MINUTES OF THE PROCEEDINGS OF THE HUGO CITY COUNCIL
MEETING OF OCTOBER 1 , 1979
The meeting was called to order by Mayor La Valle at 7:04 P.M.
PRESENT: LaValle, Spitzer and Schletty
ABSENT: Irsfeld and Vail
3.0 APPROVAL OF MINUTES
MOTION: Spitzer made motion, seconded by Schletty, to approve the minutes
of September 17, 1979, after the following correction is made:
Page 4 (ERNEST HENGEL) - meet the 10 acre zoning requirement
(with a jog behind the garage)

4.0 APPROVAL OF CLAIMS

Claims for October 1 , 1979, as submitted.

5.0 PETITIONS, REQUESTS, COMMUNICATIONS & LICENSES
5.1 Dennis Quinlan - Special Use Permit
Mr. Quinlan, 12842 HOmestead Avenue, has made application to construct a 24 x 24
garage.

He already has an attached garage. The second garage will be used for personal
storage. Mr. Quinlan's land lies in the RRII zone. After reviewing, Spitzer did
not feel a Special Use Permit was in order.
MOTION: Spitzer made motion, seconded by Schletty, that the application
for Special Use Permit made by Dennis Quinlan, 12842 Homestead
Avenue, be vacated on the grounds that a Special Use Permit is
not required for action conemplated. The $35.00 fee to be refunded.

5.2 James WArnecke - Variance and Special Use Permit
Mr. Warnecke, owner of 11 acres in the Agricultural zone, would like to construct
a 30 x 56 pole barn prior to the main residence.
MOTION: Spitzer made motion to grant a Special Use Permit to James Warnecke
to construct an accessory building prior to the main residence
subject to the following:
1 . Letter of credit, in the amount of $5,000.00, be provided to
insure obtaining of a valid Building Permit.
2. The Special Use Permit will be valid only so long as applicant
is record owner of property.
3. The Site Plan, as submitted, to be followed.
Spitzer withdrew his motion.
Mr. Warnecke stated that he had supplied a copy of a perc test for his property to
Tom Crever, and Mr. Crever approved. (VAIL ARRIVED AT 7:16 P.M. ) . LaValle stated
that in other cases of this nature, there was a valid permit in force from the
Building Inspector. Warnecke stated that he is building an underground house and
would need the assistance ,of structural engineers which could take alot of time.
He had contemplated construction of the pole barn this fall.
MOTION: Spitzer made motion, seconde d by Schletty, to grant a Special Use
Permit to James Warnecke for construction of an accessory building
prior to the main residence, subject to the following:
1 . A letter of credit, in the amount of $5,000.00, be maintained
current in favor of the City, until Mr. Warnecke obtains a valid
Building Permit for construction of the principal residence. This
Building Permit shall be obtained no later than May 1 , 1980.
2. That the letter of credit will be in default if the Building Permit
is not obtained by that time or Mr. Warnecke transfers ownership
of the property.
3. The Site Plan on file with the City be followed in its
essentials.

MOTION: Spitzer made motion, seconded by Vail, to grant a variance to Mr.
James Warnecke to construct his accessory building closer to the
front lot line than the main residence.

Let the record show that the motion contemplated the topography of the land and
the proposed type of structures envisioned by the applicant. Let the record further
show that adequate road clearance is demonstrated and unnecessary obstruction of the
main building will not exist.
5.3 Public Hearing - Revenue Sharing (7:30 P.M.)
MOTION: Spitzer made motion, seconded by Schletty, that the Public Hearing
on Revenue Sharing be opened.
VOTING FOR: LaValle, Spitzer, Schletty and Vail
MOTION CARRIED
The City of Hugo will be receiving $17,493.00 in revenue sharing.
MOTION: Spitzer made motion, seconded by Schletty, to close the Public Hearing.

• MOTION: Spitzer made motion, seconded by Vail, that Revenue Sharing for the
year 1980, in the amount of $17,493.00, be designed as part of the
road construction budget.

5.4 Ron Granger - Letter of Credit (Screening)
Mr. Granger is renovating his plumbing building to accommodate Paul's Pizza and
a letter of credit was required for screening. This has been accomplished.
MOTION: Spitzer made motion, seconded by Schletty, that the Letter of Credit,
in the amount of $1 ,000.00 to cover screening, be released.

5.5 Stephen Shaw - Special Use Permit
Mr. Shaw, 17940 Foxhill Avenue, owns 5 acres in the Agricultural zone, and would
like to construct a 24 x 40 pole barn to be used for personal storage.
MOTION: Spitzer made motion that the application for Special Use Permit
made by Stephen Shaw, 17940 Foxhill Avenue, be vacated on the grounds
that a Special Use Permit is not required for action comtemplated. The
$35.00 fee to be refunded.
Spitzer withdrew his motion.
MOTION: Spitzer made motion, seconded by Vail, to grant a Special Use Permit
to Stephen Shaw, 17940 Foxhill Avenue, to construct a 24 x 40 pole
barn to be used for storage. The Special Use Permit to be invalid
if building not constructed by the end of 1979.

