The meeting was called to order by Mayor Marvin LaValle at 7:03 PM.

3_0 APPROVAL OF MINUTES
MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes of December
189 1978, after the following change is madet
Page 6 (Peloquin) — a new plan for the Peloquin Industrial Park is to be
submitted before any future Subdivision of that park is allowed.

4.0 APPROVAL OF CLAIMS
MOTION: Irsfeld made motions seconded by Spitzer, to approve the General Claims of
January 2, 1979, after the addition of Bruce Charpentier — x66.00.

MOTION: Schletty made motions seconded by LaValle, to hire Bruce Charpentier to
clean City Hall at $4.00/hour.

5.1 Schmidtv's Letter of Credit
MOTION: LaValle made motion, seconded by Spitzer, to table this matter until January
15, 1979.

5.2 Bingo License — American Leucon Auxiliary 620
MOTION: LaValle made motion, seconded by Irefeld, to grant a Bingo License to the
American Legion Auxiliary Post 6209 with a waiver of the bond.

5.3 Joseph Niemczyk : Mobile Home Permi*

MOTION: Irsfeld made motion, seconded by Schletty, that the Mobile Home Permit
for Joe Niemczyk, 7666 170th Street North, be extended for 90 days, under
Chapter 40, Article III, Subdivision D.

5.4 Stan's Withrow Junction - License for Game of Skill
MOTION: Spitzer made motion, seconded by Irsfeld, to grant a license for Games of
Skill to Twin City Novelty at STAN's WITHROW JUNCTION, 12020 Keystone
Avenue,

5.5 Safeway House Movers_- Amended Special Use Permit
Mr. Sempel is requesting approval to move in a 24' x 60' building to be used for cold
storage. The Planning Commission recommended approval, but acted on a Site Plan
Approval rather than an Amended Special Use Permit,
MOTION: Spitzer made motion, seconded by Schletty, to approve the Amended
Special Use Permit for Safeway House Movers, to move in and set perm-
anently a 24" x 60' building to be -used for cold storage relating to
the business.

Mr. Sempel has plans of moving in more buildings, and he was instructed to draw up
a site plan indicating what his plans are for the property.
6.0 REPORTS OF OFFICERS & COMMITTEES
6.1 Ordinance Committee
Attorney Johnson suggested that a joint meeting be held to discuss the proposed Sub-
division Ordinance,
MOTION: LaValle made motion, seconded by Irsfeld, to have a Special Meeting of
the Hugo City Council, in conjunction with the Ordinance Committee, for
January 17, 1979, at 7:00 PM, to discuss the proposed Subdivision
Ordinance,

6.2 Planning Commission
McAllister stated that the Planning Commission is exploring the possibility of incor-
porating watchman's quarters into the ordinance. Spitzer stated that a definition of
"watchman's quarter's" could not be agreed upon, and that it could become an apart-
ment. The ordinance could be changed by allowing a- special Use Permit.

It was determined that the fee for resubdivision is the same as for a regular sub-
division. Requirements are the same for both. McAllister discussed the Massa property
with the Council. It was determined that there are two lots in existence (A and B).
There is no application needed for a subdivision. Ultimately, one deed will have to be
drawn for Lots A and B by metes and bounds, creating one lot.
MOTION: Spitzer made motion, seconded by Irsfeld, to approve the reappointment of
Theodora Peltier and Bill Greger for full terms on the Planning Commission.

MOTION: Irsfeld made motion, seconded by Spitzer, directing the City Clerk to
run an ad in the White Bear Press for applications for the vacancies on
the Planning Commission.

MOTION: Spitzer made motion, seconded by LaValle, to appoint Larry Ehret as Chair-
man of the Planning Commission.

6.3 Water Superintendent - No report
6.4 BuildLW Inspector
Mr. Crever submitted his monthly report. He stated that Paul Salmon, PAUL'S PIZZA, will
install the panic device on the rear door.
MOTION: Spitzer made motion, sesonded by Schletty, that the Building Inspector be
directed to notify Paul Salmon of Paul's Pizza that he is to install the
panic device on the rear door of his building within 30 days.

