PRESENT: LaValle, Spitzer, Irsfeld, Schletty, and Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes of October 30, 1978, after the following changes: Page 2 (5.2) - system does not function, the conditions 1116 1111l1V11 V G o 0 VVA" YY 111 UC 111A7 VG61.L �.u. Page 7 Flood Plain Insurance - Ordinance 153 Page 7 7.0) - send check to B -Tu -Mix in the amount of 2 for railroad protective insurance. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Vail, to approve the General Claims for November 6, 1978, after changing Item 11 to $2,000.00, and the addition of $265.00 to General Office Products. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Vail, to approve the Utility Claims for November 6, 1978 as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by LaValle, that the City Attorney be directed to draw up the release agreement for Horseshoe Lake matter. VOTING FOR: LaValle, Spitzer,Schletty, Irsfeld and Vail MOTION CARRIED .0 PETITIONS REQUESTS, COMMUNICATIONS AND LICENSES 5.1 James Leroux - Renew of Mobile Home Permit MOTION: Spitzer made motion, seconded by Irsfeld, to renew the Mobile Home Permit for James Leroux, 4360 165th Street North, under Chapter 40, Article III, Subdivision D. for a period of ninety (90) days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5 Neil Peltier Variance Mr.Peltier has made an application for a variance to connect two sewer lines to one connection, Because of the multiple connection, the City Council has to approve. LaValle stated that the REC and SAC charge will have to be paid. A site plan was submitted for the Council's and engi- neer's review. 66 NOVEMBER 6, 1978 MOTION: Spitzer made motion, seconded by Irsfeld, to approve the request of Neil Peltier for a variance for a multiple sewer connection in accordance with Chapter 262-6, Sub- division B of the City Code, according to the drawings submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED e uommitiee - No report Commission - No report erintendent - No report Inspector — No report e - No report hief - Chief Barth submitted his monthly report. Mr. Johnson submitted his monthly report. At this point, he is working on the easements for the Vail/Brevig dike dispute matter. A letter has been sent to Richard Hiniker regarding the Bogart matter, but there has been no response. The Flood Plain Ordinance has been sent to the DNR, but they have not been heard from as yet. A follow-up letter has been sent to NSP's attorney regarding the road easement, but Mr. Johnson has not heard from him. Mr. Johnson stated that the part they are condemning is off to the west. The city's main concern is with the existing line rather than the new line. Mr. Johnson will follow- up on the matter before the next meeting. Councilman Schletty will obtain statements from the previous town board members regarding this matter. The letter of credit has not been submitted by Grace Development for their proposed sewer and water hookup on County Road 8A. LaValle instructed the engineer and attorney to keep a record of their time spent on this matter and submit to the City Clerk. Mr. Johnson was instructed to proceed with the obtaining of easements for the Bridge Replacement Program, so that the city will have everything in order when necessary. 5.2 David Hunt - Sewer Connection Violation Mayor LaValle stated that there has been a sanitary sewer connection made at the home of Mr. David Hunt, 14770 Foxhill Avenue. According to City Code, the connection is required to be done by a licensed and bonded plumber. Mr. Hunt's connection was installed by Richard Birrenbach and Mr. Hunt, with the assistance of Mr. DeBruzzi. Letter from Rene Larson and Bob Vadnais regarding this matter are on file. Mr. Hunt had ob- tained a permit from the city for inside plumbing. Mr. Hunt stated that he was unaware there was a difference between the inside and outside permit. His only intention was to comply with the City Code and get hooked up to the sewer. Mr. Hunt stated that he had tried to get an estimate from Ron Granger on several occasions without success. Mr. Hunt was under the impression that Granger did not want to do the work. LaValle asked the Plumbing Inspector, Bob Vadnais, if he had checked to see if a licensed plumber was doing the work. Mr. Vadnais stated that he had not checked, but that they had hooked up a good job. He stated that he had seen the line after it was laid, and not the actual connec- tion. NOVEMBER 6, 1978 267 Hunt continued Mr. Hunt was