Permit MOTION: Spitzer made motion, seconded by Irsfeld, to approve a Special Use Permit for the Bald Eagle Sportsman Association, subject to the following conditions: 1 . A sign listing the name, hours of operation, club and emergency telephone number (Washington County ) , be installed at the main gate. The safety rule: are to be posted on the sign, which shall be 4x8 foot lateral dimension. 2. A legal fence to be maintained in a tight and upright condition. Signs identifying the property be posted so that at no point is there not a sign readable. 3. A telephone to be installed and maintained. 4. Membership not to exceed 250. An annual declaration of membership shall be filed with the city. 5. The City of Hugo be provided with a current list of names, addresses, and phone numbers of club's officers. This list should be filed annually or when there is any change in officers. 6. A minimum of 500 trees be planted each year. A reforestation plan shallbe filed with the city and revised annually. 7. A range officer must be on duty at all time the club is opened to the public. 8. Hours of operation (Sunday) a) Alternate Sundays to be closed. b) Those Sundays that are opened shall operate from 12:00 PM - 6:00 PM with the exception of six Sundays a year during which extended hours of operation from 9:00 AM - 6:00 PM will be permitted. Those extended hours may apply during operations in October and not more than once in any other month provided that a total of six (6) Sundays utilizing extended hours occur during the year. Hours of operation (Monday - Friday) -) 8:00 AM - 8:00 PM Hours of operation (Saturday) a) 10:00 AM - 6:00 PM on all Saturdays Hours of operation(Holidays) a) 12 :00 PM - 6:00 PM on legal holidays 9. Unlimited use of off hours on the days the club is authorized to be opened for youth groups and firearm safety programs. Limited to 22 calibar rimfire 10. Impulse noise levels shall at no time exceed the levels to be drawn up by the Pollution Control Agency. The City of Hugo keeps the option of settirt more restrictive levels, if needed, because of the general quiet nature d the city. APRIL 17, 1978 :. 7 Bald Eagle Sportsman Assoc. - cont. 11 . The owners shall have sixty (60) days from the date they are notified tha they exceed these standards to prepare and submit to the City Council and Planning Commission detailed plans for abatement of noise so that the operation will be brought within the required standards. Once the plans are approved by the City Council, the owners will have six (6) months to complete construction in accordance with the abatement plans so approved. 12. At no time shall there be a change in the physical operation of the club without notification to the city and at no time shall the current size of the physical operation of the club be increased. 13. The 200 yard range to be discontinued at its current location. The 200 yard range may be reinstated only after approval by the city. 14. Should the City Council determine that any of the conditions of the Speci: Use Permit have been violated and that said violation has not been corrected within thirty (30) days of notification of the property owner of said violation, the City Council shall schedule a public hearing, with notice to the owners, to consider the violation or violations, and thereafter may suspend, modify, or revoke the Special Use Permit, giving reason for the action taken. 15. The facility may open to the public only on Saturdays and Sundays. At all other times, use of the facility shall be limited to members and their immediate families, and their bonafide guests, which shall not exceed one guest per member present. 16. The club shall file with the city its scheduled operations as it relates to all Sunday activities and to any regularly scheduled events within the facility in March of each year. The city shall be notified at least ten (10) days in advance of any Sunday during which extended hours will be used. 17. The owners shall hold the City of Hugo harmlessfrom any loss, expense, damage, including reasonable attorneys fees, that may be incurred as a result of granting the within Special Use Permit. 18. The owners shall provide the city with a performance bond in the amount of $5,000.00 to insure compliance with the conditions of the Special Use Permit. 19. The Special Use Permit will be reviewed on an annual basis. 20. The existing facilities are as shown on Exhibit A, and shall not be changed as herin provided. MOTION CARRIED APRIL 17, 1978 2 ii,, 10.0 MISCELLANEOUS Tom Crever had an inquiry as to the possibility of building a pole barn on Highway 61 and using it for retail business. MOTION: LaValle made motion, seconded by Irsfeld, that the attorney be directed to draft an amendment to the zoning ordinance that Retail Business and Concentrated Business zones be required to provide a site plan for city approval.
