PRESENT: LaValle, Irsfeld and Vail ABSENT: Spitzer and Schletty 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Vail, to approve the minutes of November 20, 1978 after the following changes have been made: Page 3(Minor Sub) - Spitzer said that the city should Page 3 (Same) - The preliminary Pian to show a 60' easement VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by LaValle, to approve the General Claims for December 49 1978, after deleting Items 1 & VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims for December 49 1978, as presented. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Irsfeld, to reconsider the Utility Claims of December 4, 1978. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to approve the Utility Claims of December 4, 1978, with the deletion of - Item 5. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 7. -1 JJayla riunti — newer YJ.V.La V.LV11 Councilman Irsfeld had been contacted by Richard Birrenbach stating that Mr. DeBruzi is in the process of getting bonded, and would like a 30 day extension. MOTION: LaValle made motion, seconded by Irsfeld, to grant David Hunt a 30 day extension in the pending matter of the violation for sewer hookup. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 5.2 Off -Sale Liquor Licenses MOTION: LaValle made.motion, seconded by Irsfeld, that the Off -Sale Liquor License be approved for Thomas Co Hopkins, Hoppy's Saloon, 14777'Forest Blvd:, Hugo Minn. VOTING FOR LaValle, Irsfeld and Vail MOTION CARRIED =^ DECEMBER 4, 1978 MOTION: LaValle made motion, seconded by Vail, that the Off -Sale Liquor License for Melody Lounge and Carpenter's be tabled until December 18, 1978. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Vail, that the Off -Sale Liquor License for Richard and Larry Schmidt, Schmidty's 61 Club, 17285 Forest Blvd, North, Hugo, MN., be approved. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by LaValle, that the Off -Sale Liquor License be approved for Stanley Lynn, Stan's Withrow Junction, 12020 Keystone Avenue, Hugo, MN. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Vail made motion, seconded by Irsfeld, that the Off -Sale Liquor License be approved for Eugene Peltier, Blacksmith Lounge, 17205 Forest Blvd No., Hugo, MN. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 5.3- Iced Benson - Special Use Permit To date, the City has not received the letter of credit as conditioned in Air. Benson's Special Use Permit. Benson's attorney, Mr. Hagerty, has contacted the City Clerk stating that they have some trouble with their finances, and they have not as yet applied for the letter of credit. LaValle stated that a letter to this effect should be submitted to the civy. MOTION: LaValle made motion, seconded by Irsfeld, to table the Fred Benson matter until December 18, 1978. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 5,4 -Grace Development - Water and Sewer Agreement To date, the City has not received the letter of Credit as conditioned in Grace Development's agreement with the City. Mr. Tschida was present and stated that nothing could be done this winter, and they would come back in the spring with their requirements. MOTION: LaValle made motion, seconded by Irsfeld, that the joint Sewer and Water Agreement between the City of Hugo and Grace Devel- opment be nullified. The City of Hugo will not bring up again unless brought up by the developer. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 5.5 Inspection Checklists This matter will be discussed later on in the meeting. 6.0 REPORTS OF OFFICERS AND COMMITTEES 6.1 Ordinance Committee - No report 6.2 Planning Commission - No report 6 3 ''later simLri ntP]3r1pnt — NnrP�+. DECEMBER 49 1978 6.6, -Police Chief MOTION: LaValle made motion, seconded by Irsfeld, that Chief be directed to have the Pfilice Officers ed by the City of Hugo have a physical checkup own personal physicians. The Police Chief is scope of the examination. Copies of physicals to the city by April 1, 1979. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 6.7 Attorney 2 S 11 the Police that are employ - with their to determine the to be turned in Mr. Johnson submitted his monthly report. In reagrd to the NSP easement matter, Johnson and Kuusisto have been in contact with NSP's engineer and attorney. LaValle felt that the City should be a party to the condemnation proceedings, and Johnson stated that the city has their concern in the matte on record. Kuusisto stated that the city is exploring two possibilities to try and resolve the problem: 1) Move horizontal, curve 200' south, and 2) move the road West to stay within the west 75' of the NSP easement. Kuusisto and Johnson will keep in touch with NSP 's representatives. Mr. Johnson will submit a draft ordinance for!misdemeanor penalties to the Ordinance Committee for their review. The State has increased the fine lim to $500.00; 6.8 Engineer Mr. Kuusisto submitted his monthly report. In regard to the Busse road alignment, Kuusisto has been in touch with Mr. Ott, but he has not received any direction from Mr. Busse at this point. Mr. Ott will be establishing the north right-of-way line from the Busse driveway north. Representatives from Hugo met with the Metro Waste Control Commission, and the MWCC suggested that a letter be submitted requesting elimination of the 1975 charges. LaValle stated that he does not agree with Metro's basis for determining gallonage. LaValle also felt that a more accurate meter is needed at 180th Street. 6.9 Clerk The Clerk presented a proposed Ordinance for the recent rezoning of Property owned by Gerald Dabe. MOTION: Irsfeld made motion, seconded by Vail, to adopt ORDINANCE 155 AN ORDINANCE AMINDING CHAPTER 320 OF THE HUGO CITY CODE ENTITLED "ZONING" BY AMENDING THE ZONING DISTRICT CLASSIFICATION OF DESCRIBED REAL PROPERTY. The N,j of the SWj of the NE of Section 3 be changed from Conservancy District to Agricultural District. Irsfeld withdrew his motion for lack of 4/5's vote of the council. A letter to Mr. Shober, Burlington Northern, has been submitted requesting that the trains going through Hugo reduce their speed form 50 MPH to 30 MPH hours. MOTION: Vail mademotion, seconded by Irsfeld, to sign the letter requesting reduced speed of the trains going through Hugo, and submit to Mr. Shober. