Mr. Reynolds was present, and stated that he owns 60 acres of land adjoining
the road he is requesting to have reopened. He has been unable to sell any of
the land until the matter of the road is resolved. He stated that T"1r, Stanek'
100 acres is also landlocked. The only possible owner that would have an
objection to the reopeniAg...-of the road would be Mr. Schmidt. Spitzer stated
that the matter is complicated at this time because of a problem the city hac.

try and resolve the matter, Mr. Reynolds stated that he was not particul'-Cir

LaValle stated that, at this time, the city was financially unable to partici
pate in such a project, Mr. Reynolds stated that he will be contacting Wash-
ingotn County to find out if it would be possible to have County Road 57 ex-
tended, Mr. Reynolds is to be notified of any progress made regarding the NSI
easement matter.
PUBLIC HEARING - REASSESSMENT OF RICCI PROPERTY
The public hearing was called to order at 7:30 The hearing was called duE
to an error in REC charges made to Parcel No's. 275-2000 and 275-2050. The
home had two charges and the duplex had none.

5.2 Dumping of Tires on County Road 4 and Hi,g,hway 61
Mr. Ramaden, present owner of T41R Tourist Camp, was determined to be the ovmei
of the property in question. He was contacted regarding the nuisance, and he
stated that the tires should be removed within 10 days. Police Chief Barth
was instructed to inspect the site the first part of July.
MOTION: Spitzer made motion, seconded by Schletty, to defer this
matter until the meeting of July 3, 1978.

5.6 Bald BagleSj2,ortsman Association —,S-pecial Use Permit
Mr. Prokosch was present, and stated that the club's memberslip agreed to thi
signing of the permit as stated. The City Council had agreed to changing the
terminology of Item 17, as stated in the minutes of the meeting of June 5.
1978; however, they were not changed on the copy sent to the club. After the
correction is made, the club will sign the permit, and obtain the bond as
requested.
MOTION; Spitzer made motion, seconded by LaValle, that the Bald
Eagle Sportsman, be authorized to operate under the terms
the Special Use Permit until July 3, 1978, at which time
permit will be signed and the bond supplied to the city.

The Council discussed the Glen Reimer claim of June 19. Barth stated that
Reimer had signed a citation in January, and was required to appear in court

The Police Department had done a radar check on 148th Street and found the m,
excessive speed to be 38 mph, A Washington County traffic count is a*is on
file. LaValle felt that the installation of a stop sign would only create mo:
problems.

partment in the amount of $1,000.00. LaValle stated that the department's
money has already been allocated. Barth was instructed to bring the matter u:

The council reviewed the site plan as submitted, Thomas Crever stated that h(

Ms. Hunter was not present at the meeting because she was unable to obtain a
perc test as requested. Tom Crever was present, and disputed her statement
that Mr. Crever had inspected the site and found the building to b structuall
sound. Mr. Crever stated that the walls were. crumbling and basement unsound.
LaValle requested Mr. Crever to make a report regarding the condition of the
structure.
5.5 Bernie McDermaid — Joint Powers __-Agre'ement

Mr. McDermaid presented Mr. Johnson with a deed as drawn up by Grant 'Townshij
attorney, 111r, Briggs. Mr. McDermaid is creating one parcel of land (1.1 acre
in Hugo and 3.9 acres in Grant Township), 11r, Johnson had received a letter J
Mr. Briggs stating that at the Town Board meeting for Grant, they did not fe(
it was necessary to sign the Joint Powers Agreement regarding July Avenue,
because it would automatically be taken over the Washington County. LaValle
felt the agreement should be signed in order to protect the City of Hugo in
the future. Mr. Johnson will contact Mr. Briggs regarding this matter.
Johnson reviewed the deed, and stated that the following statement Should
be added: that conveyance is conditioned on ay subsquent transfer be approv(
by both Hugo and Grant Township, McDermaid will clarify the matter with Mr.
Briggs

Spitzer stated that a special meeting should be set up including the Planninj
Commission, City Council, attoriney, and engineer. The Council expressed a pi

Attorney Johnson was in touch with attorney Hiniker, and he acknowledged he
represents several lien claiments. He stated that they have no ritht to go
on property during the redemption period. They would like any value salvaged
and yet they are not in a position to do anything. LaValle felt it was the
city's responsibility to pursue the. matter to try and rectify the nuisance
before any injuries occur. Johnson will contact the attorney for the insur-
ance company,

The clerk received a letter from Fred Feuerpfeil stating that all funds for
Fiscal Year 1978 are allocated. The clerk stated that RenBel Larson's grant
termintes August 31, 1978, and is there a possibility of the city hiring her
LaValle stated that the city had not budgeted for her, and would have to lool,
further into the situation.

The City Clerk asked for clarification regarding union contract for the Polii
Department.
The matter of working holidays was discussed. It was determined that extra

Clerk be authorized to issue checks for the payday of June
23, 1978, to the police officer for back pay owing them uni
the existing labor contract. Retroactive compensation to
February 6, 1978.

sentatives of Shepherd of the Fields Church regarding the matter of the
road.
Kuus isto stated that Mr. Duane Neilson has contacted George Koland and will
be coordinating work for the metering service for the tai ler court.

of Hugo hire T.,Tr,, Duane Neilson to install a Fisher Porter
Sewage Meter for the trailer court flow at an approximate
cost of 8300-00. Mr. Neilson is to work with George Koland
to get the installation completed as soon as possible.

Hugo retain Gilsdorf and Johnson as its legal couns6l.

Attorney Johnson has been in contact with Harold Kimmel, attorney for Thomas
Kl*n,.f,7,, regarding the matter of their purchasing 26 acres from Perrault. They
worked out a simple contract stating that so long as they have a total of 26
acres the city would go along with the usagb. If they lost access of the 14
acres, they would only be allowed to retain a maxium of 12 horses owned or
boarded, The Kings' agreed with these conditions. The contract would run for
a term of seven years.
MOTION: Spitzer made motion, seconded by Schletty, that the attorni

the City of Hugo stating that so long as they have a total
of 26 acres, the city would go along with the usage. If
they lost access of the 14 acres, they-viwould be allowed to
