of FEBRUARY 20, 1979
The meeting was called to order by Mayor LaValle at 7:02 P.M.
PRESENT: LaValle, Irsfeld and Vail
ABSENT: Spitzer and Schletty
.0 APPROVAL OF MINUTES
MOTION: Motion made by Irsfeld, seconded by Vail, to approve
the minutes of February 5, 1979, as presented.
VOTING FOR: LaValle, Irsfeld and Vail
MOTION CARRIED
4.0 APPROVAL OF CLAIMS
MOTION: Irsfeld made motion, seconded by Vail, to approve the
General Claims of February 20, 1979, with the deletion
of the claim for $500.00 for the monitors for the
Fire Department. The claim will not be paid until an
invoice is submitted.
VOTING FOR: LaValle, Irsfeld and Vail

MOTION: Irsfeld made motion, seconded by Vail, to approve the
Utility Claims of February 20, 1979, as presented.

5.0 PETITIONS. REQUESTS. COMMUNICATIONS AND LICENSES
5.1 Joe Gregoire — Renewal of Mobile Home Permit
Mr. Gregoire and his son were present, and inquired if they could
rent the trailer after an addition was added to the house. LaValle
stated that they could live in the trailer while fixing the house,
but after completion the trailer could not be rented out.
MOTION: Irsfeld made motion, seconded by Vail, to grant a
renewal of the Mobile Home Permit for Joseph Gregoire,
7600 165th Street North, under Chapter 40, Article III,
Subdivision D, for ninety days.
VOTING FOR: LaValle, Irsfeld and Vail
MOTION CARRIED
Mr. Gregoire stated that a sign was needed on 165th Street and
Ingersoll Avenue indicating a T. in the road. Councilman Schletty
was to be informed of the matter and make a report.

5.2 Peloquin. Schwartz, Bernier - Rezoning
MOTION: LaValle made motion, seconded by Irsfeld, to table
the matters until the meeting of March 5, 1979.
VOTING FOR: LaValle, Irsfeld and Vail

5.3 Gerald Dabe - Discussion on road
Mr. Dabe and his attorney, David Doyscher, were present at the meet-
ing. Mr. Doyscher stated that when the land was acquired from Mr.
Perreault there was an agreement that when the land was developed,
the easement was to be dedicated to the city. However, the intent-
ionwas not clearly on the registered documents. Mr. Dabe has been
unable to settle the matter out of court. Mr. Doyscher presented
the city with a petition requesting that 1 ) the city accept and
dedicate the property for a public road, or 2) initiate such pro-
ceedings as are necessary pursuant to M.S. 117.011 et seq (eminent
domain) in order to acquire said premises for dedication as a pub-
lic road..
MOTION: LaValle made motion, seconded by Irsfeld, that the
city received the petition from Gerald and Sandra
Dabe regarding easement for road purposes, and the
petitioners are here by asking the City of Hugo to
do the following:
1 . To accept and dedicate the easement for a public
road.
2. To initiate such proceedings as are necessary
pursuant to M.S. 117.011 et seq (eminent domain)
in order to acquire said premises for dedication
as a public street.

MOTION: LaValle made motion, seconded by Irsfeld, to table
Item 1 of the petitioner's request until the deter-
mination of the basis of objection of the underlying
fee owner to the dedication of public purpose, and
the ability to convey the easement by the petitioners
(Gerald and Sandra Dabe) .
VOTING FOR: LaValle, Irsfeld and Vail

MOTION: Irsfeld made motion, seconded by Vail, that the City
of Hugo deny the Item 2 of the petitioners' request
to initiate such proceedings as are necessary pur-
suant to M. S. 117.011 et seq (eminent domain) in
order to acquire said premises for dedication as a
public street, for the following reasons:

2. Problem of compensation of parties involved.
3. Lack of availability of funds.

6.0 ORDINANCES AND RESOLUTIONS
6.1 Safe Deposit Box - Resolution 1979-43
MOTION: LaValle made, seconded by Irsfeld, to adopt RESOLUTION
1979-43, A RESOLUTION AUTHORIZING THE CITY OF HUGO TO
RENT A SAFE DEPOSIT BOX FROM THE FIRST STATE BANK OF
HUGO.
VOTING FOR: LaValle, Irsfeld and Vail
MOTION CARRIED
7.0 UNFINISHED BUSINESS
MOTION: Irsfeld made motion, seconded by Vail, to set the pay
rate for general labor at $4.50/hour. The wage rate
may be adjusted per incident by City Council action.
VOTING FOR: LaV-11e, Irsfeld and Vail

8.0 NEU BUSINESS
8.1 Opinion on Gun Club
House File No. 51 has been introduced to amend 116.07 of the State
Statutes. LaValle felt that the addition was a blanket statement
and not correct. To date, no standards have been adopted by PCA
regulating noise levels.
MOTION: Irsfeld made motion, seconded by LaValle, directing
the City Clerk to draft a letter to our local repre-
sentatives stating the city's objection to the vague
wording of the proposed bill.

MOTION CAARRIED
Mayor LaValle received a letter from Forest Lake Township requesting
the city to review their Comprehensive Land Use, Plan. Copies are
to be provided for the City Attorney and the City Engineer.

MOTION: LaValle made motion, seconded by Irsfeld, to refer
the comprehensive Plan from Forest Lake Township
to the Planning Commission for their review.
VOTING FOR: LaValle, Irsfeld and Vail
9.0 CLERK
Police Chief is to be present at the meeting of March 5, 1979, and
at that time submit a report stating the problems related to pro-
cedures for reporting, and his solution to the problem.
10.0 Miscellaneous
The City Attorne: reviewed the lease from Northwestern Bell relating
to the installation of an antenna on the City's Water Tower.
Johnson will submit the suggested changes to Northwestern Bell.
In conjunction with Bell's plans, bathroom facilities will also
be constructed on city property. The Hugo Lion's Club presented
the city with a check in the amount of $3,000.00 to cover partial
payment of the facility. It was determined that a performance
bond will be required.
MOTION: Irsfeld made motion, seconded by Vail, authorizing
Howard Kuusisto to advertise on bids for the bathroom
facilities on property of the City of Hugo.
VOTING FOR: LaValle, Irsfeld and Vail
MOTION CARRIED
MOTION LaValle made motion, seconded by Irsfeld, to extend
the meeting past 11 :00 PM.
ALL AYE. Motion Carried.
The Council further discussed several claims against the city. It
was determined that the claims should be forwarded to the City' s
insurance company for their determination.
MOTION: Irsfeld made motion, seconded by Vail, to adjourn
at 11 :45 PM.
