PRESENT: Spitzer, Schletty and Irsfeld ABSENT: LaValle and Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of March 5, 1979, as presented. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Schletty, to approve the General Claims for March 19, 1979, as submitted. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED MOTION: Irsfeld made notion, seconded by Spitzer, to approve the Utility Claims for March 19, 1979, as submitted. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Richard Genrich - Special Use Permit Mr. Zimmerman, prospective land purchaser, was present, and stated that he would like the opportunity to conduct a wood splitting operation on the land He stated that the operation was an agricultural product, and would fit with the surrounding area. Spitzer mentioned the concerns of the local citizens relating to truck traffic and damage to the roads. Zimmerman said that they would be doing no delivering in the spring months, because they have to abide by the state regulations. Their business would con- sist of wholesale only ( local chain stores and private home owners) . They have no intention of having individuals coming to the site to purchase wood. The operation would employ four people - six at the most. The Special Use Permit would be granted for the entire 105 acres, but only be located as indicated on the site plan. Zimmerman did not feel that noise would be a factor in the operation because of the use of electric motors, hydraulicly driven. The logs would be brought in at 100", cut into 16" pieces and then split. Zimmerman stated that a private access would be constructed on the property to service trucks, and Spitzer requested that road be indicated on the site plan. Zimmerman was concerned that the city would be able to shut down the operation at any time, and Spitzer stated that this was not ordinarily the policy of the city. The city did have the option, though, if con- ditions of the permit were not met. 34 MARCH 19, 1979 MOTION: Schletty made motion, seconded by Irsfeld, to table the request until the meeting of April 2, 1979. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.2 Fred Benson - Special Use Permit Mr. Jeff Barbour, representative for Fred Benson, was present, and stated that the letter of Credit would be forthcoming when their financial arrangements were in order. He requested that the deadline of April 1 , 1979, for submittal of the letter of credit be extended. Spitzer stated that no construction could be started until the city has the letter of credit, and Barbour concurred. MOTION: Irsfeld made motion, seconded by Schletty, that Mr. Fred Benson has until July 1 , 1979, to submit his letter of credit as required by Iten 11 of the Special Use Per- mit. VOTING FOR: Spitzer and Irsfeld VOTING AGAINST: Schletty MOTION CARRIED 5.3 Quint Enterprises - Minor Subdivision Mr. John Moore presented the council with a copy of the survey for the proposed subdivision on 145th Street (Molitor property) . The two duplexes on the property will be altered to single family dwell- ings. The Planning Commission recommended approval subject to removal of the exterior stairway and the center garage. MOTION: Spitzer made motion, seconded by Irsfeld, to grant ap- proveal of the Minor Subdivision, including existing structures, to Quint Enterprises, subject to the following: 1 . That the exterior stairway on the 70' lot be removed 2. That the center garage on the GO' lot be removed. 3. The above conditions should be met within 180 days from 3/19/79. No deeds are to be signed until the above mentioned con- ditions are met. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.4 Mardon Homes - Subdivision Mr. Tramm presented the preliminary plan with the required drainage easements. The plan was submitted to Rice Creek regarding the creek, and they okayed the 30' easements. MA OH 19, 1979 35 Mardon Homes - cont. A perc test for Lot 3, Block 1 was submitted to Howard Kuusisto, and met with his approval. Irsfeld asked if the high water table had been determined, and stated that he would like to see the home sites moved further back. Howard Kuusisto determined that a financial guarantee in the amount of $55,000.00 to cover construction of the road would be appropriate. Before preliminary plat approval can be granted, Mr. Tramm was instructed to provide the city with a copy of the restrictive covenants, and the most recent tax statement. MOTION: Irsfeld made motion, seconded by Schletty, to place Mardon Homes on the agenda for the meeting of April 2, 1979. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.5 Peloquin, Mallinger. Myer - Legal Descriptions These rezonings have been delayed until accurate legals had been obtained. The Clerk's office was directed to have Ordinance 159 published with the legal descriptions. 6.0 ORDINANCES AND RESOLUTIONS 6.1 Sign Ordinance I•IOTION: Schletty made motion, seconded by Irsfeld, that the Sign Ordinance be tabled until April 2, 1979, for fur- ther deliberation. ' VOTING FOR: Spitzer, Schletty and Irsfeld MOTION Carried 6.2 Ordinances for Rezonings (156. 157. & 158) • Let the record show that the rezonings approved by the City Council in session on March 5, 1979, have been cast as Ordinances 156, 157, and 158. The City Clerk is directed to effect publication forthwith. 6.3 Meeting date for Subdivision Ordinance MOTION: Irsfeld made motion, seconded by Schletty, to set a meeting date for April 18, 1979, at 7:00 PM, to further discuss the proposed Subdivision Ordinance. The meeting to be attended by the City Council, Planning Commission, Ordinance Committee, City Attorney, and City Engineer. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 36 MARCH 19, 1979 7.0 UNFINISHED BUSINESS - No discussion 8.0 NEW BUSINESS 8.1 Appointment to Planning Commission MOTION: Irsfeld made motion, seconded by Schletty, to appoint Bill Hanson to the Planning Commission to fill the vacancy created by the termination of Dave loeltge, for a term to expire 12/31/79. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 9.0 CLERK - No discussion 10.0 T• ISCELLANEOUS Police Chief Barth submitted a letter listing various Reserve Officers he is recommending tobe sworn in as Police Reserve Officers. MOTION: Irsfeld made motion, seconded by Schletty, that the recommendation of the Chief of Police be tabled until April 2, 1979. VOTING FOR: Spitzer, Schletty and Irsfeld NOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to adjourn at 9:15 2M. All aye. Motion Carried. Carol A.