instructed as to the two possible solutions to this matter: 1. Mr. Hunt is to have the sewer connection inspected by a licensed and bonded plumber (Ron or Rich Granger). The plumber is to certify in writing that he will accept financial responsibility for work done. The plumber would also be responsible for obtaining an outside permit, if he is agreeable on accepting the job. 2. If Mr. Hunt is unable to comply with the previous directive, he will be responsible for obtaining the financial security, and the misdemeanor fine. MOTION: Spitzer made motion, seconded by Schletty, that we give Mr. David Hunt until December 4, 1978 to comply with the City Ordinance relative to his sewer hookup. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6._8 Engineer Mr. Kuusisto and Mayor LaValle inspected the proposed road locations for the Mardon Homes subdivision. Kuusisto stated that both locations are bad. The top of the hill appears to be the best location. LaValle stated that the application should go back to the Planning Commission with Howard Kuusisto's recommendations. LaValle stated the proposed road needs realignment and the preliminary plan will have to be readjusted. He also had a problem with the 1000' driveways, and the possible pollution of Long Lake because of the suggested building sites. 6.9 Clerk The city received a letter from Shepherd of the Fields Church requesting lighting on 148th Street, between Freeland and Oneka Lake Blvd. MOTION: LaValle made motion, seconded by Spitzer, recommending that Councilman Schletty meet with the City Engineer and the rep- resentative from NSP to determine what is needed for lighting along 148th Stree, between Freeland and Oneka Lake Blvd.. VOTING FOR: LaValle, Spitzer, Schlettv. Irsfeld and va;l MOTION CARRIED Mr. Winter, representative from the church, stated that they are interested in purchasing some fluorescent fixtures that were removed along Highway 61. Councilman Schletty will check to see how many fixtures there are. The Lions Club might be interested in purchasing some lights. MOTION: Spitzer made motion that the city authorize the payment for fees for Mayor LaValle to attend the Washington County Mini -Conference on December 2, 1978. MOTION FAILED FOR LACK OF SECOND MOTION: LaValle made motion, seconded by Spitzer, to close City Hall on November 24, 1978 rather than November 10, 1978, for the observance of Veteran's Day. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, to set the Board of Canvas for November 8, 1978, at 7:00 PM. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail 268 NOVEMBER 6, 1978 VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Schletty, to adopt ORDINANCE NO. 154 AN ORDINANCE PROVIDING FOR THE COMBINATION OF THE OFFICES OF CITY CLERK AND CITY TREASURER AND PROVIDING FOR ANNUAL CITY AUDITS. Voting For: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED A LETTER WAS RECEIVED BY THE CITY FROM Ed Nuenfeldt stating his concern that the level of water, after the relocation of the Brevig dike, will be altered, and be harmful to the wildlife in the area. Let the record show that Mr. Kuusisto inspected the area, and felt the dike could be relocated without any change in the water level. MOTION: Spitzer made motion, seconded by Irsfeld, t1a.t the City Clerk be directed to reply to Mr. Ed Nuenfeldt outlining this course of action VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED Councilman Vail informed the Council that St. John's Church will be honoring Robert and Dorothy Burkard on November 12, 1978, for their contribution to the church and the community. Mayor LaValle officially declared November 12, 1978, as Mr. & Mrs. Robert E. Burkard day. The City received a statement from the Metro Waste Control Commission with the Reserve Capacity cahrges for 1979. LaValle instructed Howard Kuusisto to set up a meeting with Metro (Ray Odde) for the first part of December to discuss these charges. Attorney Johnson reviewed the documents relating to the Beisang Road matter. MOTION: Spitzer made motion, seconded by Irsfeld, that the City of Hugo accept the Beisang Road (July Avenue) subject to the iss- uance of title insurance and recordability of the appropriate documents. It is understood that Mr. Clark McDermaid will make an escrow deposit to insure the issuance of the title insurance. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, that the City Clerk be directed to write a letter to Grant Township stating the previous action taken.
