PRESENT: LaValle, Spitzer, Irsfeld and Vail 3.0 APPROVAL OF MINUTES MOTION: Spitzer made motion, seconded by Irsfeld, to approve the minutes of July 2, 1979, after the following changes have been made: Page 1 (2nd sentence) - Schletty arrived Page 4 (Benson) - Mr. Barbour appeared regarding the matter VOTING FOR: LaValle, .Spitzer, Irsfeld and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Irsfeld made motion, seconded by Spitzer, to approve the general Claims of July 16, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to approve the Utility Claims of July 16, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Irsfeld and Vail MOTION CARRIED 5.0 PETITIONS. REQUESTS. COMMUNICATIONS & LICENSES 5.1 Richard Pillard - to be discussed later in the meeting 5.2 Jack and Mary Lvsne - Farm Site Plan MOTION: LaValle made motion, seconded by Spitzer, to accept and approve the Farm Site Plan for Jack and Mary Lysne, 15063 Greene Avenue, to construct a 30 x 48 pole barn to be used for storage. VOTING FOR: LaValle, Spitzer, Irsf(-l3. and MOTION CARRIED 9 4 JULY 16, 1979 5.3 RAY OLSON - RENEW OF MOBILE HOME PERMIT Mr. Olson is now residing in his house, and has the trailer up for sale. LaValle stated that a letter should be sent to Mr. Olson stating that his permit expires on July 17, 1979, and that 60 days is a reasonable length of time in which to have the trailer removed. 5.4 FOREST LAKE YOUTH SERVICE BUREAU Mr. Tom Oswald was present, and submitted a copy of a Purchase of service agreement that he would to have approved by the City Council. He stated that there is a grant available to the Bureau if he can obtain matching funds. About 7% of the 300 youths to be served live in Hugo, Most youths are in the 15 - 16 age group, and are not con- tent at home or at school. SCHLETTY ARRIVED AT 7:10 PM. Their primary service rendered is for counseling. LaValle stated that the services are limited to the Forest Lake School District, and Hugo covers four districts. The bureau is looking for a commitment of $2,000.00 from the City. MOTION: Spitzer made motion, seconded by Schletty, that the City Clerk be directed to notify the White Bear and Forest Lake Youth Service Bureaus to make a presenta- tion at the City Council meeting of August 6, 1979, relative to their request for funding in 1980. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.5 JEROME JESSEN - PETITION FOR TEMPORARY MOBILE HOME PERMIT Mr. Jessen is proposing to construct a log home at Henna and 132nd Street. He is not ready to obtain a Building Permit at this time. Tom Crever has already approved a perc test for the property. MOTION: Spitzer made motion, seconded by Irsfeld, that Mr. Jerome Jessen be granted a Temporary Mobile Home Permit subject to the condition that an irrevocable Letter of Credit, in the amount of $5,000.00, made in favor of the city, be filed. Letter of Credit to be held in lieu of Building Permit, which must be pulled within 90 days. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.6 JOHN JUNGMANN - NUISANCE COMPLAINT (MR TOURIST CAMP) The City has received a formal complaint from John Jungman and William Leko regarding numerous violations at the MR Tourist Camp. The Health Department has inspected the area and listed their findings in a letter - dated June 4, 1979. To date, no corrections have been made. 95 JULY 16, 1979 John Jungman - Con't. MOTION: LaValle made motion, seconded by Spitzer, directing the City Clerk to send a registered letter to the State Health Department, requesting that a representative be present at the City Council Meeting of August 6, to dis- cuss violations at the MR Tourist Camp. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld, and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, that the Police Department be directed to visit the MR Tourist Camp and investigate the possible violations of the Nuisance Ordinance, in particular: 1 . Unrestrained domestic animals - dogs 2. Abandoned tires and cars, and 3. Lack of adequate sanitary sewer facilities. The City Council would also like an accurate count of the Mobile Homes permanently placed on the premises. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.7 SHEPHERD OF THE FIELDS - STREET LIGHTS MOTION: Spitzer made motion, seconded by Irsfeld, that NSP be notified that the City Council authorizes the installa- tion of three street lights at the following locations: 1 . Mid-block location by Shepherd of the Fields 2. Intersection of 148th Street and Geneva Avenue 3. Intersection of Oneka Lake Blvd. and Geneva Avenue in accordance with NSP's letter of December 18, 1978. Howard Kuusisto directed to attempt to have these lights be sodium vapor lights. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 6.0 ORDINANCE AND RESOLUTIONS MOTION: LaValle made motion, seconded by Spitzer, to table the requests of Leroy and Louren McCullough and Clyde Rehbein until all requested information is provided. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 96 JULY 16, 1979 ORDINANCES - Cont Attorney Johnson reviewed the draft of the required Site Plan for the RB and CB districts. Draft returned to the Ordinance Committee for rewording. MOTION: Spitzer made motion, seconded by LaValle, to accept the resignation of Ann Munthe from the Ordinance Committee. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 7.0 UNFINISHED BUSINESS 7.1-- County Owned Land MOTION: LaValle made motion, seconded by Irsfeld, to table this matter until the meeting of August 6, 1979. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 7.2 Building Inspector Report on Walsted Property, Mr. Gene Letourneau, present owner of the property, will be making application for the following permits: Building, Plumbing, and Heating. 8.0 NEW BUSINESS - No discussion 9.0 CLERK Chief Barth reported that Schmidty's 61 Club has completed the installa- tion of the fencing along the western portion of the business. MOTION: Spitzer made motion, seconded by Irsfeld, to release the Letter of Credit for Schmidty's 61 Club, to cover the installation of the fence. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to set a Special Meeting of the City Council for July 23, 1979, at 7:00 PM, to discuss the Police Department's Union Contract. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 97 JULY 16, 1979 Marie Connors Carol Williams stated that Marie has done a satisfactory job for the past six months, and has taken over the duties as secretary of the Police Department. MOTION: LaValle made motion, seconded by Spitzer, to increase the salary of Marie Connors from $3.50/hour to $4.00/hour. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 10.0 MISCELLANEOUS Attorney Johnson attended a meeting this date in regard to the changing of law regarding zoning, subdivision, and implementation of the Com— prehensive Plan. Another meeting has been set for August 7. Attorney Johnson suggested that the City Council might want to make written comments before the legislation is passed. Copies of the proposed changes have been forwarded to the Planning Commission and Ordinance Committee. RICHARD PILLARD MOTION: Spitzer made motion, seconded by Schletty, that the Richard Pillard matter be laid over until the meeting of August 6, 1979. Mr. Pillard to be notified to be present at this meeting to discuss the matter with him. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED Engineer Kuusisto made an onsite inspection of the lot owned by Bill Clark. Rice Creek requested that a topographical map be sub— mitted for the area. The permit to install a septic system issued by Rice Creek to Bill Clark has been suspended. The permit was not issued to allow for filling on the property, but for installation of a septic system. LaValle stated that if the land was located in the floodway, no filling would be allowed. If the land was located in the flood fringe, the city would have to determine the percentage of the lot to be filled. The City would have to consider the total area. Kuusisto and 9,chletty inspected Ethan -Avenue for patching work to be done. MOTION: LaValle made motion, seconded by Vail, to authorize Councilman Schletty to contact Washington County to do the necessary repair work on Ethan Avenue. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 9 8 JULY 16, 1979 NORTHWESTERN BELL MOTION: Spitzer made motion, seconded by Irsfeld, authorizing approval of Northwestern Bell's Job Orders 49861 and 65181 , pursuant to City Engineer's recommendations. VOTING FOR: LaValle , Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED The City received a letter from Rice Creek Watershed regarding the septic system at 14451 Homestead Avenue. They stated that an after the fact permit application is required from the property owner for installation of an individual sewage treatment system. They also re- quested copies of the exhibittJ used for basis of approval of this system be forwarded to the Board of Managers for review. MOTION: LaValle made motion, seconded by Spitzer, directing the City Clerk to notify the property owner that a sewage permit is required. The Building Inspector and/or Plumbing Inspector requested to forward the necessary information to the Rice Creek Watershed District. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to adjourn at 9:40 PM. All aye. Motion Carried. Carol A.