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 2(S2 DECEMBER 4, 1978 MOTION: Irsfeld made motion, seconded by Vail, that the City of Hugo hire Marie Connors at $3.50/hour, starting December 5, 1978. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by LaValle, to contract with Synagraphics, Minneapolis, to microfilm the old record books, at a cost not to exceed $25.00. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED A letter was received from Jim Smith requesting permission for his 4H Club to plant seedling trees at the city's park on Sunset Lake. MOTION: LaValle made motion, seconded by Irsfeld, to write a letter to Jim Smith telling him that the city agrees with the re- quest to plant seedling trees on the city's land on Sunset Lake, and grants them permission to go ahead with the project. A plan should be submitted indicating type of plan to be used (where placed on land). Mr. Martin Ziebell, ASCS office, would be helpful in developing a program for them. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED Par. Smith is also to investigate incorporating the program in other areas of the city. Mr. Gerald Dabe requested that the newly constructed road to his land be taken over for city maintenance. MOTION: Irsfeld made motion, seconded by Vail, that the City will not accept his road for snow removal because of the status of his subdivision and easement. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 6.4_ Building Inspector The city has received a complaint in regards to a house being constructed too close to a body of water on Lot 7, Evergreen 2. The issue was dis- cussed, and it was determined that input was needed from the City Engineer and City Attorney. MOTION: LaValle made motion, seconded by Irsfeld, that the high water table be determined by the City Engineer. The City Attorney is to submit a written report on Subdivision G. Zoning Ordinance, as it pertains to the house built by Richard Vail at 14451 Homestead Avenue. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by LaValle, that the City Clerk write a letter to Richard Vail, informing him that a complaint has been raised for the sewer system at 14451 Homestead Avenue. The matter is under investigation by the City Engineer and City Attorney, and they have been requested to render certain opinions. Mr. Vail is to proceed cautionously in the handling of the occupancy of said house. DECEMBER 4, 1978 VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED .The city has received a complaint form Howard Schletty regarding the drive- way at 7957 147th Street. The ditch has been filled in, and a blacktopped driveway has been installed. There was no culvert installed, but the Building Inspector stated that the permit issued required the installation of one. LaValle stated that Mr. Crever has the authority to have the culvert installed, because of violation of the driveway permit. MOTION: LaValle made motion, seconded by Irsfeld, stating the driveway complaint at 7957 147th Street has been discussed, and the Buil ing Inspector is to proceed to make the property owner conform to the way the permit was issued. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, to accept the resigna- tion of George Bernier effective December 31, 1978. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED The Building Inspector was instructed to make sure the liquor businesses in Hugo conform to all fire code requirements. MOTION: Irsfeld made motion, seconded by Vail, to accept the bid of James Olson to purchase the protable pump from the Fire De- partment, in the amount of x$50.00. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: LaValle made motion, seconded by Irsfeld, that the Fire Chief be authorized to contac-6;Capitol Electronics to negotiate a contract for the maintenance on the radio, and to submit to the City of Hugo after approval by the Fire Department. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Vail, that the Fire Chief be authorized to purchase two (2) strobe lights, 200' of 1z" hose, push brooms, and the cost of fee and tests for EMT, in an amount not to exceed q$800.00. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED Mr. Vail, Fire Chief, stated that the Fire Department could be eligible to receive matching finds from the Minnesota DNR, for fire equipment. MOTION: LaValle made motion, seconded by Irsfeld, instructing the Fire Chief to fill out the necessary forms for the Minnesota DNR to receive matching funds, and submit to the completed forms to the city. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 7.0 ORDINANCES AND RESOLUTIONS DECEMBER 49 1978 MOTION: Irsfeld made motion, seconded by Vail, to adopt RESOLUTION 1978-41, A RESOLUTION DETERMINING MILEAGE COSTS AT 17¢ PER - MILE, EFFECTItii-*: jA NU'AIff 19 1979. VOTING FOR: LaValle, Irsfeld and Vail MOTION CARRIED 8.0 UNFINISHED BUSINESS Inspection Checklists A rough draft of the proposed checklists for city inspectors.was_submitted. The City Clerk has been directed to submit copies of the checklists to the Heating Inspector and Plumbing Inspector for their comments for the meet- ing of December 18, 1979. 9.0 NEW BUSINESS The White Bear School District is no longer going to maintain the hockey rink at the Hugo Elementary School. They are asking for the cooperation of the city to maintain it. The Fire Department has agreed to take care of the flooding, and Carl Nordquist, school janitor, will remove the snow with a snowblower, when able. The heaver snow will have to be removed with a tractor. MOTION: Vail made motion, seconded by Irsfeld, that the City of Hugo authorize a contractor to remove snow from the hockey rink at Hugo Elementary School when it becomes too deep to be taken care of by the Janitor.
