PRESENT: Spitzer, schletty, irsfeld and Vail - Mayor LaValle arrived just after the roll call was made. 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of November 6, 1978, after making the following change: Page 3 (5.2) - responsible for obtaining the financial se- curity VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of November 13, 1978, after the following change is made: Page 1 (1st paragraph) - established so that info will be easily accessible VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 4,.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Schletty, to approve the General Claims for November 20, 1978, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims for November 20, 1978, deleting Item 2, in the amount of $1122.88. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.0 PETITIONS_ , REQUESTSCOMMUNICATIONS & LICENSES 5.3 Richard Busse - Pere Tests Mr. Busse.is interested in obtaining building sites on his property in exchange for an easement for the extension of Ingersoll Avenue. Mr. Busse presented copies of two perc tests for possible building sites. LaValle had instructed Kuusisto to meet with.Busse's engineer=to try and solve the problem. At this point, we are looking for approval of concept only. The matter would have to go before the Planning Commission first. A mutually agreed upon realignment of the road is necessary, along with an application for rezoning and a preliminary plan. MOTION: LaValle made motion, seconded by Spitzer, directing Howard Kuusisto to meet with Mr. Busse's engineer to work out a mutually acceptable road alignment plan. Stakes should be established indicating property lines to where we could possibly move the road to the west. A report is to be made at the meeting of 12/4/78. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.4 Joe Gregoire - Mobile Home Permit Renewal MOTION: LaValle made motion, seconded by Schletty, to grant a re- newal of the Mobile Homer Permit for Joseph Gregoire, 7600 165th Street North, under Chapter 40, Article III, 9,7 2 NOVEMBER 20, 1978 Gregoire - continued Subdivision D, for ninety days. Mr. Gregoire is to provide a restatement of hardship case for the next renewal. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.2 Mardon Homes - _Subdivision LaValle and Kuusisto had inspected the site of the proposed roads, and determined that the most suitable site for the road would be at the crest of the hill on Irish Avenue, with the center line of the road between the two houses on the west side of the road. There will be change in the preliminary plan, and will have to be returned to the Planning Commission for their review. LaValle stated that he had a number of problems with the subdivision - the 900' driveways and more consideration be given to the road relative to house locations. Irsfeld stated that another con- cern would be the location of the homes relative to drainage into Long Lake. LaValle suggested that Mr. Tramm's planner look at the possibility of getting access to the property from another route. MOTION: Spitzer made motion, seconded by Schletty, that the Mardon Homes preliminary plan be returned to the Planning CommissiDn for consideration as amended by the applicant. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.5 Off Sale Liquor License - Taxes MOTION: Spitzer made motion, seconded by Irsfeld, that the Off Sale Liquor Licenses be placed on the agenda for December 4, 1978. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.6 Francis Langer_, 1979 Contract for Assessing It was assumed that Mr. Ed Leroux did not want to assess property in Hugo after the year 1978. Mr. Langer stated that he prefers to work with Mr. Langer and would charge 750 per parcel. LaValle instructed Mr. Langer to send another proposal to the city with a rate of assessing for the year 1980, and then Mr. Langer could hire whoever he wanted. 5.7 Gerald Dabe - Rezoning and Minor Subdivision Mr. Dabe is requesting to rezone a 20 acre parcel zoned Conservancy to two 10 acre parcels zonod Agriculture. The Planning Commission recommended approval, subject to Lot C remaining in the Conservancy zone. MOTION: Spitzer made motion, seconded by Irsfeld, amending the Zoning Ordinance to include the transfer of the following described property from the Conservancy zone to the Agriculture zone: N -J of the SW4 of the NEJ of Section 3, Town 31, Range 21. VOTING FOR:* LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED Minor Subdivision (SWI of the NEI of Section 3) Spitzer said that the city should have easements of the plat because of the new road. LaValle stated that a Minor Subdivision cannot be acted on, because of the new road. Mr. Johnson said that subdivision is required if there is a new road, irrespective of size. NOVEMBER 209 1978 Dabe-continued MOTION: Spitzer made motion, seconded by Schletty, that the Minor Subdivision for Gerald Dabe be denied on the grounds that it is inappropriate. Mr. Dabe is hereby advised that fur- ther division of the property will be required with a regu- lar subdivision application. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, that the fee paid for the Minor Subdivision 040.00) be applied to the Subdivision application ($60.00). VOTING FOR: LaValle, Schletty, Irsfeld and Vail VOTING AGAINST: Spitzer MOTION CARRIED Spitzer stated that Mr. Dabe is to get title of the easement so transfer can be made of the new road to the city, or agreement of the property owners of transfer of the easement to the city. The preliminary plan to show a 60' easement along the north property line. 5.8 Dean Atkinson - Site Plan Approval Mr. Atkinson wants to build a 40 x 60 pole building in the Peloquin In- dustrial Park to use for storage. LaValle stated that before the city can grant approval of the Site Plan for Mr. Atkinson, Vern Peloquin would have to make application for a Minor Subdivision. Spitzer said that Peloquin could build the building, and get site plan approval to construct himself or get a Minor Subdivision. MOTION: Spitzer made motion, seconded by Irsfeld, to set this matter aside until later on the agenda. