PRESENT: Spitzer, Schletty, and Irsfeld ABSENT: LaValle and Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Schletty, to approve the minutes of May 7, 1979, as submitted. MOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Schletty, to:approve the General Claims of May 21 , 1979, as submitted. VOTING FOR: Spitzer, Schletty, and Irsfeld MOT]D N CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to appprove the Utility Claims of May 21 , 1979, as submitted. VOTING FOR: Spitzer, Schletty, and Irsfeld MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Joseph Gregoire - Renew of Mobile Home Permit MOTION: Irsfeld made motion, seconded by Schletty, to grant a renewal of the Mobile Home Permit for Joseph Gregoire, 7600 165th Street North, Under Chapter 40, Aritcle III, Subdivision D, for ninety days. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.2 Elmer Peterson - Site Plan Approval Mr. Peterson is requesting authorization to construct a 24 x 30 garage on the George Strecker property, to be used for private storage. The attached garage will be renovated into living quarters. The house is located at 15435 Forest Blvd. MAY 21 , 1979 MOTION: Irsfeld made motion, seconded by Schletty, to grant ap- proval to the construction of a 24 x 30 garage to be used for private storage, as indicated on the submitted site plan. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.3 Dan Spitzer - Site Plan Approval Mr. Spitzer is requesting authorization to construct a 40 x 40 pole barn on his property located at 16080 Jeffrey Avenue. The building will be used for storage and livestock. Mr. Spitzer owns 20 acres with two deeds (5 & 15). The land is in the Agricultural zone. MOTION: Schletty made motion, seconded by Irsfeld, to approve the Site Plan of Dan Spitzer to construct a 40 x 40 pole barn to be used for storage and livestock, as indicated on the submitted plan. VOTING FOR: Schletty and Irsfeld ABSTAINED: Spitzer MOTION CARRIED 5.5 Darrell Tavernier - Site Plan Approval and Licenses Spitzer stated that if the Council concurred, Tom Crever could issue a Building Permit on the facts that the business has never ceased op- eration since the fire in April, 1977, and the business should be con- sidered as a lawful non-conforming use. The Planning Commission had decided that there was no intensification of a lawful non-conforming use. MOTION: Irsfeld made motion, seconded by Spitzer, that it is the recommendation of the Planning Commission and City Council that the boat rental business of Darrell Tavernier had never ceased to operate, and that it is the feeling of the Planning Commission and City Council that a recon- struction of a storage building does not intensify a lawful non-conforming operation. The Building Inspector is directed to act appropriately, and it is not the in- tention of the City Council that any existing septic sys- tem be used or that a new one be constructed. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED Mr. Tavernier stated that he will be having Satelites placed on the property and will be having them pumped. 63 MAY 21 , 1979 Darrell Tavernier - Licenses MOTION: Schletty made motion, seconded by Spitzer, to grant an OFF-SALE Non-Intoxicating Liquor and Soft Drink License to Darrell Tavernier, LAKEVIEW INN, in an amount of $20.00. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 5.6 Hugo Slow Pitch Tournament - On Sale Non-Intoxicating and Soft Drink License MOTION: Irsfeld made motion, seconded by Schletty, to grant an On Sale Non Intoxicating Liquor and Soft Drink License for the Hugo Slow Pitch Tournament, June 2 •and 3, 1979, in the amount of $20.00. VOTING FOR: Spitzer, Schletty, and Irsfeld MOTION CARRIED 5.4 Mid AMERICAN Metal Craft - Discussion on possible rezoning; Mr. Larson and Mr. Cleman, owners of Mid American Metal Craft, are in- terested in purchasing the old Arlington Furniture building. The land is zoned RB, and would not allow the type of work they are in. They would need a rezoning to Industrial. Spitzer stated that their course of action would be to apply for an rezoning and go through the necessary formalities. The City Council is unable to give any determination at this time. 5.7 Howard Moe - Amended Special Use Permit Mr. Moe was present, and stated that he has already planted the trees as requested by the Planning Commission. Councilman Schletty will in- spect the planting, and report to the City Clerk as to whether it con- forms to the City's requirements. Howard Kuusisto determined that the letter of credit to insure blacktopping would have to be submitted in the amount.,of $7,250.00. Mr. Moe stated that rather than submitting a letter of credit in the above mentioned amount, he Would have the blacktopping done by October, 1979. MOTION: Irsfeld made motion, seconded by Schletty, to approve the Amended Special Use Permit for Howard Moe, B & H Auto Sales, 14057 Forest Boulevard, subject to the following conditions: 1 . That the access and egress to the business have a min- imum of 30' width driveway, hard surfaced. 2. That the area to be blacktopped, as proposed in the submitted Site Plan. 3. An irrevocable letter of credit, in the amount of $3,000.00, be provided to insure blacktopping by October 1 , 1979. 4. That minor body and paint work be allowed subject to all State and Federal regulations or codes for work 6 MAY 21 , 1979 Howard Moe - Amended Special Use Permit Conditions - Continued on vehicles owned by the business only. 5. Refer 320-5-M-3: Refers to said regulations for inoperable cars. That the back area of the property be maintained in a neat and orderly fashion. 6. The Special Use Permit is subject to annual review. 7. No more than thirty (30) cars parked on the property outside the building. There shall be no cars allowed for storage on the eastern 501 of the property. 