HomeMy WebLinkAbout1979.04.16 CC Minutes 48 MINUTES OF THE PROCEEDINGS OF TEE HUGO CITY COUNCIL MEETING OF APRIL 16, 1979 The meeting was called to order by Mayor LaValle at 7:01 P.M. rAbO I : LaValle, Spitzer, Schletty, Irsfeld and Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of April 2, 1979, after the following changes have been made: Page 1 (5.2) — sawing of Wood with circular or chain saw Page 5 (Ehret) — expressing our regret at the necessity for resigning VOTING FOR: LaValle, Spitzer, S.ohletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the minutes of April 9, 1979, after including the list of contributors of $300.00 for the insurance and bond for Project 7905: Richard Ferraro — $25.00 Joe Oman — $50.00 Imperial Tool — $50.00 Ed Waugh Howard Meline $120.00 Mike McAllister Mike McAllister — $5.00 Regal Plastics — $25.00 Norman Hill — $25.00 VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED ,4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Schletty, to approve the general claims for April 16, 1979, after deletion of Beulke Agency for $1,003.00. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded 'by Vail, to approve the Utility Claims for April 16, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNT..CATIONS & LICENSES 9.1 Larry Ehret — laid over until next meeting APRIL 16, 1979 5.,2 Raymond Olson - Renew of Mobile Home Permit MOTION: Spitzer made motion, seconded by Schletty, to renew the Mobile Home Permit for Raymond Olson, 7800 132nd Street North, under Chapter 40 Article III, Subdivision D, for a period of 90 days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.3 Paul R,nchke -. Possible Driveway Violation Mr. Reschke works evenings and was unable to attend the meeting. He stated that he will be rectifying the problem this summer. The Clerk was directed to forward a copy of the Driveway Ordinance to Mr. Raschke, and ask that he attend a City Council meeting to explain what is going to be done. 5.6 j,en Nos.& - Auto Dismantling. License MOTION: Spitzer made motion, seconded by Irsfeld, that the Auto Dismantling License for Mr. Len Noack be renewed until May 3, 1980, with all previous restrictions to be enforced as determined in the Special Use Permit. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED Mr. Noack is to be notified that all cars parked in front of the new fence are to be removed. SIGN ORDINANCE The City Attorney and Council discussed the various changes to be made to the ordinance as presented. MOTION: Spitzer made motion, seconded by Schletty, to table the Sign Ordinance until May 7, 1979. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 15 Richard Vail - Variance Mr. Vail is requesting a variance to install a septic system 66 2/3' from the water's edge instead of 100' as indicated in the Ordinance, at 14451 Homestead Avenue. MOTION: Spitzer made motion, seconded by Irsfeld, to grant a Variance to Mr. Richard Vail to install a septic system at 66 2/3 ' from water's edge instead of 100' in accordance with Chapter 320, Subd. G, par- agraph 4. This variance is to be granted in order to allow owner reasonable use and enjoyment of his property. 5 0 APRIL 16, 1979 Richard Vail - Variance Continued VOTING FOR: LaValle, Spitzer and Irsfeld VOTING AGAINST: Scahletty ABSTAINED: Vail XOTION CARRIED BreviR Dike Mr. Kuusisto has been in contact with Rice Creek and permit for the work will be forthcoming. It was determined that a 40' easement will be required on Lot 6, Block 2, Evergreen Hills 2nd Addition, and a 45' easement on Outlot A. It was suggested that not more than $100.00 be offered in compensation for the easements. MOTION: Spitzer made motion, seconded by Irsfeld, authorizing the City Attorney and Councilman Schletty to proceed with the acquisition of easements necessary for the relocation of the earthen dam. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.4 Thomas Zimmerman - Special Use Permit Mr. Zimmerman provided the Council with the following, requested information: des- cription of business, site plan, information and location on proposed road, a permit form Rice Creek for the ditch crossing, and building plans. Kuusisto had no pro- blem with the use of the chemical toilet, as long as an approved perc test is provided in relative proximity of the proposed building. MOTION: Spitzer made motion, seconded by Irsfeld, to grant a Special Use Permit to Thomas S. Zimmerman for the operation, maintenance, and storage of firewood supply, and construction of a 60' x 70' pole barn to use in the operation at the Wi of NE4 and the NI of SE4 of the NE4 and W of W1 of Si of SE* of NE4f Section 32, in accordance with the Site Plan as submitted. Subject to the following conditionss 1. The building to be constructed in accordance with the plans submitted and so positioned relative to perc test that a valid building Permit can be obtained. 