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.9 Dick Genrich - Variance to Standard Septic Svstem The Planning Commission was unable to make a recommendation to use the osmosis type system in Hugo for new construction. Mr. Genrich wants to divide an 80A parcel into a 30A parcel and a 50A parcel, and perc tests did not pass on either parcel. He is requesting that the City Council approve the osmosis sewer system in principal. Mr. Kuusisto stated that he was unaware that there was no area where a standard system could be installed. LaValle said that the basic question is "should the City of Hugo take land that is unbuildable and make buildable by any type of any sewer system". We have had existing problems and looked at alternative systEms. But on this piece of property, we have a couple of houses with no way out. Mr. Genrich stated that 100 systems have been installed with no failures. LaValle said that he did know if the city can go against the ordinance and grant a variance. He did not think that it was the intention to open areas for development that don't meet the requirements we now have. LaValle suggested that Mr. Genrich find a site that is buildable and then we could look at an alternative system. Mr. Johnson stated that there is an additional problem because of the Flood Plain Ordinance. The ordinance is on file and has to be followed. LaValle said that the property is located in the 100 year flood level. 9 7 NOVEMBER 20, 1978 Genrich - continued MOTION: Spitzer made motion, seconded by Irsfeld, advising Mr. Genrich that the building sites will require normal per- culation tests within a distance feasible for the disposal of sewage from any planned building location. The osmosis system may be considered as an alternative implementation, but only if normal disposal systems can be made available. VOTING FOR: LaValle, Spitzer, Irsfeld and Vail ABSTAINED: Schletty MOTION CARRIED Vern Peloquin - Farm Site Plan Let the record show that Mr. Peloquin's application is the same subject matter as dealt with by the Planning Commission under the name of Dean Atkinson. MOTION: Spitzer made motion, seconded by Irsfeld, to approve the Farm Site Plan for Mr. Vern Peloquin, as presented. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail Mr. Peloquin is to make application for a Minor Subdivision relating to this matter. 6.0 ORDINANCES AND RESOLUTIONS 6.1 Resolution Establishing Clerk/Treasurer MOTION: Spitzer made motion, seconded by Irsfeld, to adopt RESOLUTION 1978-36, A RESOULTION AUTHORIZING THE ESTABLISHMENT OF CLERK/ TREASURER, OFFICIALLY INFORMING THE FIRST STATE BANK OF HUGO TO HONOR DRAFTS WITH TWO SIGNATURES EFFECTIVE JANUARY 1, 1979. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6.2 Animal Ordinance MOTION: Spitzer made motion, seconded by Irsfeld, to table the pro- posed animal Ordinance until the first meeting of June, 1979. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED LaValle suggested that the city look at some type of alternative ordinance to help alleviate the cost of the proposed ordinance. MOTION: Spitzer made motion, seconded by Irsfeld, amending the pre- vious motion directing the Ordinance Committee to see if an alternative method of control could be found for the first meeting in June, 1979. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 7.0 UNFINISHED BUSINESS Mr. Kuusisto met with a representative from NSP regarding the installation of lights on 148th Street. NSP will submit three different proposals, and then the city act from there. Councilman Schletty located two lights at the Old Village Hall. NOVEMBER 209 1978 A; .v MOTION: LaVaile made motion, seconded by Spitzer, to sell lights for $10.00/each if Shepherd of the Fields Church wishes to pur- chase them. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, to table the pro- posed inspection checklists until the meeting of 12/4/78. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, directing the City Clerk to check for someone to become bonded to see if they would accomplish the rest of the sewer hookups in the City of Hugo. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.1 .i;d `yiau, , i�e_x i�� �- P cpeL -�;L The city will be entering into a lease with Ed Waugh for rental of one of his buildings at $75.00/month. Attorney Johnson will draw up the lease for signatures. MOTION: Spitzer made ;notion, seconded by Vail, that the City Council authorize the Mayor to execute the lease according to the terms specified, with Ed Waugh, agent for Irene Traeger, for the building at 130th Street and Highway 61. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Spitzer, authorizing the use of City Hall on December 18, 1978, from 5:45 - 6:30 PM for a Christmas program put on by the Washington County Mobile Library. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED The City Clerk will investigate further the procedure for microfilming performed at Washington County. The city has received a letter from Northwestern Bell requesting per- mission to attach a twenty foot fiberglass whip type antenna to the city's water tower. They are also requesting to install an eight foot by eight foot metal building near the base of the tower. The Lions Club has ex- pressed interest in installing bathroom facilities on the city property, so it was recommended that they contact Northwestern Bell to possibly enter into a joint proposal. MOTION: LaValle made motion, seconded by Spitzer, to set a Special Meeting of the Hugo City Council for December 1.1:, 1978, at at 7:00 PM, to discuss the Land Planning Act in accordance with Metro Council's System Statement. The following are to be present at the meeting: Bill Schwab, Washington County Planning representative, Carl Dale, the Planning Commission, City Attorney, and City Engineer. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail 276 November 20, 1978 :'MOTION CARRIED The clerk brought up the fact that there are certain outstanding matters (waiting for financial security) that ought to be handled by the City Council. The Grace Development water and sewer agreement and the Fred Benson Special Use Permit are to be placed on the agenda for 12/4/78. Spitzer said that they will be considered for vacating because of non-compliance of initial conditions. A,_meetin.gdate of 12/4/78 has been set with Metro Waste Control Commission to discuss reserve capacity charges in the City of Hugo. The time is set at 10:00 AM. Mr. Burkard, Water Superintendent, is to be informed of the meeting date and time. Tom Crever, Building Inspector, was directed to investigate the matter of the installation of a blacktopped driveway at 7959 147th Street to see if a culvert was required. He was also directed to check on the sewer system at Lot, Block 2, Evergreen Hills #2, to obtain the per- tinent data regarding dimensions, where setting on the property, setbacks, et.c. LaValle stated that all building sites have to be 1' above street grade. He suggested that the Planning Commission_ consider this when reviewing the Mardon Homes Subdivision.