8. Trees or similar vegetation be planted and maintained along the northern of the eastern property line. Trees shall be planted 6' apart, rows 8' wide, and alternate trees in each row. 9. If Mr. Moe accepts the conditions of this permit, he allow the City to count the number of cars outside, at any time. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED The City Clerk was instructed to not release the permit until Council- man Schletty attests to the planting of the trees. 6.0 ORDINANCES AND RESOLUTIONS 6.1 Resolution on Water and Sewer Rate Increase MOTION: Irsfeld made motion, seconded by Schletty, to adopt RESOLUTION 1979-47, A RESOLUTION ESTABLISHING UTILITY RATES FOR SANITARY SEWER AND WATER USE IN THE CITY OF HUGO, AS REQUIRED BY CITY CODE CHAPTERS 262 & 314, TO BECOME EFFECTIVE JULY 1 , 1979. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1 Personnel Policy Mr. Spitzer presented a rough draft of the Personnel Policy. This matter to be addressed at the next Council meeting of June 4, 1979. 7.2 Set meeting date for review of Proposed Subdivision Ordinance MAY 21 , 1979 65 MOTION: Irsfeld made motion, seconded by Schletty, to set a Special Meeting of the City Council for May 31 , 1979, 7:00 PM, to further discuss the proposed Subdivision Ordinance. Meeting to be held in conjunction with the Ordinance Committee and Planning Commission. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 8.0 New Business Mike McAllister was present, commenting on the color of the new lavatory facility. If the Council was interested in having the entire complex painted this summer, he would hold off on painting over the lavatory. It was the concensus of the Council that they would like to see the entire building painted this summer. McAllister was instructed to sub- mit a bill from OMG Construction, in the amount of $80.00, to cover a cost overrun. 8.1 Set date to discuss Police Contract MOTION: Spitzer made motion, seconded by Irsfeld, to set a Special Meeting of the City Council for May 30, 1979, .7:00 PM, to discuss the Police Contract. VOTING FOR: Spitzer, Schletty, and Irsfeld MOTION CARRIED 8.2 Washington County Highway Contract This matter will be discussed at the meeting of June 4, 1979. 80 Planning Commission reauest to petition DOT The City Clerk instructed to check on the possibility of obtaining grant money to have measures taken to prevent railroad crossing accidents. ORDINANCE COMMITTEE MOTION: Spitzer made motion, seconded by Irsfeld, to accept the resignation of Linda Gerten from the Ordinance Committee. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED MOTION: Schletty made motion, seconded by Spitzer, to appoint Ken Lorch, 13608 Homestead Avenue, as a member of the Ordinance Committee. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 66 MAY 21 , 1979 MOTION: Irsfeld made motion, seconded by Schletty, to increase the number of Ordinance Committee members from 5 to 6. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to appoint Ann Fashingbauer, 12564 Goodview Avenue, as member of the Ordinance Committee. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED Spitzer stated that the Ordinance Committee questioned as to where the Certificate of Occupancy should be addressed in the City Code. Attorney Johnson stated in the Building ()ode - Section 40. Mrs. Peltier was to be notified that she should notify the Building Inspector at which meeting this matter will most probably be discussed. Mrs. Peltier is also to be notified to make as part of the Driveway Permit the following: Grant city necessary access to the property on which the driveway would be built in order to construct the driveway. The City Clerk was directed to obtain a copy of Forest Lake's Sub- division Ordinance for the Ordinance Committee. 9.0 Clerk MOTION: Spitzer made motion, seconded by Irsfeld, to accept the resignation of Virgil Ekbom as Heating Inspector for the City of Hugo. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED 10.0 MISCELLANEOUS The permit form Rice Creek in regard to the Brevig dike has been received. Councilman Schletty will attempt to find someone to do the work, along with a letter of intent. MOTION: Spitzer made motion, seconded by Schletty, that the City Clerk notify Washington County Library that they have permission to use City Hall on A'Ui eT 13, 1979, from 6:00-6:45 PM, as requested. VOTING FOR: Spitzer, Schietty and Irsfeld MOTION: Spitzer made motion, seconded by Schletty, to appoint Peter Kluegel as Heating Inspector for the City of Hugo. VOTING FOR: Spitzer, Schietty and Irsfeld MOTION CARRIED MAY 21 , 1979 67 Mr. John Moore submitted a bill to the city for hooking up to sewer at 6020 Oneka Lake Blvd. He stated that the actual hookup was at 14' , and it was supposed to be at 11 ' . The Clerk was instructed to send the bill back to John Moore. MOTION: Spitzer made motion, seconded by Irsfeld, that adjust- ments were made to the following parcels at the Board of Review held May 8, 1979: Parcel No. 93023-2855 Parcel No. 35020-0020 Parcel No. 93007-2705 VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED The city received a notice from the Minnesota Department of Health re- garding violations at the MR Tourist Camp. The City Clerk is to make sure the city is informed as to the outcome of the hearing. The City Attorney has received correspondence in regard to the Rehbein matter. The stipulations did not address the city's zoning require- ments. MOTION: Irsfeld made motion, seconded by Schletty, that the City Attorney work out modifications to the stipulations re- garding the Rehbein matter. VOTING FOR: Spitzer, Schletty and Irsfeld MOTION CARRIED Attorney Johnson has been in contact with Preston's attorney, Jack Wallace, regarding the NSP matter. A 300' easement will have to be obtained form Preston. MOTION: Spitzer made motion, seconded by Irsfeld, directing the City Attorney to meet with Jack Wallace and NSP, and see what sort of arrangement can be worked out that would pro- vide the city with the Preston easement and provide us with a 10 acre parcel.