Mr. Crever stated that Schmidty's 61 Club has failed to install the fire door as required.
MOTION: LaValle made motion, seconded by Schletty, that the City Clerk be directed
to send a registered letter to Schmidty's 61 Club stating that their letter
of credit guarantying all conditions of their Special Use Permit, that,
in fact, unless all requirements of the Building Inspector and State Fire
Marshall are met, they do not have a Special Use Permit. We would consider
granting an extension of the letter of credit for six (6) months for the
parking and screening, and thirty (30) days for the requirements of the
Building Inspector and State Fire Marshall. Unless conditions are met,
your Special Use Permit is null and void, and you could be ordered to
close, and the letter of credit could be forfeited.

The Vail house on Homestead Avenue was discussed. Attorney Johnson determined that
according to the DNR, the house was constructed on public water. The septic system
system can be moved to meet the setback requirements, and will be done according to
the requirements set forth by Howard Kuusisto's office.
6.5 Fire Chief
MOTION: LaValle made motion, seconded by Spitzer, that the City Council concur
with the recommendations for the Fire Department to appoint Ron Is—
tvanovich, Fire Chief, Ken Granger, lot Assistant Chief, Joe McMahon,
2nd Assistant Chief,

6.6 Police Chief
The City Clerk and Councilman Irsfeld are to report on unemployment procedures at the
Council meeting of January 15s, 1979.
MOTION: Spitzer made motion, seconded by Irsfeld, that the City Clerk be instructed
to make application for Marie Connors to attend BCA school as soon as
possible.

6.7 Attorney
Mr. Johnson submitted his monthly report. Mr. Johnson was instructed to check with
NSP's attorney to see if they need a permit or a bond to construct the power lines
in Hugo.
Mr. Johnson has talked with Mr. Charles Weber's attorney in regarding to the proposed
subdivision of Gerald Dabs. They allege that the road should be private, that the
road has not been built on the easement, and the road splits the Weber land.
MOTION: LaValle made motion, seconded by Spitzer, that the City Attorney write
a letter to the Planning Commission for their meeting of January 10,
1979, explaining the information and facts, and the alleged allega—
tions, as he has them, relating to the Gerald Dabe proposed subdivision
and road.

6.9 Clerk
The City has received two letters requesting safety signs be installed on Oneka
Lake Blvd., and 157th Street.

MOTION: LaValle made motion, seconded by Spitzer, that the letters be referred
to Howard Schletty and the Police Chief. Recommendations are to be
made for the first meeting in February, 1979.

The Clerk requested permission to change the payroll to the lot and 15th rather than
biweekly. It was determined that there would be a conflict with the union contract.
The Clerk was instructed to recognize the Police Officer's anniversary date as an
effective pay raise. j

8.1 David Hunt - Sewer Violation
MOTION: LaValle made motion, seconded by Spitzer, to table the David Hunt matter
until January 159 1979.

8.2 Insvection Checklists
Mr. Crew stated that he would like to see an Iten 5 added to the checklist -
Certificabeof Occupancy issued for residential homes (Type I Classification). Spitzer
stated that an enabling ordinance will have to be drafted so it can be enforced. Peter
Kluegel, acting Heating Inspector, indicated that he thought the procedure would be '
beneficial. Plumbing Inspector, Bob Vadnais, made no response.
MOTION: Spitzer made motion, seconded by Irsfeld, that the City Attorney be dir-
ected to draft the appropriate ordinance for the Occupancy Permit,

Mr. Crever stated that a ditch was filled in at 12280 Goodview Avenue. The contractor
stated that it would be corrected in the spring.
MOTION: Spitzer made motion, seconded by Schletty, that the Building Inspector
be authorized to accept an escrow fund of $1,000.00, on behalf of the
city, in the form of a letter of credit or a cashier's check, for the
purpose of completion of the driveway at 12280 Goodview Avenue. The
Building Inspector is to notify K & E Builders to make arrangements with
the City Clerk for the acceptance of the 51,000.00. This $19000.00 is
to guarantee the completion of the driveway in accordance with the
Driveway Permit no later than June 15, 1979. The City agrees that these
conditions will be accepted in lieu of earlier completion of Driveway
Ordinance.

Mr. Crever will check with the Plumbing Inspector to obtain his comments on the
Plumbing Permit checklist.
LaValle suggested that some kind of financial guaranty be attached to Driveway Per-
mits, and then be returned when all conditions of the permit are met.

Ordinance Committee, City Attorney, and City Engineer are to work together
to draft a proposed ordinance to amdnd the Driveway Ordinance to require
a financial guaranty for performance.
