PRESENT: LaValle, Spitzer, Schletty, Irsfeld and Vail 3.0 APPROVAL OF MINUTES MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes of September 4, 1979, after the following changes have been made: Page 2 (Clark) - Milner Carley Page 5 (Marier) - restrain from placing sand Add to minutes - Spitzer made motion, seconded by Irsfeld, to adjourn at 9:35 P.M. All aye. Motion Carried. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Spitzer made motion, seconded by Irsfeld, to approve the minutes for the Special Meeting of September 10, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to approve the minutes for the Special Meeting of September 13, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 4.0 APPROVAL OF CLAIMS MOTION: Spitzer made motion, seconded by Irsfeld, to approve the General Claims for September 17, 1979, as submitted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Spitzer, to approve the Utility Claims for September 17, 1979, as submitted. VOTING FOR: LaValle, -Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES 126 SEPTEMBER 17, 1979 5.9 Clyde Rehbein - Rezoning Mr. Rehbein, CR Investments, is requesting a rezoning of his property at 15587 Forest Boulevard from RB to Industrial. This matter had been discussed previously, but the required proof of ownership was not in order. An updated proof of ownership had been submitted, and approved by Attorney Johnson. MOTION: Spitzer made motion, seconded by Schletty, to adopt Ordinance 163, an Ordinance amending the Zoning Ordinance to rezone property known as C.R. Investment, Inc. , from Retail Business to Industrial. Legal description from Washington County to be used for publication. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.2 Occupant 8478 - 147th Street - Disposing of diseased trees Mr. NOrm Danner, 8478 147th Street and Andy Goiffon, 8124 147th Street, have granted Haines Tree Removal permission to dispose of diseased trees on their property. This is in violation of Chapter 80-11, because no permit had been sub- mitted by the Tree Inspector. The trees will be used solely by the property owners for firewood. No Trees will be removed form their property. MOTION: LaValle made motion, seconded by Irsfeld, that Mr. Charles Beach be notified to contact Mr. Norm Danner and Andy Goiffon in regard to a permit for utilization of diseased elm and oak trees for firewood. Mr. Beach to consider the City Council's following recommendations in issuance of the permit: 1 . That there be no resale of the wood, 2. No further transporting of the wood of either property 3. If there is determined infestation of elm trees in the immediate area, necessary treatment will be accomplished. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED Mr. Danner and Mr. Goiffon will be responsible for all costs incurred as a result of the issuance of this permit. Mr. Beach charges $10.00 per hour and 200 a mile. 5.3 Reset Public Hearing Date for Revenue Sharing MOTION: Spitzer made motion, seconded by Irsfeld, that the public hearing for Revenue Sharing be set for October 1 , 1979, at 7:30 P. M. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED Err SEPTEMBER 17, 1979 5.1 Paul Hasecuster - Variance Mr. Hasecuster, 12670 Ingersoll Avenue, has requested a variance to construct a 22 x 28 garage 20' from the right-of-way of Ingersoll. The Zoning Ordinance dic- tates a 40' setback requirement. His present drainfield is not functioning, so he would like the additional land to remedy that problem. HIs present tuck-under garage will be made into living space. Schletty felt that granting of the variance could become a problem when Ingersoll Avenue is reconstructed. MOTION: Spitzer made motion, seconded by Irsfeld, to approve Variance request of Mr. Paul Hasecuster, 12670 INgersoll Avenue, to locate his garage not less than 20' from Ingersoll Avenue, for the purpose of providing adequate area for operation of drainfield to accomplish the topography associated with the property. VOTING FOR: LaValle, Spitzer, Irsfeld and Vail VOTING AGAINST: Schletty MOTION CARRIED 5.4 George Crockett - Variance Mr. Crockett is requesting to construct a garage 3i' from the property line (5' required) . The Planning Commission recommended denial because of no undue hardship on the property owner and more land available. MOTION: Spitzer made motion, seconded by Irsfeld, to deny the request of George Crockett for a variance to construct a garage 3i' from property line (5' required) on the grounds that no proper grounds for a variance here exist. VOTING FOR: Spitzer, Irsfeld and Vail VOTING AGAINST: LaValle and Schletty MOTION CARRIED 5.5 Release Letter of Credit - Grace Development (Sewer hookup The sewer hookup has been made at 5927 Egg Lake Road, and the Plumbing Inspector has signed off on the permit. MOTION: LaValle made motion, seconded by Spitzer, that the Letter of Credit, in the amount of $2,000.00, form Grace Development to insure sewer hookup at 5927 Egg Lake Road be released. VOTING FOR: LaVAlle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.6 Letter of Credit - Grace Development (parking lot} The Letter of Credit covering the parking lot in the Bald Eagle Industrial Park will expire on October 1 , 1979. No comments were available from the City Engineer. 