5.6 Safeway House Movers - Temporary Mobile Home Permit
Mr. Sempel has made application to move in a trailer to his property to be used for
watchman's quarters. Presently, there is no provision in ordinance to allow for
this in the Industrial zone. LaValle stated that in this case, the city could amend
the ordinance and allow a mobile home under the hardship clause. The Council pre-
ferred amending of the ordinance. This had been discussed previously with the
problem of quarters becoming a residence.
MOTION: Spitzer made motion, seconded by Schletty, that the Ordinance
Committee be directed to consult with the City Attorney and draft
an amendment to Chapter 320-4 to permit caretaker's quarters being
careful to exclude the possibility of creating an additional residential
zone. Report to be submitted by December 17, 1979.

5.7 Vern Peloquin - Letter of Credit for Freeland in Industrial Park
Mr. Peloquin has completed construction of Freeland in the park and would like his
letter of credit released at this time. Spitzer suggested that the letter of credit
be reduced to insure durability of the road in case the subdivision is not approved.

MOTION: Spitzer made motion, seconded by Vail, that the Letter of Credit from
Vern Peloquin to guarantee the interim construction of Freeland Avenue
be reduced from $5,000.00 to $1 ,000.00 and be released, if and when
financial guarantees for the total Peloquin Park subdivision are
instituted. In the event that the subdivision is not instituted before
July 1 , 1980, then the Letter of Credit be released upon satisfactory
performance of the present road.

Peloquin stated that several occupants in the Industrial Park had expressed interest
in obtaining street lights on Highway 61 and 152nd Street and across from Miscellaneous
Metals. Councilman Schletty will contact NSP to obtain a cost estimate.
6.0 REPORTS OF OFFICERS & COMMITTEES
6.2 Planning Commission
McAllister stated that he will draw up guidelines regarding the construction of
Pole Barns in the City (Farm Site Plan or Special Use Permit) . McAllister and
Council reviewed the discussions with Carl Dale.
6.3 Water Superintendent - No discussion
6.4 Building Inspector - Mr. Crever submitted his monthly report.
MOTION: Spitzer made motion, seconded by LaValle, that the Letter of Credit
for Mr. Jesson be released at the time the Building Permit is issued.

6.5 Fire Chief - No discussion
6.6 Police Chief - Acting Police Chief Fure submitted his monthly report.
MOTION: Spitzer made motion, seconded by Schletty, that the Mayor be authorized
to employ a licensed Police Officer on a temporary basis to alleviate
the existing shortage of Policemen in the City.

6.8 Engineer
Mr. Kuusisto submitted his monthly report. The Bridge Replacement Program is
nearing completion. Northwestern Bell has installed telephone cable along County
Road 8A right where the city was to install a watermain. Kuusisto will contact
Mr. Bob Parent at Washington County regarding this matter.

6.1 Ordinance Committee
MOTION: Spitzer made motion, seconded by Vail, to adopt Ordinance 163, AN
ORDINANCE AMENDING THE HUGO CITY CODE DEFINING THE PENALTY FOR A
MISDEMEANOR.
VOTING FOR: LaValle, Spitzer, Schletty and Vail
MOTION CARRIED
6.9 Clerk
The Clerk stated that there will be a public hearing October 11 , 1979, from 7:00 P.M.
- 10:00 P.M. , Hugo Elementary School, regarding the powerline of Anoka Electric
going through Hugo.
MOTION: Spitzer made motion, seconded by Schletty, that the City of Hugo
utilize Anderson Johnson and Company to audit the books for 1979.
VOTING AGAINST: LaValle, Spitzer, Schletty and Vail
MOTION FAILED
MOTION: Vail made motion, seconded by Schlety, to hire the firm of Anfinson
Hendrickson and Company to audit the books for 1979.
VOTING FOR: LaValle, Spitzer, Schletty and Vail

The Ordinance Committee was directed to investigate the establishing of a nudity
ordinance for the City of Hugo. Attorney Johnson will obtain model ordinances
from St. Paul and Mahtomedi.
6.7 Attorney Mr. Johnson submitted his monthly report. Engineer Kuusisto will
contact the surveyor to try and resolve the right-of-way problem on July Avenue.
Johnson has heard nothing regarding the MR Tourist Camp. He Stated that Diana
Marsh would like a statement from the City regarding the problem of standing sewage
on the property.
Brevig Dike Matter - After a lengthy discussion, the City Council determined that
as far as they can determine, the dike matter is a private matter between Mr. Brevig
and Mr. Richard Vail.
MOTION Spitzer made motion, seconded by Vail, to adopt Solution # 1 , as
proposed. Abandonment of the project.

10.0 MISCELLANEOUS
The City reveived correspondence regarding the filling of Big Marine Lake with 130
cubic yards of sand. This matter was referred to the City Engineer for his
comments.

Councilman Schletty stated that a volunteer crew will be grading and graveling
Ingersoll-Avenue along Sunset Lake. The City Council had no problem with this
action.
MOTION: Spitzer made motion, seconded by Schletty, to adjourn at 10:40 P.M.