2. That the access road south from 130th Street to be completed not later than July 1, 1981. 3. During period of the construction of the access road, the haul road will be designated as 130th Street and Goodview Avenue. Such route to be vacated upon completion of the access road. 4. Dust suppression measures shall be installed at the expense of the permit holder to protect those residences existing along the temporary haul route. 5. Hours of operation shall be restricted to the hours between 7:00 AM and 7:00 PM, local time, Monday through Saturday. Additional hours by special authorization only. APRIL 16, 1979 51 Zimmerman — Special Use Permit Continued 6. All state EPA noise requirements shall helmet. 7. Permit holder shall provide a bond in the amount of $5,000.00, in favor of the City of Hugo, to guarantee compliance with Items 2 and 4. Said bond shall be released on satisfactory compliance. 8. This permit shall be reviewed annually. 9. This permit shall be null and void unless it is signed by all parties concerned by August 1, 1979, and the bond has been received by the City office. VOTING FOR: LaValle, Spitzer, Irsfeld and Vail ABSTAINED: Schletty MOTION CA RIED MOTION: Spitzer made motion, seconded by Irsfeld, to amend the previous motion, Item 8, to add the following: This is not to be construed as a requirement for renewal. (VAIL LEFT THE MEETING AT 9:16 PM) VOTING FOR: LaValle, Spitzer and Irsfeld ABSTAINED: Schletty MOTION CARRIED 7.0 ui:V,r-ira.SHED BUS N SS 7.2 Reserve Officers Chief Barth had explained to Mayor LaValle what was entailed in the education of Reserve Officers. Barth stated that their training was not completed as yet, but at this point, felt that they were no longer a liability to the city. MOTION: Irsfeld made motion, seconded by Schletty, to accept Chief Barth's recommendation that Reserve Officers Greg Gahlet, James Zimmerman, Sue DeJonker, and Gary Schoonover be be sworn in as Police Reserve Officers for the City of Hugo. VOTING FOR: LaValle, Spitzer, Schletty and Irsfeld NOTION CARRIED It was determined that no time schedule could be established, at this time, in re— gard to the correlation of work to be done by Marie Connors between the Clerk's office and the Police Department, until the training in period is completed. Barth to report on status of training at the meeting of May 9th. Chief Barth submitted a report regarding use of personal vehicles; by Officers while on duty. Chief Barth was instructed to contact Sheriff Trudeau as to the.possibil— ity of the city renting or leasing a vehicle for emergency purposes while the city's squad is immobile. APRIL 16, 1979 $eserve Officers eon't MOTION: LaValle made motion, seconded by Spitzer, authorizing the Police Chief to purchase a shotgun, in an amount not to exceed $110.00. VOTING FOR: LaValle, Spitzer, Schletty and Irsfeld MOTION CARRIED 7.1 FOREST LAKE TOWNSHIP - COMPREHENSIVE ?LAN MOTION: LaValle made motion, seconded by Spitzer, directing the City Clerk to notify Forest Lake Township that their Comprehensive Plan of May, 1977, and revised June, 1978, poses no objections by the City of Hugo. If any amendments to the plan are made, the city would like to be notified and be allowed to make comments. VOTING FOR: LaValle, Spitzer, Schletty and Irafeld MOTION CARRIED PLANNING COMMISSION CHATRPE•RSON MOTION: Schletty made motion, seconded by Spitzer, to table the matter of appointing a Planning Commission Chairperson until May 9, 1979. VOTING FOR: LaValle, Spitzer, Schletty and Irsfeld MOTION CARRIED 9.0 Clerk The Clerk had discussed the possibility of the City-obtaining insurance with Wash- ington County for its employees. Washington County has passed a Resolution stating that the only hospitalization caverage they offer is for those employed by Washing- ton County. Insuring employees of outside communities is a closed issue. The Clerk was directed to notify Mr. Evans of this action. Councilmen Schletty and Vail have been trying to lacate a resident willing to super- vise the Summer Youth Program. LaValle stated that some guideliIas should be drawn for work to be done. MOTION: Spitzer made motion, seconded by Irafeld, to extend the meeting past 11:00 PM. All aye. Motion carried. MOTION: Spitzer made motion, seconded by Irsfeld, to adjourn at 11:03 PM. All aye.