128 SEPTEMBER 17, 1979 Letter of Credit - Grace Development (parking lot) continued MOTION: LaValle made motion, seconded by Schletty, to extend the letter of credit, in the amount of $2,000.00, to insure construction of a parking lot in the Bald Eagle Industrial Park, until November 6, 1979. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED This letter of credit to be submitted prior to September 28, 1979, or the City will call on the letter of credit. 5.7 Hire Diseased Tree Inspector MOTION: Spitzer made motion, seconded by Schletty, that Mr. Charles Beach be hired as the City's Tree Inspector on a per occasion basis, at the rate of $10.00/hour and 200/mile. Mr. Beach is to be utilized at the request of the City Council only. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 5.8 Ray Olson - Removal of Mobile Home Mr. Olson was instructed to have his mobile home removed from his property by September 18, 1979.. Mr. Robert Barth, neighbor of Olson, stated that the home had been removed. MISCELLANEOUS - Ernest Hengel Mr. Hengel owns 20 acres along 147th Street and would like to divide the property. Because of the location of a garage, a straight dividing line cannot be obtained. It was suggested that Mr. Hengel divide the property to meet the 10 acre zoning requirement (with a jog behind the garage) , and obtain a variance to 300' road frontage requirement. 6.0 ORDINANCES AND RESOLUTIONS A draft of the Gambling Ordinance was submitted to Attorney Johnson for his review. The following statement is to be added to Section 2: All terms used herein are as defined in Minnesota State Statutes 349 and 507. 7.0 UNFINISHED BUSINESS 7.1 County Owned Land Tabled until next meeting. 7.2 Report on Brevig Dike Matter Attorney Johnson has been in touch with Brevig's attorney. Mr. Geck stated that he did net f feel that the October 1 , 1980 offer to complete the removal of the dike would be acceptable to his client. Mr. Geck will offer an alternative or start legal action. If a deadline can not be agreed upon, a possible point of negotiation would be to obtain an easement and leave the dike where it is. SEPTEMBER 17, 1979 129 7.3 Waugh Lease Agreement MOTION: Schletty made motion, seconded by Irsfeld, to approve the Lease Agreement for the rental of the Traeger building, for a term of one year. The Mayor is duly authorized to sign the lease. VOTING FOR: Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 8.0. NEW BUSINESS 9.0 CLERK The City has received a request from the Washington County Library to use City Hall on November 5, 1979, from 5:45 - 6:45 P.M. , to present a program on quilting for teenagers and adults. MOTION: Spitzer made motion, seconded by Schletty, to grant permission to Washington County Library to use City Hall on November 5, 1979, from 5:45 - 6:45 P.M. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED MOTION: Irsfeld made motion, seconded by Schletty, to authorize the City Clerk to purchase a typewriter ($886.00) and a calculator ($152.10) . VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED The City received a letter from Mrs. Theodora Peltier stating that wood was hauled to the property of Thomas Zimmerman at 10:30 P.M. , September 16, 1979. She also stated that no dust-control measures have been placed on 130th Street. Mr. Zimmerman has been reluctant to meet this requirement of his Special Use Permit, because gravel is scheduled for that street. Councilman Schletty will be discussing this matter with Mr. Zimmerman. PERSONNEL POLICY The following changes were made in the City's Personnel Policy adopted June 4, 1979: MOTION: Spitzer made motion, seconded by Irsfeld, to amend the Personnel Policy as follows: 1 . Item 4.0 (paragraph 1 ) - Change 2/3's to one day per month. 2. Item 12.1 - Delete the last sentence. 3. Item 9.0 (paragraph 3) add the following - Each employee shall be entitled to the difference between the disability insurance policy benefits and 80% of his/her salary for one month for each year of service to a maximum of six (6) months. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED 130 SEPTEMBER 17, 1979 MOTION: LaValle made motion, seconded by Spitzer, that Councilman Schletty be authorized to barricade 130th Street at a location 50' west of Grace Jackson's driveway and a location on Exhall as far as the road has been legally platted. VOTING FOR: LaValle, Spitzer, Schletty, Irsfeld and Vail MOTION CARRIED The City Clerk was instructed to send a letter to Washington County Highway Depart- ment notifying them that this is private property and the letter to serve as notice that no maintenance is to be performed on that part that is closed Mr. Ron Granger's letter of credit to cover screening at the new location for Paul's Pizza is to be placed on the agenda for 10/1/79. MOTION: LaValle made motion, seconded by Spitzer, that James Fure be paid an additional $150 .00/month, beginning July 23, 1979, for the added duties as acting Police Chief. To be in effect for the duration of tenure as acting chief.
